अनुसूजर्त फॉमूवलेिनों के सभी जनमावता, िो उपयुवि उत्पादों / ब्ांडस को सरकार द्वारा इस प्रकार जनधावठरत और अजधसूजर्त अजधकतम मल्ू य (र्स्ट्तु और सेर्ा कर के साथ) से अजधक कीमत पर बेर् रह े ह,ैं ऐसे सभी फॉमूवलेिनों की कीमतों को इस प्रकार संिोजधत करेंगे िो उपरोि सारणी म ें कॉलम (5) में जनर्दवष्ट अजधकतम मूल्य (साथ ही र्स्ट्त ु और सेर्ा कर, यदद कोई हो) स ेअजधक नहीं होंग े। (ग) उपयिुव अनुसूजर्त फॉमूवलेिन के जनमावता, जिनका अजधकतम खुदरा कीमत का.आ. 1554(अ) ददनांक 26.3.2024 (साथ ही र्स्ट्तु और सेर्ा कर, यदद कोई हो) द्वारा अजधसूजर्त अजधकतम मल्ू य स े कम ह,ै र् े डीपीसीओ, 2013 के पैरा 16(2) के अनुसार र्षव 2023 की तलु ना में र्ष व 2024 के जलए डब्लल्यूपीआई @ 1.74028% के आधार पर अपन े फॉमूवलेिन के मौिूदा अजधकतम खुदरा कीमत को संिोजधत कर सकते ह।ैं (घ) जनमावता र्स्ट्तु एर्ं सेर्ा कर तभी िोड़ सकते ह ैंिब यह उपरोि सारणी के कॉलम (5) म ेंउजल्लजखत अजधकतम मल्ू य पर सरकार को र्ास्ट्तर् म ेंभुगतान दकया हो या देय हो।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (ङ) कोई भी अन्य जनमावता िो जर्िेष जर्िेषताओं र्ाले प्रत्येक डूअल र्ैम्बर बगै मे जपपेराजसजलन (ए) + टैजोबैक्टम (बी) इंिेक्िन पाउडर (i) 2 ग्राम (ए) + 250 जमलीग्राम (बी) (ii) 4 ग्राम (ए) + 500 जमलीग्राम (बी) के जलए अलग अजधकतम मल्ू य का दार्ा करता ह ैतो उसे अलग से अजधकतम मूल्य के अनुमोदन के जलए एनपीपीए को आर्ेदन करेगा। (र्) यदद संिोधन दकया िाता ह ै तो, इसकी सूर्ना ऐसे संिोधनों को दकए िाने के पंद्रह ददनों के भीतर की अर्जध म ें प्रपत्र- ।। के रूप में इलेक्रॉजनक अथर्ा र्ास्ट्तजर्क दकसी भी तौर पर सरकार को अग्रेजषत की िाएगी और इस उप-पैराग्राफ के तहत सूर्ना प्रस्ट्तुत नहीं दकए िाने को अजधकतम खुदरा मल्ू य में संिोधन नहीं दकया िाना माना िाएगा और संबंजधत जनमावता अजधक िुल्क लेने की जतजथ से उस पर ब्लयाि सजहत पर्ू व-संिोजधत अजधकतम खुदरा मूल्य (एमआरपी) से अजधक की राजि िमा करने के जलए उत्तरदायी होगा। (छ) अनसु ूजर्त फॉमूवलिे नों के एक पैकेट के जलए अजधकतम मल्ू य संबंजधत जनमावता द्वारा डीपीसीओ 2013 के पैरा 11 म ें जनजहत प्रार्धानों के अनुसार उपरोि सारणी के कॉलम (5) म ें जनर्दवष्ट अजधकतम मूल्य के अनुसार जनधावठरत दकया िाएगा। जनमावता डीपीसीओ 2013 के परै ा 24 के अनुसार अजधसूर्ना की तारीख स े आईपीडीएमएस के माध्यम स े एनपीपीए को प्रपत्र-v में मल्ू य सूर्ी िारी करेगा और राज्य औषजध जनयंत्रक और जर्क्ेताओं को इसकी एक प्रजत प्रस्ट्ततु करेगा। (ि) डीपीसीओ 2013 के परै ा 24 (4) के अनुसार, प्रत्येक खुदरा जर्क्ेता और जर्क्ेता जनमावता द्वारा प्रस्ट्तुत मल्ू य सूर्ी और पूरक मूल्य सूर्ी, यदद कोई हो, पठरसर के उस जर्जिष्ट भाग में प्रदर्ितव करेंग े िहां र्ह इस तरह से व्यर्साय करता ह ै तादक दकसी भी व्यजि के जलए आसानी से सुलभ हो सके िो उससे परामिव करना र्ाहता ह।ै (झ) िहां उपरोि सारणी में जनर्दवष्ट अनुसूजर्त फॉमलूव ेिनों के खुराक या िजि या दोनों का कोई मौिूदा जनमावता डीपीसीओ, 2013 के पैराग्राफ 2 (1) (यू) के अनुसार एक नई दर्ा िुरू करता है, तो ऐसा मौिूदा जनमावता डीपीसीओ, 2013 की अनुसूर्ी-II के तहत जनर्दवष्ट प्रपत्र-I में एनपीपीए को ऐसी नई दर्ा के पूर् व मूल्य अनुमोदन के जलए आर्ेदन करेगा। (ञ) उपरोि अनुसूजर्त फॉमूवलेिनों के जनमावता आईपीडीएमएस के माध्यम से डीपीसीओ, 2013 की अनुसूर्ी-II के प्रपत्र-III में अनुसूजर्त फॉमूवलेिनों के उत्पादन/आयात और जबक्ी के संबंध में एनपीपीए को जतमाही जर्र्रणी प्रस्ट्तुत करेंगे। उपरोि अनुसूजर्त फॉमूवलिे नों का उत्पादन बंद करने का इरादा रखन े र्ाला कोई भी जनमातव ा डीपीसीओ, 2013 की अनुसूर्ी-II के प्रपत्र-IV में अनसु ूजर्त फॉमूवलेिनों के उत्पादन और/या आयात को बंद करने के संबंध म ें एनपीपीए को कम से कम छह महीन े पहले िानकारी प्रस्ट्ततु करेगा। (ट) ऊपर जनर्दष्टव अजधकतम मल्ू य और ितो का पालन नहीं करन े र्ाल े जनमावता आर्श्यक र्स्ट्तु अजधजनयम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रार्धानों के तहत ब्लयाि के साथ अजधप्रभाठरत राजि िमा करने के जलए उत्तरदायी होंगे। (ि) इस अजधसूर्ना में उपरोि सारणी के कॉलम (2) में जनर्दवष्ट दकए गए ऐसे फॉमलूव ेिनों के अजधकतम मूल्य िारी करन े के पठरणामस्ट्र्रूप, उपरोि अजधसूर्ना की तारीख से पहल ेिारी अजधकतम मल्ू य या खुदरा मल्ू य, यदद कोई हो, जनधावठरत करने र्ाल ेमूल्य आदेि का AND FERTILIZERS (Department of Pharmaceuticals) (NATIONAL PHARMACEUTICAL PRICING AUTHORITY) ORDER New Delhi, the 27th March, 2025 S.O. 1475(E):— In exercise of powers, conferred by sub paragraph (3) and (4) of paragraph 11,14 and 16 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated 30th May, 2013, S.O. 1192(E) dated 22nd March, 2016 and S.O. 5249(E) dated 11th November, 2022 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of the order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) S.O. No. 1554(E) dated 26.3.2024 in so far as it relate to formulation packs mentioned in the Table A below, manufactured by the manufacturers specified in Table B for specified products and pack-sizes, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority, hereby revises the price based on Wholesale price index (WPI) of 2024 as specified in column (5) of the Table A herein below as separate ceiling price exclusive of Goods and Services Tax applicable, if any, in respect of the scheduled formulations specified in the corresponding entry in column (2) of the said Table with the dosage form and strength and unit/packaging specified respectively in the corresponding entries in columns (3) and (4) thereof: Table A Price Revision as per Annual Wholesale Price Index (WPI) @ 1.74028% increase. (b) The manufacturers of scheduled formulations, selling above said products/brands of scheduled formulations at price higher than the ceiling price (plus Goods and Services Tax as applicable) so fixed and notified by the Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified in column (5) in the above table plus Goods and Services Tax as applicable, if any. (c) The manufacturers of above-mentioned scheduled formulations having MRP lower than the ceiling price notified vide S.O. No. 1554(E) dated 26.3.2024 (plus Goods and Services Tax as applicable, if any), may revise the existing M.R.P. of their formulations, on the basis of WPI @ 1.74028% for year 2024 over 2023 in accordance with paragraph 16(2) of DPCO, 2013. (d) The manufacturers may add Goods and Services Tax only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above said table. (e) Any other manufacturer claiming separate ceiling price for Piperacillin (A) + Tazobactam (B) Injection (i) Powder for injection 2g (A) + 250mg (B) (ii) 4g (A) + 500mg (B) Per Dual chamber bag having special features shall apply to NPPA for separate ceiling price approval. (f) Information about the revision, if carried out, shall be forwarded to the Government in either electronic or physical form in Form-II within a period of fifteen days of such revision and non-submission of information under this sub-paragraph shall be construed as non revision of maximum retail price (MRP) and the concerned[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 manufacturer shall be liable to deposit the amount charged over and above the pre-revised maximum retail price (MRP), alongwith interest thereon from the date of overcharging. (g) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in accordance with the ceiling price specified in column (5) of the above table as per provisions contained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers. (h) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same. (i) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2 (1) (u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013. (j) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation. (k) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955. (l) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.
