Public Service Commission, Hyderabad Lr.No.75/RT-I/2/2012, dated 25.01.2012 *** ORDER : In the reference 1st read above, the Commissioner for Cooperation and Registrar of Cooperative Societies, A.P., Hyderabad has stated that Sri Sayeed Bin Awaz, Cooperative Sub Registrar [Retd], Karimnagar has unauthorisedly stayed away from official duties for a period of 9 years 2 months and 26 days. The individual worked as Cooperative Sub Registrar/Recovery Officer, AP HOUSEFED, Regional Office, Karimnagar and was surrendered from the said post on 02.10.1993. On surrender, the individual was allotted to the District Cooperative Officer, Adilabad for further postings. The individual has not reported for further postings since then. 2. In the reference 2nd read above, charge has been framed against the individual under Rule 20 of the A.P.Civil Services (C.C & A) Rules, 1991. 3. In the reference 3rd read above, the Charged Officer has submitted his explanation. Since, the explanation of the Charged Officer is not convincing and in persuasion of the Government instructions issued in the reference 4th read above, in the reference 5th read above the individual was placed under suspension from Government service in public interest with retrospective effect for his unauthorized absence from service without applying for any kind of leave for a period of 9 years 2 months and 26 days. In the reference 6th read above, the Joint Registrar /District Cooperative Officer, Adilabad was appointed as Enquiry Officer to enquire into the charge framed against the Charged Officer Sri Syed Bin Awaz, Coop.Sub Registrar [Retd],Karimnagar and the Divisional Cooperative Officer, Karimnagar was appointed as Presenting Officer to present the case. The individual was permitted to retire from Government service on superannuation on 31.5.2003 AN with condition that the disciplinary case initiated against him will continue even after his retirement under the provisions of Rule 9 of the A.P.Revised Pension Rules, 1980. 5. In the reference 7th read above, the Inquiry Authority has submitted his Enquiry Report and he has not accepted the explanation of the Charged Officer and held the charge proved. In the reference 8th read above a copy of the Inquiry Report has been communicated to the individual under rule 21 of A.P.Civil Service (CC&A) Rules, 1991 and in the reference 8th read above, the Charged Officer has submitted his explanation. 6. In the reference 9th read above, the Commissioner for Cooperation and Registrar of Cooperative Societies, AP., Hyderabad has furnished proposals to review the disciplinary case of Sri Sayeed Bin Awaz, Coop. Sub Registrar [Retd], Karimnagar and to issue orders deemed fit, as per Rule 9 of A,P,Revised Pension Rules, 1980. 7. In the reference 10th read above, Government after examining the explanation of the Charged Officer have provisionally decided to impose a penalty of withholding entire Pension and Gratuity against the Charged Officer under Rule 9 of the AP Revised Pension Rules and issued Show Cause Notice to submit his written statement of defense within 15 days, failing which further action will be taken based on the material available with the Government. 8. In the reference 12th cited, the Commissioner for Cooperation and Registrar of Cooperative Societies, AP., Hyderabad while enclosing the explanation of the Charged Officer has furnished his remarks thereon and denied the explanation of the Charged Officer and requested the Government to issue appropriate orders in the matter. 9. In the reference 13th read above, the Secretary, A.P.Public Service Commission, Hyderabad was consulted on the provisional decision of the Government against the Charged Officer and in the reference 14th read above, the A.P.Public Service Commission have given their concurrence on the proposal of the Government for imposision of the penalty of withholding gratuity and entire pension permanently against Sri Sayeed Bin Awaz, Coop. Sub Registrar [Retd]. 10. Government, after careful examination of the entire matter have decided and hereby order to impose a penalty of withholding entire Pension and Gratuity against the Charged Officer Sri Sayeed Bin Awaz, Coop. Sub Registrar [Retd], Karimnagar 11. The Commissioner for Cooperation and Registrar of Cooperative Societies, AP., Hyderabad shall take necessary further action in the matter.
