Parliament Question: Implementation of Forest Rights Act, 2006

GOVERNMENT OF INDIA MINISTRY OF TRIBAL AFFAIRS LOK SABHA UNSTARRED QUESTION NO- ✝710 TO BE ANSWERED ON- 23/07/2026 IMPLEMENTATION OF FOREST RIGHTS ACT, 2006 ✝710. SHRI DARSHAN SINGH CHOUDHARY: Will the Minister of TRIBAL AFFAIRS be pleased to state: (a) whether the large number of eligible tribal families across the country have not yet received the benefits of land leases under the Forest Rights Act (FRA), 2006 and the other prevailing provisions and if so, the details thereof, State-wise; (b) whether coordination is being maintained by the Government with the States to provide land leases to eligible tribal families under individual and community forest rights in a time- bound manner and for the early disposal of pending claims and if so, the details thereof; (c) the details of the claims received, land leases distribution approved, cases pending and claims rejected during the last three years, State-wise; (d) whether the Government is implementing any coordinated action plan to link eligible tribal families with irrigation, housing, agriculture, livelihood and other development schemes after they receive land leases; and (e) if so, the details thereof? ANSWER MINISTER OF STATE FOR TRIBAL AFFAIRS (SHRI DURGA DAS UIKEY) (a) to (c): The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 recognizes the different usufruct rights of the Forest Dwelling Tribal Communities and Other Traditional Forest Dwellers to forest resources, on which these communities were dependent for a variety of needs, including livelihood, habitation and other socio-cultural needs. Upon determination of eligibility under the provisions of the Act, eligible individuals are granted heritable forest rights. However, such rights are neither alienable nor transferable. The State Governments are responsible for implementation of various provisions of the Act. As per the latest information reported by the States and collated under MPR as on 30.06.2026, a total of 25,42,359 Titles have been distributed comprising 24,18,197 Individual Forest Rights (IFR) Titles and 1,24,162 Community Forest Rights (CFR) Titles. A statement showing state wise details of titles distributed under FRA as on 30.06.2026 is at Annexure. During the last three years i.e. from 30.06.2023 to 30.06.2026, a total of 8,46,958 claims have been filed, a total of 2,30,318 Claims have been approved (Titles Distributed), 11,671 claims have been rejected and a total of 6,04,969 claims are pending for decision.Further, the details of number of claims (individual and community) received, the number of claims approved (Title distributed), Claims rejected, Claims disposed off during the last three years, month- wise and State/UT-wise are available at this Ministry’s website- on FRA- MPR- https://tribal.nic.in/FRA.aspx. The Ministry of Tribal Affairs, being the Nodal Ministry for administering the legislative matters of FRA, exhorts all State Governments to abide by the provisions contained in FRA and ensure that all eligible claimants are provided the rights which are due to them. (d) & (e): As stipulated in Rule 16 of FRA, the State Government has to ensure through its departments that all government schemes, including those relating to land improvement, land productivity, basic amenities and other livelihood measures, are provided to such claimants and communities whose rights have been recognized and vested under the FRA. Further, the Ministry of Tribal Affairs provides financial support to State Governments under the Dharti Aaba Janjatiya Gram Utkarsh Abhiyan (DA-JGUA) for strengthening Gram Sabhas and Community Forest Resource Management Committees. Additionally, FRA patta holders are supported through convergence with schemes of the Department of Agriculture, Animal Husbandry and Fisheries, wherein beneficiary contribution has been limited to 10%, wherever required, to facilitate greater uptake. Further, eligible FRA title holders are covered under the PM-KISAN scheme implemented by the Department of Agriculture & Farmers Welfare.
