Parliament Question: Compliance with NGT Orders on Industrial Pollution

SHRI PATEL UMESHBHAI BABUBHAI: Will the Minister of ENVIRONMENT, FOREST AND CLIMATE CHANGE be pleased to state: (a) whether any orders have been passed by the National Green Tribunal (NGT) and other courts since the year 2000 regarding pollution in the Bilkhadi, Damanganga and Kolak river and coastal areas caused by chemical and pharmaceutical industries operating in the industrial areas of Valsad district including Vapi in Gujarat, if so, the details thereof, year-wise, case numbers, dates of orders and current status of compliance thereof; (b) whether it is a fact that in the year 2019, the NGT passed a restoration order for the Vapi-Daman region, if so, the details of the major findings, objectives, responsible agencies and actions taken so far for compliance; (c) the number of new chemical/pharmaceutical industries granted Environmental Clearance (EC/CTE/CTO) in the Vapi industrial area after the said orders from 2019 to date along with the production capacity, product category and classification (Red/Orange category) of each unit; and (d) whether the area has been classified as a Critically Polluted Area, if so, the details of specific restrictions/stringency or special conditions added to new clearances to ensure compliance with judicial orders? ANSWER MINISTER OF STATE IN THE MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE (SHRI KIRTI VARDHAN SINGH) (a) to (d): There are ongoing litigations regarding the pollution of mentioned rivers by industrial pollution of Vapi-Valsad region of Gujarat. In one of the matter, Original Application No. 95 of 2018 (PB), New Delhi titled as Aryavart Foundation v/s M/s Vapi Green Enviro Ltd. (CETP Vapi) was filed before Hon’ble NGT, pertaining to discharge of untreated/partially treated trade effluent by more than 500 industrial units of Vapi industrial cluster into River Damanganga which meets the Arabian Sea at Daman; pollution in River Damanganga; and non-compliances of discharge standards by industries & CETP, Vapi. Vide order dated 11.01.2019, a five-member committee comprising of CPCB, IIM-Ahmedabad, IIT- Gandhinagar, NEERI-Nagpur & GPCB was constituted to assess the extent of damage and cost ofrestoration of the environment, individual accountability and liability of CETP and polluting industries. Subsequently, the Hon’ble NGT, vide order dated 28.08.2019, imposed environmental compensation of ₹117.72 crore (₹92.36 crore on the CETP and ₹25.36 crore on individual industries). The said order was challenged before the Hon’ble Supreme Court in Civil Appeal No. 9398/2019 (M/s Vapi Green Enviro Limited vs. Aryavart Foundation & Ors.), wherein a stay has been granted, and the matter is presently sub judice. The Hon'ble NGT in OA 673 of 2018 vide its order dated 20.09.2018 inter alia directed that – i) All States and Union Territories are directed to prepare action plans within two months for bringing all the polluted river stretches to be fit at least for bathing purposes (i.e BOD ˂ 3 mg/L and FC ˂ 500 MPN/100 ml) within six months from the date of finalisation of the action plans. ii) The action plans may be prepared by four-member Committee comprising, Director, Environment, Director, Urban Development., Director, Industries, Member Secretary, State Pollution Control Board of concerned State. This Committee will also be the Monitoring Committee for execution of the action plan. The Committee may be called ‘’River Rejuvenation Committee’’ (RRC). The RRC will function under the overall supervision and coordination of Principal Secretary, Environment of the concerned State/Union Territory. In compliance to the aforesaid directions passed by the Hon'ble NGT, Govt. of Gujarat and Daman - Diu constituted RRC. Action plans were prepared for improving water quality of polluted river stretches (PRS-2018 data). Progress of implementation of action plans is reviewed by the RRC’s at State Level and by Central Monitoring Committee (CMC) constituted under the Chairmanship of the Secretary, Ministry of Jal Shakti at Central Level. CMC reviews the progress of execution of action plans for rejuvenation of polluted river stretches. MoEFCC has granted Environmental Clearance (EC) to 82 project proposals in Vapi industrial area, Gujarat from 2019 till date. The details are enclosed as Annexure I. Further, the Consent to Establish/Consent to Operate (CTE/CTO) is granted by respective State Pollution Control Boards/Pollution Control Committee (SPCBs/PCCs) as per the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The Vapi Industrial Area was identified as a Critically Polluted Area (CPA) based on monitoring carried out by CPCB in 2018. Subsequently, MoEFCC formulated the “Mechanism for Environmental Management of Critically and Severely Polluted Areas and consideration of activities/projects in such areas” vide letter dated 25.10.2019 which is shared with State/UT Governments for implementation.
