(ख) कोई अन्य मौजूदा धनमावता, जो इस अधिसूचना के राजपत्र में प्रकाशन की धतधथ से बारह माह के भीतर उपयुवि सारणी के स्तंभ
(2), (3) एर् ं(4) में धर्धनर्दवष्ट उसी "नई ड्रग" को लॉन्च करता ह,ै उसे उपयुवि सारणी के स्तंभ (6) में धर्धनर्दवष्ट मूल्य से अधिक
न होने र्ाले खुदरा मूल्य पर उसका धर्पणन करने की अनुमधत होगी, बशते दक र्ह लॉन्च की धतधथ से एक माह के भीतर
सहायक दस्तार्ेजों सधहत आईपीडीएमएस 2.0 पर फॉमव-IA प्रस्तुत करे।
(ग) अगर जनमावताओं ने उपयुवक्त सारणी के स्ट्तंभ (6) मे र्र्णवत खुदरा कीमत पर सरकार को र्ास्ट्तर् मे भुगतान दकया ह ैतो र्े र्स्ट्तु
एर् सेर्ा कर को िोड़ सकते है।
(घ) औषध (मूल्य जनयंत्रण) आदेि, 2013 के पैराग्राफ 11 मे ददए गए प्रार्धानों के तहत जनमातव ाओं को उपयुवक्त सारणी के स्ट्तंभ
(6) मे जर्जनर्दवष्ट खुदरा मूल्य के आधार पर अनुसूजित जर्जनर्मजव तयों के जलए खुदरा मूल्य जनधारव रत करें । जनमावता औषध (मूल्य
जनयंत्रण) आदेि, 2013 के पैराग्राफ 24 के तहत फॉमव V में अजधसूिना की तारीख से एक मूल्य सूिी एनपीपीए को
आईपीडीएमएस के माध्यम से िारी करें तथा उसकी प्रजत राज्य औषजध जनयंत्रकों और जर्जनमावता जर्तरकों को िारी करें।
(ङ) औषध (मूल्य जनयंत्रण) आदेि, 2013 के 24 (4) के अनुसार प्रत्येक फुटकर जर्क्रेता और जर्तरक जर्जनमावता द्वारा ददए गए रूप
में ऐसे पररसर, िहां कारबार को इस प्रकार दकया िा रहा ह ैदक उससे परामिव के इच्छुक दकसी व्यजक्त के जलए पहिं आसान
हो, र्हां उसके दकसी सुस्ट्पष्ट भाग पर कीमत सूिी और पूरक सूिी, यदद कोई हो, को प्रदर्िवत करेगा।
(ि) जर्जनमातव ा या जर्पणन कम्पनी, उपरोक्त जर्जनर्मवजतयों और जर्जनर्दष्टव ितों का पालन नहीं करती ह ै तो र्े आर्श्यक र्स्ट्तुएँ
अजधजनयम, 1955 के साथ परित डीपीसीओ, 2013 के प्रार्धानों के अधीन ब्याि सजहत अजधप्रभाररत राजि को िमा करने के
जलए उत्तरदायी होंगे।

Notes:
(a) The manufacturer, as mentioned in column (5) of the table above, of formulations i.e., “new drug” under
paragraph 2(1)(u) of the DPCO, 2013 shall fix the retail price not exceeding the price as specified in column
(6) of the table above.
(b) Any other existing manufacturer launching the same new drug as specified in column (2), (3) and (4) of table
above within twelve months of the date of publication of this notification in the Official Gazette is permitted
to do so at a retail price not exceeding the price as specified in column (6) of the table above subject to filing
of Form-IA on IPDMS 2.0 along with supporting documents within one month of launch.
(c) The manufacturer may add Goods and Services Tax only if they have paid actually or it is payable to the
Government on the retail price mentioned in column (6) of the above said table.
(d) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in
accordance with the retail price specified in column (6) of the above table as per provisions contained in
paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of notification
as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller
and dealers.
(e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price
list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business
in a manner so as to be easily accessible to any person wishing to consult the same.
(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price notification
and notes specified hereinabove, then the concerned manufacturer/marketing company shall be liable to deposit
the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the
Essential Commodities Act, 1955.
