This order establishes the rules and procedures for the reservation and allotment of election symbols to candidates contesting elections for the Municipal Corporation of Delhi (MCD). The core purpose is to ensure a fair and transparent process for symbol allocation, accommodating national, state, and independent candidates. Key provisions address the recognition of political parties, the choice of symbols, and the authorization process for candidate nomination. **2. Introduction:** The purpose of this report is to provide information and analysis of the Municipal Corporation of Delhi Election Symbols Reservation and Allotment Order, 2022, based solely on the provided policy text. This report aims to inform the reader about the policy's key objectives, provisions, and potential impact on the MCD elections. **3. Policy Overview:** This document outlines a new policy establishing processes for election symbol selection and allocation. * **Core Objective(s):** * To direct and control the election process of the Municipal Corporation of Delhi. * To provide a framework for the choice and allotment of election symbols to political parties (national and state) and independent candidates contesting MCD elections. * To ensure fairness and transparency in the allocation of election symbols. **4. Background and Rationale:** * **New Policy:** The policy addresses the need for a structured and regulated process for allocating election symbols. The text infers that without such a policy, the symbol allocation process might be arbitrary, inconsistent, or susceptible to disputes. The rationale includes ensuring that recognized political parties can utilize their reserved symbols and providing a fair mechanism for independent candidates to select symbols. The need for clear guidelines is crucial for ensuring orderly and fair elections. **5. Key Provisions / Changes:** * This is a New Policy outlining symbol allocation. * The order establishes: * A defined set of terms related to the election process (Commission, Municipal Corporation, Ward, National Party, State Party, Act, Rules) and the meaning of those terms within the policy. * Recognition of National Parties based on the Election Commission of India's recognition. These parties are authorized to utilize the symbols reserved for them by the ECI. * Similar recognition is given to state parties recognized by the Election Commission of India. * The adoption of the ECI's size and shape specifications for election symbols. * A process for candidates nominated by National Parties and the Delhi State Party to choose and be allotted the symbol reserved for that party by the Election Commission of India * A process for candidates nominated by State Parties not recognized in Delhi to apply to the commission for allotment of the symbol reserved for the party, and conditions that must be met in order for that application to be granted. * A listing of free symbols that independent candidates can select from. * The policy outlines conditions for candidates to be "set up" by a recognized political party, including declarations made by the candidate in their nomination paper, and the submission of notice (Form B) that candidate is set up by the political party. * A process for authorized designees from a political party to submit names of candidates set up by the National/State Political Party(Forms A & B). * The power of the Election Commission to issue instructions and directions in relation to the provisions of the order. **6. Target Audience and Stakeholders:** The directly affected stakeholders include: * Candidates contesting elections for the Municipal Corporation of Delhi (MCD). * National and State political parties participating in MCD elections. * The State Election Commission of the National Capital Territory of Delhi. * Returning Officers involved in the election process. * Independent candidates. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The State Election Commission of the National Capital Territory of Delhi is the primary body responsible for implementing and overseeing the order. Returning Officers at the ward level also play a crucial role in the allotment of symbols. * **Timelines and Procedures:** * State Parties other than the Delhi State Party must apply for exclusive allotment of that symbol to the candidate set up by it at an election to the Municipal Corporation of Delhi not later than the third day after publication in the official gazette of the Notification calling the election to the Municipal Corporation of Delhi. * Notice in Form B of setting up the candidate must be delivered not later than 3:00 P.M. on the last day of filing nomination, in writing, to the Returning Officer of the ward to which the candidate is contesting and State Election Commission of NCT Delhi by the party concerned. * Specimen signature of such authorized person in Form A are communicated to the Returning Officer concerned and the State Election Commission of the NCT Delhi not later than 3.00 P.M. on the last date fixed for filing nominations. **8. Expected Outcomes / Impact of Changes:** The intended outcomes of this policy are likely: * A standardized and transparent process for election symbol allocation, reducing the potential for disputes and challenges. * Ensuring that recognized political parties can effectively utilize their reserved symbols, enhancing their visibility and brand recognition. * Providing independent candidates with a fair opportunity to choose from a list of available symbols, promoting a level playing field. * Improved clarity and understanding of the election symbol allocation process among candidates and political parties. **9. Conclusion:** The Municipal Corporation of Delhi Election Symbols Reservation and Allotment Order, 2022, is a significant policy instrument aimed at regulating the election symbol allocation process for MCD elections. By establishing clear rules and procedures, the policy seeks to ensure fairness, transparency, and consistency in the allocation of symbols, promoting a more orderly and democratic election process.
