LAW (LA & J-SC.F) DEPARTMENT G.O.Ms.No. 28 Dated: 16-03-2012 Read:- From the Registrar General, High Court of A.P., Hyderabad, Lr.Roc.No.286/2011/R.J.spl, dt.2.9.2011. * * * O R D E R The Registrar General, High Court of Andhra Pradesh in the letter read above has stated that the High Court desires that appropriate post-retiral benefits shall be extended to the retired Chief Justices and retired Judges of the High Court of A.P. in the light of the resolution of the Conference of Chief Ministers of States and Union Territories and the Chief Justices of High Courts held on 18.9.2004, that “the retired Chief Justices and Judges of High Courts need to be provided with facilities such as Secretary/Driver/Orderly and protocol assistance for travelling and medical treatment”. 2. In pursuance of and in implementation of the said resolution, the Supreme Court Judges Rules, 1959 were amended incorporating Rule 3B, which is as follows: “3B. Post retiral benefits ------ (1) A retired Chief Justice shall be entitled during his lifetime to a payment of rupees twenty five thousand per month for defraying the services of an orderly, driver and security guard, for meeting the expenses incurred towards secretarial assistance on contract basis and for maintenance of an office-cum-residence. He shall also be entitled to a residential telephone free of cost and number of free calls to the extent of 1,500 per month (over and above the number of free calls per month allowed by the telephone authorities) (2) A retired judge shall be entitled during his lifetime to a payment of fourteen thousand rupees per month for defraying the services of an orderly and for meeting the expenses incurred towards secretarial assistance on contract basis and also shall be entitled to a residential telephone free of cost and the number of free calls to the extent of 1,500 per month (over and above the number of free calls per month allowed by the telephone authorities)”. 3. In pursuance of the resolution of the Conference of Chief Ministers of States and Union Territories and the Chief Justices of High Courts, most of the States in the country have extended various post retiral benefits to the retired Chief Justices and retired Judges of the respective High Courts. To name a few states, Jammu & Kashmir, Gujarat, West Bengal, Jharkhand, Orissa, Uttar Pradesh, Chattisgarh, Karnataka, Madhya Pradesh and Sikkim have issued and implemented orders granting such post retiral benefits. 4. In the state of Andhra Pradesh, no post retiral benefits have been extended to the retired Chief Justices and retired Judges of the High Court. Engaging the services of a driver, a security guard, a domestic help etc., apart from having secretarial assistance on contract basis to maintain an office at the residence is a must for the retired Chief Justices and retired Judges by virtue of the very nature of offices held by them. In G.O.Ms.No.46, Law (LA & J- SC.F) Department, dt.18.4.2011, the retired Judicial Officers in the State of Andhra Pradesh were sanctioned Domestic Help Allowance of Rs.2500/- per month and Medical Allowance of Rs.1500/- per month. 6. The Registrar General, A.P.High Court has therefore, requested that the retired Chief Justices and Judges of the High Court of A.P. may also be extended the facility of residential telephone free of cost with number of free calls to the extent of 1,500 per month over and above the number of free calls per month allowed by the telephone authorities. 7. The Registrar General also requested that the retired Chief Justices of the High Court of Andhra Pradesh may be sanctioned a payment of Rs.14,000/- (fourteen thousand rupees) per month for defraying the services of an orderly, driver, security guard etc., and for meeting the expenses incurred towards secretarial assistance on contract basis on par with the retired Judges of the Supreme court. 8. Correspondingly, the retired Judges of the High Court of Andhra Pradesh may be sanctioned a payment of Rs.12,000/- (twelve thousand rupees) per month for defraying the services of an orderly, driver, security guard etc., and for meeting the expenses incurred towards secretarial assistance on contract basis. 9. Government, after careful consideration of the proposal, hereby sanction an amount of Rs.14,000/- per month to the retired Chief Justices of High Court of A.P. and an amount of Rs.12,000/- per month to the retired Judges of High Court of A.P. for defraying the services of an orderly, driver, security guard etc. and for meeting the expenses incurred towards secretarial assistance on contract basis and a residential telephone free of cost with number of free calls to the extent of 1,500 per month over and above the number of free calls per month allowed by the Telephone authorities to both the retired Chief Justices and Judges of High Court of Andhra Pradesh with effect from 1.4.2012. 10. Pension Disbursing Officers shall draw and pay the above sanctioned amounts and residential telephone charges including the charges for 1500 free calls per month over and above the number of free calls per month allowed by the telephone authorities to the retired Chief Justices and retired Judges of the High court of Andhra Pradesh. 11. This order issues with the concurrence of the Finance Department vide their U.O.No.6461/86/A2/Expr.Home/2012, dt.14.3.2012.
