Read the following: 1) G.O.Ms.No.1394, Revenue (UC.I) Department dated 28.11.2008. 2) Govt. Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad, Lr.No.UC2/441/2011, dated 30/9/2011. * * * In the G.O. 1st read above, Government have prohibited the registration of certain lands classified as Urban Land Ceiling surplus lands in Guntur village, Guntur Urban Agglomeration, under the provisions of the Registration Act,1908. 2. In the reference 3rd read above, the Special Officer, Urban Land Ceiling, Guntur has reported that the land measuring 2047 Sq. Mtrs, situated in R.S.No.448/2 Guntur Village, was declared as surplus land. Basing on the said report the Government have prohibited the Registration of the said land in the reference 1st read above. He has further reported that one Sri Kanugula Venkat Rayulu has filed a petition that even though he was declared as a non-surplus holder, the Government have issued orders to prohibit the Registration of said land, vide G.O.Ms.No.1394, Revenue (UC.I) Department, dated 28.11.2008 and requested for deletion of the land measuring 2047 Sq.Mtrs in RS.No.448/2 of Guntur (Vg) from the purview of the said G.O. 3. Whereas, the S.O & C.A., ULC, Guntur, has reported that the Director of Appeals in his orders No.GNT/58 & 59/2008, dated 10.3.2008, set aside the orders of the S.O & C.A., ULC, Guntur issued U/s 8 (4) of the Act dated 16.10.2003 and all subsequent proceedings and remanded the matter to the S.O & CA, ULC, Guntur to pass revised orders U/s 8 (4) of the Act. Accordingly, the S.O & C.A., ULC, Guntur vide his revised orders issued U/s 8(4) of the Act in C.C.No.682/76-B, dated 25.3.2008 declared the land in question as non-surplus before the date of repeal of Urban Land (C&R) Act, 1976. Hence, the said land has not been vested with Government under ULC Act 1976. 4. Whereas, in the reference 4th read above the Spl. Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad, has examined the matter and recommended for considering the request of Sri K. Venkata Rayalu for deletion of land in survey number 448/2 an extent of 2047 Sq. Mtrs, from the purview of G.O.Ms.No.1394, Revenue (UC.I) Department dated 28.11.2008. Contd…2.: 2 : 5. Whereas, in the circumstances reported by the S.O & C.A., ULC, Guntur and as recommended by the Spl. Chief Secretary and Chief Commissioner of Land Administration, A.P., Hyderabad, the Government have decided to delete the land measuring 2047 Sq. Mtrs, situated in R.S.No.448/2 of Guntur Village, Guntur Urban Agglomeration from the list of land prohibited from Registration. 6. Accordingly, Government after careful examination of the proposal on the request of Sri K. Venkata Rayalu hereby delete the land measuring 2047 Sq. Mtrs, situated in R.S.No.448/2 of Guntur Village, Guntur Urban Agglomeration, shown against Sl.No. 190 in the annexure to G.O.Ms.No.1394 Revenue (UC.I) Department, dated 28/11/2008.
