L.-33004/99 सी.जी.-डी.एल.-अ.-01112024-258399 CG-DxLxx-GEI-D01H1x1x2x 024-258399 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 616] नई ददल्ली बधु िार, अक्त बू र 30, 2024/ कार्तकव 8, 1946 No. 616] NEW DELHI, WEDNESDAY, OCTOBER 30, 2024/KARTIKA 8, 1946 सचं ार मत्रं ालय (दरू सचं ार जिभाग) अजधसचू ना नई ददल्ली, 29 अक् तूबर, 2024 सा. का. जन. 674(अ).—िबदक दरू संचार (िैजिक समुद्री सकं ट और सरु क्षा प्रणाली के प्रचालन के जलए िाजणजययक रेजडयो ऑपरेटर का प्रिीणता प्रमाणपत्र) जनयम, 2024 का एक प्रारूप जिसे केंद्रीय सरकार दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खडं (यि) के साथ पठित धारा 46 के अधीन प्रदत्त िजियों का प्रयोग करत े हुए बनान े का प्रस्ट्ताि करती ह,ै जिसे भारत सरकार के संचार मंत्रालय, दरू संचार जिभाग संख्या सा.का.जन 446 (अ.) तारीख 24 िुलाई 2024 की अजधसूचना के द्वारा भारत के रािपत्र, असाधारण, भाग 2, धारा 3, उप-धारा (i), तारीख 24 िुलाई 2024 द्वारा उि अजधजनयम की धारा 56 की उप-धारा (1) अधीन प्रकाजित दकया गया था, जिससे प्रभाजित होन े िाले संभाजित व्यजियों से उस तारीख से तीस ददन की अिजध की समाजि से पूिव जिसको उि अजधसूचना की रािपत्र की प्रजतयां िनता को उपलब्ध कराई गई थीं, आपजत्तयां और सुझाि आमंजत्रत दकए गए थ;े और उि रािपत्र की प्रजतयां 24 िुलाई, 2024 को िनता के जलए उपलब्ध कराई गई थीं; और उि प्रारूप जनयमों के संबधं म ें िनता स े प्राि आपजत्तयों और सुझािों पर केंद्रीय सरकार द्वारा सम् यक रूप से जिचार दकया गया ह;ै अत: अब केन्‍द द्रीय सरकार, दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खडं (यि) के साथ पठित धारा 46 द्वारा प्रदत्त िजियों का प्रयोग करते हुए और भारतीय बेतार टेलीग्राफी (िाजणजययक रेजडयो 7079 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ऑपरेटर का प्रिीणता प्रमाणपत्र और िैजिक समुद्री संकट और सुरक्षा प्रणाली के प्रचालन के जलए लाइसेंस) जनयम, 1997 के अजधक्रमण म ें जिन्‍द ह ें ऐसे अजधक्रमण से पूि व दकया गया या करन े का लोप दकया गया ह ै और जनबंधन और ितों को अध् यारोही प्रभाि के जबना ऐसी व्यिस्ट्थाओं की समाजि की तारीख तक उन जनयमों के अधीन जिद्यमान व्यिस्ट्थाओं के संबंध में जनम्नजलजखत जनयम बनाती ह ैअथावत:् - 1. सजं क्षि नाम और प्रारंभ – (1) इन जनयमों का संजक्षप् त नाम दरू संचार (िैजिक समुद्री संकट और सुरक्षा प्रणाली के प्रचालन के जलए िाजणजययक रेजडयो ऑपरेटर का प्रिीणता प्रमाणपत्र) जनयम, 2024 ह।ै (2) य ेरािपत्र में अपन ेप्रकािन की तारीख से प्रिृत्त होंगे। 2. पठरभाषाए ँ – (1) इन जनयमों में िब तक दक संदभव से अन्‍दयथा अपेजक्षत न हो: क) "अजधजनयम" से दरू संचार अजधजनयम, 2023 (2023 का 44) अजभप्रेत ह;ै ख) "िैजिक समुद्री संकट और सुरक्षा प्रणाली" से समुद्री सुरक्षा के जलए सुरक्षा प्रदक्रयाओं, आिृज‍ तयों, उपकरणों के प्रकार और संचार प्रोटोकॉल का अंतरराष्ट्रीय स्ट्तर पर सहमत सेट िो िहाि और तट दोनों ही स्ट्थानों पर स्ट्थलीय और उपग्रहीय रेजडयो प्रौद्योजगदकयों का उपयोग करते हुए प्रचालन अजभप्रेत ह;ै ग) "िैजिक समुद्री संकट और सरु क्षा प्रणाली (िीएमडीएसएस) प्रमाणपत्र" से, िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र या िीएमडीएसएस प्रजतबंजधत प्रचालक प्रमाणपत्र अजभप्रेत ह,ै िैसा दक जनयम 4 के उप-जनयम (1) के अधीन जनर्दवष्ट ह,ै और "िीएमडीएसएस प्रमाणपत्र धारक" स े अजभप्राय ह ै िह व्यजि जिसे जनयम 8 के अधीन ऐसा प्रमाणपत्र ददया गया ह;ै घ) "अंतरावष्ट्रीय दरू संचार सम्मले न" से 1992 में जिनेिा में हस्ट्ताक्षठरत अतं रावष्ट्रीय दरू संचार संघ का सम्मेलन या उसके बाद का कोई संिोधन या सुधार अजभप्रते ह ैजिसे भारत सरकार न े अनुसमर्थवत या स्ट्िीकार दकया है; ङ) "पोटवल" से िह पोटवल अजभप्रेत ह ै जिसे इन जनयमों के जनयम 15 के अधीन केंद्रीय सरकार द्वारा अजधसूजचत दकया िा सकता ह;ै च) "रेजडयो जिजनयम" स े जिि रेजडयो संचार सम्मले न (िेनेिा 1995) द्वारा अपनाए गए जिजनयमन और इसमें प्र‍येक संिोधन या सुधार िाजमल ह ैंजिसे भारत सरकार द्वारा अनुसमर्थवत या स्ट्िीकार दकया गया अजभप्रेत है; छ) “डब्ल्यूपीसी विंग" से दरू संचार जिभाग, संचार मंत्रालय, भारत सरकार का बेतार आयोिना एिं समन्‍दिय विंग अजभप्रेत ह।ै (2) उन िब्दो और पदों के िो इसमें प्रयुि ह ैं और पठरभाजषत नहीं ह ै ककंतु इस अजधजनयम म ें पठरभाजषत ह ैं क्रमिः िही अथव होंगे िो उनके जलए उस अजधजनयम म ेंह।ैं 3. काय-व क्षत्रे – कोई भी व्यजि इन जनयमों के अधीन िीएमडीएसएस प्रमाणपत्र के जनबंधन और ितों के अनुसार िैजिक समुद्री संकट और सुरक्षा प्रणाली का प्रचालन करेगा। 4. िीएमडीएसएस प्रमाणपत्रों की श्रजे णया ँ और पात्रता – (1) िीएमडीएसएस प्रमाणपत्रों की जनम्नजलजखत दो श्रेजणयां होंगी जिन्‍दह ेंकेंद्रीय सरकार द्वारा जनयम 8 के अधीन प्रदान दकया िा सकता ह,ै अथावत:् (क) िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र; और (ख) िीएमडीएसएस प्रजतबंजधत प्रचालक प्रमाणपत्र (2) कोई भी व्यजि भारत का नागठरक होन े के नाते, िो नीचे जनधावठरत पात्रता मानदंडों को पूरा करता ह ै और जनयम 7 के अधीन जनर्दष्टव परीक्षा उत्तीणव करता है, यथाजस्ट् थजत िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र या, िीएमडीएसएस प्रजतबंजधत प्रचालक प्रमाणपत्र की मंिूरी के जलए पात्र होगा - क्रम स.ं िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र िीएमडीएसएस प्रजतबजं धत प्रचालक प्रमाणपत्र (1) (2) (3) 1. परीक्षा की तारीख को अिारह िषव से अजधक आयु। परीक्षा की तारीख को अिारह िषव से अजधक आयु।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 2. (क) अजखल भारतीय उच्च माध्यजमक (क) माध्यजमक जिद्यालय प्रमाण-पत्र परीक्षा (10 जिद्यालय प्रमाण-पत्र परीक्षा (12 िीं िीं कक्षा) या भारत म ें दकसी मान्‍दयता प्राि कक्षा) या भारत में दकसी मान्‍दयता प्राि बोडव या जििजिद्यालय द्वारा आयोजित बोडव या जििजिद्यालय द्वारा आयोजित समकक्ष परीक्षा उत्तीणव की ह ै या केंद्रीय सरकार गजणत और भौजतक जिज्ञान जिषयों के या रायय सरकार के समुद्री या म‍स्ट्य पालन साथ समकक्ष परीक्षा उत्तीणव की है; जिभागों के कानूनी जनकायों द्वारा िारी अथिा जिजधमान्‍दय प्रमाण-पत्र रखता ह;ै अथिा (ख) िाजणय य पोत पठरिहन अजधजनयम, (ख) िाजणय य पोत पठरिहन अजधजनयम, 1958 1958 (1958 का 44) के उपबंधों के (1958 का 44) के उपबंधों के अधीन नौिहन अंतगतव नौिहन महाजनदेिालय, भारत महाजनदेिालय, भारत सरकार द्वारा िारी या सरकार द्वारा िारी या मान्‍दयता प्राि मान्‍दयता प्राि योग्यता या इसके समकक्ष का योग्यता या इसके समकक्ष का जिजधमान्‍दय जिजधमान्‍दय प्रमाण-पत्र रखता ह;ै अथिा प्रमाण-पत्र रखता ह;ै अथिा (ग) डब्ल्यूपीसी विंग द्वारा िारी प्रिीणता या इसके (ग) डब्ल्यूपीसी विंग द्वारा िारी प्रिीणता या समकक्ष कोई जिजधमान्‍दय प्रमाण-पत्र रखता ह।ै इसके समकक्ष कोई जिजधमान्‍दय प्रमाण-पत्र रखता ह।ै 3. केंद्रीय सरकार द्वारा समय-समय पर अनुमोदन केंद्रीय सरकार द्वारा समय-समय पर अनुमोदन प्राि प्राि दकसी भी संस्ट्थान में िैजिक समुद्री संकट और दकसी भी संस्ट्थान म ें िैजिक समुद्री संकट और सुरक्षा सुरक्षा प्रणाली उपकरण पर व्यािहाठरक प्रजिक्षण प्रणाली उपकरण पर व्यािहाठरक प्रजिक्षण प्राि दकया प्राि दकया हो जिसकी अिजध लगातार दो सिाह हो जिसकी अिजध कम से कम एक सिाह (न्‍दयनू तम (न्‍दयूनतम जियानब ेघंटे) के जलए हो। चालीस घंटे) के जलए हो। परंतु केंद्रीय सरकार, ऐसे जनबंधन और ितों के अधीन िो समय-समय पर जनर्दवष्ट हो सकती ह,ै दकसी व्यजि को, िो भारत का नागठरक नहीं ह,ै जनयम 7 के अधीन आयोजित परीक्षा और गृह मंत्रालय और जिदेि मंत्रालय से इस संबंध म ें संबंजधत श्रेणी के अधीन िीएमडीएसएस प्रमाणपत्र प्रदान करने पर जिचार करने हते ु प्रिासजनक मंिूरी के जलए अनुमजत द े सकती ह।ै (5) िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र प्रदान करन े के जलए परीक्षा के जलए आिदे न – (1) जनयम 4 के उप- जनयम (2) के अधीन जनधावठरत पात्रता मानदंडों को परू ा करने िाला कोई भी व्यजि िीएमडीएसएस िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र प्राि करन े के जलए केंद्रीय सरकार को परीक्षा हते ु इस प्रयोिन के जलए पोटवल में जनर्दष्टव प्रपत्र में आिेदन कर सकता ह ैऔर एक हिार रुपय ेकी फीस का भुगतान कर सकता ह।ै (2) िीएमडीएसएस साधारण प्रचालक प्रमाणपत्र को प्रदान करने के जलए परीक्षा में जनम्नजलजखत दो भाग होंग:े (क) भाग-I में 60 अंकों के जलए जलजखत परीक्षा ह,ै जिसके जलए उत्तीणाांक 36 अंक होंगे; (ख) भाग-II में 100 अंकों के जलए व्यािहाठरक और मौजखक परीक्षा िाजमल है, जिसके जलए उत्तीणाांक 70 अंक होंगे। (3) परीक्षा के भाग-I को सफलतापूिवक उत्तीणव करन े के बाद भाग-II को करना केिल उन आिदे कों के जलए आज्ञापक अपेक्षा होगी जिन्‍दहोंने पहले िीएमडीएसएस साधारण प्रचालक प्रमाण पत्र नहीं दकया ह ै और िो ऐसे प्रमाण-पत्र की समाजि के पांच िषव से अजधक समय बाद िीएमडीएसएस साधारण प्रचालक प्रमाण पत्र के जलए आिेदन कर रह ेह ैं । (4) जनयम 9 के उप-जनयम (1), उप-जनयम (2) और उप-जनयम (3) के अधीन निीकरण के जलए आिेदन करने िाले व्यजि भाग- II परीक्षा के जलए सीधे आिेदन कर सकत े ह।ैं 6. िीएमडीएसएस प्रजतबजं धत प्रचालक प्रमाणपत्र के अनदु ान के जलए परीक्षा के जलए आिदे न – (1) जनयम 4 के उप-जनयम (2) के तहत जनधावठरत पात्रता मानदंडों को परू ा करन े िाला कोई भी व्यजि केंद्रीय सरकार को िीएमडीएसएस प्रजतबंजधत ऑपरेटर प्रमाणपत्र प्राि करन े के जलए परीक्षा हते ु इस प्रयोिन के जलए पोटवल में ददए जनर्दष्टव प्रपत्र में आिेदन कर सकता ह ै और एक हिार रुपय ेकी फीस का भुगतान कर सकता ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) िीएमडीएसएस प्रजतबंजधत प्रचालक प्रमाणपत्र प्रदान करन े के जलए परीक्षा दो भागों में होगी भाग-I जलजखत परीक्षा होगी और भाग-II म ें व्यािहाठरक और मौजखक परीक्षा होगी परीक्षा के प्र‍येक भाग के जलए 50 अंक होगा और एक सफल आिेदक को भाग-I और भाग-II दोनों म ेंसंयुि रूप स ेकुल 50 अंक प्राि करन े होंगे। 7. िीएमडीएसएस प्रमाण पत्र प्रदान करन े के जलए परीक्षा का आयोिन – (1) केंद्रीय सरकार क्रमिः िीएमडीएसएस साधारण प्रचालक प्रमाण पत्र और िीएमडीएसएस प्रजतबंजधत प्रचालक प्रमाणपत्र प्राि करन े के जलए परीक्षा के जलए पाठ्यक्रम, स्ट्थान, रीजत, तारीख और समय और ऐसी परीक्षा के पठरणामों की घोषणा की तारीख प्रकाजित करेगी। (2) ऐसी परीक्षा की भाषा अग्रं िे ी होगी। 8. िीएमडीएसएस प्रमाण पत्र प्रदान करना और िधै ता – (1) केंद्रीय सरकार जनयम 7 के अधीन िांच पूरी होने पर अनंजतम प्रमाण-पत्र िारी करेगी िो िह माह तक िैध होगा। जनबंधन और ित ें अतं रावष्ट्रीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के अंतगतव जिजनर्दवष्ट की िाएंगी। (2) अनंजतम प्रमाण-पत्र धारक को प्रोजििनल प्रमाण-पत्र िारी होने की तारीख से िह माह की अिजध के भीतर संबंजधत श्रेणी के िीएमडीएसएस प्रमाण-पत्र के जलए आिेदन करना होगा। (3) कोई भी अनंजतम प्रमाण-पत्र धारक िो िह माह की अिजध के बाद और अनंजतम प्रमाण-पत्र िारी करन े की तारीख स ेदो िषव तक िीएमडीएसएस प्रमाण-पत्र हते ु आिेदन करता ह,ै उसे उप-जनयम (5) के अंतगवत दये िुल्क के अजतठरक्त एक हिार रुपए के जिलंब िल्ु क का भुगतान करना होगा। (4) उप-जनयम (1) के अंतगतव अनंजतम प्रमाण-पत्र िारी करने की तारीख स े दो िष व की अिजध समाप् त होन े पर िीएमडीएसएस प्रमाण-पत्र प्रदान नहीं दकया िाएगा। (5) जनम्नजलजखत श्रेजणयों में से दकसी भी श्रेणी के अधीन िीएमडीएसएस प्रमाण-पत्र जनम्न जलजखत ताजलका में जिजनर्दवष्ट िुल्क के भुगतान के अधीन िारी दकया िाएगा: प्रमाण पत्र की श्रणे ी िल्ु क (i) िीएमडीएसएस साधारण प्रचालक बीस िषव की िैधता अिजध के जलए दस हिार रुपये; और प्रमाण-पत्र आिीिन िैधता के जलए पंद्रह हिार रुपये (ii) िीएमडीएसएस प्रजतबंजधत ओपरेटर आिीिन िैधता के जलए पांच हिार रुपय े प्रमाण-पत्र स्ट्प ष्ट ीकरण- इस उप-जनयम के प्रयोिन के जलए "आिीिन" िब् द से िीएमडीएसएस प्रमाण-पत्र धारक द्वारा अस्ट्सी िषव की आयु प्राि करन े से अजभप्रेत ह।ै (6) िीएमडीएसएस प्रमाण-पत्र की िैधता अिजध उप-जनयम के अंतगवत अनं जतम प्रमाण-पत्र िारी होने की घोषणा की तारीख से िुरू होगी और िीएमडीएसएस प्रमाण-पत्र की प्र‍येक श्रेणी अतं रावष्ट्रीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के अनुसार यथाजिजनर्दवष्ट जनबंधन और ितों के अधीन होगी। 9. िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र का निीकरण – (1) बीस िष व की प्रारंजभक अिजध के जलए िैध िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र का निीकरण ऐसे िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र की समाजि से एक िषव पूि व दकए गए आिेदन के आधार पर इस पोटवल में इस प्रयोिन के जलए केन्‍दद्रीय सरकार द्वारा जिजनर्दवष्ट प्रारूप म ें इसके जनयम 8 के उप-जनयम (5) के अधीन जनधावठरत दकए गए िल्ु क का भुगतान करने पर और जनम्न जलजखत जनधावठरत मानदंडों में से दकसी एक मानदंड को पूरा करने पर आगे बीस िषव की अिजध के जलए अथिा आिीिन के जलए निीकृत दकया िा सकता ह:ै (क) िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र की समाजि की तारीख से िीक पूिव पांच िषव की अिजध के भीतर कम से कम िह माह के कुल अनुभि का प्रमाण प्रस्ट्ततु करना; अथिा (ख) जनयम 5 के उप-जनयम (2) के खंड (ख) के अतं गतव यथाजिजनर्दवष्ट परीक्षा के भाग-II को सफलतापूिवक उ‍ तीण व करना।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (2) िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र की समाजि की तारीख से दो िष व की अिजध के भीतर निीकरण के जलए आिेदन उप-जनयम (1) के अतं गवत जिजनर्दवष्ट मानदडं ों की पूर्तव और एक हिार रुपय े के जिलंब िुल्क के भुगतान के अधीन होगा। (3) िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र की समाजि की तारीख से दो िषव के बाद निीकरण के जलए आिेदन पर जनयम 8 के उप-जनयम (5) के अंतगतव जनधावठरत दकए गए िल्ु क के भुगतान तथा एक हिार रुपये के जिलंब िुल्क का भुगतान भी करने के अजतठरक्त जनयम 5 के अतं गतव यथाजिजनर्दवष्ट परीक्षा के भाग-II को आिेदक द्वारा सफलतापूिवक उ‍ तीणव करन े पर ही जिचार दकया िाएगा। (4) िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र की समाजि की तारीख से पांच िषव की अिजध समाप् त होने के बाद दकसी भी िीएमडीएसएस साधारण प्रचालक प्रमाण-पत्र का निीकरण नहीं दकया िाएगा। 10. प्रजतकृजत िीएमडीएसएस प्रमाण-पत्र िारी करना - (1) िीएमडीएसएस प्रमाण-पत्र की प्रजतकृजत प्रजत के जलए केंद्रीय सरकार को इस प्रयोिन के जलए यथाजिजनर्दवष्ट प्रारूप म ेंएक हिार रुपय े के िुल् क के भुगतान के साथ आिेदन करना होगा। परंतु यदद िीएमडीएसएस प्रमाण-पत्र खो िाता ह ैतो आिेदन के साथ स्ट्थानीय पुजलस स्ट् टेिन म ें प्रमाण-पत्र खोन े के संबंध म ें दिव कराई गई ठरपोटव सलं ग्न करनी होगी। (2) केन्‍दद्रीय सरकार ऐस ेआिेदन के आधार पर प्रजतकृजत िीएमडीएसएस प्रमाण-पत्र िारी कर सकती ह।ै 11. िीएमडीएसएस प्रमाण-पत्र धारकों पर लाग ू साधारण दाजय‍ि- (1) केन्‍दद्रीय सरकार इन जनयमों के अतं गतव दकसी भी समय िीएमडीएसएस प्रमाण-पत्र धारक से िीएमडीएसएस प्रमाण-पत्र प्रस्ट्तुत करन े की मांग कर सकती ह ै और िीएमडीएसएस प्रमाण-पत्र धारक को ऐसी मांग का अनुपालन करना होगा। (2) िीएमडीएसएस प्रमाण-पत्र धारक ऐसे िीएमडीएसएस प्रमाण-पत्र प्रदान करन े की प्रदक्रया को जनयंजत्रत करन े िाली दकसी भी जनबंधन एिं ितव में दकए गए संिोधन, पठरितवन, प्रजतसंहरण अथिा जनलबंन से बाध्य होगा। जनयम 15 के अंतगवत अजधसूजचत होन े पर ऐसे पठरितवनों को आजधकाठरक िेबसाइट और इसके साथ-साथ पोटवल पर पर प्रकािन के माध्यम से उपलब्ध कराया िाएगा और िीएमडीएसएस प्रमाण-पत्र प्राप् त करन े के जलए आिेदक द्वारा आिेदन म ें ददए गए ईमेल एड्रसे पर ईमले भी भेिा िाएगा। (3) यदद कोई संदिे जिस े प्राि करन े का अजधकार िीएमडीएसएस प्रमाण-पत्र धारक को नहीं ह,ै उस े िह संदेि प्राि होता ह ै तो ऐसा िीएमडीएसएस प्रमाण-पत्र धारक इसके जिषयों, इसके स्रोत अथिा गंतव् य, इसके अजस्ट्त‍ि अथिा इसकी प्राजि के तथ्य दकसी भी व्यजि को ज्ञात नहीं करेगा अथिा ज्ञात करने की अनुमजत नहीं दगे ा, (केंद्रीय सरकार अथिा दकसी न्‍दयायालय द्वारा इस प्रयोिन के जलए सम् यक रूप स े प्राजधकृत अजधकारी के अलािा दकसी अन्‍द य व् यजक्त को) और ऐसे संदिे की जलजखत म ें प्रजतकृजत नहीं बनाएगा, उसकी प्रजतजलजप नहीं बनाएगा अथिा ऐस े संदेि का कोई उपयोग नहीं करेगा अथिा उस संदेि को जलजखत म ेंप्रजतकृजत बनान,े प्रजतजलजप बनान े अथिा उसका उपयोग दकए िान े की अनुमजत प्रदान नहीं करेगा। 12. अन्‍दय देिों द्वारा िारी दकए गए प्रमाण-पत्रों की मान्‍दयता - केन्‍दद्रीय सरकार िैज‍ िक समुद्री संकट और सुरक्षा प्रणाली संचाजलत करन े के प्रयोिन से समय-समय पर यथाजिजनर्दवष्ट जनबंधन एिं ितों के अधीन जनयम 8 के अतं गतव प्रदान दकए गए प्रमाण-पत्रों की तिव पर दकसी अन्‍दय दिे म ेंसक्षम प्राजधकारी द्वारा िारी दकए गए प्रमाण-पत्रों को मान्‍दयता द ेसकती ह।ै 13. िीएमडीएसएस प्रमाण-पत्र को जनलजं बत अथिा रद्द करना - केन्‍दद्रीय सरकार िीएमडीएसएस प्रमाण-पत्र को जनलंजबत अथिा रद्द कर सकती ह ैयदद उसके जिचार म ें िीएमडीएसएस प्रमाण-पत्र धारक ने: (क) ऐसे िीएमडीएसएस प्रमाण-पत्र के जलए लाग ू अंतरावष्ट्रीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के उपबंधों अथिा रेजडयो उपकरण के प्रचालन के संबंध में िारी दकए गए िीएमडीएसएस प्रमाण-पत्र की जनबंधन एि ं ितों का पालन करन े में जिफल रहा हो अथिा (ख) िानबूझकर केन्‍दद्रीय सरकार को गलत अथिा अस‍ य सूचना दी हो; परंत ु इस उप-जनयम के अतं गतव जनलंजबत अथिा रद्द करन े का कोई आदेि तब तक नहीं ददया िाएगा िब तक िीएमडीएसएस प्रमाण-पत्र धारक को ऐसे जनलंजबत अथिा रद्द करन े के आदेि के जिरुद्ध अभ्यािेदन देन े का उजचत अिसर नहीं ददया गया हो।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 14. फीस िापस नहीं की िाएगी - दकसी भी कारण से िीएमडीएसएस प्रमाण-पत्र को जनलंजबत अथिा रद्द करन े अथिा िीएमडीएसएस प्रमाण-पत्र के जनबंधन और ितों के दकसी भी संिोधन, पठरितवन, रद्द करने अथिा प्रजतसंहरण के पठरणामस्ट्िरूप कोई मआु ििा नहीं ददया िाएगा अथिा िुल्क िापस नहीं दकया िाएगा। 15. इन जनयमों का जडजिटल कायान्‍दव ियन - केंद्रीय सरकार इस अजधजनयम की धारा 53 के अनुक्रम में इन जनयमों के जडजिटल कायावन्‍दियन के जलए पोटवल अजधसूजचत कर सकती ह ै जिसमें आिेदन प्रस्ट्तुत करना, पाठ्यक्रम का प्रकािन, परीक्षा का स्ट्थान, रीजत, तारीख और समय, परीक्षा के पठरणामों की घोषणा, िीएमडीएसएस प्रमाण-पत्र प्रदान करना, जनबंधन और ितों म ें संिोधन, िीएमडीएसएस प्रमाण-पत्रों के संचालन के जलए यथा अपेजक्षत कोई अन्‍दय अनुमजत, अनदु ेि अथिा जनदिे िाजमल ह।ैं [फा. स.ं 24-03/2024-यूबीबी] देिेन्‍द द्र कुमार राय, संयुक् त सजचि MINISTRY OF COMMUNICATIONS (Department of Telecommunications) NOTIFICATION New Delhi, the 29th October, 2024 G.S.R. 674(E).—Whereas a draft of the Telecommunications (Commercial Radio Operator Certificate of Proficiency to Operate Global Maritime Distress and Safety System) Rules, 2024, which the Central Government proposes to make in exercise of the powers conferred under section 46, read with clause (zh) of sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), was published as required by sub-section (1) of section 56 of the said Act vide notification of the Government of India in the Ministry of Communications, Department of Telecommunications number G.S.R. 446 (E), dated the 24th July 2024 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), dated the 24th July 2024, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public; And whereas copies of the said Official Gazette were made available to the public on the 24th July, 2024; And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 46 read with clause (zh) of sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), and in supersession of the Indian Wireless Telegraphy (Commercial Radio Operators Certificate of proficiency and licence to operate Global Maritime Distress ad Safety System) Rules, 1997 except as respects things done or omitted to be done before such supersession and without overriding the terms and conditions of existing arrangements under those rules till the date of expiry of such arrangements, the Central Government hereby makes the following rules, namely:– 1. Short title and commencement. – (1) These rules may be called the Telecommunications (Commercial Radio Operator Certificate of Proficiency to Operate Global Maritime Distress and Safety System) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. – (1) In these rules, unless the context otherwise requires,- (a) “Act” means the Telecommunications Act, 2023 (44 of 2023); (b) “Global Maritime Distress and Safety System” means an internationally agreed set of safety procedures, frequencies, types of equipment, and communication protocols for maritime safety, which operates using terrestrial and satellite radio technologies, both onboard ships and onshore; (c) “Global Maritime Distress and Safety System (GMDSS) Certificate” means the, GMDSS General Operator Certificate or the GMDSS Restricted Operator Certificate, as specified under sub-rule (1) of rule 4, and a “GMDSS Certificate holder” means the person who has been granted such certificate under rule 8; (d) “International Telecommunication Convention” means the Convention of the International Telecommunication Union signed at Geneva in 1992 or any subsequent revision or modification thereof, which the Government of India has ratified or accepted;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (e) “portal” means the portal to be notified by the Central Government under rule 15 of these rules; (f) “Radio Regulations” means the regulations adopted by the World Radiocommunication Conference (Geneva 1995) and includes every revision or modification thereof which the Government of India has ratified or accepted; and (g) “WPC Wing” means the Wireless Planning and Co-ordination Wing of the Department of Telecommunications, Ministry of Communications, Government of India. (2) Words and expressions used and not defined herein but defined in the Act shall have the meanings respectively assigned to them in the Act. 3. Scope. – No person shall operate Global Maritime Distress and Safety System except under and in accordance with the terms and conditions of a GMDSS Certificate granted under these rules. 4. Categories of GMDSS certificates and eligibility. – (1) There shall be the following two categories of GMDSS certificates, which may be granted by the Central Government under rule 8, namely: (a) GMDSS General Operator Certificate; and (b) GMDSS Restricted Operator Certificate (2) Any person, being a citizen of India, who satisfies the eligibility criteria as set forth below and qualifies the examination specified under rule 7, shall be eligible for grant of a GMDSS General Operator Certificate or, as the case may be, GMDSS Restricted Operator Certificate,- S. Application for examination for grant of GMDSS General Operator Certificate. – (1) Any person satisfying the eligibility criteria set forth under sub-rule (2) of rule 4 may make an application for the examination for obtaining the GMDSS General Operator Certificate to the Central Government, in the form as may be specified for this purpose in the portal along with fees of one thousand rupees. (2) Examination for grant of GMDSS General Operator Certificate shall consist of the following two parts, namely, -8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) Part-I - comprising a written examination for 60 marks, for which the passing marks shall be 36 marks; and (b) Part-II - comprising a practical and oral examination, for 100 marks, for which the passing marks shall be 70 marks. (3) The successful completion of Part-I of the examination shall be a mandatory requisite for undertaking Part-II only for applicants who have previously not held GMDSS General Operator Certificate, and those applying for a GMDSS General Operator Certificate more than a period of five years after the expiry of such certificate. (4) The persons applying for renewal under sub-rule (1), sub-rule (2) and sub-rule (3) of rule 9 may apply directly for the Part-II examination. 6. Application for examination for grant of GMDSS Restricted Operator Certificate. – (1) Any person satisfying the eligibility criteria set forth under sub-rule (2) of rule 4 may make an application for the examination for obtaining GMDSS Restricted Operator Certificate to the Central Government, in the form as may be specified for this purpose in the portal along with fees of one thousand rupees. (2) Examination for grant of GMDSS Restricted Operator Certificate shall consist of Part-I comprising a written examination and Part-II comprising practical and oral examination, each part having 50 marks, and a successful applicant shall be required to obtain a total combined score of 50 marks in Part I and Part II together. 7. Conduct of examination for grant of GMDSS Certificate. – (1) The Central Government shall publish the syllabus, place, manner, date and time for the examination for obtaining the GMDSS General Operator Certificate and GMDSS Restricted Operator Certificate respectively, and the date of announcement of the results of such examination. (2) The language of such examination shall be English. 8. Grant and validity of GMDSS Certificate. – (1) The Central Government shall, upon successful completion of the examination under rule 7, issue a provisional certificate with a validity of six months, the terms and conditions of which shall be as specified therein, in accordance with the International Telecommunication Convention and the Radio Regulations. (2) A provisional certificate holder shall apply for GMDSS Certificate of the relevant category, within a period of six months from the date of issue of the provisional certificate. (3) Any provisional certificate holder who applies for the GMDSS Certificate beyond a period of six months and up to two years from date of issue of provisional certificate, shall be required to make a payment of late fees of one thousand rupees in addition to the fees payable under sub-rule (5). (4) The GMDSS Certificate shall not be granted upon lapse of two years from the date of issue of provisional certificate under sub-rule (1). (5) GMDSS Certificate under any of the following categories shall be issued subject to payment of fees as specified below,- Category of Certificate Fee (i) GMDSS General Operator Certificate Ten thousand rupees for validity period of twenty years; and Fifteen thousand rupees for lifetime validity. (ii) GMDSS Restricted Operator Certificate Five thousand rupees for lifetime validity. Explanation.- For the purposes of this sub-rule, the expression “lifetime” means till the GMDSS Certificate holder attains the age of eighty years. (6) The validity period of the GMDSS Certificate shall commence from the date of issue of provisional certificate under sub-rule (1), and each category of GMDSS Certificate shall be subject to terms and conditions as specified therein, in accordance with the International Telecommunication Convention and the Radio Regulations. 9. Renewal of GMDSS General Operator Certificate. – (1) A GMDSS General Operator Certificate which is valid for an initial period of twenty years, may be renewed for another twenty years or for lifetime, based on an application made within a period of one year prior to the expiry of such GMDSS General Operator Certificate, in the form as may be specified by the Central Government for this purpose in the portal along with payment of fees as provided under sub-rule (5) of rule 8 thereof, and fulfilment of either of the following criteria namely,- (a) submission of proof of total experience of not less than six months, within a period of five years immediately preceding the date of expiry of the GMDSS General Operator Certificate; or (b) successful completion of Part-II of the examination as specified under clause (b) of sub-rule (2) of rule 5.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (2) An application for renewal made within a period of two years after the date of expiry of the GMDSS General Operator Certificate, shall be granted subject to the fulfilment of the criteria specified under sub-rule (1) along with payment of late fee of one thousand rupees. (3) An application for renewal after a period of two years from the date of expiry of the GMDSS General Operator Certificate, shall be considered only upon successful completion by the applicant of Part-II of the examination as specified under rule 5, in addition to payment of fee as provided under sub-rule (5) of rule 8, as well as payment of late fee of one thousand rupees. (4) No GMDSS General Operator Certificate shall be renewed after a lapse of five years from the date of expiry of the GMDSS General Operator Certificate. 10. Issue of duplicate GMDSS Certificate. – (1) An application for duplicate GMDSS Certificate may be made to the Central Government in the form as specified for this purpose in the portal, along with payment of fee of one thousand rupees: Provided that in case the GMDSS Certificate is lost, such application shall be accompanied with the report filed with the local police regarding such loss. (2) The Central Government may issue a duplicate GMDSS Certificate based on such application. 11. General obligations applicable to GMDSS Certificate holders. – (1) The Central Government may at any time require the GMDSS Certificate holder to produce the GMDSS Certificate and the GMDSS Certificate holder shall comply with such requirement. (2) The GMDSS Certificate holder shall be bound by modification, variation, cancellation or revocation of any of the terms and conditions governing the grant of such GMDSS Certificate and such changes shall be made available through publication on the official website, as well as on the portal as and when notified under rule 15, and an email shall also be sent to the email address provided by the applicant in his application for grant of GMDSS Certificate. (3) If any message which a GMDSS Certificate holder is not entitled to receive, is received, such GMDSS Certificate holder shall not make known or allow to be made known, its contents, its origin or destination, its existence or the fact of its receipt, to any person, other than to an officer duly authorised for this purpose by the Central Government or a court of law, and shall not reproduce in writing, copy or make any use of such message or allow the same to be reproduced in writing, copied or made use of. 12. Recognition of certificates issued by other countries. – The Central Government may, subject to the terms and conditions as it may specify from time to time, recognise the certificates similar to those granted under rule 8, issued by a competent authority in any other country, for the purpose of operating a Global Maritime Distress and Safety System. 13. Suspension or cancellation of GMDSS Certificate. – The Central Government may suspend or cancel the GMDSS Certificate, if in its opinion, the GMDSS Certificate holder has,- (a) failed to comply with the provisions of the International Telecommunication Convention or the Radio Regulations, as applicable for such GMDSS Certificate, or the terms and conditions subject to which the GMDSS Certificate was issued in respect of operation of radio equipment; or (b) wilfully furnished incorrect or false information to the Central Government: Provided that no order of suspension or cancellation under this sub-rule shall be made unless the GMDSS Certificate holder has been given a reasonable opportunity of making a representation and being heard against such suspension or cancellation. 14. No refund of fees. – No compensation or refund of fees shall be applicable as a result of any suspension or cancellation of the GMDSS Certificate, for any reason whatsoever, or for any modification, variation, cancellation or revocation of the terms and conditions of the GMDSS Certificate. 15. Digital Implementation of these rules. – The Central Government shall, in furtherance of section 53 of the Act, notify a portal for the digital implementation of these rules, including for submission of applications, publication of syllabus, place, manner, date and time of examination, declaration of results of examinations, grant of GMDSS Certificate, modification of terms and conditions, any other permission, instruction or direction, as may be required for the operation of the GMDSS Certificates.
