No. 8/166/2024/HP-II/3501-3505.—Whereas, the Ministry of Home Affairs. Government of India, vide notification SO 2660(E) dated 8th July, 2024, issued under sub-section (1) of section (3) of the Unlawful Activities (Prevention) Act. 1967 (37 of 1967) has extended the declaration of the Sikhs For Justice (SFJ) as an unlawful association for a further period of 05 years from 10th of July, 2024, and Whereas, subsequently, the Ministry of Home Affairs, Government of India, in exercise of powers conferred under section 42 of the Unlawful Activities (Prevention) Act, 1967, has directed that the State Governments of Assam, Gujarat, Haryana. Himachal Pradesh, Jharkhand, Punjab, Rajasthan, Uttrakhand and Uttar Pradesh and Union Territory Administrations of Chandigarh, Jammu and Kashmir and National Capital Territory of Delhi shall exercise the powers exercisable by the Central Government under section 7 and section 8 of the said Act: and Whereas, vide order No. 17014/23/2024-IS VII dated 29th July, 2024, issued by the Ministry of Home Affairs, Government of India, it has been considered necessary that the powers directed to be exercised by State Governments of Assam, Gujarat. Haryana, Himachal Pradesh, Jharkhand, Punjab, Rajasthan, Uttrakhand and Uttar Pradesh and Union Territory Administrations of Chandigarh, Jammu and Kashmir and National Capital Territory of Delhi may be exercised by any person subordinate to the Government, and Whereas, the approval of Central Government has been accorded under Section 42 of the Unlawful Activities (Prevention) Act, 1967 whereby the Central Government authorized that the State Governments of Assam, Gujarat, Haryana, Himachal Pradesh, Jharkhand, Punjab, Rajasthan, Uttrakhand and Uttar Pradesh and Union Territory Administrations of Chandigarh, Jammu and Kashmir and National Capital Territory of Delhi may, by order in writing, direct that any power which has been directed to be exercised by it, shall, in such circumstances and under such conditions, as may be specified in the direction, be exercised by the Inspectors general of Police, the District Magistrates or the Deputy Commissioners of Districts under the State Government. Now, therefore, the Lt. Governor of National Capital Territory of Delhi, with the previous approval of the Central Government, as conveyed vide order No 17014/23/2024-IS VII dated 29 July, 2024, of Ministry of Home Affairs. Government of India, hereby directs that the powers exercisable by the Lt. Governor of National Capital Territory of Delhi under section 7 and 8 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) in relation to the aforesaid association, shall be exercised by the Commissioner of Police.
