Public Service Commission, Hyderabad Lr.No.1888/RT-I/1/2011, dt.03.01.2012. # # # ORDER:- In his letter 1st read above, Commissioner, Endowments Department has informed that Sri G.C.Yogeswara Reddy, former Executive Officer and now retired, Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District has committed certain irregularities in the administration of the temple. In the G.O. 2nd read above, sanction was accorded for departmental proceedings under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 and in the G.O 3rd read above, as many as (17) charges were framed against Sri G.C.Yogeswara Reddy, former Executive Officer and now retired, Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District under Andhra Pradesh Executive Officer’s Disciplinary (Control and Appeal) Rules, 1977 Rules read with as per Rule 20 of Andhra Pradesh Civil Services (CCA) Rules, 1991. (Contd…P-2): 2 : 2. In the G.O. 5th read above, the Deputy Commissioner, Endowments Department, Kurnool was appointed as Enquiry Officer to enquire into the charges and to submit his enquiry report. In the reference 7th read above, the Commissioner, Endowments Department, Hyderabad has furnished the Enquiry Report submitted by the Enquiry Officer. As per the enquiry report, out of 17 charges, all 17 charges were held proved. 3. In the reference 8th read above, the Government have communicated a copy of the Enquiry officer’s report to the Charged Officer Sri G.C. Yogeswara Reddy, Executive Officer (Retired), Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District in terms of Rule 21 of Andhra Pradesh Civil Services (CCA) Rules, 1991 read with Rule 9 of the Andhra Pradesh Revised Pension Rules, through Commissioner, Endowments Department with a direction to submit his further explanation on the findings of Enquiry Officer’s report within (15) days from the date of receipt of the memo. In the reference 9th read above, the charged Officer has submitted his explanation. The Charged Officer has not put forth any new grounds in his explanation, except what he has stated before the Enquiry Officer. 4. In Government Memo 10th read above, a show cause notice was issued under Rule 9 of Andhra Pradesh Revised pension Rules, 1980 and as per Andhra Pradesh Executive Officer’s Disciplinary (Control & Appeal) Rules, 1977 to Sri G.C.Yogeswara Reddy, Executive Officer (Retired), Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District to explain as to why a 02% (two percent) cut in pension for a period of 02 (two) years should not be imposed for the irregularities committed by him. 5. In reply, the charged Officer has submitted his further explanation in the letter 11th read above, Government have examined the same and found that the explanation is not convincing with reference to facts of the case and therefore, decided to impose a penalty of 02% (two percent) cut in pension for a period of 02 (two) years against Sri G.C.Yogeswara Reddy, Executive Officer (Retired), Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District. 6. In the letter 14th read above, the Government have referred the matter to Andhra Pradesh Public Service Commission for concurrence as required under Rule 9 (2) of Andhra Pradesh Revised Pension Rules, 1980. In the letter 15th read above, the Andhra Pradesh Public Service Commission has given its concurrence to the proposal of the Government to impose the punishment of 02% (two percent) cut in pension for a period of 02 (two) years against Sri G.C.Yogeswara Reddy, Executive Officer (Retired), Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District. 7. Accordingly, the Government in exercise of the powers conferred under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 and as per Andhra Pradesh Executive Officer’s Disciplinary (Control & Appeal) Rules, 1977 hereby impose the punishment of 02% (two percent) cut in pension for a period of 02 (two) years against Sri G.C.Yogeswara Reddy, Executive Officer (Retired), Sri Mukthi Ramalingeswara Swamy Temple, Rameswaram (Village) Proddutur (Mandal), Kadapa District. A copy of the advice of Andhra Pradesh Public Service Commission communicated in the reference 15th read above is herewith enclosed. (Contd…P-3): 3 : 8.
