(1) इन जनयमों को अतं िेिीय िलयान (िीवन रक्षक उपकरण) (प्रथम संिोधन) जनयम, 2024 कहा िा सकेगा। (2) य े आजधकाररक रािपत्र म ेंउनके अंजतम प्रकािन की जतजथ स े लाग ू होंगे। अंतिेिीय िलयान (िीवन रक्षक उपकरण) जनयम, 2022 (यहा ं बाि म ें उि जनयम के रूप म ेंसंिर्भगत) म ेंजनयम 2 म ें (i) खंड (क) के पश्चात जनम्नजलजखत खडं अंत:स्ट्थ ाजपत दकया िाएगा, अथागत:् - ‘‘(कख) वगीकरण सोसायटी’’ का तात् पयग इस अजधजनयम की धारा 3 के खंड (िडे ओ) के अथ ग के अतं गतग एक मान् यता प्राप् त सगं िन ह,ै िो वगीकरण सोसायरटयों के अंतरागष्‍टर ीय संघ का एक सिस्ट् य ह;ै’’ (ii) खडं (ग) के बाि जनम्नजलजखत स्ट् पष्‍टट ीकरण अंत:स्ट् थाजपत दकया िाएगा, नामत:- “स्ट्पष्टीकरण. - इस उप-जनयम के प्रयोिन के जलए, 24 मीटर स े अजधक के िलयानों के सकल टन भार की गणना पोतों के टनभार माप पर अंतरागष्ट्रीय कन्वेंिन, 1969 के अनुसार की िाएगी, िबदक 24 मीटर स े कम के िलयानों के सकल टनभार की गणना वाजणज्य नौवहन (पोतों के टन भार माप) जनयम, 1991 के जनयम 2 के अनुसार की िाएगी।” 3. उि जनयमों के जनयम 7 म,ें - (i) उप-जनयम (2) के स्ट्थान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- “इन जनयमों के प्रावधानों के अनुसार प्रित्त प्रत्येक िीवन रक्षक उपकरण को वगीकरण सोसायटी द्वारा अनुमोदित दकया िाएगा या इसका स व् रूप वाजणजज्यक समुद्री जवभाग द्वारा अनुमोदित दकया िाएगा।” (ii) उप-जनयम (2) को उप-जनयम (3) स े पूवग उप-जनयम (3) के रूप म ें पनु ःसंख्यांदकत दकया िाएगा, तथा इस प्रकार पुनःसंख्यांदकत दकए िाने पर, जनम्नजलजखत उप-जनयम अतं ःस्ट्थाजपत दकया िाएगा, अथागत,् - “(2) अनुमोिन या इसके स्ट् वरूप का अनुमोिन, िैसा भी मामला हो, उप-जनयम (1) के तहत प्रिान दकया िाएगा, िो दक जनम्नजलजखत म ें जवजनर्िष्टग मानकों के अनपु ालन के अधीन होगा: (क) समुद्र म ें िीवन की सुरक्षा के जलए कन्विें न, 1974म ें प्रित्त अंतरागष्ट्रीय िीवन रक्षक उपकरण संजहता; या (ख) अंतरागष्ट्रीय मानकीकरण सगं िन।” [फा. स.ं आईडब् ल् यटू ी-11011/91/2021-आईडब् ल् यटू ी(7)] डॉ. कमला कान्ता नाथ, सलाहकार (सांजख्यकी) MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi the 29th October, 2024 G.S.R. 673(E).—In exercise of the powers conferred by sub-section (1) of section 51 and clause (e) of sub-section (1) of section 98 read with clause (zl) and (zza) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government proposes to amend the Inland Vessels (Life Saving Appliances) Rules, 2022 notified by the Government of India in the Ministry of Ports, Shipping and Waterways vide number G.S.R. 425(E) dated the 7th June, 2022 and hereby publish as required by sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021) for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 251, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at ajay.sirohi@nic.in and uttam.mishra27@gov.in within the period specified above;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 Draft Amendment 1. (1) These rules may be called the Inland Vessels (Life Saving Appliances) (First Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Inland Vessels (Life Saving Appliances) Rules, 2022 (hereinafter referred to as the said rules), in Rule 2 i. after clause (a), the following clause shall be inserted namely.- “(ab) classification society” means a recognised organisation within the meaning of clause (zo) of section 3 of the Act which is a member of International Association of Classification Societies;” ii. after the clause (c), the following explanation shall be inserted, namely.- “Explanation. - For the purpose of this sub-rule, Gross Tonnage of vessels above 24 meters shall be calculated according to International Convention on Tonnage Measurement of Ships, 1969 whereas Gross Tonnage of vessels less than 24 meters shall be calculated according to Rule 2 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991.” 3. In rule 7 of the said rules,- i. For sub-rule (1), the following shall be substituted, namely. – “Every life-saving appliance provided as per provisions of these rules shall be approved by the Classification Society or be type approved by the Mercantile Marine Department.” ii. sub-rule (2) shall be renumbered as sub-rule (3) before sub-rule (3) and so renumbered, the following sub-rule shall be inserted, namely, - “(2) The approval or type-approval, as the case may be, shall be granted under sub-rule (1), subject to compliance with the standards specified in: (a) the International Life Saving Appliance Code provided in the Convention for the Safety of Life at Sea, 1974; or (b)International Organization for Standardisation.” [F.
