Åu o flykbZ 196. ukxfjd 197. dwM+ s nku STATE ELECTION COMMISSION ORDER Delhi, the 4th March, 2022 No.F.4(1)/OSDI/Legal/SEC/2022/4053.—WHEREAS the superintendence, direction and control of elections to three Municipal Corporations of Delhi viz. North Delhi, South Delhi and East Delhi are vested in the State Election Commissioner of NCT of Delhi vide Section 7 of the Delhi Municipal Corporation Act, 1957 as amended by the Delhi Municipal Corporation (Amendment) Act, 2011; And whereas it is necessary to provide for the choice and allotment of symbols to the contesting candidates sponsored by political parties (National and State) and to the independent candidates for election to three Municipal Corporations in the National Capital Territory of Delhi viz. North Delhi, South Delhi and East Delhi; Now, therefore in exercise of the powers conferred under Section 7 of the Delhi Municipal Corporation Act 1957, (hereinafter referred to as the ‘ACT’) read with Rule 15 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012 (hereinafter referred to as ‘Rules’) and all other provisions enabling it in this behalf and in supersession of all its earlier Notifications on the subject, the State Election Commissioner of the National Capital Territory of Delhi hereby makes the following order:- 1. Short Title, Application and Commencement: This order will be called the “Municipal Corporation of Delhi Election Symbols (Reservation and Allotment) Order, 2022”. It extends to the whole areas of the three Municipal Corporations of Delhi viz. North Delhi, South Delhi and East Delhi in the NCT of Delhi and applies in relation to elections to the wards of the said three Municipal Corporations of Delhi to be held hereafter. It shall come into force on the date of its publication in the Gazette of NCT of Delhi. 2. Definitions, Interpretation: (a) In this order, unless the context otherwise requires, the words ‘the Commission’ means the State Election Commission of the National Capital Territory of Delhi. (b) “ A Municipal Corporation of Delhi” means any of the three Municipal Corporations of Delhi viz. North Delhi, South Delhi and East Delhi; (c) The ‘ward’ means a Ward of a Municipal Corporation of the NCT of Delhi. (d) ‘National Party’ means a party recognized by the Election Commission of India as such under section 29-A of the Representation of the People Act, 1951, to which a reserved symbol has been allotted for election to Lok Sabha/ Assembly Constituency in the NCT of Delhi by Election Commission of India. (e) Delhi State Party means a State Party recognized by the Election Commission of India for N.C.T. of Delhi under section 29-A of the Representation of the People Act, 1951 to which a reserved symbol is allotted for election to Lok Sabha/Assembly Constituency from NCT of Delhi.[PART IV DELHI GAZETTE : EXTRAORDINARY 21 (f) Other ‘State Party’ means a party recognized by the Election Commission of India in a State or States (Other than N.C.T. of Delhi) under section 29-A of the Representation of the People Act, 1951 to which a reserved symbol is allotted for election to Lok Sabha/Assembly Constituency in that State or States. (g) ‘Act’ means The Delhi Municipal Corporation Act, 1957 as amended by the Delhi Municipal Corporation (Amendment) Act, 2011 (h) ‘Rules means Delhi Municipal Corporation (Election of Councillors) Rules, 2012; 3. Recognition of National and State parties: (a) The National Parties recognized as such for the time being by the Election Commission of India in respect of election to Lok Sabha and State Legislative Assemblies in India, under section 29-A of the Representation of the People Act, 1951 and as per Symbol Orders of Election Commission of India vide Notification No. 56/2016/PPS-III dated the 13.12.2016 and amended time to time thereafter by the Election Commission of India are hereby recognized as such by this Commission for purposes of elections to the above said three Municipal Corporations of the National Capital Territory of Delhi to be held hereafter under the provisions of Rule 15 of the aforesaid Rules. (b) The Commission hereby also adopts for the National Parties those very symbols which are reserved for these parties by the Election Commission of India and not any other symbol. (c) The facsimiles of the symbols reserved for the National Parties (in size and shape) as prescribed for elections to Lok Sabha and State Assemblies by the Election Commission of India as well as those prescribed for other candidates (independents) in the list of Election Symbols are adopted and prescribed as such by this Commission for purposes of the elections to the three Municipal Corporations of Delhi, to be held hereafter. The names of such National Parties and State Parties and symbols prescribed for them are mentioned in Table-I & Table II of Schedule-I annexed. (d) “Aam Aadmi Party” is recognized for N.C.T. of Delhi by the Election Commission of India as ‘Delhi State Party’ and Symbol allotted to this party is “Broom” which is also adopted by this Commission under rule 15 of the said "Rules" for purpose of aforesaid elections (e) A list of ‘free symbols’ to be chosen by other candidates (independents) etc. as prescribed by Election commission of India is contained in Table-III in the Schedule-I and these are also adopted by this Commission for prupose of aforesaid election under Rule 15 of the said "Rules" 4. Choice of Symbol by candidates of National and State Parties and allotment thereof: (a) For every contested election of a Municipal Corporation of Delhi, a symbol shall be allotted to each contesting candidate in accordance with the provisions of the said Rules, this Order and the instructions issued by the Commission from time to time in this regard. (b) A candidate set up by a National Party and Delhi State Party at an election to a ward of Municipal Corporation of Delhi shall choose, and shall be allotted, ONLY the symbol reserved for that party by Election Commission of India and no other symbol. (c) If a candidate set up by a State Party other than Delhi State Party (N.C.T. of Delhi) to contest election to a ward of a Municipal Corporation of Delhi which party is not recognized in the National Capital Territory of Delhi under Section 29-A of the Representation of People Act 1951 by Election Commission of India, intends to choose or chooses a symbol reserved for it in the State or States in which it is a recognized as ‘State Party’ (see schedule-I table-II) other than Delhi State Party then such candidate shall be allotted that symbol to the exclusion of any other candidate and no other symbol on fulfillment of each of the following conditions, namely: (i) that an application is made to the Commission by the State Party for exclusive allotment of that symbol to the candidate set up by it at an election to a Municipal Corporation of Delhi not later than the third day after publication in the official gazette of the Notification calling the election to a Municipal Corporation of Delhi;22 DELHI GAZETTE : EXTRAORDINARY PART IV] (ii) that the said candidate has made a declaration in his nomination paper that he has been set up by that party at the election to a ward of Municipal Corporation of Delhi and that the party has also fulfilled the requirements of clauses (b),(c),(d), & (e) of paragraph 5 of this Order; (iii) that, in the opinion of the Commission, there is no reasonable ground for refusing the application for such allotment. (iv) In case more than one State Parties having the same ‘reserve’ symbol as per Election Commission of India’s order, choose the ‘reserve’ symbol it shall be allotted to a candidate of a State Party by draw of lot and in no other manner. All or any other State Party whose candidate does not get the ‘reserve’ symbol as explained above shall be allotted a ‘free symbol’ of his choice by the Returning Officer in preference to the independent candidates. (v) Candidates sponsored by recognized National Parties & Delhi State Party will have to file nomination paper with one proposer and their choice of symbol to be indicated in the nomination paper(s) shall be restricted to the Symbol reserved for it by the Election Commission of India. (vi) Candidates sponsored by such State Parties (other than Delhi State Party) will have to file nomination papers with ten proposers and their choice of symbol to be indicated in the nomination paper(s) shall be restricted to the symbol reserved for it in the State or States in which it is so recognized by the Election Commission of India. (d) The candidates belonging to unrecognized parties registered by Election Commission of India shall be treated as independent candidates for all purposes including number of proposers required i.e. 10 proposers of the ward to which the nomination is filed and for allotment of symbols. They shall not be given any preference over other independent candidates in allotment of free symbols or allotment of only one free symbol to all its candidates in any ward of a Municipal Corporation of Delhi. (e) (i) Any candidate at an election to a ward of a Municipal Corporation of Delhi other than a candidate set up by a National Party, Delhi State Party or State party (other than “Delhi State Party”) i.e. Independent Candidates etc. shall choose and shall be allotted in accordance with the provisions hereafter set out in this paragraph, one of the symbols specified as ‘free symbols’ as per this Order. (ii) A different symbol to each contesting candidate will be allotted in conformity as far as practicable, with his choice as per three preferences mentioned in his/her nomination paper; (iii) If more contesting candidates than one have indicated their preference for same symbol, the Returning Officer shall decide by lot to which of such candidates the symbol will be allotted. (iv) Other contesting candidates not covered in (ii) or (iii) above, can be allotted a symbol out of list of left out symbols as per their choice as far as practicable. If a candidate still insists to have a symbol out of his three preferences only, as given by him in his first nomination paper, allotted and he refuses to give his choice for any other symbol left out in that ward, the Returning Officer shall allot him a ‘free symbol’ out of the remaining symbols and his decision in this context shall be final unless action of the Returning Officer is contrary to the foregoing direction. 5. Authorization by National and State Parties for allotment of Symbols: (a) For the purpose of this Order, a candidate shall be deemed to have been set up by a recognized political party if and only if the candidate has made a declaration to that effect in the nomination paper filed by him/her. (b) The candidate or substitute candidate has chosen only the ‘reserved’ symbol of his party in his/her nomination paper filed and no ‘other symbol’. (c) A notice in Form ‘B’ of setting up the candidate has been delivered not later than 3.00 P.M. on the last day of filing nomination, in writing, to the Returning Officer of the ward to which the candidate is contesting and State Election Commission of NCT Delhi by the party concerned. (d) The above said notice is signed by a person authorized in Form ‘A’ by the President or the Secretary of the party, in ink. Facsimile signatures shall not be accepted. Similarly fax, Photostat, cyclostyled[PART IV DELHI GAZETTE : EXTRAORDINARY 23 copy of such forms i.e. (form A & B) are also acceptable if the same is signed by the authorized person of the National/State Political Party in ink/ball pen. (e) The name and specimen signature of such authorized person in Form A are communicated to the Returning Officer concerned and the State Election Commission of the NCT Delhi not later than 3.00 P.M. on the last date fixed for filing nominations. (f) Any subsequent authorization by a National or State Party canceling or substituting the earlier authorization in Form ‘B’ shall be sent to the Returning Officer concerned and the State Election Commission of NCT of Delhi also so as to be received by the Commission and the concerned Returning Officer not later than 3.00 P.M. on the last date for making nomination. Such subsequent authorization in Form ‘B’ is to be signed by the authorized Office bearer whose name has been duly intimated in Form ‘A’ and is to be unambiguous and clearly showing that it either cancels or substitutes the earlier authorization, as the case may be. (g) If more than one notice in Form ‘B’ are received from a National or State Party by the Returning Officer/Commission in respect of two or more candidates in a ward from the same political party and that political party fails to indicate in such notices in Form ‘B’ that one of these notices is cancelled or supersedes all other previous notices, the Returning Officer shall accept the notice in Form ‘B’ in respect of that candidate whose Nomination Paper was first delivered to him, and the remaining candidates in respect of whom also notices in Form ‘B’ have been received by him, shall not be treated as candidates set up by such political party and their nomination(s) shall also be rejected (h) Form ‘A’ and ‘B’, as applicable, are prescribed as in Schedule II with this order. 6. Power of Commission to issue instructions and directions: The Commission may issue instructions and directions – (a) for clarification of any of the provisions of this order. (b) for the removal of any difficulty or doubt which may arise in relation to the implementation of any such provisions, and (c) in relation to any matter with respect to the reservation and allotment of symbols and recognition of political parties, for which this order makes no provision or makes insufficient provision, and provision is, in the opinion of the Commission, necessary for the smooth and orderly conduct of elections.
