And whereas, the said Recruitment & Placement license bearing No. RPSL-MUM- 324 in respect of M/s Good Result Marine Services Pvt. Ltd located at, Unit No.903,9th Floor, Sri Krishna, Opp, Laxmi Ind. Estate, MEW Link Road, Andheri (W), Mumbai - 400053 was suspended by the Director Seamen's Employment Office, Mumbai vide order No.SEO/RPSL/Gr-11712018129.51120915351209 dated 6.5.2019 For violations of M.S.(R&PS) Rules, 2016. 3. And whereas, the IRS has conducted annual inspection of the RPSL and submitted their inspection reporl bearing No. BOMl9RP5087 in respect of M/s Good Result Marine Services Pvt. Ltd., RPSL-MUM-324 raising various deficiencies of the said RPSL. 4. And whereas on receipt of the report from the IRS, the Director SEO, Mumbai has initiated proceedings against M/s Good Result Marine Services Pvt. Ld. Under Rule l2 of M.s.(R&PS) Rules 2016 and show cause notice bearing No.SEO/RPSL/Gr- 11712018129,5112019152312019 dated 6.5.2019 was issued against M/s Good Result Marine Services Pvt. Ltd. 5. And whereas this office as well as Directorate General of Shipping, Mumbai also received grievances/complaints against M/s Good Result Marine Services Pvt. Ltd. from various seafarers which are appended below :5.1. Indian Consulate at Hanoi. Vietnam vide e-mail dated 10.10.2018 intimated Directorate General of Shipping, Mumbai regarding request for consular assistance sought by Mr. Vishalkumar Devendrabhai Patel bearer of Indian Passport No. R4538338 who was serving at Vietnam through M/s Good Result Marine Services Pvt. Ltd. for repatriation to India. Several violations were noted in recruitment of seafarer, viz. violation of Rules 5(l) of M.S.(R&PS) Rules,20l, recruitment of seafarer not as per procedure; to intimate and submit Form-VII, manning agreement, list of vessels etc. in respect of M/s An Binh Shipping, Vinh City, Vietnam as per Rule 16, etc. 5.2. Mr. Mahender Singh holder of Indian CDC No. KOL 106498 submitted grievance against RPS provider for non-payment of balance of wages. 5.3. Mr. Suryaprakash vide e-mail dated 27.12.2018 submitted grievance stating that he was sent to Vietnam on 08.09.2018 for placement on board by RPS provider. However, he remained stranded there fbr 4 months without joining any vessel. There were 40 other seafarers who were awaiting to join the vessel & whose source of manning is not confirmed. 5.4 Mr. Umang bearer of Indian CDC No.KOL 106766 vide e-mail dated 2.4.2019 submitted grievance stating that he paid an amount of INR 40,000/- in case and INR 2.3 Lacs in the account of M/s Griffin Forex Pvt. Ltd. for getting placement onboard through RPS provider. He was sent to Vietnam wherein already 50 seafarers sent by RPs Provider were awaiting for their joining. After 07 months, he was sent onboard a vessel and whereas, name of vessel updated on Master Checker was noted to be different (M .V. Vimaru Pearl). He was signed-off from the vessel on 13.3.2019 and was told to stay in Vietnam on the pretext ofjoining on board another vessel. 5.5. Mr. Pushpak Kumar bearer of Indian CDC No. KOL 105548 vide e-mail dated 11.5.2019 submitted grievance stating that he paid service charge to RPS provider (Cash INR 50,000/ to Mr. Murari sated as employer of said RPs provider and INR I Lac through M/s Griffin Forex Pvt. Ltd.). He was given a packet of US $ 1500/- and was sent to Saigon, Vietnam where he was received by Mr. Krishan Madhav, Vice Director, M/s Good Result Marine Services Pvt. Ltd., RPSL - MUM-324 who took packet and documents from him. The seafarer was taken to a guest house where he found that already 50-50 Indian crew were waiting for their joining onboard. The seafarer waited for 02 months and after that he was being sent onboard M.V .Hamron whereas his online Form-l was updated for the vessel M.V. Pasco 98. The seafarer remained on board fbr 02 months and then signed off without been paid his due wages. He was again kept at Guest House for 02 months and thereafter, was sent to Bangkok for joining. But immigration authorities at Bangkok told him that his documents are not proper and hence, was deported to India on 26.01 .2019.'5'6' Mr. Manish Kumar Rawat bearer of Indian CDC. No. MUM 271767 vide representation dated 17 .5.2019 submitted grievance stating that he met Mr. Murari, agent for M/s Good Result Marine Services Pvt. Ltd., RPSL-MUM-3}4 and paid 3.5 Lacs to him for placement onboard. He was given flight ticket from Mumbai to Bangkok & Bangkok to Saigon (Vietnam) dated 14.09.2018 and was directed to contact Mr. Krishna at Vietnam. The seafarer found many persons waiting fbr their joining at Vietnam and stayed there at hostel for 04 months. Thereafter, he came back to India and reported to RpS provided office on2.2.2019 and met Mr. Rohit (Sajesh Kumar) who agreed to give back INR 2.5 lacs after deduction of l lacs as documentation charge. 5.7. Mrf. Ishaque Yusuf Khan bearer of Indian CDC No. MUM 276974 vide representation dated 28.05.2019 submitted grievance stating that he paid an amount of INR 3'l5lacs to M/s Good Result Marine Services Pvt. Ltd. RPSL MUM-324 as service charge for getting placement onboard. He was given contract dated 1 6.02.2019 in respect of vessel M'T' Loc Phat Star and was kept waiting at Vietnam for one to one and half months. Thereafter, he was given placement on board a scrap vessel namely, Vassai VCT 02 wherein no proper facility was maintained onboard. After long intervention by his parents, he was finally given sign-off and came back to India. RPS provider is now refusing to return the service charge the seafarer paid to RpS provider. 6 And whereas subsequent to show cause notice bearing No.SEO/RpSL/Gr- 11712018129,5112019152312019 dated, 6.5.2019, and in the light of aforementioned issues, this office passed order bearing No.SEo/RPSL/Gr-1 17l2o1gl2g,5ll20g/5351209 dated 6'5'2019 wherein to protect the interest of seafarers, M/s Good Result Marine Services pvt. Ltd' RPSL-MUM-324 was suspended from recruiting seafarers until further orders in this regard. 7 ' And whereas, M/s Good Result Marine Services Pvt. Ltd. vide letter bearing No. GRMS/008412018 dated 12.11.2018 and further letter dated 14.5.2019 replied to the show cause notice. However, no reply has been received for some of the complaints. This Office vide letter No.SEO/RPSLlGrl74l2}lgl7}ll}otg dated 10.06.201g, the RpsL provide was directed to furnish recruitment procedure adopted by RpS provider with respect to engagement of seafarer through Vietnam Port with necessary documentary evidences. However, the same has remained unanswered as on date. 8. And whereas the DSEO, vide letter No.SEO/RpSL/Gr. l17l20lgl29-51-7412019 dated 2l .08.2019 directed the Indian Register of Shipping (lRS) to conduct an inspection into the conduct of business of recruitment by M/s Good Result Marine Services pvt. .Ltd., RPSL -Mumb-324 to ascertain its recruitment procedure in co-relating with allgrievances/complaints as mentioned above and other non-conformity found during annual inspection of said RPS provider. The IRS has intimated this office that the RPSL has not given their readiness to conduct the inspection. Hence the RPSL's License was not renewed and the same has now been expired. 9. And whereas post expiry of RPS Lincense of M/s Good Result Marine Services Pvt. Ltd., this office as well as the Directorate General of Shipping, Mumbai. have continuously received grievances/complaints from several seaf-arers against M/s Good Result Marine Services Pvt. Ltd., regarding cheating. This office has received a complaint from Shri Subham Thakur, Marine Engineer intimating that M/s Good Result Marine Services Pvt. Ltd., RPSL-Mum-324, has charged him an amount of Rs. 3.70 lakhs for providing employment on board ship. After receiving the money, the petitioner was issued with an agreement offering employment on board vessel 'Vassai VCT 02' owned by M/s Almighty Maritime Services Pvt. Ltd, RPSL-MUM-439. He was provided with an air tickets to Vietnam. M/s Good Result Marine Services Pvt. Ltd. kept running a fake Master Checker on the petitioner's name MR. Sajesh Kumar, CEO of M/s Good Result Marine Services Pvt. Ltd. Mumbai was asked by the complainant to return the money paid to them which they could not do. 10. And whereas, as evident by the business practices adopted by M/s Good Result Marine Services Pvt. Ltd., the conduct of the said RPSL company and its associated Directors and CEO have been found to be in contravention of M.S.(R &PS) Rules,2016. 11. Therefore, the Recruitment and Placement Service license bearing No. RPSL-MUM- 324 which has been expired in respect of M/s Good Result Marine Services Pvt. Ltd. is hereby withdrawn with immediate effect in terms of Rule 12 of Merchant Shipping (Recruitment & Placement of Seafarers) Rules, 2016. 12. And whereas, it is evident that M/s Good Result Marine Services and its associated Directors cheated lndian citizens, caused hardship & harassed them, by misusing the Government online E-migrate system with malafide intention to dupe the seafarer and thereby to gain monetary benefits, putting saf-ety and well-being of Indian Nationals at risk in foreign shores by misusing the Government of India license and its e-migrate system/mechanism. 13. In view of the circumstances explained herein-above, the Competent Authority has decided and ordered herein that M/s Good Result Marine Services Private Ltd. (CIN No.U74120MH2014PTC256081) and its associated Directors, namely, Shri Krishan Madhav (DIN 06860784) and Shri Sajesh Kumar Sudhanshu (DIN 08459706) are blacklisted andto conduct any associated the Directorate General of Shipping, Mumbai and its allied offices from the date of issue of this order. 14.
