3781. SHRI SANJAY RAUT:

Will the Minister of ROAD TRANSPORT AND HIGHWAYS be pleased to state:

(a) whether Government will place in the public domain, all concession agreements executed with private toll operators, including project cost, concession period, traffic projections, rate escalation formula, revenue-sharing terms and penalty clauses;

(b) the project-wise details of cumulative toll collected vis-à-vis sanctioned project cost and approved return and whether any toll plazas continue to collect toll beyond recovery of cost and agreed returns;

(c) the number of contract renegotiations undertaken during the last five years and their financial implications; and

(d) whether independent audits of toll collections have been conducted and if so, whether such audit reports will be made public? ANSWER THE MINISTER OF ROAD TRANSPORT AND HIGHWAYS (SHRI NITIN JAIRAM GADKARI)

(a) The Government has taken several measures to promote transparency in Public-Private Partnership (PPP) projects. Concession Agreements executed with private concessionaires for development, operation and maintenance of National Highway projects are contractual documents between the Authority and the Concessionaire. Standard concession documents, including the Model Concession Agreement (MCA), are placed in the public domain. In addition, key project- related information is made available through platforms such as the NHAI/ Ministry’s website, annual reports. Wherever feasible and in accordance with applicable policies and legal provisions, relevant information is proactively disclosed.

(b) Collection of user fee at fee plazas on National Highways is not related to the recovery of project development cost. The fee in accordance with the applicable National Highways Fee Rules is collected by the concessionaire till the end of the concession period, and after the concession period is over, the fee is collected on behalf of the Central Government as per the fee specified under the provisions of NH Fee Rules, 2008 on the date of transfer of such section of the National Highway, bridge, tunnel or bypass, as the case may be, to be revised annually. The Page 1 of 54revenue collected by the Central Government from user fee collection is deposited in Consolidated Fund of India (CFI) and the fund provided through budgetary allocation are utilised for further maintenance, development and augmentation of National Highways. In Build-Operate- Transfer (BOT/)Toll-Operate-Transfer (TOT)/Infrastructure Investment Trust (InvIT), the collection of user fee is assigned to the Concessionaire for the specific period of the concession.

The details of project wise Capital Cost Investment is at Annexure A. Further, Fee plaza wise user fee revenue collected are at Annexure B.

(c) There is no provision for contract renegotiation under the standard Request for Proposal (RFP) adopted for awarding works. Contracts for highway development projects are awarded based on the lowest bid submitted by responsive bidders, while contracts for tolling operations are awarded based on the highest remittance offered by participating bidders. The award of work and signing of the contract agreement are carried out in accordance with the standard Request For Proposal

(RFP) and Draft concession Agreement (DCA) approved by the Government with only project- specific modifications incorporated wherever applicable.

(d) User-fee at a fee plaza is levied in accordance with the NH Fee rules and respective Concession Agreement and the revenue collected is deposited in the Consolidated Fund of India in case of public funded toll plaza. Regular audit of user fee plazas are conducted by the Comptroller & Auditor General (C&AG) including user fee plazas operated by concessionaire.

These reports are laid by C&AG on the table of the two Houses of Parliament.
