L.-33004/99 सी.जी.-डी.एल.-अ.-24072024-255711 CG-DxLx-xEG-I2D4H0x7x2x0 24-255711 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 407] नई कदल्ली बधु िार, िुलाई 24, 2024/ श्रािण 2, 1946 No. 407] NEW DELHI, WEDNESDAY, JULY 24, 2024/ SHRAVANA 2, 1946 सचं ार मत्रं ालय (दरू सचं ार जिभाग) अजधसचू ना नई दिल्‍ली, 24 जुलाई, 2024 सा.का.जन. 446(अ).—जनम्नजलजखत प्रारूप जनयम जिसे केंद्र सरकार दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खंड (िेडएच) के साथ पठित धारा 46 के तहत प्रदत्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताि करती ह,ै को इससे प्रभाजित होने िाल े सभी व्यजियों की सूचना के जलए एतद्दिारा प्रकाजित ककया िाता ह ै तथा एतद्वारा नोठिस कदया िाता ह ै कक उि प्रारूप जनयम पर उस तारीख से तीस कदन की अिजध की समाजि के पश्चात् जिचार ककया िाएगा जिस तारीख से सरकारी रािपत्र म ें यथाप्रकाजित इस अजधसूचना की प्रजतयां सिवसाधारण को उपलब्ध कराई िाएगी; यकद कोई आपजत्त या सुझाि हो तो उस े संयुि सजचि (दरू संचार), दरू संचार जिभाग, सचं ार मंत्रालय, भारत सरकार, संचार भिन, 20, अिोक रोड, नई कदल्ली 110001 को भेिा सकता है; केंद्र सरकार द्वारा उि अिजध की समाजि से पूिव उि प्रारूप जनयम के संबंध म ें ककसी भी व्यजि स े प्राि आपजत्त या सुझाि पर जिचार ककया िाएगा। 4555 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. सजं िि िीर्कव और प्रारंभ (1) इन जनयमों को दरू संचार (िैजिक समुद्री संकि और सुरिा प्रणाली के प्रचालन के जलए िाजणजययक रेजडयो ऑपरेिर का प्रिीणता प्रमाणपत्र) जनयम, 2024 कहा िा सकता ह।ै (2) ये रािपत्र में अपन े प्रकािन की तारीख से प्रिृत्त होंगे। 2. पठरभार्ाए ं (1) इन जनयमों म ेंिब तक कक संदभव से अन्यथा अपेजित न हो: क) "अजधजनयम" से दरू संचार अजधजनयम, 2023 (2023 का 44) अजभप्रेत ह;ै ख) "िीएमडीएसएस" या " िजै िक समद्रु ी सकं ि और सरु िा प्रणाली " से समुद्री सुरिा के जलए सुरिा प्रकियाओं, किक्वेंसी, उपकरणों के प्रकार और संचार प्रोिोकॉल का अंतरराष्ट्रीय स्ट्तर पर सहमत सेि िो िहाि और ति दोनों ही स्ट्थानों पर स्ट्थलीय और उपग्रहीय रेजडयो प्रौद्योजगककयों का उपयोग करते हुए प्रचालन अजभप्रेत ह;ै ग) "िीएमडीएसएस प्रमाणपत्र" प्रमाण पत्र की दो श्रेजणयों में से कोई भी, अथावत्, िीएमडीएसएस िीओसी और िीएमडीएसएस आरओसी, िैसा कक जनयम 4 के उप-जनयम (1) के तहत जनर्दवष्ट स े अजभप्रेत ह ै और " िीएमडीएसएस प्रमाणपत्र धारक" या "धारक" से अजभप्राय िह व्यजि जिसे जनयम 8 के तहत ऐसा प्रमाणपत्र कदया गया ह;ै घ) "अतं राष्ट्रव ीय दरू सचं ार सम्मले न" से 1992 म ें जिनेिा में हस्ट्तािठरत अंतराष्ट्रव ीय दरू संचार संघ का सम्मेलन या उसके बाद का कोई संिोधन या सुधार अजभप्रेत ह ै जिसे भारत सरकार न े अनुसमर्थवत या स्ट्िीकार ककया ह;ै ङ) "पोिवल" से िह पोिवल अजभप्रते ह ै जिसे इन जनयमों के जनयम 15 के तहत केंद्र सरकार द्वारा अजधसूजचत ककया िा सकता ह;ै च) “रेजडयो जिजनयमन”‍ स े जिि रेजडयो संचार सम्मेलन (जिनेिा 1995) द्वारा अपनाए गए जिजनयमन और इसम ें प्रत्येक संिोधन या सुधार िाजमल ह ैं जिसे भारत सरकार द्वारा अनुसमर्थवत या स्ट्िीकार ककया गया अजभप्रेत ह;ै छ) "जनयम" से दरू संचार (िैजिक समुद्री संकि और सुरिा प्रणाली के प्रचालन के जलए िाजणजययक रेजडयो ऑपरेिर का प्रिीणता प्रमाणपत्र) जनयम, 2024अजभप्रते ह;ै ि) "डब्ल्यपू ीसी विगं " स े दरू संचार जिभाग, भारत सरकार का बते ार आयोिना एिं समन्िय विंग अजभप्रेत ह।ै (2) ि े िब्द और पद िो इसमें प्रयिु ह ैं और पठरभाजर्त नहीं ह ै परंतु इस अजधजनयम म ें पठरभाजर्त ह ैं उनके िही अथ वहोंगे िो उनके जलए उस अजधजनयम में ह।ैं 3. कायिव त्रे कोई भी व्यजि इन जनयमों के तहत प्रदान ककए गए िीएमडीएसएस प्रमाणपत्र के जनबंधन और ितों के तहत और उनके अनुसार ही िीएमडीएसएस का प्रचालन करेगा। 4. िीएमडीएसएस प्रमाणपत्रों की श्रजे णया ाँऔर पात्रता (1) िीएमडीएसएस प्रमाण पत्र की दो श्रेजणयां होंगी िो जनयम 8 के तहत केंद्र सरकार द्वारा प्रदान की िा सकती ह,ैं अथावत:्[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 क) िीएमडीएसएस - सामान्य ऑपरेिर का प्रमाणपत्र, या िीएमडीएसएस - िीओसी; ख) िीएमडीएसएस - सीजमत ऑपरेिर का प्रमाणपत्र, या िीएमडीएसएस -आरओसी. (2) संबंजधत श्रेणी के तहत िीएमडीएसएस प्रमाणपत्र जनयम 8 के अनुसार उस व्यजि को कदया िाएगा िो नीच े कदए गए पात्रता मानदडं ों को परू ा करता है और जनयम 7 के तहत जनर्दवष्ट परीिा उत्तीणव करता ह:ै िीएमडीएसएस-िीओसी िीएमडीएसएस-आरओसी भारत का नागठरक भारत का नागठरक परीिा की जतजथ को अिारह िर्व से अजधक आयु। परीिा की जतजथ को अिारह िर्व से अजधक आयु। क) अजखल भारतीय उच्च माध्यजमक जिद्यालय क) माध्यजमक जिद्यालय प्रमाण-पत्र परीिा (10 िीं किा) प्रमाण-पत्र परीिा (12 िीं किा) या भारत म ें या भारत में ककसी मान्यता प्राि बोडव या ककसी मान्यता प्राि बोडव या जििजिद्यालय जििजिद्यालय द्वारा आयोजित समकि परीिा उत्तीणव द्वारा आयोजित गजणत और भौजतक जिज्ञान की ह ै या केंद्र सरकार या रायय सरकार के समुद्री या मत्स्ट्य पालन जिभागों के साजं िजधक जनकायों द्वारा जिर्यों के साथ समकि परीिा उत्तीणव की है; िारी जिजधमान्य प्रमाण-पत्र रखता ह;ै अथिा अथिा ख) िाजणयय पोत पठरिहन अजधजनयम, 1958 ख) मचेंि नौिहन अजधजनयम, 1958 (1958 का 44) के (1958 का 44) के प्रािधानों के अंतगवत पोत प्रािधानों के तहत नौिहन महाजनदेिालय, भारत सरकार द्वारा िारी या मान्यता प्राि योग्यता या इसके पठरिहन महाजनदेिक, भारत सरकार द्वारा समकि का जिजधमान्य प्रमाण-पत्र रखता ह;ै अथिा िारी या मान्यता प्राि योग्यता या इसके समकि का जिजधमान्य प्रमाण-पत्र रखता ह;ै ग) डब्ल्यपू ीसी विंग द्वारा िारी प्रिीणता या इसके अथिा समकि कोई जिजधमान्य प्रमाण-पत्र रखता ह।ै ग) डब्ल्यपू ीसी विंग द्वारा िारी प्रिीणता या इसके समकि कोई जिजधमान्य प्रमाण-पत्र रखता ह।ै समय-समय पर केंद्र सरकार द्वारा अनुमोदन प्राि ककसी समय-समय पर केंद्र सरकार द्वारा अनुमोदन प्राि ककसी भी भी संस्ट्थान म ें िैजिक समुद्री संकि और सुरिा प्रणाली संस्ट्थान म ें िैजिक समुद्री संकि और सुरिा प्रणाली उपकरण उपकरण पर व्यािहाठरक प्रजििण प्राि ककया हो जिसकी पर व्यािहाठरक प्रजििण प्राि ककया हो जिसकी अिजध कम अिजध लगातार दो सिाह (न्यूनतम जछयानबे घंिे) के से कम एक सिाह (न्यूनतम चालीस घंिे) के जलए हो। जलए हो। (3) इन जनयमों में समाजिष्ट ककसी बात के होते हुए केन्द्रीय सरकार, ऐसी ितों के अधीन रहत े हुए िो िह समय- समय पर लाग ू करे, ककसी ऐस े व्यजि को िो भारत का नागठरक नहीं ह ै जनयम 7 के तहत संबंजधत श्रेणी के अंतगतव िीएमडीएसएस प्रमाणपत्र प्रदान करन े के प्रयोिन से आयोजित परीिा में बैिने की अनुमजत दे सकती ह।ै 5. िीएमडीएसएस िीओसी प्रदान करन ेके जलए परीिा हते ुआिदे न (1) जनयम 4 के उप-जनयम (2) के तहत जनधावठरत पात्रता मानदंडों को पूरा करन े िाला कोई भी व्यजि िीएमडीएसएस िीओसी प्राि करन े के जलए केंद्र सरकार को परीिा हते ु इस उद्दश्े य के जलए जनर्दवष्ट प्रपत्र म ें आिेदन कर सकता ह ैऔर एक हिार रुपय ेकी फीस का भुगतान कर सकता ह।ै (2) िीएमडीएसएस िीओसी को प्रदान करन े के जलए परीिा म ेंजनम्नजलजखत दो भाग होंग:े क) भाग-I में 60 अंकों के जलए जलजखत परीिा है, जिसके जलए उत्तीणाांक 36 अंक होंग;े ख) भाग-II म ें 100 अंकों के जलए व्यािहाठरक और मौजखक परीिा िाजमल है, जिसके जलए उत्तीणाांक 70 अंक होंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) परीिा के भाग-I को सफलतापूिवक उत्तीणव करन े के बाद भाग-II को करना केिल उन आिेदकों के जलए अजनिायव होगी जिन्होंने पहले िीएमडीएसएस िीओसी नहीं ककया ह ै और िो ऐसे प्रमाण-पत्र की समाजि के पांच साल से अजधक समय बाद िीएमडीएसएस िीओसी के जलए आिेदन कर रह े ह।ैं जनयम 9 के उप जनयम (1), (2) और (3) के तहत आिेदक परीिा के भाग-II के जलए सीधे आिेदन कर सकते ह।ैं 6. िीएमडीएसएस आरओसी प्रदान करन ेके जलए परीिा के जलए आिदे न (1) जनयम 4 के उप-जनयम (2) के तहत जनधावठरत पात्रता मानदडं ों को परू ा करन े िाला कोई भी व्यजि केंद्र सरकार को िीएमडीएसएस आरओसी प्राि करने के जलए परीिा हते ु इस उद्दश्े य के जलए जनर्दवष्ट प्रपत्र म ें आिेदन कर सकता ह ैऔर एक हिार रुपय ेकी फीस का भुगतान कर सकता ह।ै (2) िीएमडीएसएस आरओसी प्रदान करने के जलए परीिा दो भागों म ें होगी भाग-I जलजखत परीिा होगी और भाग-II म ें व्यािहाठरक और मौजखक परीिा होगी परीिा के प्रत्येक भाग के जलए 50 अंक होगा। सफल होन े के जलए आिेदक को भाग-I और भाग-II दोनों म ेंसंयुि रूप से कुल 50 अंक प्राि करने होंग।े 7. िीएमडीएसएस प्रमाण-पत्र प्रदान करन ेके जलए परीिा का आयोिन (1) केन्द्र सरकार िमिः िीएमडीएसएस िीओसी और िीएमडीएसएस आरओसी प्राि करने के जलए परीिा का पाठ्यिम, स्ट्थान, तरीका, जतजथ और समय तथा ऐसी परीिा के पठरणाम की घोर्णा की जतजथ प्रकाजित करेगी। (2) ऐसी परीिा की भार्ा अंग्रेिी होगी। 8. िीएमडीएसएस प्रमाण-पत्र प्रदान करना और िधै ता (1) केंद्र सरकार पठरणाम घोजर्त होने के तरु ंत बाद सफल उम्मीदिारों को अनंजतम (प्रोजििनल) प्रमाण-पत्र िारी करेगी िो छह माह तक िैध होगा। ऐसे प्रमाण-पत्रों की जनबंधन और ित ें अतं राष्ट्रव ीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के अंतगवत जिजनर्दवष्ट की िाएगं ी। (2) अनंजतम (प्रोजििनल) प्रमाण-पत्र धारक को प्रोजििनल प्रमाण-पत्र िारी होने की जतजथ से छह माह की अिजध के भीतर संबंजधत श्रेणी के िीएमडीएसएस प्रमाण-पत्र के जलए आिेदन करना होगा। (3) कोई भी अनंजतम (प्रोजििनल) प्रमाण-पत्र धारक िो छह माह की अिजध के बाद और प्रोजििनल प्रमाण-पत्र िारी करन े की जतजथ से दो िर् व तक िीएमडीएसएस प्रमाण-पत्र हते ु आिेदन करता ह,ै उसे उप-जनयम (5) के अंतगवत देय िुल्क के अलािा एक हिार रुपए के जिलंब िल्ु क का भुगतान करना होगा। (4) उप-जनयम (1) के अतं गतव अनजं तम (प्रोजििनल) प्रमाण-पत्र िारी करने की जतजथ से दो िर्व की अिजध समाप् त होने पर िीएमडीएसएस प्रमाण-पत्र प्रदान नहीं ककया िाएगा। (5) जनम्नजलजखत श्रेजणयों में से ककसी भी श्रेणी के अंतगतव िीएमडीएसएस प्रमाण-पत्र जनम्न जलजखत ताजलका में जिजनर्दवष्ट िुल्क के भगु तान के अधीन िारी ककया िाएगा: प्रमाण पत्र की श्रणे ी िल्ु क (i) िीएमडीएसएस िीओसी बीस िर्व की िैधता अिजध के जलए दस हिार रुपये आिीिन िैधता के जलए पंद्रह हिार रुपये (ii) िीएमडीएसएस आरओसी आिीिन िैधता के जलए पांच हिार रुपये[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 इस उप-जनयम के प्रयोिनों के जलए "आिीिन" िब्द का तात्पयव िीएमडीएसएस प्रमाण-पत्र धारक द्वारा अस्ट्सी िर्व की आय ुप्राि करने से ह।ै (6) िीएमडीएसएस प्रमाण-पत्र की िैधता अिजध जनयम 7 के अंतगवत आयोजित परीिा के पठरणाम की घोर्णा की जतजथ स े िुरू होगी। िीएमडीएसएस प्रमाण-पत्र की प्रत्येक श्रेणी अतं रावष्ट्रीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के अंतगवत जिजनर्दवष्ट जनबंधन और ितों के अधीन होगी। 9. िीएमडीएसएस िीओसी का निीकरण (1) बीस िर्व की प्रारंजभक अिजध के जलए िैध िीएमडीएसएस िीओसी का निीकरण ऐसे िीएमडीएसएस िीओसी की समाजि स े एक िर्व पूि व ककए गए आिेदन के आधार पर इस प्रयोिन के जलए केन्द्र सरकार द्वारा जिजनर्दवष्ट प्रारूप म ें जनयम 8 के उप-जनयम (5) के अंतगवत जनधावठरत ककए गए िल्ु क का भुगतान करन े पर और जनम्न जलजखत जनधावठरत मानदंडों म ें से ककसी एक मानदंड को परू ा करन े पर आग े बीस िर्व की अिजध के जलए अथिा आिीिन के जलए निीकृत ककया िा सकता ह:ै क) िीएमडीएसएस िीओसी की समाजि की जतजथ से िीक पूिव पांच िर्व की अिजध के भीतर कम से कम छह माह के कुल अनुभि का प्रमाण प्रस्ट्तुत करना; अथिा ख) जनयम 5 के उप-जनयम (2) के उप-पैरा (ख) के अतं गतव जिजनर्दवष्ट परीिा के भाग-II को सफलतापूिवक उत् तीण व करना। (2) िीएमडीएसएस िीओसी की समाजि की जतजथ से दो िर् व की अिजध के भीतर निीकरण के जलए आिेदन उप-जनयम (1) के अंतगवत जिजनर्दवष्ट मानदंडों की पूर्त व और एक हिार रुपये की दर स े जिलंब िुल्क के भुगतान के अधीन होगा। (3) िीएमडीएसएस िीओसी की समाजि की जतजथ से दो िर्व के बाद निीकरण के जलए आिेदन पर जनयम 8 के उप-जनयम (5) के अतं गतव जनधावठरत ककए गए िल्ु क के भगु तान तथा एक हिार रुपय े के जिलंब िुल्क का भुगतान भी करने के अजतठरक्त जनयम 5 के अंतगवत जिजनर्दवष्ट परीिा के भाग-II को आिेदक द्वारा सफलतापूिवक उत् तीणव करन े पर ही जिचार ककया िाएगा। (4) िीएमडीएसएस िीओसी की समाजि की जतजथ स े पांच िर् व की अिजध समाप् त होन े के बाद ककसी भी िीएमडीएसएस िीओसी का निीकरण नहीं ककया िाएगा। 10. डुप्लीकेि िीएमडीएसएस प्रमाण-पत्र िारी करना (1) िीएमडीएसएस प्रमाण-पत्र की डुप्लीकेि प्रजत के जलए केंद्र सरकार को इस प्रयोिन के जलए जिजनर्दवष्ट प्रारूप में एक हिार रुपये की िुल् क के भगु तान के साथ आिेदन करना होगा। यकद िीएमडीएसएस प्रमाण- पत्र खो गया ह ै तो आिेदन के साथ स्ट्थानीय पुजलस स्ट् िेिन म ें प्रमाण-पत्र खोने के संबंध में दिव कराई गई ठरपोिव संलग्न करनी होगी। (2) केन्द्र सरकार ऐसे आिेदन के आधार पर डुप्लीकेि िीएमडीएसएस प्रमाण-पत्र िारी कर सकती ह।ै 11. िीएमडीएसएस प्रमाण-पत्र धारकों पर लाग ूसामान्य दाजयत्ि (1) केन्द्र सरकार इन जनयमों के अतं गवत ककसी भी समय िीएमडीएसएस प्रमाण-पत्र धारक स े प्रमाण-पत्र को प्रस्ट्तुत करन े की मांग कर सकती ह ैऔर प्रमाण-पत्र धारक को ऐसी मांग का अनुपालन करना होगा। (2) िीएमडीएसएस प्रमाण-पत्र धारक ऐस े िीएमडीएसएस प्रमाण-पत्र प्रदान करन े की प्रकिया को जनयंजत्रत करने िाली ककसी भी ितव में ककए गए संिोधन, पठरितवन, प्रजतसंहरण अथिा जनलबंन से बाध्य होगा। जनयम 15 के अंतगवत अजधसूजचत होने पर ऐसे पठरितवनों को आजधकाठरक िेबसाइि और इसके साथ-साथ6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] पोिवल पर पर प्रकािन के माध्यम से उपलब्ध कराया िाएगा और िीएमडीएसएस प्रमाण-पत्र के जलए आिेदक द्वारा आिेदन में कदए गए ईमेल पत े पर ईमले भी भेिा िाएगा। (3) यकद कोई संदेि जिस े प्राि करने का अजधकार िीएमडीएसएस प्रमाण-पत्र धारक को नहीं ह,ै कफर भी उसे िह संदेि प्राि होता ह ै तो ऐसा िीएमडीएसएस प्रमाण-पत्र धारक इसके जिर्यों, इसके स्रोत अथिा गंतव् य, इसके अजस्ट्तत्ि अथिा इसकी प्राजि के तथ्य ककसी भी व्यजि को ज्ञात नहीं करेगा अथिा ज्ञात करन े की अनुमजत नहीं दगे ा, (केंद्र सरकार अथिा ककसी न्यायालय द्वारा इस प्रयोिन के जलए जिजधित रूप स े प्राजधकृत अजधकारी के अलािा ककसी अन् य को), और ऐसे संदेि की जलजखत में प्रजतकृजत नहीं बनाएगा, उसकी प्रजतजलजप नहीं बनाएगा अथिा ऐसे संदेि का कोई उपयोग नहीं करेगा अथिा उस संदेि को जलजखत में प्रजतकृजत बनाने, प्रजतजलजप बनाने अथिा उसका उपयोग ककए िाने की अनुमजत प्रदान नहीं करेगा। 12. अन्य देिों द्वारा िारी ककए गए प्रमाण-पत्रों की मान्यता केन्द्र सरकार समय-समय पर यथाजिजनर्दवष्ट ितों के अधीन जनयम 8 के अंतगवत प्रदान ककए गए प्रमाण-पत्रों की तिव पर ककसी अन्य देि में सिम प्राजधकारी द्वारा िारी ककए गए प्रमाण-पत्रों को मान्यता द ेसकती ह।ै 13. िीएमडीएसएस प्रमाण-पत्र को जनलजं बत अथिा रद्द करना केन्द्र सरकार िीएमडीएसएस प्रमाण-पत्र को जनलंजबत अथिा रद्द कर सकती ह ै यकद उसके जिचार में िीएमडीएसएस प्रमाण-पत्र धारक न:े क) ऐसे िीएमडीएसएस प्रमाण-पत्र के जलए लाग ू अतं रावष्ट्रीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के प्रािधानों अथिा रेजडयो उपकरण के प्रचालन के संबंध म ें ऐसे िीएमडीएसएस प्रमाण-पत्र धारक पर लाग ू जनयमों का पालन करने म ेंजिफल रहा हो अथिा ख) िानबूझकर केन्द्र सरकार को गलत अथिा असत् य सूचना दी हो; बिते कक इस उप-जनयम के अतं गवत जनलंजबत अथिा रद्द करन े का कोई आदेि तब तक नहीं कदया िाएगा िब तक िीएमडीएसएस प्रमाण-पत्र धारक को केंद्र सरकार के समि प्रमाण-पत्र जनलंजबत अथिा रद्द करन े के जिरुद्ध अभ्यािेदन दने े का उजचत अिसर नहीं कदया गया हो। 14. फीस िापस नहीं की िाएगी ककसी भी कारण से िीएमडीएसएस प्रमाण-पत्र को जनलंजबत अथिा रद्द करन े अथिा New Delhi, the 24th July, 2024 G.S.R. 446(E).—The following draft rules, which the Central Government proposes to make in exercise of the powers conferred under section 46, read with clause (zh) of sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), are hereby published for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which copies of this notification as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, may be addressed to the Joint Secretary (Telecom), Department of Telecommunications, Ministry of Communications, Government of India, Sanchar Bhawan, 20, Ashoka Road, New Delhi - 110001; The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be taken into consideration by the Central Government. 1. Short title and commencement (1) These rules may be called the Telecommunications (Commercial Radio Operator’s Certificate of Proficiency to Operate Global Maritime Distress and Safety System) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions (1) In these rules, unless the context otherwise requires: a) “Act” means the Telecommunications Act, 2023 (44 of 2023); b) “GMDSS” or “Global Maritime Distress and Safety System” means an internationally agreed set of safety procedures, frequencies, types of equipment, and communication protocols for maritime safety, which operates using terrestrial and satellite radio technologies, both onboard ships and onshore; c) “GMDSS Certificate” means either of the two categories of certificates, namely, GMDSS GOC and GMDSS ROC, as specified under sub-rule (1) of rule 4, and a “GMDSS Certificate holder” or “holder” means the person who has been granted such certificate under rule 8; d) “International Telecommunication Convention” means the Convention of the International Telecommunication Union signed at Geneva in 1992 or any subsequent revision or modification thereof which the Government of India has ratified or accepted; e) “portal” means the portal which may be notified by the Central Government under rule 15 of these rules; f) “Radio Regulations” means the regulations adopted by the World Radiocommunication Conference (Geneva 1995) and includes every revision or modification thereof which the Government of India has ratified or accepted; g) “rules” means the Telecommunications (Commercial Radio Operator’s Certificate of Proficiency to operate Global Maritime Distress and Safety System) Rules, 2024; h) “WPC Wing” means the Wireless Planning and Co-ordination Wing of the Department of Telecommunications, Government of India. (2) Words and expressions used and not defined herein but defined in the Act shall have the meaning assigned to them in the Act. 3. Scope No person shall operate GMDSS except under and in accordance with the terms and conditions of a GMDSS Certificate granted under these rules. 4. Categories of GMDSS certificates and eligibility (1) There shall be two categories of GMDSS Certificates which may be granted by the Central Government under rule 8, namely:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] a) GMDSS - General Operator’s Certificate, or GMDSS- GOC; b) GMDSS - Restricted Operator’s Certificate, or GMDSS- ROC. (2) A GMDSS Certificate under the relevant category shall be granted in accordance with rule 8 to a person who satisfies the eligibility criteria as set forth below, and qualifies the examination specified under rule 7: GMDSS – GOC GMDSS - ROC Citizen of India Citizen of India Above the age of eighteen years, as on the date of Above the age of eighteen years, as on the date of examination. examination. (3) Notwithstanding anything contained in these rules, the Central Government may, subject to such conditions as it may impose from time to time, permit a person, not being a citizen of India, to take the examination held under rule 7, for the purpose of grant of the GMDSS Certificate under the relevant category. 5. Application for examination for grant of GMDSS GOC (1) Any person satisfying the eligibility criteria set forth under sub-rule (2) of rule 4 may make an application for the examination for obtaining the GMDSS GOC to the Central Government, in the form as may be specified for this purpose and pay fees of one thousand rupees. (2) Examination for grant of GMDSS GOC shall consist of the following two parts: - (a) Part-I comprising of a written examination for 60 marks, for which the passing marks shall be 36 marks; and (b) Part-II comprising of a practical and oral examination, for 100 marks, for which the passing marks shall be 70 marks. (3) The successful completion of Part-I of the examination shall be a mandatory requisite for undertaking Part-II only for applicants who have previously not held GMDSS GOC, and those applying for GMDSS GOC more than five years after the expiry of such certificate. Applicants under sub rules (1), (2) and (3) of rule 9 can apply directly for the Part-II examination. 6. Application for examination for grant of GMDSS ROC (1) Any person satisfying the eligibility criteria set forth under sub-rule (2) of rule 4 may make an application for the examination for obtaining GMDSS ROC to the Central Government, in the form as may be specified for this purpose and pay fees of one thousand rupees.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (2) Examination for grant of GMDSS ROC shall consist of Part-I comprising of a written examination and Part-II comprising of practical and oral examination, each part having 50 marks. A successful applicant shall be required to obtain a total combined score of 50 marks in Part I and Part II together. 7. Conduct of examination for grant of GMDSS Certificate (1) The Central Government shall publish the syllabus, place, manner, date and time for the examination for obtaining the GMDSS GOC and GMDSS ROC respectively, and the date of announcement of the results of such examination. (2) The language of such examination shall be English. 8. Grant and validity of GMDSS Certificate (1) The Central Government shall issue a provisional certificate with a validity of six months to the successful candidates immediately on declaration of the results. The terms and conditions for such certificates shall be as specified under the International Telecommunication Convention and the Radio Regulations. (2) A provisional certificate holder shall apply for GMDSS Certificate of the relevant category, within a period of six months from the date of issue of the provisional certificate. (3) Any provisional certificate holder who applies for the GMDSS Certificate beyond a period of six months and up to two years from date of issue of provisional certificate, shall be required to make a payment of late fees of one thousand rupees in addition to the fees payable under sub-rule (5). (4) The GMDSS Certificate shall not be granted upon lapse of two years from the date of issue of provisional certificate under sub-rule (1). (5) GMDSS Certificate under any of the following categories shall be issued subject to payment of fees as specified below: Category of Certificate Fee (i) GMDSS GOC Ten thousand rupees for validity period of twenty years Fifteen thousand rupees for lifetime validity (ii) GMDSS ROC Five thousand rupees for lifetime validity For the purposes of this sub-rule, the expression “lifetime” means till the GMDSS Certificate holder attains the age of eighty years. (6) The validity period of the GMDSS Certificate shall commence from the date of declaration of the result of the examination conducted under rule 7. Each category of GMDSS Certificate shall be subject to terms and conditions as specified under the International Telecommunication Convention and the Radio Regulations. 9. Renewal of GMDSS GOC (1) A GMDSS GOC which is valid for an initial period of twenty years, may be renewed for another twenty years or for lifetime, based on an application made within one year prior to the expiry of such GMDSS GOC, in the form as may be specified by the Central Government for this purpose, on payment of fee as provided under sub-rule (5) of rule 8, and fulfilment of either of the criteria set forth below: a) submission of proof of total experience of not less than six months, within a period of five years immediately preceding the date of expiry of the GMDSS GOC; or b) successful completion of Part-II of the examination as specified under sub-paragraph (b) of sub- rule (2) of rule 5. (2) An application for renewal within two years after the date of expiry of the GMDSS GOC, subject to the fulfilment of the criteria specified under sub-rule (1) above and payment of late fees at the rate of one thousand rupees. (3) An application for renewal after two years of the date of expiry of the GMDSS GOC, shall be considered only upon successful completion by the applicant of Part-II of the examination as specified under rule 5, in addition to payment of fee as provided under sub-rule (5) of rule 8, as well as payment of late fee of one thousand rupees. (4) No GMDSS GOC shall be renewed after a lapse of five years from the date of expiry of the GMDSS GOC.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10. Issue of duplicate GMDSS Certificate (1) An application for duplicate GMDSS Certificate shall be made to the Central Government in the form as specified for this purpose, along with payment of fees of one thousand rupees. In case the GMDSS Certificate has been lost, the application shall be accompanied with the report filed with the local police regarding such loss. (2) The Central Government may issue a duplicate GMDSS Certificate based on such application. 11. General obligations applicable to GMDSS certificate holders (1) The Central Government may under these rules at any time require the GMDSS Certificate holder to produce the same and the holder shall comply with such requisition. (2) The GMDSS Certificate holder shall be bound by modification, variation, cancellation or revocation of any of the conditions governing the grant of such GMDSS Certificate. Such changes shall be made available through publication on the official website, as well as on the portal as and when notified under rule 15, and an email shall also be sent to the email address provided by the applicant in his application for GMDSS Certificate. (3) If any message which a GMDSS Certificate holder is not entitled to receive is, nevertheless received, such GMDSS Certificate holder shall not make known or allow to be made known its contents, its origin or destination, its existence or the fact of its receipt to any person, (other than to an officer duly authorised for this purpose by the Central Government or a court of law), and shall not reproduce in writing, copy or make any use of such message or allow the same to be reproduced in writing, copied or made use of. 12. Recognition of certificates issued by other countries The Central Government may recognize, subject to conditions as it may specify from time to time, certificates similar to those granted under rule 8, issued by a competent authority in any other country. 13. Suspension or cancellation of GMDSS Certificate The Central Government may suspend or cancel the GMDSS Certificate if in its opinion, the GMDSS Certificate holder has: (a) failed to comply with the provisions of the International Telecommunication Convention and the Radio Regulations as applicable for such GMDSS Certificate, or rules applicable to such GMDSS Certificate holder in respect of operation of radio equipment, or (b) wilfully furnished incorrect or false information to the Central Government; Provided that no order of suspension or cancellation under this sub-rule shall be made unless the GMDSS Certificate holder has been given a reasonable opportunity of making a representation against such suspension or cancellation to the Central Government. 14. No refund of fees No compensation or refund of fees shall be applicable as a result of any suspension or cancellation of the GMDSS Certificate, for any reason whatsoever, or for any modification, variation, cancellation or revocation of terms and conditions of the GMDSS Certificate. 15. Digital Implementation of these Rules The Central Government, in furtherance of section 53 of the Act, may notify a portal for the digital implementation of these rules, including for submission of applications, publication of syllabus, place, manner, date and time of examination, declaration of results of examinations, grant of GMDSS Certificate, modification of terms and conditions, any other permission, instruction or direction as may be required for the operation of the GMDSS Certificates.
