Parliament Question: Delayed payments from Government and PSUs

GOVERNMENT OF INDIA MINISTRY OF MICRO, SMALL AND MEDIUM ENTERPRISES RAJYA SABHA UNSTARRED QUESTION NO. 4088 TO BE ANSWERED ON 30.03.2026 DELAYED PAYMENTS FROM GOVERNMENT AND PSUs 4088. SHRI RAGHAV CHADHA: Will the Minister of MICRO, SMALL AND MEDIUM ENTERPRISES be pleased to state: (a) whether payments to Micro, Small and Medium Enterprises (MSMEs) by Central Ministries, Departments, Central Public Sector Enterprises (CPSEs) and State PSUs are being made within the 45-day mandate under the MSMED Act, 2006 and if not, the details thereof; (b) the total outstanding dues payable to MSMEs by Government entities and PSUs as on date, Ministry-wise and State-wise; (c) the number of payment cases pending beyond 45 days during the last five years, year-wise; and (d) whether any penal interest has been imposed and recovered from defaulting entities and if so, the details thereof? ANSWER MINISTER OF STATE FOR MICRO, SMALL AND MEDIUM ENTERPRISES (SUSHRI SHOBHA KARANDLAJE) (a) and (b): As per Section 15 of the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006 payment to the MSEs is to be made within 45 days. Under the provisions of the MSMED Act, 2006, Micro & Small Enterprises Facilitation Councils (MSEFCs) have been set up in the States/UTs to deal with cases of delayed payments of the Micro and Small Enterprises (MSEs). The cumulative dues reported by Central Public Sector Enterprises (CPSEs) towards MSMEs on the Samadhaan portal till February 2026 are Rs. 21,137.88 crore, of which Rs. 18,731.45 crore has been reported as paid by the CPSEs, resulting in total pending dues of Rs. 2,406.46 crore. The details of dues reported by CPSEs, Ministry -wise, on Samadhaan portal till February, 2026 are given at Annexure. MSEFC undertakes conciliation and, where required, arbitration for settlement of such disputes. As per Section 17 of the MSMED Act, the buyer is liable to pay the amount due to the supplier along with interest as provided under the Act. Further, as per Section 16, where the buyer fails to make payment within the period specified under Section 15, the buyer is liable to pay compound interest with monthly rests on the amount due at a rate equal to three times the bank rate notified by the Reserve Bank of India. Accordingly, MSEFC, while deciding the cases, passes awards directing payment of the principal amount along with interest calculated as per the statutory provisions of the MSMED Act, based on the applicable bank rate, thereby ensuring protection of the financial interests of the aggrieved MSEs. *****Annexure Annexure referred to in reply to part (a) & (b) of Rajya Sabha Unstarred Question No. 4088 for answer on 30.03.2026.
