का.आ. 369(अ).— भारत सरकार, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् न े पर्ाावरण (संरक्षण) जनर्म,
1986 के जनर्म(5) के उप-जनर्म (3) के साथ परित पर्ाावरण(संरक्षण) अजधजनर्म,1986 (1986 का 29) की धारा 3 की
उप-धारा(1) और उप-धारा (2) के खडं (v) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए अजधसूचना िारी की जिस े भारत के
रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) म ें का.आ.5481(अ), में तारीख 31 दिसबं र, 2021 को प्रकाजित दकर्ा
गर्ा था (जिसे इसम ेंइसके पश्चात राख के उपर्ोग से सबंजधत अजधसूचना, 2021 के रूप में सिं र्भात दकर्ा िाएगा);
और राख के उपर्ोग से संबजधधत अजधसूचना के उपबंधों के कार्ााधवर्न के संबंध में जवजभन्न जितधारकों से अनुरोध
प्राप्त हुए ि;ैं
अतः अब, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) तथा उप-धारा (2)
के खंड (v) के साथ परित पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म (5) द्वारा प्रित् त िजिर्ों का प्रर्ोग करते हुए, केन्द्रीय
सरकार एतद ्द्वारा राख के उपयोग स े संबंधधत अधधसूचना, 2021 में जनम्नजलजखत संिोधनों का मसौिा प्रकाजित करती िै,
जिसे केन्द्रीय सरकार आम िनता की िानकारी के जलए प्रस्ट् ततु करती ि,ै जिनके इससे प्रभाजवत िोने की संभावना िै, और

एतत्द्वारा र्ि नोरिस दिर्ा िाता ि ै दक आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन की तारीख से साि दिनों की
अवजध समाप्त िोने के बाि केन्द्रीय सरकार द्वारा उि सिं ोधनों के प्रारूप पर जवचार दकर्ा िाएगा।
तर् समर् स े पिले इन मसौिा संिोधनों के बारे म ें दकसी भी व्यजि से प्राप्त िोन े वाली रिप्पणी र्ा सुझाव पर केंद्र
सरकार द्वारा जवचार दकर्ा िाएगा।
कोई भी व्यजि िो उि मसौिा संिोधनों के संबंध म ें कोई आपजत्त र्ा सुझाव िने ा चािता िै, इस अजधसूचना के
रािपत्र में प्रकािन की जतजथ से 60 दिनों की अवजध के भीतर उसे सजचव,पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर्,

राख के उपयोग स ेसबं धं धत अजधसचू ना, 2021 म ेंसिं ोधन का मसौिा
राख के उपयोग स े संबंधधत अजधसूचना, 2021 म,ें-
(1) पैरा ‘क’ म,ें-
(i) उप पैरा (3) म,ें -
(क) “केन्द्रीय प्रदषू ण धनयंत्रण बोड ड (सीपीसीबी)” शब्द और अक्षर के स्थान पर “केन्द्रीय धिद्युत
प्राधधकरण” शब्द रखा जाएगा;
(ख) “सड़क पररविन और रािमाग ा मंत्रालर्” िब्ि और अक्षर के पश्चात, “केधद्रीर् प्रिषू ण जनर्ंत्रण
बोडा” िब्ि और अक्षर अंतःस्थाधपत ककए जाएगं े ।
(ii) उप-पैरा (4) में,
(क) तीसरे परंतुक म,ें -
(i) “बिते दक” िब्िों के पश्चात “तक” िब्ि िाजमल दकए िाएंग,े
(ii) “अगले चक्र म ें भी ल े जाया जाएगा” शब्दों के पश्चात “(अथाडत् अनुपालन चक्र के दौरान उपयोग
स े छूट दी जा सकती ह)ै ” शब्द, अक्षर, अंक और कोष्ठक अंतःस्थाधपत ककए जाएंगे।
(ख) चौथ ेपरंतुक म,ें -
(i) “सारणी म ें धिधनर्दडष्ट 60 प्रधतशत स े कम ताप धिद्युत संयंत्रों के धलए धिधनर्दडष् ट अनुपालन चक्र
के समान” शब्दों, संख्याओं और अंकों के स्थान पर “पााँच िषों का” शब्द रखा जाएगा।
(ग) टटप्पण म,ें-
(i) “ 01 अप्रैल, 2022” िब्ि, संख्र्ा, अक्षर और अंक के पश्चात , “ अथवा ताप जवद्युत संर्ंत्रों के
चालू िोने का जवत्तीर् वषा, िैसा लाग ूिो” िब्ि और अंक अंतःस्थाधपत ककए जाएगं े।
(iii) उप पैरा (5) म,ें -
(क) पिले परंतुक में , “ ताप जवद्युत संर्ंत्र की संस्ट्थाजपक क्षमता के अनुसार” िब्िों के स्ट्थान पर,
“तत्कालीन वष ा के िौरान ताप जवद्युत संर्ंत्र द्वारा” िब्ि प्रजतस्ट्थाजपत दकए िाएंगे।
(ख) िसू रे परंतुक के स्ट्थान पर ,-
(i) “इस संबंध म ें प्रमाजणत करेगा” िब्िों के स्ट्थान पर “ 31 माचा, 2025 तक इस संबंध म ें
प्रमाजणत कर दिर्ा ि”ै िब्ि, अक्षर, संख्र्ा तथा आंकड़ ेप्रजतस्ट्थाजपत दकए िाएंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3
(ii) िब्ि, अक्षर, संख्र्ा, आंकड़े और कोष्ठक “ राज्र् प्रिषू ण जनर्त्रं ण बोडा(एसपीसीबी) र्ा
प्रिषू ण जनर्ंत्रण सजमजत (पीसीसी) द्वारा प्रमाणीकरण सजित राख तालाब र्ा डाइक का
जस्ट्थरीकरण और भूजम-उद्धार का कार्ा 01 अप्रैल, 2022 स े तीन वष ा के भीतर दकर्ा
िाएगा।” का लोप दकर्ा िाएगा।
(iv) उप परै ा (6) म ें ,-
(क) आरंजभक परै ा में ,-
(i) “केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा (सीपीसीबी) द्वारा केंद्रीर् जवद्युत प्राजधकरण (सीईए) के
परामिा से बनाए गए और र् े दििाजनिेि” िब्िों, अक्षरों और कोष्ठकों के स्ट्थान पर, “िनू ,
2023 में िारी दकए गए, और इसके संिोधन, केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा (सीपीसीबी)
के परामि ासे केंद्रीर् जवद्युत प्राजधकरण (सीईए) द्वारा तैर्ार दकए गए और िो” िब्ि, अक्षर,
आंकड़ ेऔर कोष्ठक प्रजतस्ट्थाजपत दकए िाएंगे,
(ii) “और इस अजधसूचना के प्रकािन की जतजथ से तीन मिीन े के भीतर लाग ू दकर्ा िाएगा”
िब्िों का लोप दकर्ा िाएगा ।
(ख) पिले परंतुक म ें,-
(i) “बित े दक िो दक्रर्ािील राख तालाब अथवा डाइक तक” िब्िों के पश्चात , “अनुमजत ि”ै
िब्ि अंतर्वाष्ट दकए िाएंग,े
(ii) “अजधकतम चार पररचालन राख तालाब अथवा डाइक” िब्िों के पश्चात , “अनुमजत ि”ै
िब्ि अंतर्वाष्ट दकए िाएगं े,
(iii) िब्ि "िो सकता ि"ै ििा दिए िाएंगे,
(iv) “सूजचत करेगा” िब्िों के स्ट्थान पर “सूजचत दकर्ा गर्ा” िब्ि प्रजतस्ट्थाजपत दकर्ा िाएगा,
(v) “केधद्रीर् प्रिषू ण जनर्ंत्रण बोड ा(सीपीसीबी)” िब्िों, अक्षरों और कोष्ठकों के पश्चात, “केधद्रीर्
जवद्युत प्राजधकरण (सीईए)” िब्ि, अक्षर, अंक और कोष्ठक िाजमल दकए िाएगं े।
(ग) िसू रे परंतुक म ें,-
(i) “केधद्रीर् प्रिषू ण जनर्ंत्रण बोड ा(सीपीसीबी)” िब्िों, अक्षरों और कोष्ठकों के पश्चात , “केधद्रीर्
जवद्युत प्राजधकरण (सीईए)” िब्ि, अक्षर, अंक और कोष्ठक िाजमल दकए िाएगं े।
(ii) िब्ि, अक्षर, संख्र्ा तथा आंकड़ े“अथवा 31 माचा, 2023 तक , िो भी बाि म ेंिो” ििा दिए
िाएंगे।
(v) उप पैरा (8) में , 'सूखी फ्लाई ऐि के भण्डारण िते ु' िब्िों के पश्चात, 'साइलोस' िब्ि ििा दिए िाएंगे।
(vi) उप परै ा (9) म ें , “केधद्रीर् प्रिषू ण जनर्ंत्रण बोड ा के वेब पोिाल” िब्िों और आंकड़ों के स्ट्थान पर
“कोर्ला राख प्रबंधन पोिाल (सीएएमपी)” िब्ि, आंकड़े और अक्षर प्रजतस्ट्थाजपत दकए िाएंगे।
(2) पैरा ख म ें ,-

(क) आरंजभक पैरा के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकर्ा िाएगा, अथाात्,-
“(3) कोर्ला र्ा जलग्नाइि ताप जवद्युत संर्ंत्रों से (सड़क मागा स)े 300 दकलोमीिर के िार्रे म ें जस्ट्थत
सभी खानों(सरकारी, सावािजनक तथा जनिी क्षेत्र) के जलए र्ि अजनवार्ा िोगा दक वे मिाजनिेिक,
खान सुरक्षा (डीिीएमएस) के दििा-जनिेिों के अनुसार जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व (ईपीआर)
के अंतगात बैकदिललंग अथवा स्ट्िोलवंग (चल रिी अथवा पररत्र्ि, िैसी भी जस्ट्थजत िो) को भरें।”
(ख) परंतुक म ें , िब्ि “और खानों के खाली स्ट्थानों और डरे ों में अजधकभार के साथ राख़ को जमजित
करना,सृजित अजधभार के जलए इस अजधसूचना के प्रकािन की जतजथ स े लाग ू िोगा” का लोप दकर्ा
िाएगा।
(ग) 'स्ट्पष्टीकरण' म ें,-
(i) िब्ि और संख्र्ा “और अजधभार वाले ढरे के साथ जमजित करने के जलए खाली स्ट्थान को
भरने के जलए राख़ के 25 प्रजतित जिस्ट्से के उपर्ोग” का लोप दकर्ा िाएगा।
(ii) “को भरन े के जलए” िब्िों के पश्चात “राख” िब्ि को िाजमल दकर्ा िाएगा।
(ii) उप -परै ा (4)(i)म,ें-
(क) िब्ि “और अजधभार वाले ढरे के साथ राख़ को जमजित करन े के जलए” का लोप दकर्ा िाएगा,
(ख) “28 अगस्ट्त, 2019” िब्ि, अक्षर, संख्र्ा और आंकड़ा के पश्चात, िब्ि “और उसमें दकए िाने वाल े
संिोधन” अंतर्वाष्ट दकए िाएंगे।
(iii) उप पैरा 4(ii) म,ें -
(क) “मंत्रालर्” िब्ि स्ट्थान पर “पर्ावा रण, वन और िलवार्ु पररवतना मंत्रालर्” िब्ि प्रजतस्ट्थाजपत दकए
िाएंगे;
(ख) िब्ि “और अजधभार वाले ढरे के साथ जमिण करना ” का लोप दकर्ा िाएगा।
(iv) उप पैरा (5) (i) म,ें -
(क) “केधद्रीर् प्रिषू ण जनर्ंत्रण बोड ा(सीपीसीबी)” िब्िों , अक्षरों और कोष्ठकों के स्ट्थान पर “केधद्रीर् जवद्युत
प्राजधकरण (सीईए)” िब्ि, अक्षर और कोष्ठक प्रजतस्ट्थाजपत दकए िाएंगे ।
(ख) “कोर्ला मंत्रालर्” िब्िों और आंकड़े के पश्चात, “सड़क पररविन और रािमाग ामंत्रालर्, पत्तन,पोत
पररविन एवं िलमागा मंत्रालर्, सूक्ष्म, लघु और मध्र्म उद्यम मत्रं ालर्, उद्योग और आंतररक व्यापार
संवधान जवभाग (डीपीआईआईिी), केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा (सीपीसीबी)” िब्ि, अक्षर, आकं ड़े
और कोष्ठक अंतर्वाष्ट दकए िाएगं े।
(ग) “अथवा अजधभार वाले ढरे के साथ जमिण करना” िब्िों का लोप दकर्ा िाएगा,
(घ) “एक सजमजत िोगी जिसकी अध्र्क्षता.... करेगी.” वाक्र् के पश्चात , “सजमजत की बैिक छि माि म ें
कम से कम एक बार िोगी.” वाक्र् प्रजतस्ट्थाजपत दकर्ा िाएगा।
(v) उप परै ा 5 (ii) के पश्चात जनम्नजलजखत उप-परै ा िाजमल दकर्ा िाएगा, अथाात,् -
“(iii) राख उपर्ोगकतााओं के अनुरोध पर, उप-पैरा (5) (i) के अंतगता गरित सजमजत ताप जवद्युत संर्ंत्रों म ें
राख की उपलब्धता की समीक्षा करेगी, उपर्ोगकतााओं की व्यविार्ाता और भौगोजलक जनकिता का आकलन[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
करेगी तथा प्रासंजगक पर्ाावरणीर् मापिंडों पर जवचार करेगी, तादक जनधााररत पर्ाावरण अनकु ूल उद्दश्े र्ों
के जलए राख के आवंिन के संबंध में ताप जवद्युत संर्ंत्रों को जसिाररिें िी िा सकें।”
(vi) उप-पैरा (7) में,-
(क) “केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा (सीपीसीबी)”, िब्िों, अक्षरों और कोष्ठकों के बाि “केंद्रीर् जवद्युत
प्राजधकरण (सीईए) के परामि ासे” इन िब्िों, अक्षरों और कोष्ठकों को िाजमल दकर्ा िाएगा ।
(ख) िब्ि "एक वष ा के भीतर" ििा दिर्ा िाएगा,
(ग) "अनुिान के जलए ऑनलाइन आवेिन प्रदक्रर्ा" िब्िों के बाि, "का" िब्ि िाजमल दकर्ा िाएगा।
(vii) उप-पैराग्राि (9) म,ें "भारतीर् मानक ब्र्ूरो, भारतीर् सड़क काग्रं ेस और केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा" िब्िों
के जलए िब्िों और अंकों के स्ट्थान पर "भारतीर् मानक ब्र्रू ो और भारतीर् सड़क काग्रं ेस" िब्िों और अंकों
को िाजमल दकर्ा िाएगा।
(viii) "उप-परै ाग्राि 10 म,ें ""अधर् प्रासंजगक जवजनर्मन के जलए" िब्िों के बाि, "संवधान और अजधकतम" िब्ि
िाजमल दकर्ा िाएगा।"
(3) अनुच्छेि ग में,-
(i) उप-पैराग्राि (1) के जलए, जनम्नजलजखत को प्रजतस्ट्थाजपत दकर्ा िाएगा, र्था,-
(i) तीन वष ा के चक्र के प्रथम िो वषों में, र्दि कोर्ला र्ा जलग्नाइि आधाररत तापीर् ऊिाा संर्ंत्र
(कैजप्िव और/ र्ा सि-उत्पािक स्ट्िेिनों र्ा िोनों सजित) ने कम-से-कम 80 प्रजतित राख (फ्लाई-राख
और बॉिम-राख) उपर्ोग निीं की ि ैतो ऐसे गैर-अनपु ालन ताप जवद्युत संर्ंत्रों पर प्रस्ट्ततु की गई वार्षाक
ररपोिों के बाि वार्षाक अनुपालन लेखापरीक्षा पर दकए गए पनु आाकलन के आधार पर जवत्तीर् वषा के अतं
में अप्रर्ुि राख पर 1000 रुपए प्रजत िन की िर से पर्ाावरणीर् प्रजतकर लगार्ा िाएगा और र्दि र्ि
अनुपालन चक्र के अतं तक अनपु ालन चक्र (ऐसी अप्रर्ुि राख मात्रा को छोड़कर अथाात जवत्तीर् वषा के
अंजतम वषा के िौरान उत्पन्न राख के 20% तक, जिसे पैरा ए (4) के अनुसार उत्पन्न औसत 100 प्रजतित
राख का उपर्ोग करन े में असमथा ि ै अजतररि उपर्ोग के जलए अगल े अनुपालन चक्र म ें ले िान े की
अनुमजत ि,ै र्ि अप्रर्िु मात्रा पर, जिस पर पूवा में पर्ाावरणीर् प्रजतपूर्ता निीं लगाई गई ि,ै पर प्रजत िन
1000 रुपर् ेकी पर्ाावरणीर् प्रजतपूर्ता िने े के जलए उत्तरिार्ी िोगा:
बिते दक पर्ाावरणीर् प्रजतकर का अनुमान परै ा क के उप-परै ा (4) म ेंउजल्लजखत जवजभन्न उपर्ोगी िेजणर्ों
के अनुसार प्रथम अनुपालन चक्र के अंजतम वषा के अतं म ेंलगार्ा िाएगा और अजधरोजपत दकर्ा िाएगा।
इसके बाि, प्रस्ट्ततु वार्षाक ररपोिों के बाि प्रस्ट्तुत वार्षाक अनपु ालन लेखापरीक्षा ररपोिा के आधार पर
दकए गए पुनआाकलन के आधार पर जवत्तीर् वषा के अंत में पर्ाावरणीर् प्रजतकर का अनुमान लगार्ा
िाएगा जिसके बाि प्रस्ट्तुत वार्षाक अनुपालन लेखापरीक्षा ररपोिा के आधार पर पुनमल्ूा र्ांकन दकर्ा
िाएगा।
(ii) उप-पैराग्राि (2) के जलए, जनम्नजलजखत को प्रजतस्ट्थाजपत दकर्ा िाएगा, र्था,-
“(2) ताप जवद्युत संर्ंत्र और अधर् चूककतााओं स े एकत्र दकर्ा गर्ा पर्ाावरण प्रजतकर संबंजधत राज्र् प्रिषू ण जनर्ंत्रण
बोडा (एसपीसीबी) र्ा प्रिषू ण जनर्ंत्रण सजमजत (पीसीसी) के जनर्िाष्ट खाते में िमा दकर्ा िाएगा, िो 75% राजि अपन े
पास रखेगा और कुल राजि का 25% केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा को िस्ट्तांतररत करेगा।”
(iii) उप-पैराग्राि (4) का ििार्ा िाएगा;
(iv) उप-पैराग्राि (5) म,ें िब्ि और अंको "1500 र्ा" को "1000" अंको के साथ प्रजतस्ट्थाजपत दकर्ा िाएगा;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(v) उप-पैराग्राि (6) म,ें "1500" अंको को "1000" अंको के साथ प्रजतस्ट्थाजपत दकर्ा िाएगा;
(vi) उप-पैराग्राि (7) (i) के जलए, "केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा" िब्ि ििार्ा िाएगा;
(4) पैराग्राि ङ में,-
(i) उप-पैराग्राि (1) के जलए, जनम्नजलजखत प्रजतस्ट्थाजपत दकर्ा िाएगा, र्था,-
“(1) (i) केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा (सीपीसीबी) और संबंजधत राज्र् प्रिषू ण जनर्ंत्रण बोडा (एसपीसीबी) र्ा
प्रिषू ण जनर्ंत्रण सजमजत (पीसीसी), उपबंधों के अनुपालना सुजनजश्चत करन े के जलए प्रवतना और जनगरानी
प्राजधकरण िोंगे और जतमािी आधार पर राख के उपर्ोग की जनगरानी करेंग े। केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा
(सीपीसीबी) केंद्रीर् जवद्युत प्राजधकरण (सीईए) के साथ परामिा से अजधसूचना की प्रकािन की तारीख स े
छः माि के भीतर एक पोिाल तर्ै ार करेगा और केंद्रीर् जवद्युत प्राजधकरण (सीईए) और संबंजधत राज्र् प्रिषू ण
जनर्ंत्रण बोड ा (एसपीसीबी) पोिाल पर सभी कोर्ला र्ा जलग्नाइि आधाररत ताप जवद्युत संर्ंत्रों द्वारा
पंिीकरण और राख डेिा अपलोड सुजनजश्चत करेंगे। संबंजधत जिला अजधकारी के पास इस अजधसूचना के
उपबंधों को लागू करने और जनगरानी करन े के जलए समवती क्षेत्राजधकार िोगा।
(iii) केंद्रीर् जवद्युत प्राजधकरण (सीईए) जतमािी आधार पर राख के उपर्ोग के साथ-साथ ताप जवद्युत संर्ंत्रों द्वारा
प्रावधानों के अनुपालन की जनगरानी करेगा, और इस संबंध में ररपोिा प्रस्ट्तुत करेगा।
(iv) (ii) उप-पैराग्राि (2) (i) के जलए, -
(क) "केधद्रीर् प्रिषू ण जनर्ंत्रण बोड ा और केधद्रीर् जवद्युत प्राजधकरण" िब्िों के जलए, "केधद्रीर् जवद्युत
प्राजधकरण (सीईए) और संबंजधत राज्र् प्रिषू ण जनर्ंत्रण बोडा र्ा प्रिषू ण जनर्ंत्रण सजमजत (पीसीसी)"
िब्ि, अक्षर और कोष्ठक को प्रजतस्ट्थाजपत दकए िाएंगे।
(ख) “31 मई तक पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को प्रस्ट्तुत” िब्ि और अक्षर के जलए, िब्िों
के स्ट्थान पर िब्ि, अक्षर और सख्ं र्ा को "इसे अपनी वेबसाइिों पर प्रकाजित करत े ि ैंऔर 30 िून तक

NOTIFICATION
New Delhi, the 23rd January, 2026
S.O. 369(E).— Whereas, the Government of India, Ministry of Environment, Forest and Climate Change, in
exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3) of rule (5) of the Environment (Protection)
Rules, 1986, issued a notification published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii)
vide S.O.5481(E), dated the 31st December, 2021 (herein after referred to as the Ash Utilisation Notification, 2021);
And whereas, requests have been received from various stakeholders regarding implementation of provisions
of the ash utilisation notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with rule (5) of the Environment (Protection)
Rules, 1986, the Central Government hereby publishes the following draft amendments to the Ash Utilisation
Notification, 2021, which the Central Government proposes to make, for information of the public likely to be affected
thereby, and notice is hereby given that the said draft amendments will be taken into consideration by the Central
Government after expiry of a period of sixty days from the date of publication of this notification in the Official Gazette.
The objections or suggestions which may be received from any person in respect of the said draft amendments
before the period specified will be taken into consideration by the Central Government.
Any person desirous of making any objection or suggestion with respect to the said draft amendments may
forward the same, within the period of 60 days from the date of publication of this notification in the Gazette, to the

DRAFT AMENDMENTS TO ASH UTILIZATION NOTIFICATION, 2021
In the Ash Utilisation Notification, 2021,-
(1) in paragraph A,-
(i) in sub-paragraph (3),-
(a) the words, letters and figures “Central Pollution Control Board (CPCB)” will be replaced with
the words “Central Electricity Authority”;
(b) after the words and figure “Ministry of Road Transport and Highways,”, the words and figure
“Central Pollution Control Board,” will be inserted.
(ii) in sub-paragraph (4),
(a) in the third proviso, -
(i) after the words “Provided also that”, the words “up to” shall be inserted,
(ii) after the words “carried forward to the next cycle”, the words, letters, figures and brackets
“(i.e. may be exempted from utilization during the compliance cycle)” shall be inserted.
(b) in the fourth proviso,-
(i) for the words, numbers and figures “similar to the compliance cycle specified for thermal
power plants having utilisation per cent. less than 60 per cent. as specified in the table”, the
words “of five years” shall be substituted.
(c) in the Note,-
(i) after the word, numbers, letters and figure “1st April, 2022”, the words and figure “or the
financial year of commissioning of the thermal power plants, as applicable” shall be
inserted.
(iii) in sub-paragraph (5),-
(a) in the first proviso, for the words “as per installed capacity of thermal power plant”, the
words “by the thermal power plant during the corresponding year” shall be substituted.
(b) for the second proviso,-
(i) for the words “shall certify in this regard”, the words, letters, numbers and figure “has

(ii) the words, letters, numbers, figures and brackets “Stabilisation and reclamation of an
ash pond or dyke including certification by the State Pollution Control Board (SPCB)
or Pollution Control Committee (PCC) shall be carried out within three years from 1st
April, 2022.” shall be deleted.
(iv) in sub-paragraph (6),-
(a) in the opening paragraph,-
(i) for the words, letters and brackets “of Central Pollution Control Board (CPCB) made in
consultation with the Central Electricity Authority (CEA) and these guidelines shall”,
the words, letters, numbers, figures and brackets “issued in June, 2023, and its
amendments thereon, prepared by the Central Electricity Authority (CEA) in
consultation with Central Pollution Control Board (CPCB) and which shall” shall be
substituted,
(ii) the words “and shall be put in place within three months from the date of publication of
this notification” shall be deleted.
(b) in the first proviso,-
(i) after the words “Provided that up to two operational ash ponds or dykes”, the words
“are permitted” shall be inserted,
(ii) after the words “up to four operational ash ponds or dykes”, the words “are
permitted” shall be inserted,
(iii) the words “may be” shall be deleted,
(iv) for the words “shall inform”, the word “informed” shall be substituted,
(v) after the words, letters and brackets “Central Pollution Control Board (CPCB)”, the
words, letters, figure and brackets “, Central Electricity Authority (CEA)” shall be
inserted.
(c) in the second proviso,-
(i) after the words, letters and brackets “Central Pollution Control Board (CPCB)”, the
words, letters, figure and brackets “, Central Electricity Authority (CEA)” shall be
inserted.
(ii) the words, letters, numbers and figures “or by 31st March, 2023, whichever is later” shall
be deleted.
(v) in sub-paragraph (8), after the words ‘for storage of dry fly ash’, the word ‘silos’ shall be deleted.
(vi) in sub-paragraph (9), for the words and figure “Central Pollution Control Board’s web portal”, the words,
letters and figures “Coal Ash Management Portal (CAMP)” shall be substituted.
(2) in paragraph B,-
(i) in sub-paragraph (3),-
(a) for the opening paragraph, the following shall be substituted, namely,-
“(3) It shall be obligatory on all mines (Government, Public and Private Sector) located within
300 kilometers radius (by road) from coal or lignite thermal power plants to undertake backfilling
of mine voids or stowing of mines (running or abandoned as the case may be), under Extended
Producer Responsibility (EPR), as per the guidelines of the Director General of Mines Safety
(DGMS):”
(b) in the proviso, the words “and mixing of ash with overburden in mine voids and dumps shall be
applicable for the overburden generated from the date of publication of this notification” shall
be deleted.
(c) in the ‘Explanation’,-
(i) the words and numbers “using 25 per cent of ash for mixing with overburden dump
and” shall be deleted,

(ii) in sub-paragraph (4) (i),-
(a) the words “and mixing of ash with overburden dumps” shall be deleted,
(b) after the word, letters, numbers and figure “28th August, 2019”, the words “and amendments
thereon” shall be inserted.
(iii) in sub-paragraph 4 (ii), -
(a) for the word “Ministry”, the words “Ministry of Environment, Forest and Climate Change” shall
be substituted;
(b) the words “and mixing with overburden dumps” shall be deleted.
(iv) in sub-paragraph (5) (i) ,-
(a) for the words, letters and brackets “Central Pollution Control Board (CPCB)”, the words, letters
and brackets ‘Central Electricity Authority (CEA)” shall be substituted,
(b) after the words and figure “Ministry of Coal,”, the words, letters, figures and brackets “Ministry
of Road Transport and Highways, Ministry of Ports, Shipping, and Waterways, Ministry of
Micro, Small & Medium Enterprises, Department for Promotion of Industry and Internal
Trade (DPIIT), Central Pollution Control Board (CPCB),” shall be inserted,
(c) the words “or mixing of ash with overburden dump” shall be deleted,
(d) after the sentence “There shall be a committee headed by….”, the sentence “The committee shall
meet at least once in six months.” shall be inserted.
(v) after sub-paragraph 5(ii), the following sub-paragraph shall be inserted, namely,-
“(iii) Upon request from ash users, the Committee constituted under sub-paragraph (5)(i) shall review
the availability of ash at thermal power plants, assess the feasibility and geographical proximity of
users and consider relevant environmental parameters, to provide recommendations to thermal power
plants regarding the allocation of ash for prescribed eco-friendly purposes.”
(vi) in sub-paragraph (7),-
(a) after the words, letters and brackets “Central Pollution Control Board (CPCB)”, the words, letters
and brackets “in consultation with Central Electricity Authority (CEA)” shall be inserted,
(b) the words “within one year” shall be deleted,
(c) after the words “online application process for the grant”, the word “of” shall be inserted.
(vii) in sub-paragraph (9), for the words and figures “Bureau of Indian Standards, Indian Road Congress,
and Central Pollution Control Board”, the words and figures “Bureau of Indian Standards and Indian Road
Congress” shall be substituted.
(viii) in sub-paragraph 10, after the words “other relevant regulations for”, the words “promoting and
maximizing” shall be inserted.
(3) in paragraph C,-
(i) for sub-paragraph (1), the following shall be substituted, namely,-
“(1) In the first two years of a three years cycle, if the coal or lignite based thermal power plant (including
captive or co-generating stations or both) has not achieved at least 80 per cent ash (fly ash and bottom ash)
utilisation, then such non-compliant thermal power plants shall be imposed with an environmental
compensation of Rs. 1000 per ton on unutilised ash after the end of financial year of the compliance cycle
based on the annual reports submitted, followed by reassessment based on the annual compliance audit
report, and if it is unable to utilise average 100 per cent of ash generated during the compliance cycle by
the end of compliance cycle (except for such unutilized ash quantity i.e. up to 20% of ash generated during
the last year of the financial year, which is permitted to be carry forward to the next compliance cycle for
additional utilization as per Para A(4)), it shall be liable to pay an environmental compensation of Rs. 1000
per ton on the unutilised quantity on which environmental compensation has not been imposed earlier:
Provided that the environmental compensation shall be estimated and imposed at the end of last year of the
first compliance cycle as per the various utilisation categories as mentioned in sub-paragraph (4) of Para
A. Thereafter, the environmental compensation shall be estimated and imposed at the end of the financial
year based on the annual reports submitted, followed by reassessment based on the annual compliance

(ii) for sub-paragraph (2), the following shall be substituted, namely,-
“(2) Environmental compensation collected from thermal power plants and other defaulters shall be
deposited in the designated account of concerned State Pollution Control Board (SPCB) or Pollution
Control Committee (PCC), which shall retain 75% amount with it and transfer 25% of the total amount
to Central Pollution Control Board.”
(iii) sub-paragraph (4) shall be omitted;
(iv) in sub-paragraph (5), the word and number “1500 or” shall be substituted with the number “1000”;
(v) in sub-paragraph (6), the word “1500” shall be substituted with the number “1000”;
(vi) for sub-paragraph (7) (i), the words “by Central Pollution Control Board” shall be deleted;
(4) In paragraph E,-
(i) for sub-paragraph (1), the following shall be substituted, namely,-
“(1) (i) The Central Pollution Control Board (CPCB) and the concerned State Pollution Control Board
(SPCB) or Pollution Control Committee (PCC) shall be the enforcing and monitoring authority for
ensuring compliance of the provisions and shall monitor the utilisation of ash on quarterly basis. Central
Pollution Control Board (CPCB) in consultation with Central Electricity Authority (CEA) shall develop
a portal for the purpose within six months of date of publication of the notification and Central Electricity
Authority (CEA) and the concerned State Pollution Control Board (SPCB) shall ensure the registration
and ash data upload by all the coal or lignite based thermal power plants on the portal. The concerned
District Magistrate shall have concurrent jurisdiction for enforcement and monitoring of the provisions of
this notification.
(ii) Central Electricity Authority (CEA) shall monitor the utilization of ash as well as the compliance of
the provisions by the thermal power plants, on a quarterly basis, and shall furnish the reports in this
regard.”
(ii) for sub-paragraph (2)(i), -
(a) for the words “Central Pollution Control Board and Central Electricity Authority”, the words,
letters and brackets “Central Electricity Authority (CEA) and the concerned State Pollution
Control Board or Pollution Control Committee (PCC)” shall be substituted,
(b) for the words, letters and numbers “submit to Ministry of Environment, Forest and Climate
Change by 31st May”, the words, letters and numbers “publish it on their websites and submit
to Ministry of Environment, Forest and Climate Change by 30th June” shall be substituted.
(iii) for sub-paragraph (2)(ii), -
(a) for the words “in compliance report of”, the words “who have obtained” will be substituted;
(b) for the words “whichever is applicable,” the words “annually to concerned State Pollution Control
Board or Pollution Control Committee, on online portal functional under this notification” shall
be substituted;
(c) for the sentence starting with “Central Pollution Control Board (CPCB) ….”, the sentence “The
concerned State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) shall
separately publish annual report of ash utilisation of all other agencies except thermal power
plants to review the effective implementation of the provisions of the notification on its website
along with submission to Central Electricity Authority (CEA) and Central Pollution Control
Board (CPCB).” shall be substituted.
(iv) for sub-paragraph (3),-
(a) for the words, letters and figures “Chairperson, Central Pollution Control Board (CPCB)”, the
words, letters and figures “Chairperson, Central Electricity Authority (CEA)” will be substituted;
(b) for the words “Ministry Road Transportation and Highways”, the words, letters, figures and
brackets “Ministry of Road Transport and Highways, Central Pollution Control Board (CPCB),”
shall be substituted,
(c) after the words, letters and figures “Ministry of Environment, Forest and Climate Change

(v) for sub-paragraph (5), the following shall be substituted, namely,-
“(5) The compliance audit for ash disposal by the thermal power plants and the user agency shall be
conducted by auditors, authorised by Central Pollution Control Board (CPCB) and/or Certified
Environment Auditors under the Environment Audit Rules, 2025. The audit report is to be prepared as
per SOP issued by Central Pollution Control Board (CPCB) and audit report shall be submitted to
Central Pollution Control Board (CPCB) and concerned State Pollution Control Board (SPCB) or
Pollution Control Committee (PCC) by 30th August every year. Central Pollution Control Board and
concerned State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) shall initiate
action against non-compliant thermal power plants within fifteen days of receipt of audit report. The
annual ash compliance status report based on the annual compliance audit reports shall be compiled by
the Central Electricity Authority (CEA) and reviewed by the Committee constituted in Para E(3).”
(5) In the Annexure, for the word, letters and numbers “31st May”, the word, letters and numbers “30th April” will
be substituted.
This notification shall come into force on the date of its publication in the Official Gazette.
