Public Servants - Revenue (Endowments) Department – Disciplinary action against
Sri K.Rama Rao, former Executive Officer and now Retired, Sri Someswara Swamy
Temple, Aravalli (Village), Attili (Mandal), West Godavari District - Certain
irregularities committed – Imposition of punishment of 10% (ten percent) cut in
pension for a period of 4 (four) years besides recovery of loss caused to the temple
in exercise of the powers conferred under Rule 9 of Andhra Pradesh Revised Pension

ORDER:-
In his letter 1st read above, the Commissioner of Endowments Department,
A.P., Hyderabad has informed that as many as 4 charges were framed the following
charges against Sri K.Rama Rao, former Executive Officer, Sri Someswara Swamy
Temple, Aravalli (Village) Attili (Mandal) West Godavari District as he committed
certain irregularities in the administration of temples.
1) That he misappropriated a sum of Rs.1295/- towards cost of 12 bags
and 25 Kgs of paddy for dalwa crop paid by Sri Murali Krishna Murthy,
tenant of the subject temple for the year 1985-86 i.e., F.1395 on
11-04-1986 and failed to account for the same.
2) That he has issued white paper receipt for an amount of Rs.1295/-
towards the cost of bags 12.25 Kgs of paddy to Sri Murali Krishna
Murthy, tenant for the dalwa crop for the year 1985-86 i.e., F.1395
instead of proper receipt issued to him and thus cheated the tenant and
caused breach of trust.
3) That he failed to credit the proceeds to the temple account and
misappropriated the temple funds to a tune of Rs.1295/- by misfeasance
and with malafide motive.
4) That he wasted temple funds for filing eviction petition against the
tenant knowing well that he is not a defaulter to cover up his
misfeasance and malfeasance.
2. The Jewellery Verification Officer, (J.V.O), Endowments Department,
Kakinada was appointed as Enquiry Officer and submitted his enquiry report on
01-03-1997. Not satisfied with the findings of the above enquiry, the Commissioner
of Endowments Department, issued orders appointing the Deputy Commissioner of
Endowments Department, Kakinada as Enquiry Officer with instructions to enquire
into the charges framed against the Charged Officer in his Lr.dt.05-05-1997.

3. The Deputy Commissioner of Endowments Department, Kakinada has
submitted his enquiry report in his Lr.Dt.15-11-2007. As per the enquiry report, all
the 4 charges were held proved. A copy of the enquiry report has been
communicated to the Charged Officer for submission of his explanation as required
under Rule 21 (4) of A.P.C.S (CCA) Rules 1991 vide C.E.D., Lr. Rc. Dt:03.01.1998.
The Charged Officer has not submitted his explanation. Since the delinquent officer
retired from service on 30-06-2003 on attaining the age of superannuation, the
Commissioner of Endowments Department, A.P., Hyderabad has referred the case
to Government for imposing of suitable punishment against the delinquent as per
Rule 9 of A.P Revised Pension Rules, 1980.
4. In Government Memo 2nd read above, a show-cause notice was issued under
rule 9 of Andhra Pradesh Revised pension Rules, 1980 to Sri K.Rama Rao, former
Executive Officer, Sri Someswara Swamy Temple, Aravalli (Village) Attili (Mandal)
West Godavari District to explain as to why a cut of 10% (ten percent) cut in
pension for a period of 04 (four) years besides recovery of loss caused to the
temple should not be imposed on him for the charges held proved.
5. In reply, the charged Officer has submitted his further explanation in his
letter 5th read above. Government have examined the same and found that the
explanation is not convincing with reference to facts of the case and, therefore,
decided to impose a penalty of 10% (ten percent) cut in pension for a period of 04
(four) years besides recovery of loss caused to the temple against Sri K.Rama Rao,
Executive Officer (Retired), Sri Someswara Swamy Temple, Aravalli (Village) Attili
(Mandal) West Godavari District.
6. In the letter 8th read above, the Government have referred the matter to
Andhra Pradesh Public Service Commission for concurrence as required under Rule
9 (2) of Andhra Pradesh Revised Pension Rules, 1980. In its letter 9th read above,
the Andhra Pradesh Public Service Commission has given its concurrence to the
proposal of the Government to impose the punishment of 10% (ten percent) cut in
pension for a period of 04 (four) years besides recovery of loss caused to the
temple against Sri K.Rama Rao, Executive Officer (Retired), Sri Someswara Swamy
Temple, Aravalli (Village) Attili (Mandal) West Godavari District.
7. Accordingly, the Government in exercise of the powers conferred under Rule
9 of Andhra Pradesh Revised Pension Rules, 1980 hereby impose a punishment of
10% (ten percent) cut in pension for a period of 04 (four) years besides recovery of
loss caused to the temple against Sri K.Rama Rao, Executive Officer (Retired), Sri
Someswara Swamy Temple, Aravalli (Village) Attili (Mandal) West Godavari District.
A copy of the advice of Andhra Pradesh Public Service Commission communicated
in the reference 9th read above is herewith enclosed.
8. The Commissioner, Endowments Department, A.P., Hyderabad shall take
necessary action accordingly.
