Orders of the High Court of Andhra Pradesh, Hyderabad in W.P.M.P.No.26579/2009 in W.P.No.20379/2009, dated 22.09.2009 filed by K.Sudarshan Murthy & (41) others. * * * O R D E R: Whereas the Government have issued guidelines in the reference 1st read above for allotment of the surplus lands taken possession by the Government under the provisions of Principal Act, 1976, and saved under section 3 (1) (a) of the Urban Land (Ceiling & Regulation) Repeal Act 1999. 2. Whereas, the Special Officer, Urban Land Ceiling, Hyderabad has submitted proposal vide reference 2nd read above and the Special Chief Secretary & Chief Commissioner of Land Administration, Andhra Pradesh, Hyderabad verified the said proposal and recommended vide reference 3rd read above, for allotment of excess land taken possession by the State Government and saved U/s. 3 (1) (a) of Urban Land (Ceiling & Regulation) Repeal Act, 1999 and under occupation of 3rd parties in accordance with the guidelines issued in G.O. first read above, to regularize the unauthorized occupation. 3. Whereas, in the reference 4th read above, the Hon’ble High Court of Andhra Pradesh, Hyderabad have issued interim orders dt.22.9.2009 in W.P.M.P.No.26579/2009 in W.P.No.20379/2009 to consider for regularization of plots bearing Nos.A-104, A-117, A-116, B-27, A-83, A-84, A-118, A-100, B- 267, B-325, A-126, A-127, B-186, B-187, C-161, & 162, B-10, B-10/1, B- 133, A-17, B-316, A-80, B-323. A-136, A-79, B-356, B-357, B-122, B- 153, A-198 & 199, B-303, B-254, A-200 & 201, B-260, B-256/A, B-257, B- 352, A-196 & 197 B-241, B-240 B-353, B-190 & B-163 belonging to the petitioners respectively situated in Sy.Nos.60, 71 to 77 of Kondapur Village, Serilingampally Mandal, Ranga Reddy District, to pass appropriate orders as per law, with out reference to the pendency of the Writ Petition Nos.W.P.No.17882, 19809 and 21580 of 2008. 4. Accordingly, the Government after careful examination of the proposal hereby allot the excess land taken possession by the State Government under the provisions of the Principal Act, 1976 to the extents and location mentioned in column Nos.4 & 5 of the annexure in favour of the applicants:: 2 :: as shown in Col.No.3 of the annexure who are reported to be in possession of the excess land supported by registered documents as shown in Col.No.6 of the annexure as they have paid the amounts prescribed, the details of which are as indicated in columns 7 to 9 of the annexure. 5. The name of the allottees (05) (cases) shall be incorporated in Revenue, Registration & Survey records accordingly by the authorities concerned. The Chief Commissioner of Land Administration and the Commissioner & Inspector General of Registration & Stamps shall ensure compliance of these orders. 6. A copy of this order, together with the relevant sketch of the land allotted, measurements thereof and its boundaries with topographical details, duly attested by the competent authority shall be delivered to the allottee concerned under proper acknowledgement 7. The above orders are subject to final outcome of W.P.Nos.17882/08, 19809/08, 21580/08 and W.P.No.20379/2009. 8. The Special Officer, Urban Land Ceiling, Hyderabad is requested to report compliance to the Government within a month.
