माध्यम से लगातार अवसरों पर सुनवाई की ह,ै सुनवाई की अंजतम जतजि 1 अप्रलै , 2024 ह,ै जिसमें सुनवाई पूरी हो चुकी है, मामला आदिे पाररत करने के जलए सरु जित रखा गया। पष्ठृ भजू म: ददनांक 5 अक्टूबर, 2023 के पीसीएसओ संख्या HRHSKO51023PR28648 के माध्यम स,े कजित जमल कंपनी को हररयाणा राज्य सरकार को आपूर्ता के जलए बी-टवील बारदानों की आपूर्ता हते ु िोक आदिे ददए गए िे। सांजवजधक प्रावधानों के जनयमानुसार, जमल के प्रजतजनजधयों, जनरीिण अजभकरणों अिाात मेससा एस्ट्केप्स और पटसन आयुक्त कायाालय के अजधकाररयों की उपजस्ट्िजत म,ें 5 और 6 ददसंबर 2023 को कजित जमल पररसर में जनरीिण दकया गया िा। जनरीिण के दौरान जनम्नजलजखत जवसंगजतयााँ पाई गई:- “जमल प्रजतजनजधयों एव ं मेससा एस्ट्केप्स इंजडया प्राइवेट जलजमटेड की उपजस्ट्िजत में 46 जववादीत गांठों म ें से 3 गांठों को खोला गया एवं जनम्नजलजखत अवलोकन प्रस्ट्तुत ह।ै 5460 GI/2024 लडलो) दोहरे लाल जचह्न वाल े बी-टवील बारदानें पाए गए 3. 0057 i. पजिम बगं ाल, पंिाब एव ं हररयाणा सरकार के बी-टवील बारदानों म ें एकल नील े जचह्न पाए गए टीम ने 8 बी-टवील बैग्स [दो (02) गरै -ब्ांडेड बगै जिनमें दो लाल और एकल नीले पहचान जचह्न ह ैं और एक (01) टाइप- ए, तीन (03) ब्ांडेड बगै जिनमें पंिाब, मध्य प्रदेि एव ं छत्तीसगढ़ सरकारों के नील े पहचान जचह्न एकत्र दकए ह,ैं एक (01) बैग जिस पर हररयाणा सरकार (जमल का नाम - लडलो) की ब्ांडडंग ह ै और एक (01) बगै अंजबका की छपाई और भारत में जनर्मात] के हस्ट्तािर के साि नमूने के रूप में ऊपर उजल्लजखत 3 जववाददत गांठें जमल प्रजतजनजध खोलें।.जमल प्रजतजनजध के समि 3 जववाददत गाठें जिन्ह ें खोला गया िा, उन्ह ें दोबारा पैक कर िील कर ददया गया (िील संख्या 4287601 स े 4287606). आग,े पटसन आयक्तु के प्रजतजनजधयों द्वारा पटसन और पटसन वस्त्र जनयंत्रण आदिे , 2016 की प्रावधानों के अनुसार ददनांक 05.10.2023 की पीसीएसओ संख्या HRHSK051023OPR28648 के तहत हररयाणा सरकार के 150 गाठें िप्त दकए गए। िप्त दकए गए गाठों को जिम्मा से श्री जसताराम गांगुली, प्रबंधक दिजनडिगं एवं मसे सा ओजलसा ररयल्टी प्राइवेट जलजमटेड के एसक्यूसी को सुपुद ा कर ददया गया। जमल कंपनी को यह सलाह दी गई दक िप्त दकए गए गाठों को अलग और सुरजित स्ट्िान पर रखा िाए एवं अप्रजतयाजित जस्ट्िजत के जसवाय इन गाठों का उपयोग/बदलाव/प्रेषण न दकया िाए (जिस े पटसन आयुक्त के कायाालय को अजवलंब सूजचत कर ददया िाए)। िब तक दक पटसन आयुक्त के कायाालय से कोई आगे की सूचना प्राप्त न हो िाए।“ तदनुसार, ददनांक 15 ददसंबर, 2023 के पत्र संख्या पटसन(टी)-6/1/397/23-I(ई) के तहत कजिन जमल कंपनी को कारण बताओ नोरटस िारी दकया गया, जिसका उत्तर 19 ददसंबर, 2023 के पत्र के माध्यम स ेप्राप्त हुआ। सुनवाई के दौरान िप्त दकए गए बारदानों के जवसंगजतयों को दिााया गया, कारावाई पिकारों की उपजस्ट्िजत म ें सुनवाई के समय जवभाग द्वारा कजित जमल कंपनी के जवरुध सबूत के रुप में उक्त बारदानों का इस्ट्तेमाल दकया गया िा। जवभाग के प्रजतजनजधयों द्वारा कजित जमल कंपनी स े प्राप्त कारण बताओ नोरटस के हवाल े से यह रुख अपनाया गया दक जमल प्राजधकारी ने अपना अपराध स्ट्वीकार कर जलया ह ैऔर इसकी जिम्मेदारी कमाचाररयों पर डाली गई ह।ै दसू री ओर कजित जमल कंपनी के प्रजतजनजध ने जवभाग द्वारा उनके जखलाि लगाए गए आरोपों से इनकार दकया, उन्होंने स्ट्पष्ट रूप स े इस बात पर िोर ददया दक जवभाग उनके द्वारा ददए गए कारण बताओ नोरटस की व्याख्या करने म ें जविल रहा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ह।ै उन्होंने बताया दक, कुछ बी-टवील बैग्स बहुत पहल े प्रजतस्ट्पधी बािार में गुणवत्ता की िाचं करन े के जलए अलग-अलग िसल वषों की जवजभन्न जमलों से जलए गए िे, यह कुछ कमाचाररयों की सरासर लापरवाही के कारण ह ै दक बैग जनरीिण लॉट के साि जमजश्रत हो गए।, इसमें न तो कोई आपराजधक मिं ा ह ै और न ही अनुजचत व्यवहार को बढ़ावा देन े का कोई प्रयास ह,ै अिाता भारी मात्रा में आपूर्ता के बीच, केवल कुछ बगै यदद गलत पाए िाते ह ैं तो दकसी भी तरह से कजित जमल कंपनी के दकसी भी गलत इरादे का उिागर नहीं होता ह,ै क्योंदक िैसा दक आरोप लगाया गया ह,ै कदाचार से कंपनी को मामूली लाभ जमलगे ा जिसकी आवश्यकता नहीं ह।ै सुनवाई के दौरान कजित जमल कंपनी के प्रजतजनजधयों ने हालांदक स्ट्वीकार दकया दक उनकी ओर से लापरवाही हुई ह,ै लेदकन लापरवाही से उनका व्यवसाय का अजधकार नहीं छीना िाना चाजहए, िो हिारों श्रजमकों को उनकी आिीजवका देकर लाभाजन्वत कर रहा ह।ै जवभाग ने कजित जमल कंपनी पर पीसीएसओ की रोक लगाने की प्रािना ा की और कजित जमल कंपनी ने उनकी साख और अनिाने म ेंहुई अवहले ना को दखे ते हुए जिकायत को खाररि करने की प्रािाना की। सभी प्रस्ट्तुजतयााँ अजभलेखों में रखी गईं और सुनवाई की तारीखों की आरओपी के माध्यम से जवचार-जवमिा दकया गया, उक्त आरओपी को कायावाही के दौरान संबंजधत पिों को जवतररत दकया गया। जनरीिण एिेंसी ESKAPS न े भी कायावाही के सभी पिों की उपजस्ट्िजत में इस जनणाायक प्राजधकारी के समि गवाही दी, उन्होंने प्रस्ट्ततु दकया दक पीसीएसओ नंबर HRHSK051023OPR28648OPR28648 ददनांक 05.10.2023 के जखलाि जवतरण योग्य सामजियों का 5 ददसंबर, 2023 को जनरीिण दकया गया िा, जिसमें 150 गांठें िी जिन्ह ें हररयाणा सरकार को भेिा िाना िा। इन 150 गांठों म ें स े 46 गांठें छेड़छाड़/टूटी हुई जनरीिण सील और जस्ट्टकर के साि पाई गईं, िबदक गांठें अभी भी जमल कंपनी की जनगरानी म ें िीं; छेड़छाड़ की गई गांठों के अंदर अलग-अलग िसल वष ा और अलग- अलग खेप के बैग पाए गए (05.12.2023 को जनरीिण के दौरान क्रमरजहत रूप स े खोली गई एव ं 3 गांठों स े छेड़छाड़ की गई) िो अस्ट्वीकाया िीं, और िसै ा दक संकेत ददया गया ह ैउन बोररयों को िब्त कर जलया गया िा और िब्त दकए गए नमून े बैगों को प्रदर्िात दकया गया िा सुनवाई के दौरान जनरीिण एिेंसी के बयानों की पुजष्ट हुई। जनरीिण एिेंसी के बयान को ररकॉडा म ेंरखा गया ह।ै आदेि:- कजित जमल कंपनी द्वारा ददए गए कारण बताओ नोरटस का अवलोकन दकया गया है, िब्त दकए गए साम्रगी और जनरीिण एिेंसी के साि-साि जवभाग के बयानों की पुजष्ट की गई है, कजित जमल कंपनी के जवरुध आरोप स्ट्िाजपत हो गए ह,ैं पटसन और पटसन वस्त्र जनयत्रं ण आदेि, 2016 का पालन करना होगा। इसजलए कानून के जनयमानुसार, पटसन और पटसन वस्त्र जनयंत्रण आदिे , 2016 के पैरािाि 8 (ए) को लागू करते हुए, मेससा ओजलसा ररयजलटी प्रा. जलजमटेड को इस आदेि की तारीख स े 3 महीन े तक संभाजवत आधार पर पीसीएसओ प्रदान करन े से रोक ददया गया ह।ै यह स्ट्पष्ट दकया िाता ह ै दक, मेससा ओजलसा ररयजलटी प्राइवेट जलजमटेड को प्राप्त सभी आदेि, िो इस आदेि के पाररत होने के समय जमल कंपनी द्वारा अभी तक प्रेजषत नहीं दकए गए ह,ैं उन्ह ें उजचत समय म ें पूरा करना होगा, अन्यिा अलग स े कायावाही होगी; यह आग े स्ट्पष्ट दकया िाता ह ै दक, इस जविेष मामले में जनपटाए गए िो सामान दोषपूणा पाए िाते हैं, उन्ह ें इस आदेि की प्राजप्त की तारीख से एक पखवाड़े के भीतर कंपनी की लागत पर बदला िाना ह।ै पटसन और पटसन वस्त्र जनयंत्रण आदेि, 2016 के पैरािाि 10 के अनुसार, जमल कंपनी को, यदद असहमत ह,ै उजचत िोरम के समि अपील दायर करन े की स्ट्वतंत्रता दी गई ह।ै मामला जनस्ट्ताररत हो गया OF TEXTILES (Office of the Jute Commissioner) ORDER Kolkata, the 27th August, 2024 S.O. 3636(E).—The allegations levelled against the alleged mill company i.e. Olisa Reality Pvt. Ltd. vide show cause letter No. Jute(T)-6/1/397/23-I(E) dated 15th December, 2023, has been heard on successive occasions, the final date of hearing being 1st April, 2024, wherein the hearing stood concluded, the matter was reserved for passing order. BACKGROUND:- Vide PCSO being numbered HRHSKO510230PR28648 dated 5th October, 2023, the alleged mill company was given bulk orders for supply of B-Twill Jute Bags for supply to the State Government of Haryana. In terms with statutory provisions, an inspection was held at the alleged mill premises on 5th & 6th December 2023, in presence of the Mill’s representatives’, inspection agency i.e. M/s Eskaps and officials from the Office of Jute Commissioner. The said inspection revealed following anomalies:- “The inspection team opened 3 bales out of 46 disputed bales in presence of mill representative & M/s Eskaps India Pvt. Ltd and following observations have been made- Sl. Bale No. Observations No. 1 0038 i. Found unbranded B-Twill bags having two red identification marks. 2 0068 i. Type-A unbranded B-Twill bags have been found. ii. B-Twill bags of Govt. of Punjab having single Blue / Red & Black identification marks have been found. iii. B-Twill bags of Govt. of UP, MP, Uttrakhand & Haryana having single Blue identification marks have been found. iv. B-Twill bags of Govt. of Chhattisgarh having single Blue / Red identification marks have been found. v. B-Twill bags of Govt. of West Bengal having single Blue & Black identification marks have been found. vi. Found unbranded B-Twill bags having two Red / Blue & Black identification marks. vii. B-Twill bags of having two Red identification marks have been found with printing of Ambica & Manufactured in India. viii. B-Twill bags of having two Red identification marks have been found with branding of Govt of Haryana (Mill Name – Ludlow) 3 0057 i. B-Twill bags of Govt. of West Bengal, Punjab & Haryana having single Blue identification marks have been found. The team has collected the 8 B-Twill Bags [Two (02) unbranded bags having two red and single Blue identification marks and one (01) Type-A, three (03) branded bags having single blue identification marks of Govt of Punjab, MP and CG, one (01) bag having branding of Govt of Haryana (Mill Name–Ludlow) and one (01) bag printing of Ambica & Manufactured in India] form the 3 above mentioned opened disputed bales as sample along with the signature of mill representative. The 3 disputed bales, which were opened, were repacked and sealed (Seal No. 4287601 to 4287606) in presence of the mill representative. Further, the representative from O/o the Jute Commissioner had seized the 150 bales of Govt. of Haryana (HSWC) under PSCO No. HRHSK051023OPR28648 dated 05.10.2023 as per the provision in Jute and Jute Textiles Control Order, 2016. The seized bales were handed over/ Zimma to Shri Sitaram Ganguli, Manager Finishing & SQC of M/s Olisa Reality Pvt. Ltd. The mill company has been advised to keep the seized bales segregated in safe custody and not to use/shift/delivered except under force majeure conditions (which should be immediately informed to the O/o the Jute Commissioner) until further instructions received from office of the Jute Commissioner.” Accordingly, a show cause notice was served on the alleged mill company vide letter No Jute(T)-6/1/397/23-I(E) dated 15th December, 2023, reply thereto was received on 19th December, 2023 vide letter No. Nil. The seized jute bags depicting anomalies were kept as exhibits during the course of hearing, the said bags were used as evidence against the alleged mill company, by the department at the time of hearing, in presence of parties’ to the proceedings.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 The stand taken by the representatives from the department, quoting from the reply to show cause received from the alleged mill company, that the mill authority has admitted the guilt and the onus was thrashed upon employees. On the other hand the representative from the alleged mill company denied the point of admission being levelled by the department against them, they categorically emphasized that department has failed to interpret the reply against the show cause given by them. They pointed out that, few B-Twill bags long back were taken from different mills of different crop years, only to check the quality in a competitive market, it is by sheer negligence of few employees that the bags got mixed up with the inspecting lot, there is neither any mens rea nor any attempt as such to perpetrate unfair practice, i.e. amongst huge bulk supply, only few bags if are found to be not in order in no way discloses any mala fide intention of the alleged mill company, since the malpractice as alleged, will reap miniscule benefit which is not called for. The representatives from the alleged mill company during the course of hearing however admitted that there is negligence on their part but that negligence should not take away the right of them to business, which is practically benefiting thousands of workers by giving them their livelihood. The department prayed for debarment of PCSO on the alleged mill company and the alleged Mill company prayed for, dismissal of the complaint considering their reputation and unintentional negligence. All the submissions were kept on record and deliberated through ROP of hearing dates, the said ROP (s) were circulated to the parties‘ to the proceedings in course . The inspection agency ESKAPS also deposed before this adjudicating authority in presence of all the parties’ to the proceedings, they submitted that amongst the deliverable material against PCSO No. HRHSK051023OPR28648 dated 05.10.2023 inspection was conducted on 5th December, 2023, in which there were a lot of 150 bales about to be dispatched to Govt. of Haryana. Out of these 150 bales, 46 bales were found with tampered/ broken inspection seals and stickers while the bales were still in the custody of the mill company; bags of different crop year and of different consignees were found inside the tampered bales (3 tampered bales opened at random during inspection on 05.12.2023) which were unacceptable, and those bags as has been indicated were seized and sample seized bags were exhibited in course of hearing which corroborated the statements of the inspection agency. The deposition of Inspection Agency has been kept on record. ORDER:- The reply to the show cause given by the alleged mill company has been perused, the seized goods and the statements of the inspection agency, as well as the department, has been corroborated, the allegations against the alleged mill company stands established, the provisions of the Jute & Jute Textile Control Order, 2016, has to be followed. Therefore, in strict terms of the statute and invoking paragraph 8 (a) of the Jute & Jute Textiles Control Order, 2016, M/s Olisa Reality Pvt. Ltd. is debarred from being granted with PCSO on prospective basis from the date of this order to 3 months. It is made clear that, all the orders received by the M/s Olisa Reality Pvt. Ltd., which are yet to be dispatched by the mill company at the time of passing of this order, has to be fulfilled by them in proper time, else separate proceedings will follow; it is further made clear that, the goods which are found to be defective, dealt in this particular case, are to be replaced at the cost of the company within a fortnight from the date of receipt of this order. Liberty is given to the mill company, if aggrieved, to file appeal before appropriate forum in terms with paragraph 10 of the Jute & Jute Textiles Control Order, 2016. The matter is disposed. Let this order be circulated forthwith, to all necessary parties’. [F.
