की धारा 16 की उपधारा (1) के साथ परठत धारा 3 की उपधारा (1) द्वारा प्रदत् त िजक्त यों का प्रयोग करते हुए
का.आ. 4250(अ) तारीख 26 नवम् बर, 2020 के द्वारा, को उन बातों के जसवाय अजधक्रमण करत े हुए जजन्द् ह ें ऐस े अजधक्रमण

2. सरकारी ई-जवपणन (जीईएम) पोटलय के माध्यम स े खाद्यान्नों की पैककग के जलए जूट थलै ों की खरीद परीिण आधार पर
िुरू की जाएगी ।
3. िुरुआत म,ें मांग पर का दस प्रजतित राज्य क्रय एजेंसी द्वारा प्रजतवती नीलामी के माध्यम स े सरकारी ई-जवपणन
(जीईएम) पोटयल पर रखा जायगे ा ।
4. उस सीमा तक जहााँ तक जटू जमलें सरकारी ई-जवपणन (जी ई एम) पोटलय पर बोली के माध्यम से अनुमेय तीस ददन के
भीतर आपूर्तत करने म ेंअसफल रहती ह,ैं वस्त्र मरं ालय अजनवाय य पैकेजजग मानक को भजवष्य म ें कम कर सकता ह।ै
5. जूट पैकेजजग सामग्री की आपूर्तत म ें दकसी कमी या बाधा की दिा म ें या दकसी अन्द्य आकजस्ट्मक या अत्यावश्यक दिा म,ें
वस्त्र मंरालय सम्बंजधत उपभोक्ता मंरालयों के परामि य स,े उक्त सारणी के स्ट्तम्भ (3) म ें जवजनर्ददष्ट पैकेजजग सामग्री के
प्रजतित को अजधकतम तीस प्रजतित तक और कम करने की अनुमजत द ेसकेगा ।
6. खाद्य और सावयजजनक जवतरण जवभाग द्वारा तैयार आपर्तू त योजना के अनुसार खाद्यान्न पैक करने के जलए यदद क्रय
एजेंजसयों द्वारा जूट थलै ों के जलए मांग पर नहीं ददए जात े और मागं (मागं पर) एकर हो जाती ह,ैंतब जूट जमलों को जूट
थैलों की आपूर्तत के जलए यथोजचत समय ददया जायगे ा ।
7. उच्च घनत्व वाल े पॉली एजथलीन/पॉली प्रोपीलीन (एचडीपीई/पीपी) थलै ों के न्द्यूनतम उपयोग को सुजनजश्चत करन े की
दजृ ष्ट स,े खाद्य और सावयजजनक जवतरण जवभाग राज्य क्रय एजेंजसयों (एफसीआई सजहत) के परामिय और समन्द्वय स े जूट
थैलों की आपूर्तत के पूव-य सहमत अनुसूची के अनुसार वास्ट्तजवक मांग परों को समय पर प्रस्ट्त ुत करेगा :

8. उक्त अजधजनयम के अधीन जनम्न जलजखत को आरिण की पररजध स े बाहर रखा जा सकता ह,ै अथायत:्-
(क) जवटाजमन स े पुष्ट चीनी;
(ख) जनयायत की जाने वाली वस्ट्त ुओं की पैकेजजग ;
(ग) खाद्यान्द् नों के जलए दस दक.ग्रा. और उससे कम और चीनी के जलए पच्चीस दक.ग्रा. और उससे कम के छोटे उपभोक्त ा
पैकेज;
(घ) एक सौ दक.ग्रा. स ेअजधक थोक पैकेजजग; और
(ड.) जनयायत के जलए पैक की गई चीनी जजसे खाद्य और सावयजजनक जवतरण जवभाग द्वारा दकए गए जनधायरण और
जसफाररिों के आधार पर जनयातय नहीं दकया जा सका था।
9. यह सुजनजश्चत करन े के जलए दक कच्च े जूट और जूट पैककग सामग्री के उत्पादन म ें लग े व्यजक्त अजनवायय पैकेजजग स े लाभ
प्राप्त करें, जूट श्रजमकों को वैधाजनक तौर पर दये का भुगतान और जूट दकसानों को तथा कच्च े जूट के क्रय पर गॉंठ बनान े
वालों को त्वररत भुगतान के जलए समथ य बनान े के जलए मजदरू ी संजहता, 2019 (2019 का 29) सजहत प्रवृत्त श्रजमक
जवजधयों के अनुसार उजचत तंर बनाया जायेगा ।

ORDER
New Delhi, the 27th December, 2021
S.O. 5421(E).—Whereas, the Central Government is empowered under sub-section (1) of section 3 of the
Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (10 of 1987) to specify, by order, the
commodities or class of commodities or such percentage thereof to be packed for the purpose of its supply or
distribution in such jute packaging material, after considering the recommendations of the Standing Advisory
Committee;
And whereas, the Central Government has, in exercise of the powers conferred under sub-section (1) of
section 4 of the said Act, constituted the Standing Advisory Committee vide number S.O. 473(E), dated the 27th
January, 2019, to recommend the norms of packaging in jute material;
And whereas, the Central Government, after considering the recommendations made to it by the Standing
Advisory Committee, is satisfied that it is necessary in the interest of production of raw jute and jute packaging
material, and of persons engaged in the production thereof, to specify the commodity or class of commodities and
percentage thereof to be packed in jute packaging material;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with sub-section (1)
of section 16 of the Jute Packaging Materials (Compulsory Use in Packaging Commodities) Act, 1987 (10 of 1987),
and in supersession of order number S.O. 4250 (E), dated the 26th November, 2020, except as respects things done or
omitted to be done before such supersession, the Central Government hereby directs that the commodities specified in
column (2) of the Table below, shall be packed in jute packaging material for supply or distribution, in such minimum
percentage as specified in corresponding entries in column (3) of the said Table, with effect from the date of
publication of this notification in the Official Gazette, upto the 30th June, 2022 (Jute Year 2021-22), namely:-

*Note 1:- Initially ten per cent. of the indents for foodgrains would be placed through reverse auction on the
Government e-Marketplace (GeM) portal.
**Note 2:- In diversified jute bags under direct purchase by the procuring agencies from the mills or open market.
2. Procurement of jute bags for packing of foodgrains through the Government e-Marketplace (GeM) portal shall
be initiated on trial basis.
3. To begin with, ten per cent of the indents shall be placed by the State Procurement Agencies through reverse
auction on the Government e-Marketplace (GeM) portal.
4. To the extent jute mills fail to supply through the Government e-Marketplace (GeM) portal bidding within the
permissible thirty days, the Ministry of Textiles will allow upfront dilution of mandatory packaging norm.
5. In case of any shortage or disruption in supply of jute packaging material or in case of any other contingency or
exigency, the Ministry of Textiles may, in consultation with the user Ministries concerned, allow further dilution of
packaging material up to a maximum of thirty per cent of the percentage specified in column (3) of the said Table.
6. In case the Procurement Agencies do not place indents for jute bags to pack foodgrains as per supply plan
prepared by the Department of Food and Public Distribution and bunching of demand (indents) takes place, then the
jute mills shall get reasonable additional time for the supply of jute bags.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
7. With a view to ensure the minimum usage of High Density Poly Ethylene/ Poly Propylene (HDPE/PP) bags, the
Department of Food and Public Distribution, in consultation and coordination with State Procurement Agencies
(including FCI) shall place realistic indents on time as per pre-agreed schedule of supply of jute bags:
Provided that if the mills fail to supply the bags in the extended period, the conditions relating to dilution
shall be applicable.
8. The following may be kept out of the purview of reservation under the said Act, namely :-
(a) sugar fortified with vitamins;
(b) packaging for export of commodities;
(c) small consumer packs of ten kilograms and below for foodgrains and twenty-five kilograms and
below for sugar;
(d) bulk packaging of more than one hundred kilograms; and
(e) sugar packed for export but which could not be exported on the basis of an assessment and
recommendation by the Department of Food and Public Distribution.
9. To ensure that persons engaged in production of raw jute and jute packaging material are benefitted from the
mandatory packaging, a suitable mechanism shall be devised for enabling payment of statutory dues to jute workers
and prompt payment to jute farmers and balers on procurement of raw jute as per the Labour Laws in force including
the Code on Wages, 2019 (29 of 2019).
