और उक्त प्रारूप जनयमों के सबं ंध में िनता स े प्राप्त आिपे ों और सुझावों पर केंद्रीय सरकार द्वारा जवचार दकया गया ह।ै अतः, अब केंद्रीय सरकार, अंतििे ीय िलयान अजधजनयम, 2021 (2021 का 24) की धारा 28 की उपधारा (1), धारा 106 की उपधारा (1) तथा उपधारा (2) के खंड (च) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए जनम्नजलजखत जनयम बनाती ह,ै अथागत ् :- 1. सजं िप्त नाम और प्रारंभ .- (1) इन जनयमों का संजिप्त नाम अंतिेिीय िलयान (पररवतनग या उपांतरण के जलए पूव ग अनुमोिन) जनयम, 2026 ह।ै 5013 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. पररभाषाएं :- (1) इन जनयमों में, िब तक दक संिभ गसे अन्यथा अपेजित न हो, - (क) "अजधजनयम" स ेअंतिेिीय िलयान अजधजनयम, 2021 (2021 का 24) अजभप्रेत ह;ै या (ख) "पररवतनग या उपातं रण" स ेजनम्नजलजखत म ेंसे कोई भी अजभप्रेत है, अथागत,् :- (i) िलयान की जवमाओं और िमताओं का सारभूत पररवतनग ; या (ii) िलयान के प्रकार या प्राथजमक कायग का पररवतगन; या (iii) िस प्रजतित से अजधक द्वारा िलयान के सकल टनभार का पररवतगन; या (iv) नोिन प्रणाली या मुखय इंिन या इंधन के प्रकार का पररवतगन; या (v) िलयान के सेवा िीवन म ेंसारभूत वृजि; या (vi) उप-प्रभाग को सारभूत रुप से प्रभाजवत करता है; या (vii) िलरूि तथा मौसमरूि समग्रता को सारभूत रुप से प्रभाजवत करते ह;ैं (ग) "वगीकरण सोसायटी" से मान्यता प्राप्त सगं ठन अजभप्रेत ह ैिो अंतरराष्ट्रीय वगीकरण सोसायटी संगम का सिस्ट्य ह।ै (2) इसमें प्रयक्तु िब्ि और अजभव्यजक्तयां तथा िो इन जनयमों म ेंपररभाजषत नहीं ह ैककंत ु अजधजनयम में पररभाजषत ह,ैं का वही अथग होगा िो उन्ह ेंक्रमिः अजधजनयम में दिया गया ह।ै 3. अजभजहत प्राजधकारी का पवू ग अनमु ोिन :- (1) िलयान स्ट्वामी या प्रचालक िो अपने िलयान म ें कोई पररवतगन या उपांतरण करने का इच्छुक ह ै जिससे उसकी समथगता, जस्ट्थरता या सुरिा पर प्रभाव पड़ता है, इन जनयमों से संलग्न प्ररुप म ें एक आवेिन प्रस्ट्ताजवत पररवतनग या उपांतरण की प्रकृजत तथा जवस्ट्तार को जवजनर्िगष्ट करते हुए अजभजहत प्राजधकारी को प्रस्ट्तुत करेगा। (2) आवेिन प्राप्त होन े पर, अजभजहत प्राजधकारी िलयान की सुरिा, समथतग ा, जस्ट्थरता तथा अवसंरचनात्मक समग्रता पर उनके प्रभाव के जनधागरण के जलए प्रस्ट्ताजवत पररवतगन या उपांतरण का पनु र्वगलोकन करेगा । (3) पररवतगन या उपांतरण िलयान के जडिाइन या वगीकरण म ें सुरिा मानकों और दकन्हीं जवजनर्िगष्ट रूपरेखा की अपेिाओं के संबंध म ेंअतं िेिीय िलयान (जडिाइन और जनमाणग ) जनयम, 2024 के उपबंधों की अनुपालना करेगा। (4) अजभजहत प्राजधकारी द्वारा आवश्यक समझ े िान े की ििा में, अंतििे ीय िलयान (जडिाइन और जनमागण) जनयम, 2024 के जनयम 5 में यथाजवजनर्िगष्ट िलयान स्ट्वामी द्वारा प्रस्ट्ताजवत पररवतनग या उपांतरण के तकनीकी पहलओंु के जनधागरण के जलए यथालागू दकसी नौसेना वास्ट्तुजवि या समुद्री इंिीजनयर या सवेिक या वगीकरण सोसायटी के माध्यम स े स्ट्वतंत्र मूल्यांकन का आिेि कर सकेगा। (5) पररवतनग या उपांतरण की ििा म ें िो िलयान सुरिा या पयागवरण पर प्रभाव करेगा, अजभजहत प्राजधकारी िलयान को सुरिा जनधागरण के माध्यम स े िाने का आिेि करेगा तथा ऐसा उपाय प्रभाव को कम करने के जलए कायागजन्वत दकया िाएगा। (6) उन ििाओं म ें िहां ऐसे िलयान अंतििे ीय िलयान (जडिाइन और जनमागण) जनयम, 2024 के जनयम 4 के अनुसार वगीकरण सोसायटी के सवेिण के अधीन अनरु जित करना अपेजित है, संबि वगीकरण सोसायटी को भी िलयान स्ट्वामी द्वारा तिनुसार सूजचत दकया िाएगा। (7) िलयान स्ट्वामी या प्रचालक द्वारा पररवतनग या उपांतरण के जलए दिए गए आवेिन के सत्यापन पर, अजभजहत प्राजधकारी िलयान स्ट्वामी या प्रचालक को पूवग अनुमोिन का एक प्रमाणपत्र अनुित्त करेगा तथा स्ट्वामी हर समय िलयान के फलक पर पूवग अनुमोिन प्रमाणपत्र को उपिर्िगत करेगा। (8) िलयान स्ट्वामी अंतििे ीय िलयान (रजिस्ट्रीकरण और अन्य तकनीकी मुद्दे) जनयम, 2022 के जनयम 9 के अनुसार िलयान के पररवतगन या उपांतरण या पुनरर्िगस्ट्रीकरण (यथालाग)ू के अजभलेखन के जलए आवश्यक किम उठाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 4. अन्य पररवतनग या उपातं रण :- सभी अन्य पररवतनग या उपांतरण, अंतििे ीय िलयान (रजिस्ट्रीकरण और अन्य तकनीकी मुद्दे) जनयम, 2022 के प्ररुप 6 में ऐसे पररवतगन या उपांतरणों को दक्रयाजन्वत करने के तीस दिन के भीतर अजभजहत प्राजधकारी को जलजखत म ेंसूजचत दकए िाएंगे। 5. अनमु ोिन के अनिु त्त होन ेके जलए मानिंड :- जनयम 4 म ें यथाजनर्िगष्ट िलयानों के सभी पररवतगन और उपांतरण जनम्नजलजखत मानिडं का पालन करेंगे, अथागत् :- (क) पररवतगन या उपांतरण अंतिेिीय िलयान (जडिाइन और जनमागण) जनयम, 2024 के जनयम 5 तथा अजधजनयम के अधीन जवरजचत अन्य लाग ू जनयमों के अनुसरण म ें िलयान, चालकिल, यात्री तथा पयागवरण की सरु िा सुजनजित करेंगे; (ख) अवसंरचनात्मक पररवतनग या उपांतरण ऐस े तरीके से जडिाइन और जनष्पादित दकए िाएंगे जिससे िलयान की अवसंरचनात्मक समग्रता और जस्ट्थरता का रखरखाव या वधगन हो सके तथा अवसंरचनात्मक संगणना और जनधागरण जडिाइनर द्वारा दक्रयाजन्वत दकया िा सके और सत्यापन तथा अनुमोिन के जलए यथालाग ू अजभजहत प्राजधकारी या वगीकरण सोसायटी (वगीकरण सोसायटी के अधीन िलयानों के जलए) प्रस्ट्तुत दकया िा सके। (ग) पररवतगन या उपांतरण के जलए िो िलयान की जस्ट्थरता को प्रभाजवत करता ह,ै यथालागू अजभजहत प्राजधकारी या वगीकरण सोसायटी द्वारा सत्यापन के जलए अतं िेिीय िलयान (जडिाइन और जनमाणग ) जनयम, 2024 के उपबंधों के अनुसार जस्ट्थरता जवश्लेषण संचाजलत दकया िाएगा तथा िलयान उसकी अनुमोदित जस्ट्थरता सीमाओं के भीतर प्रचाजलत दकया िाएगा। प्ररुप अंतिेिीय िलयान में पररवतगन या उपांतरण के पूव गअनुमोिन के जलए आवेिन [जनयम 3(1) िेखें] सेवा म,ें अजभजहत प्राजधकारी ............................. ............................ जवषय : अंतििे ीय िलयान म ेंपररवतगन या उपांतरण के जलए पूवग अनुमोिन आवेिन महोिय/महोिया, म,ैं [स्ट्वामी का नाम], अंतििे ीय िलयान के स्ट्वामी के रुप में नाजमत " ------ ",िासकीय संखया सजहत ..... उक्त िलयान के जनम्नजलजखत प्रस्ट्ताजवत पररवतनग ों/उपांतरणों को दक्रयाजन्वत करन े के जलए पूवग अनुमोिन प्राप्त करने हते ु यह आवेिन प्रस्ट्तुत करता ह ं: 1...................................................................................................................... 2 .................................................................................................................... 3 .................................................................................................................... प्रस्ट्ताजवत पररवतनग /उपांतरण जनम्नजलजखत के जलए आिजयत ह ैं:- .................................................................................................................... [फा सं. आईडब्ल्यूटी-II- 12011/4/2025-आईडब्ल्यूटी-II] डॉ कमला कांत नाथ, सलाहकार (सांजखयकी)[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 3rd July, 2026 G.S.R. 562(E).—Whereas a draft of the Inland Vessels (Prior Approval for Alteration or Modification) Rules, 2025 were published, as required under sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), vide notification of the Government of India in the Ministry of Ports, Shipping and Waterways number G.S.R. 464 (E), dated the 11th July, 2025 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), dated the 11th July, 2025, inviting objections and suggestions from persons likely to be affected thereby, before expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, copies of the said notification were made available to the public on the 11th July, 2025. And whereas, objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government. Now, therefore, in exercise of the powers conferred by sub section (1) of section 28, sub-section (1) and clause (f) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government hereby makes the following rules, namely: – 1. Short title and commencement. – (1) These rules may be called the Inland Vessels (Prior Approval for Alteration or Modification) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. – (1) In these rules, unless the context otherwise requires, - (a) “Act” means the Inland Vessels Act, 2021 (24 of 2021); (b) “Alteration or Modification” means any of the following, namely: - (i) substantially alter the dimensions or capacity of the vessel; or (ii) changes type or primary function of the vessel; or (iii) changes the gross tonnage of the vessel by more than ten per cent., or (iv) changes the propulsion system or main engines or type of fuels; or (v) substantially increase service life of the vessel; or (vi) substantially affects the sub-division; or (vii) substantially affect the watertight and weathertight integrity; (c) “classification society” means a recognised organisation which is a member of the International Association of Classification Societies. (2) Words and expressions used herein and not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Prior approval of designated authority. – (1) The vessel owners or operators desirous of making any Alteration or Modification to their vessel so as to affect its strength, stability or safety shall submit an application in the Form appended to these rules, specifying the nature and scope of the proposed alteration or modification to the designated authority. (2) Upon receiving the application, the designated authority shall review the proposed Alteration or Modification to assess their impact on vessel safety, strength, stability and structural integrity. (3) Alteration or Modification shall comply with the provisions of the Inland Vessels (Design and Construction) Rules, 2024, in respect of the safety standards and any specific requirement outlined in the design or classification of the vessel. (4) In case, it is deemed necessary by the designated authority, an independent evaluation may be ordered through a naval architect or marine engineer or surveyor, or through classification society, as applicable, to assess the technical aspects of the proposed Alteration or Modification by the vessel owner as specified in rule 5 of the Inland Vessels (Design and Construction) Rules, 2024. (5) In case of Alteration or Modification that would impact vessel safety or environment, the designated authority6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] shall order the vessel to undergo a thorough safety assessment and such measure shall be implemented to mitigate the impact. (6) In cases where such vessel is required to be maintained under survey of a classification society as per rule 4 of the Inland Vessels (Design and Construction) Rules, 2024, the concerned classification society shall also be informed accordingly by the vessel owner. (7) Upon verification of application for Alteration or Modification submitted by the vessel owner or operator, the designated authority shall grant a certificate of prior approval to the vessel owner or operator and the owner shall display the certificate of prior approval onboard the vessel at all times. (8) The vessel owner shall take necessary measures for recording of Alteration or Modification or re-registration of vessel (as applicable) as per rule 9 of the Inland Vessels (Registration and other Technical issues) Rules, 2022. 4. Other alterations or modifications.- All other alterations or modifications shall be intimated in writing to the designated authority within thirty days of carrying out such alterations or modifications in Form 6 of the Inland Vessels (Registration and other Technical issues) Rules, 2022 . 5. Criteria for grant of approval. – All Alterations or Modifications to vessels as referred to in rule 4, shall adhere to the following criteria, namely:- (a) Alteration or Modification shall ensure the safety of the vessel, crew, passengers and the environment in accordance with rule 5 of the Inland Vessels (Design and Construction) Rules, 2024 and other applicable rules framed under the Act. (b) structural alterations or modifications shall be designed and executed in a way that maintains or enhances the structural integrity and stability of the vessel and the structural calculations and assessments may be carried out by the designer and submitted to the designated authority or classification society (for vessels under classification society), as applicable, for verification and approval. (c) for Alterations or Modifications that affect the stability of the vessel, a stability analysis shall be conducted as per the provisions of the Inland Vessels (Design and Construction) Rules, 2024 for verification by designated authority or classification society, as applicable, and the vessel shall be operated within its approved stability limits.
