Read the following. 1. G.O.Rt.No.1025 Law (LA&J Home Courts.C) Department, dated 21.05.2008. 2. From the Registrar General, High Court of Andhra Pradesh, Hyderabad, Letter ROC.No.1621/SO-2/2007, dated: 27.09.2011 and dated 11.11.2011. *** ORDER: In the reference first read above, Government have issued orders for appointment of Special Judicial Magistrate of Second Class in Guntur District and issued notification for the individual specified in Annexure, i.e., Sri G.C.Venkatadri, who was the one of the candidate, for a period of two years with a consolidated honorarium of Rs.2,500/- p.m. as per the existing rules. 2. In the reference second read above, the Registrar General, High Court of Andhra Pradesh, Hyderabad has stated that the Government have issued orders appointing Sri G.C.Venkatadri, Retired Additional Public Prosecutor as II Special Judicial Magistrate of II Class, Guntur and he assumed charge of the of the said post on 25.06.2008 and his tenure of service expired on 26.04.2010. The District Judge, Guntur has stated that he instructed the Chief Judicial Magistrate, Guntur to inspect all the Courts of Special Judicial Magistrate of II Class at Guntur and other Judicial Officers to inspect Court of Special Judicial Magistrate of II Class in their respective stations and submit notes of inspection. In turn, the Chief Judicial Magistrate–cum-Principal Senior Civil Judge, Guntur has submitted a report about the omissions and commissions noticed while inspecting the Court of Special Judicial Magistrate of II Class, Guntur. The misappropriated amount is estimated to Rs.1,72,110/- The District Judge, Guntur has sent a report to the High Court stating that Sri G.C.Venkatadri, II Special Judicial Magistrate of II Class, Guntur and Sri L.Venkat Rao, Junior Assistant, VI Additional Junior Civil Judges Court, Guntur, who is entrusted with the work in II Special Judicial Magistrate of II Class, Guntur, are responsible for misappropriation of the said amount and the confiscated amounts so they are liable for prosecution for the offences committed by them individually and severally. The High Court having considered the report of the District Judge, Guntur is of the view that it is desirable to prosecute Sri G.Venkatadri, formerly II Special Judicial Magistrate of Second Class, Guntur and requested the Government to sanction orders for prosecution of Sri G.Venkatadri, formerly II Special Judicial Magistrate of Second Class, Guntur at the earliest. 3. In the circumstances explained above, Government after careful examination, hereby order to sanction for prosecution of Sri G.C.Venkatadri, formerly II Special Judicial Magistrate of Second Class, Guntur for misappropriation committed for an amount of Rs.1,72,110/-, in the Court of II Special Judicial Magistrate of II Class, Guntur. 4. The Registrar General, High Court of Andhra Pradesh, Hyderabad is requested to take necessary action accordingly.
