Proceedings of the Review Screening Committee held on 01.02.2012 received through U.O. Note. No.2657/ DPC.I/2011-1, GA (DPC-I) Dept., dated: 01.02.2012. * * * O R D E R: In the reference first read above, the Commissioner of Prohibition and Excise, Hyderabad has informed that, consequent on revision of seniority, Sri P.Surya Rao, Assistant Proh.& Excise Superintendent, Parvathipuram, Vizinagaram District has submitted representation requesting to consider his name for notional promotion to the cadre of Prohibition and Excise Superintendent on par with his junior Sri U.Chandraiah, who was promoted as Prohibition and Excise Superintendent in the panel year 2009-10 vide G.O.Ms. No. 1322 Rev (Ex-I) Dept., Dt: 18.12.2009. 2. The Commissioner of Prohibition and Excise has reported that the Review Screening Committee, which met on 15-12-2010, recommended for inclusion of the name of Sri. P.Surya Rao at cycle point No.76 in R.P.No.7 in the panel year 2005-06 as per the earlier recommendations of the screening committee meeting held on 6-5-2006. As such the name of Sri P.Surya Rao was to be included in the final integrated list of Assistant Proh.& Excise Superintendents for the year 2005-06 with date of regularization as 12.05.2006 in the cadre of Assistant Proh.& Excise Superintendent. 3. The Commissioner of Prohibition and Excise in his lr.No.7649/03/CPE/L3, Dt:10-8-2011 has issued notices to all the affected officers on assigning notional seniority to Sri.P.Surya Rao, Assistant Proh.& Excise Superintendent with a direction to submit their objections, if any within 15 days from the date of receipt of the notice, failing which it would be construed that they have no objection to assigning notional seniority and the same would be finalized as per the rules. The notice was also published in Andhra Pradesh Extraordinary Gazettee No.165 dt:3-9-2011. But no objections were received against the proposed notional seniority of Sri P.Surya Rao. Therefore the Commissioner ofProhibition and Excise in his Proc. No. 7649/2003/CPE/L3, Dt:14-12-2011 has re-fixed the seniority of Sri P.Surya Rao, Assistant Proh.& Excise Superintendent notionally in the cadre of Assistant Proh.& Excise Superintendent with date of regularization as 12.05.2006 in the panel year 2005-06 i.e below Sri S.V.VN.Babji Rao (Sl.No.1 whose date of regularization is 6-5-2006) and above Sri U.Chandraiah (at Sl.2 whose date of regularization is 31-10-2006). 4. The Commissioner of Prohibition and Excise has therefore requested the Government to place the case of Sri P.Surya Rao, Assistant Proh.& Excise Superintendent before the Review Departmental Promotion Committee to review his case for considering his notional promotion to the post of Prohibition and Excise Superintendent in the panel year 2009-2010 on par with his junior viz., Sri U.Chandraiah, who was promoted as Prohibition and Excise Superintendent vide G.O.Rt. No.11, Rev (Ex-I)Dept., Dt: 01.01.2010. Contd.P..2.. ::2:: 5. Accordingly the proposal has been placed before the Departmental Promotion Committee for review. The Review Departmental Promotion Committee meeting was held on 01.02.2012. The Committee, after going through the ACRs and other material papers relating to Sri P. Surya Rao, Assistant Prohibition & Excise Superintendent and after making an overall assessment of his service record and work done, has recommended that he is eligible for notional promotion in the category of Prohibition and Excise Superintendent on par with his junior and accordingly, recommended that the name of Sri P.Surya Rao-SC be included at Sl.No.2 against SC(W)-RP-87 in place of Sri D.Venkatesh Netha-SC i.e below the name of Sri M. Sridhar(Sl.No.1) and above the name of Sri G.Venkataramana (Sl.No.3) in the panel of Assistant Proh.& Excise Superintendent for notional promotion to the category of Prohibition & Excise Superintendent in Revenue Department for the panel year 2009-10. The Committee also recommended that the name of Sri D.Venkatesh Netha-SC be pushed down from Sl.No.2 to Sl.No.6 and placed below the name of Sri K.A.B.Sastry(Sl.No.5) and above the name of Sri G.J.Dougulas(Sl.No.7) against SC R.P.No. 91, which was carried forward in the main panel. 6. Government after careful examination of the matter, hereby accept the above recommendation of the Review Screening Committee held on 01.02.2012 and decided to include the name of Sri P.Surya Rao, Assistant Prohibition and Excise Superintendent at SL.No. 2 against SC(W)-RP. 87 below the name of Sri M. Sridhar (Sl.No.1) and above the name of G.Venkataramana (Sl.No.3) in the Panel of Assistant Prohibition & Excise Superintendents for notional promotion to the category of Prohibition & Excise Superintendent for the panel year 2009-10 and push down the name of Sri D.Venkatesh Netha-SC from Sl.No.2 to Sl.No.6 and place him below the name of Sri K.A.B.Sastry (Sl.No.5) and above the name of Sri G.J.Dougulas (Sl.No.7) against SC R.P.No. 91, which was carried forward in the main panel. 7. Accordingly, under Rule 10(a) of Andhra Pradesh State & Subordinate Service Rules, 1996 Sri P.Surya Rao, Assistant Prohibition & ExciseSuperintendent is hereby promoted as Prohibition & Excise Superintendent notionally in the panel year 2009-2010 at SL.No. 2 against SC(W)-RP. 87 below the name of Sri M. Sridhar (Sl.No.1) and above the name of G.Venkataramana (Sl.No.3), and push down the name of Sri D.Venkatesh Netha-SC from Sl.No.2 to Sl.No.6 below the name of Sri K.A.B.Sastry (Sl.No.5) and above the name of Sri G.J.Dougulas (Sl.No.7) against SC R.P.No. 91. 8. The Commissioner of Prohibition & Excise, A.P., Hyderabad shall take necessary further action in the matter. 9. The above promotion shall be subject to the outcome of SLPs /WPs /OAs /CAs /RPs etc., pending in the Hon’ble Supreme Court/ High Court/Tribunal as the case may be.
