L.-33004/99 सी.जी.-डी.एल.-अ.-17022025-261101 CG-DxLx-xEG-I1D7H0x2x2x0 25-261101 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 822] नई दिल्ली, सोमवार, फरवरी 17, 2025/माघ 28, 1946 No. 822] NEW DELHI, MONDAY, FEBRUARY 17, 2025/MAGHA 28, 1946 पत्तन, पोत पररवहन और िलमाग ग मत्रं ालय अजधसचू ना नई दिल्ली, 14 फरवरी, 2025 िजिणी महासागर म ेंजवजिष्ट मत्सस्ट्य सचं ालन मत्सस्ट्य िलयान के जलए मागिग िी जसधातं । का.आ. 826(अ).— भारत, अंटार्टगक समुद्री सिीव संसाधन संरिण आयोग का स्ट्थायी सिस्ट्य है; और अंटार्टगक समुद्री सिीव संसाधन संरिण आयोग (जिसे इसमें इसके पश्चात् आयोग कहा गया ह)ै की स्ट्थापना अंटार्टगक समुद्री सिीव संसाधन के उद्देश्यों के साथ अंटार्टगक संजध प्रणाली के अधीन की गई है और इसका प्रबंधन व्यापक संसाधन उपायों के दियान्वयन द्वारा दकया िाता है, जिसके अतं गगत ऐसे संसाधनों का सतत उपयोग सजममजलत ह ै ; और मत्सस्ट्य के सतत उपि के जलए अजभसमय िेत्र को जवजिष्ट िेत्रों प्रिाजतयों और समयावजध के ब्यौरे वाल े उनके ध्वि लग े िलयानो को अनुज्ञजि, परजमट और प्राजधकाररता िारी करन े वाले राज्यों के साथ िेत्रों, उपिेत्रों और प्रभागों में जवभाजित करता ह ैजिसके जलए आयोग द्वारा मत्सस्ट्य पालन अजधकृत दकया िाता है; और, यह मान्यता ह ै दक िजिण महासागर मुख्य रूप से िो प्रकार के मत्सस्ट्य पालन अथातग ् (i) टूथदफि, (ii) दिल, जिनमें से प्रत्सयेक के जलए जविेष मत्सस्ट्य िलयान और अनन्य मछली पकड़ने की रीजतयां अपेजित होती ह ैं ; 1209 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, केवल मत्सस्ट्य िलयान, िो वषग में जवजिष्ट अवजध के जलए िजिणी महासागर म ें मत्सस्ट्य उपि के जलए पृथ्वी जवज्ञान मंत्रालय द्वारा अनज्ञु जि िारी करने, अनुमजत या प्राजधकृत करने के साथ-साथ आयोग द्वारा जनधागररत अपेिाओं का अनुपालन दकया िाता ह ै; और, भारत सरकार का लक्ष्य िेि के आर्थगक जवकास में अजिम अनुसंधान िमता और भागीिारी करन े के िोहरे उद्देश्यों के साथ िजिणी महासागर म ें पूवोक्त मत्सस्ट्य पालन के जवस्ट्तार म ें भारतीय इकाईयों की भागीिारी का संवधनग करना ह ै; और, कोई भी भारतीय मत्सस्ट्य िलयान िजिणी महासागर म ें मछली पकड़न े के जलए उपयुक्त नहीं ह ै या िजिणी महासागर में मत्सस्ट्य उपि के जलए जिकायत पर जवचार करन े हते ु प्रमाणपत्र या अनुमोिन नहीं जलया ह ै ; और, कजतपय भारतीय इकाईयों ने ऐसे एक या अजधक ऐसे मत्सस्ट्य िलयानों को चाटगर करने की वांछा अजभव्यक्त की ह,ै िो टूथ दफि या दिल दफि की उपि करने म ें भागीिारी के जलए आयोग की अपेिाओं का अनुपालन करते ह ैंऔर पत्तन, पोत पररवहन और िलमाग ग मत्रं ालय से अनरु ोध दकया ह ै दक ऐसे िलयानों का भारत म ें रजिस्ट्रीकृत करने के जलए अनुग्यात दकया िाए और ऐसे चाटगर की अवजध के जलए भारतीय ध्वि के अधीन प्रचाजलत दकया िाए ; और, समुद्री महासागर म ेंमतस्ट्य उपि म ेंभारतीय इकाईयों द्वारा भागीिारी से आयोग के उद्दश्े यों को प्राि करन े म ें केवल सहायता ही नहीं जमलती बजल्क िेि म ेंब्ल ूइकोनोमी के संवधगन में भी सहायता जमलती ह ै। 2. अत:, अब केंद्रीय सरकार, वाजणज्य पोत पररवहन अजधजनयम, 1958 (1958 का 44) की धारा 435ख के खडं (ग) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, िजिणी महासागर (जिसे इसमें इसके पश्चात् जवजिष्ट मत्सस्ट्य िलयान कहा गया ह)ै , िो जनम्नजलजखत ितों के अधीन, इस धारा के प्रयोिन के जलए मछली पकड़न ेवाली नाव स ेमछली पकड़न ेके जलए प्रयोग म ेंलाया िाता ह,ै के प्रचालन म ेंप्रत्सयेक िलयान को जवजनर्िगष्ट करता है, अथागत् :-- (क) भारतीय इकाईयों द्वारा दकराए पर जलया गया कोई जवजिष्ट मत्सस्ट्य िलयान जपछले पांच सत्रों में से कम से कम एक मछली पकड़ने के सत्र के जलए िजिणी महासागर में मत्सस्ट्य उपि दकया होगा ; (ख) ऐसे स्ट्वामी की राष्ट्रजयता के संबधं म ेंकोई प्रजतबंध नहीं होगा, िो जवजिष्ट मत्सस्ट्य िलयान को दकराए पर ले िा रहा हो ; (ग) जवजिष्ट मत्सस्ट्य िलयान सुरिा, संरिण और पयागवरण संरिण के संबंध म ेंवाजणज्य पोत पररवहन अजधजनयम, 1958 और उसके अधीन बनाए जनयमों और जवजनयमों की अपेिाओं का अनुपालन करेगा और अन्य लाग ूजवजध की अपेिा सजहत िजिणी महासागर म ें मत्सस्ट्य उपि के जलए उसके आवेिन को आयोग द्वारा यथा अपेिा के रूप म ेंअन्य अंतराष्ट्रग ीय जलजखत के साथ परू ा दकया िाएगा ; (घ) जवजिष्ट मत्सस्ट्य िलयान, मत्सस्ट्य पालन के वष ग के जलए अवैध, असूजचत, अजनयजमत िलयान सूची में सजममजलत नहीं होना चाजहए ; और (ङ) ऐसे िलयान पर कम से कम पच्चीस प्रजतित जनयोजित कमी िल भारतीय नागररक होंग े। स्ट्पष्टीकरण—इस अजधसूचना के प्रयोिन के जलए “अजभसमय िेत्र” से अजभसमय िेत्र के रूप में अटं ार्टगक समुद्री सिीव संसाधन आयोग द्वारा जवजनर्िगष्ट िेत्र अजभप्रेत ह ै। [फा. सं. एसआर-23011/10/2024-एमिी] रािेि कुमार जसन्हा, अपर सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 14th February, 2025 Guidelines for specialised fishing vessels for fishing operations in the Southern Ocean. S.O. 826(E).—Whereas, India is a permanent member of the Commission for the Conservation of Antarctic Marine Living Resources; And whereas, the Commission for the Conservation of Antarctic Marine Living Resources (herein referred to as the Commission), was established under the Antarctic Treaty System with the objective of conserving Antarctic marine living resources and its management by implementing a set of comprehensive conservation measures which includes sustainable utilisation of such resources; And whereas, for the sustainable harvesting of fisheries, the Convention area has been divided into areas, sub- areas and divisions with member States issuing licence, permit or authorisation to their flagged vessels detailing the specific areas, species and time periods for which fishing is authorised by the Commission; And whereas, recognising that the Southern Ocean is predominantly home to two major types of fisheries, namely, (i) toothfish and (ii) krill, each requiring specialised fishing vessels and unique fishing methods; And whereas, only those fishing vessels, which comply with the requirements stipulated by the Commission, inter-alia, may be licensed, permitted or authorised by the Ministry of Earth Sciences to carry out harvesting of fisheries in the Southern Ocean, for a specific period in a year; And whereas, the Government of India aims to enhance the participation of Indian entities in the exploration of the aforesaid fisheries in the Southern Ocean, with the dual objectives of advancing research capabilities and contributing to the country's economic development; And whereas, no Indian fishing vessel is suitable for undertaking fishing in the Southern Ocean or has the certification or approval necessary for being considered compliant for harvesting fisheries in the Southern Ocean; And whereas, certain Indian entities have expressed desire to charter one or more of such fishing vessels, which comply with the requirements of the Commission, to participate either in harvesting of toothfish or krill fishery and have requested the Ministry of Ports, Shipping and Waterways to allow such vessel be registered in India and operate under the Indian Flag for the duration of such charter; And whereas, the participation by Indian entities in harvesting of fisheries in the Southern Ocean may not only add to India’s efforts in furthering the objectives of the Commission but also contribute in augmentation of the blue economy of the country. 2. Now, therefore, in exercise of the powers conferred by clause (c) of section 435 B of the Merchant Shipping Act 1958 (44 of 1958), the Central Government, hereby specifies, every vessel certified to operate in the Southern Ocean (herein referred to as specialised fishing vessel), used solely for fishing, to be a fishing boat for the purposes of this section, subject to the following conditions, namely:- (a) the specialised fishing vessel, being bareboat chartered by Indian entities, shall have carried out harvesting of fisheries in the Southern Ocean for at least one fishing season out of the last five seasons; (b) there shall not be any restraint in respect to the nationality of the owner, whose specialised fishing vessel is being chartered; (c) the specialised fishing vessel shall comply with the requirements of the Merchant Shipping Act 1958 and the rules and regulations made thereunder in respect to safety, security and environment protection, and with other international instruments as required by the Commission in its application to harvesting of fisheries in the Southern Ocean, including the requirement of other applicable law; (d) the specialised fishing vessel must not be included in the Illegal, Unreported and Unregulated Vessel List for the year of fishing; and (e) at least 25% of crew employed on such vessels shall be Indian nationals. Explanation. – For the purposes of this notification, the expression “Convention area” means area specified by the Commission for the Conservation of Antarctic Marine Living Resources to be the Convention area.
