L.-33004/99 xxxGIDHxxx सी.जी.-डी.एल.-अ.-12032020-218612 xxxGIDExxx CG-DL-E-12032020-218612 असाधारण EXTRAORDINARY भाग II—खण्ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 870] नई दिल्ली, बधु वार, माच ि 4, 2020/फाल्ग नु 14, 1941 No. 870] NEW DELHI, WEDNESDAY, MARCH 4, 2020/PHALGUNA 14, 1941 सक्ष्ू म, लघ ु और मध्यम उद्यम मत्रं ालय अजधसचू ना नई दिल्ली, 28 फरवरी, 2020 का.आ. 974(अ).—िबदक सेवाओं अथवा फायिों अथवा सहाजयकी प्रिान करन े के जलए पहचान िस्ट्तावेि के रूप म ें आधार का उपयोग सरकारी जवतरण प्रदियाओं को सरल बनाता ह ै और पारिर्िति ा और कायिकुिलता लाता ह ै तथा जहतधाररयों को सीधे सुजवधािनक और जनबािध रूप से पात्रता प्राप्त करने के जलए सक्षम बनाता ह ैऔर आधार व्यजि की पहचान साजबत करन े के जलए जवजभन्न िस्ट्तावेि प्रस्ट्तुत करने की िरूरत का जनवारण करता ह;ै और िबदक, भारत सरकार म ें सूक्ष्म, लघ ु और मध्यम उद्यम मंत्रालय (इसके पश्चात ् मंत्रालय के रूप म ें जनर्िष्टि दकया गया ह)ै एक केन्द्रीय सेक्टर की स्ट्कीम ‘‘प्रधानमंत्री रोिगार सृिन कायििम (पीएमईिीपी)’’ (इसके पश्चात ् स्ट्कीम के रूप म ें जनर्िष्टि दकया गया ह)ै बैंक स े ऋण लेकर मुरा तथा पीएमईिीपी के अंतगित स्ट्थाजपत मौिूिा उद्यमों के उन्नयन अथवा नए उद्यम आरंभ करन े के जलए व्यजियों (इसके पि जहतधारी के रूप म ें उल्लेख दकया गया ह)ै को पूंिीगत सहाजयकी (इसके पश्चात ् जहतधारी के रूप म ेंजनर्िष्टि दकया गया) प्रिान करन े की व्यवस्ट्था करता ह;ै और िबदक, खािी और ग्रामोद्योग आयोग (केवीआईसी) के माध्यम स े राष्ट्रीय स्ट्तर पर एकल केंरक अजभकरण के रूप म ें स्ट्कीम कायािजन्द्वत की िाती ह।ै राज्य स्ट्तर पर राज्य केवीआईसी जनिेिालयों, राज्य खािी और ग्रामोद्योग बोडों (केवीआईबी) और जिला उद्योग केंरों (डीआईसी) और बैंकों (इसके पश्चात ् कायािन्द्वयन अजभकरणों के रूप म ें उल्लेख दकया गया ह)ै के माध्यम स े स्ट्कीम कायािजन्द्वत की िाती ह।ै मौिूिा स्ट्कीम दििा-जनिेिों के अनुसार स्ट्कीम के अंतगित सरकारी सहाजयकी फायिाग्राजहयों/उद्यजमयों को उनके बैंक खातों में अंजतम जवतरण के जलए जचजन्द्हत बैंकों के माध्यम से केवीआईसी द्वारा कराई िाती ह।ै 1264 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और िबदक, पूवोि स्ट्कीम म ें भारत की समेदकत जनजध स े प्राप्त आवती व्यय िाजमल ह;ै अतः अब केंरीय सरकार आधार जवत्तीय और अन्द्य सहाजयदकयों, प्रसुजवधाओं का लक्षजयत परिान अजधजनयम, 2016 (2016 का 18) (इसके पश्चात् उि अजधजनयम कहा गया ह)ै लजक्षत जवतरण की धारा 7 के उपबंधों के अनुसरण म ें जनम्नजलजखत अजधसूजचत करती हःै - 1. (1) स्ट्कीम के अंतगित फायिा प्राप्त करने के इच्छुक लाभाथी को एतद्दवारा आधार रखने अथवा आधार प्रमाणीकरण को साजबत करना अपेजक्षत ह।ै (2) स्ट्कीम के अंतगित लाभ लेन े के इच्छुक जहतधारी जिनके पास आधार संख्या नहीं ह ै अथवा, जिन्द्होंने अभी तक आधार के जलए नामांकन नहीं दकया ह,ै उन्द्ह ें आधार नामांकन के जलए एक आवेिन करना अपेजक्षत होगा, तथा यदि वह उि अजधजनयम की धारा 3 के उपबंधों के अनसु ार आधार प्राप्त करने के जलए हकिार ह ैं तो, ऐसे व्यजि दकसी आधार नामांकन केन्द्र पर िा सकते ह।ैं आधार के जलए नामांदकत दकए िाने के जलए केंरों की सूची भारत के जवजिष्ट पहचान प्राजधकरण (यूआईडीएआई) की वेबसाइट www.uidai.gov.in पर उपलब्ध ह।ै (3) आधार (नामांकन और अद्यतन) जवजनयम, 2016 के जवजनयम 12 के अनुसार, मंत्रालय द्वारा अपनी कायािन्द्वयन अजभकरणों के माध्यम स े उन जहतधाररयों को आधार नामांकन सुजवधायें प्रिान करना अपेजक्षत ह ै जिन्द्होंन े आधार के जलए नामांकन नहीं दकया ह ै और यदि संबंजधत ब्लॉक या तालुका अथवा तहसील म ें कोई आधार नामांकन केंर जस्ट्थत नहीं ह ै तो मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम स े स्ट्वय ं भारत का जवजिष्ट पहचान प्राजधकरण (यूआईडीएआई) रजिस्ट्रार बनकर अथवा यआू ईडीएआई के मौिूिा रजिस्ट्रारों के समन्द्वय म ें सुजवधािनक स्ट्थानों पर आधार नामांकन सुजवधाएं प्रिान करेगा। उपाबंध ह ै दक व्यजि को िब तक आधार सौंपा नहीं िाता ह ै तब तक स्ट्कीम के अंतगित ऐसे व्यजियों को जनम्नजलजखत िस्ट्तावेिों की प्रस्ट्तजु त के अधीन लाभ दिया िाएगा अथाित-् (क) (i) यदि दकसी पुरूष या मजहला न े आधार के जलए नामांकन दकया ह ै तो उसकी आधार नामांकन पहचान जस्ट्लप; अथवा (ii) आधार नामांकन के जलए दकए गए अनुरोध की एक प्रजत िैसा दक पैरा (2) के उप-पैरा (2) म ें जवजनर्िष्टि दकया गया ह;ै और (ख) जनम्नजलजखत िस्ट्तावेिों म ेंस े कोई भी एक िस्ट्तावेि, अथाित् (i) भारत के जनवािचन आयोग द्वारा िारी मतिान पहचान पत्र; या (ii) मोटर यान अजधजनयम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राजधकारी द्वारा िारी चालन अनुज्ञजप्त या; (iii) एक िासकीय पत्र िीष ि पर रािपजत्रत अजधकारी अथवा तहसीलिार द्वारा िारी ऐस े व्यजि का फोटोयुि पहचान प्रमाण पत्र; या (iv) आयकर जवभाग द्वारा िारी स्ट्थायी लेखा संख्या (पीएएन) काड;ि या (v) पासपोट;ि या (vi) रािन काड;ि या (vii) फोटो युि बैंक पास बुक या डाकघर की पासबुक; या (viii) मंत्रालय द्वारा जवजनर्िष्टि कोई अन्द्य िस्ट्तावेि; परंतु यह और दक उस प्रयोिन के जलए मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम स े जवजिष्ट रूप से अजभजहत अजधकारी द्वारा उपयिुि िस्ट्तावेिों की िा च की िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 2. स्ट्कीम के अंतगति जहतधाररयों को सुजवधािनक और जनबािध रूप स े लाभ प्रिान करने के जलए मत्रं ालय अपनी कायािन्द्वयन अजभकरणों के माध्यम स े सभी अपेजक्षत प्रबंध करेगा जिसम ें जनम्नजलजखत िाजमल होंग,े अथाित:्- )1( लाभार्थियों को मीजडया और व्यजिगत नोरटस के माध्यम स े व्यापक प्रचार दिया िाएगा तादक वे इस स्ट्कीम के िरुरतों के प्रजत िागरुक हो सकें और यदि उनका नामांकन नहीं हुआ ह ै तो उन्द्ह ें अपन े क्षेत्रों म ें उपलब्ध नज़िीकी आधार नामांकन केंर म ें अपना नामांकन कराने का परामि ि दिया िाएगा और स्ट्थानीय उपलब्ध नामांकन केंरों की सूची इन्द्ह ेंउपलब्ध कराई िाएगी। (2) यदि लाभाथी ब्लॉक अथवा तालुका अथवा तहसील िैसे जनकटवती नामांकन केंरों की अनुपलब्धता की विह स े नामांकन कराने म ें असमथ ि हों तो यह मंत्रालय अपनी कायािन्द्वयन एिेंसी के माध्यम से सुजवधािनक स्ट्थलों पर आधार नामांकन सुजवधाएं प्रिान करेगा और लाभाथी अपना नाम, पता, मोबाईल नंबर और पैरा 1 के उप-पैरा (3) के प्रथम परंतुक म ें यथा जवजनर्िष्टि अन्द्य जववरण प्रिान करके नामांकन के जलए अपन े अनरु ोध का पंिीकरण कायािन्द्वयन एिेंसी के पिनाजमत अजधकारी के समक्ष अथवा इस उद्देश्य के जलए उपलब्ध वेबपोटिल के माध्यम स े अपना पंिीकरण करा सकते ह।ैं (3) यदि इस स्ट्कीम के अंतगित जहतधाररयों न े आधार के जलए नामांकन करा जलया है, तथाजप दकसी कारणवि वे आधार प्रस्ट्तुत करन े म ें अक्षम ह ैं तो यह मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम स े भारत के जवजिष्ट पहचान प्राजधकरण के नामकंन के माध्यम से "सचि माई आधार" सुजवधा प्रिान करेगा और सुजवधािनक स्ट्थलों पर आधार नामांकन सुजवधाओं को आसान बनात े हुए जहतधाररयों को अद्यतन करेगा और जहतधाररयों स े अनुरोध दकया िा सकता ह ै दक वे अपना नाम, पता, मोबाईल संख्या, फफंगर प्प्रंट और ऑपरेटर के पास मौिूि अन्द्य जववरण िेकर सहायता पद्धजत स े अपन े आधार की तलाि करें िो उि अजधजनयम और जवजनयमों के प्रावधानों के अधीन जहतधाररयों का आधार तलािन े के जलए अपेजक्षत ह ैं और आधार संख्या को साझा करन,े पररचाजलत करन ेऔर प्रकाजित करने पर पाबंिी लगान ेके संबंध म ें बनाए गए ह।ैं 3. (1) उन सभी मामलों में, िहां जहतधाररयों के खराब बायोजमररक की विह स े अथवा दकसी अन्द्य कारण स े आधार प्रमाणन सफल नहीं हो पाता ह ैतो तो जनम्नवत अपवाि स्ट्वरूप हडैं प्लगं प्रणजलया ं अपनाई िाएंगी, नामतः- (क) खराब गुणवत्ता वाली अगं ुजलछाप के मामले म,ें प्रमाणन के जलए आईररस स्ट्कैन सुजवधा को अपनाया िाएगा जिससे मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम से जनबािध रूप से फायिों को प्रिान करन े के जलए अंगुजलछाप स्ट्कैनरों समेत आईररस स्ट्कैनरों के जलए उपाबंध करेगा। (ख) जहतधाररयों के अगं ुजलछाप अथवा आईररस प्रमाणन म ें करिनाई होने पर यह मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम स े ऐस े वररष्ठ नागररकों अथवा जहतधाररयों के जलए जिनका अन्द्य ज़ररयों से प्रामणन सफल नहीं हो सका ह,ै के जलए व्यवहायिता अनुसार फेस प्रमाणन हते ु व्यवस्ट्था करेगा। (ग) यदि अंगुजलछाप अथवा आईररस अथवा फेस प्रमाणन के माध्यम से बायोमैररक प्रमाणन सफल नहीं होता ह,ै िहां कहीं व्यवहायि एव ं स्ट्वीकाय ि ह ै पररजस्ट्थजत अनुसार सीजमत समय की वैधता के साथ आधार का एक- बारगी पासवडि (ओटीपी) या समय-आधाररत एक-बारगी पासवडि (टीओटीपी) के माध्यम से प्रमाणन को प्राथजमकता िी िाएगी; (घ) अन्द्य सभी मामलों म,ें िहां बायोमैररक या ओटीपी या टीओटीपी प्रमाणन संभव नहीं होता ह ै तो वास्ट्तजवक आधार पत्र के आधार पर फायिा प्रिान दकए िा सकते ह ैं जिसके वास्ट्तजवक आधार पत्र पर मुदरत त्वरत प्रत्युत्तर (क्यूआर) कोड के माध्यम स े सत्याजपत दकया िा सकता ह।ै (2) खंड (घ) के प्रयोिन के जलए, यह मंत्रालय अपनी कायािन्द्वयन अजभकरणों के माध्यम से सेवा प्रिाय क्षेत्रों म ें क्यूआर कोड रीडर उपलब्ध कराएगा तादक आधार पत्र अथवा ई-आधार पर मुदरत क्यूआर कोड रीड दकया िा सके जिससे ऑफलाईन रूप स े आधार संख्या की प्रामाजणकता का सत्यापन संभव होता ह।ै (3) उि क्यूआर कोड को प्राथजमकता स े भारत के जवजिष्ट पहचान प्राजधकरण (यूआईडीएआई) द्वारा जवकजसत जसक्योर क्यूआरकोड रीडर के माध्यम स े रीड दकया िाएगा क्योंदक यह रीडर आधार धारक के जडिीटल हस्ट्ताक्षर जववरण4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उपलब्ध कराता ह ैऔर इस उद्देश्य के जलए बनाए गए हडैं प्लगं रजिस्ट्टर के अपवाि के साथ इस प्रकार के सभी मामलों म ें लाभ अथवा सेवा कायि-जववरण जवजधवत िि ि हो िाने के बाि ही िी िाती ह,ैं जिनकी आवजधक समीक्षा और लेखा- परीक्षा इस मंत्रालय द्वारा अपनी कायािन्द्वयन अजभकरणों के माध्यम स े की िाती ह,ै और इन रजिस्ट्टरों का अनुरक्षण और आवजधक जनरीक्षण कायि अपवाि स्ट्वरूप हडैं प्लंग प्रणाली का महत्वपूणि घटक होगा। 4. यह अजधसूचना असम और मेघालय राज्यों स े इतर, सभी राज्यों और केंर िाजसत सेक्टर के प्रिासनों के रािपत्र म ें प्रकािन की तारीख को प्रवृत्त होंगी। [फा. स.ं ए-54/1270/2018-डीएटीसी (यूआईडीएआई)-पीएमईिीपी] सुधीर गग,ि संयुि सजचव MINISTRY OF MICRO, SMALL AND MEDIUM ENTERPRISES NOTIFICATION New Delhi, the 28th February, 2020 S.O. 974(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one's identity; And whereas, the Ministry of Micro, Small and Medium Enterprise (hereinafter referred to as the Ministry) in the Government of India is administering a Central Sector Scheme of "Prime Minister Employment Generation Program (PMEGP) (hereinafter referred to as the Scheme) by providing capital subsidy (hereinafter referred to as the benefit) to individuals (hereinafter referred to as the beneficiary) for starting a new enterprise or upgrading the existing enterprise setup under PMEGP and MUDRA by taking a loan from the bank; And whereas, the Scheme is implemented through the Khadi and Village Industries Commission (KVIC), as the single nodal agency at the national level. At the State level, the Scheme is implemented through State KVIC Directorates, State Khadi and Village Industries Boards (KVIBs) and District Industries Centers (DICs) and Banks (hereinafter together referred to as the Implementing Agencies). As per the extant Scheme guidelines, the Government subsidy under the Scheme is routed by KVIC through the identified Banks for eventual distribution to the beneficiaries/entrepreneurs in their Bank accounts. And whereas, the aforesaid Scheme involves expenditure incurred from the Consolidated Fund of India; Now, therefore, in pursuance of the provisions of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely: - 1. (1) A beneficiary desirous of receiving the benefits under the Scheme is hereby required to furnish proof of possession of Aadhaar or undergo Aadhaar authentication. (2) A beneficiary desirous of receiving the benefits under the Scheme who does not possess the Aadhaar number or, who has not yet enrolled for Aadhaar, shall be required to make an application for Aadhaar enrolment, and in case, he or she is entitled to obtain Aadhaar as per the provisions of section 3 of the said Act, such individuals may visit any Aadhaar enrolment centre. The list of centres is available at Unique Identification Authority of India (UIDAI) website (www.uidai.gov.in) to get enrolled for Aadhaar. (3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry through its . Implementing Agencies, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not enrolled for Aadhaar, and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry through its Implementing Agencies shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by itself becoming the Unique Identification Authority of India (UIDAI) Registrar: Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (a) (i) If he or she has enrolled for Aadhaar, his or her Aadhaar Enrolment ID slip; or (ii) A copy of the request made for Aadhaar enrolment, as specified in sub-paragraph (2) of paragraph 2; and (b) any one of the following documents, namely :- (i) Voter Identity Card issued by the Election Commission of India; or (ii) Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988);or (iii) Certificate of identity having photo of such individual issued by a Gazetted Officer or a Tehsildar on an official letter head; or (iv) Permanent Account Number (PAN) Card issued by the Income-tax department; or (v) Passport; or (vi) Ration Card; or (vii) Bank Passbook or Post Office Passbook with photo; or (viii) any other document specified by the Ministry: Provided further that the above documents shall be checked by an officer specifically designated by the Ministry through its Implementing Agencies for that purpose. 2. In order to provide convenient and hassle free benefits to the beneficiaries under the Scheme, the Ministry through its Implementing Agencies shall make all the required arrangements including the following, namely:- (1) wide publicity through media and individual notices shall be given to the beneficiaries to make them aware of the requirement of Aadhaar to receive the benefits under the Scheme and, in case they are not enrolled, they may be advised to get themselves enrolled at the nearest Aadhaar enrolment centre available in their areas and the list of locally available enrolment centers shall be made available to them. (2) in case, the beneficiaries are not able to enroll due to non-availability of the enrolment centers in the vicinity such as in the Block or Taluka or Tehsil, the Ministry through its Implementing Agencies shall provide Aadhaar enrolment facilities at convenient locations and the beneficiaries may register their requests for enrolment by giving their names, addresses, mobile number and other details as specified in the first proviso to sub-paragraph (3) of paragraph 1, with the designated officials of the Implementing Agencies or through the web portal provided for the purpose. (3) in case, the beneficiaries under the Scheme have enrolled for Aadhaar, however, are not able to produce Aadhaar number for any reason whatsoever, the Ministry through its Implementing Agencies shall provide “Search My Aadhaar” facility through the Unique Identification Authority of India’s Enrolment and Update Client by facilitating Aadhaar enrolment facilities at convenient locations and the beneficiaries may be requested to search their Aadhaar in assisted mode by giving their names, addresses, mobile numbers, finger prints and other details, with the operator required to search beneficiaries Aadhaar, subject to the provisions of the said Act and regulations made there under with respect to restriction on sharing, circulating or publishing, of Aadhaar number. 3. (1) In all cases, where Aadhaar authentication fails due to poor biometrics of beneficiaries or due to any other reason, the following exception handling mechanisms shall be adopted, namely:- (a) in case of poor fingerprint quality, iris scan facility shall be adopted for authentication, thereby the Ministry through its Implementing Agencies shall make provisions for iris scanners along with finger print scanners for delivery of benefits in seamless manner; (b) in case of difficulty in fingerprints or iris authentication of the beneficiaries, face authentication shall be used and the Ministry through its Implementing Agencies shall make arrangements for face authentication wherever feasible, for those senior citizens or those beneficiaries whose other modes of authentication fail.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (c) in case of biometric authentication through finger prints or iris or face authentication is not successful, wherever feasible and admissible, authentication by Aadhaar One Time Password (OTP) or Time-based One Time Password (TOTP) with limited time validity, as the case may be, shall he preferred; (d) in all other cases where biometric or OTP or TOTP authentication is not possible, services or benefits may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response (QR) code printed on the Aadhaar letter. (2) For the purpose of clause (d), the Ministry through its Implementing Agencies shall provide QR code readers at point of service delivery to read QR code printed on Aadhaar letter or E-Aadhaar which allows verifying the authenticity of Aadhaar number in an offline manner. (3) The QR code shall preferably be read through Secure QR code reader developed by the Unique Identification Authority of India (UIDAI) as it provides digitally signed details of Aadhaar holder and in all such cases the benefits or services may be provided after duly recording the transaction in the exception handling register made for this purpose, which is to be reviewed and audited periodically by the Ministry through its Implementing Agencies, and maintenance of these registers and periodic inspection shall be an essential component of exception handling mechanism. 4. This notification shall come into effect from the date of its publication in the Official Gazette in all the States and Union territories, except the States of Assam and Meghalaya. [F.
