THE LEGAL METROLOGY ACT, 2009.
No. GTH/2026/14/FCSCAD/GAT/e-file/5/2025/0638/D : The following draft of a rules farming The Gujarat Legal Metrology (Government Approved Test Centre) Rules, 2026, which is proposed to be issued after consultation with the Central Government, under sub section (1) read with clause (d) and (e) of sub-section (2) of section 53 of the Legal Metrology Act, 2009 (1 of 2010), is hereby published as required by sub-section (4) of section 53 of the said Act, inviting objections and suggestions from all persons likely to be affected thereby and notice is hereby given that the said draft of rules will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of its publication in Official Gazette.
Any objection or suggestion which may be received by the Principal Secretary to the Government of Gujarat, Food, Civil Supplies, and Consumer Affairs Department, Sachivalaya, Gandhinagar from any person with respect to the said draft on or before the expiry date of the expiry of the aforesaid period will be considered by the Government.

No: GTH/2026/14/ FCSCAD/GAT/e-file/5/2025/0638/D : In exercise of the of the powers conferred by sub section (1) of section 53 read with clause (d) and (e) of sub-section (2) of section 53 of the Legal Metrology Act, 2009 (1 of 2010), and after consultation with the Government of India, the Government of Gujarat hereby makes the following rules further to frame the Gujarat Legal Metrology (Enforcement) Rules, 2011, namely: -
CHAPTER-I PRELIMINARY
1. Short title and commencement.– (1) These rules may be called the Gujarat Legal Metrology (Government Approved Test Centre) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definition.- (1) In these rules, unless the context otherwise requires,-
(a) “Act” means the Legal Metrology Act, 2009 (1 of 2010);
(b) “Certificate” means certificate of approval issued to Government approved Test Centre by Controller, Legal Metrology;
(c) "Competent Authority" means Controller, Legal Metrology Department, Government of Gujarat;
(d) “Controller” means the officer appointed as a Controller under section 14 of the Act;
(e) “Government” means the Government of Gujarat;
(f) “Government Approved Test Centre” means a test centre, which has been approved by Controller to undertake verification of weights or measures used in intra state trade and commerce specified in these rules;
(g) “Principal Officer” means the officer who is in-charge of the Government Approved Test Centre;
(h) “Schedule” means Schedule appended to these rules.
(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning as respectively assigned to them in the Act.
CHAPTER-II VERIFICATION OF WEIGHTS AND MEASURES IN GOVERNMENT APPROVED TEST CENTRE.
3. Verification by Government Approved Test Centre.- (1) The weights and measures specified in the Schedule I shall be verified by the Government Approved Test Centre.
(2) Any person can apply for verification of one or more kinds of weights and measures.
(3) Separate application shall be submitted for each weight or measure.
CHAPTER-III APPROVAL OF GOVERNMENT APPROVED TEST CENTRE
4. General provisions relating to Government Approved Test Centre.- (1) The list of recognized Government Approved Test Centre shall be notified by the Government from time to time.
(2) A Government Approved Test Centre recognized under these rules shall carry out verification of weights or measures as specified in these rules and according to the specification given in the Legal Metrology (General) Rules, 2011 and as per recommendations of International Organization of Legal Metrology, as the case may be, as advised by Controller, Legal Metrology, from time to time.
(3) Government Approved Test Centre shall maintain Standard Weights or Measures as specified in the Legal Metrology (General) Rules, 2011 and other instruments and equipments as advised by the Controller, Legal Metrology.PART IV-A ] GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 138-3
5. Recognition of Government Approved Test Centre.- (1) Any person desirous of obtaining recognition under these rules for carrying out verification of weights or measures specified herein shall submit an application to the Controller, Legal Metrology Department in the form specified in the Schedule II.
(2) The application shall be made only by the Principal Officer.
(3) While making recommendation for approval of a Government Approved Test Centre, the Controller, Legal
Metrology Department shall consider the following:-
(a) Availability and accessibility of land and building granted for Non-Residential purpose (Minimum 50 Sq.mtr)
(b) Adequacy of measuring equipments, testing facilities and other infrastructure;
(c) Availability of technically qualified man power;
(d) Capacity for efficient and timely service to customers;
(e) Shall get standard equipment periodically verified by secondary standard laboratory or prescribed by Controller, Legal Metrology;
(f) Shall get trained its employees in institution nominated by Director, Legal Metrology, New Delhi;
(g) No criminal Case shall be pending against the principal officer or any other employees as well as on laboratory/firm applying for Government approved test centre.
(h) Any other factor, which in the opinion of Controller, Legal Metrology will affect proper functioning of Government Approved Test Centre.
(i) Conditions to Set up,-
(i) Only weight or measure as per The Legal Metrology ( General) Rules – 2011 shall be verified by Government Approved Test Centre.
(ii) Government Approved Test Centre shall verify the weights and measures which are submitted with
requisite fee of verification with an application indicate therein:-
(A) Name and Full address of manufacturer or importer or dealer or user;
(B) Location of the factory or premises in which such weight or measure is manufactured or imported or inteded to be used;
(C) Maximum and Minimum Capacity, ‘e’ or ‘d’ value, accuracy class of weight or measure to be verified or whichever specifications applicable to weight or measure to be verified.
(iii) after verification, Government Approved Test Centre shall issue the certificate of verification.
(iv) the certificate of verification shall remain valid for a period as specified in the Legal Metrology
(General) Rules, 2011 and shall be renewed for such period on payment of prescribed fees and after reverification of such weights and measures.
(j) Qualifications,- The qualification of the principal officer or any of the employees of the Government Approved Test Centre shall be equivalent to the qualification as specified in the Legal Metrology (General Rules), 2011 for a Legal Metrology Officer
(k) Experience of Principal Officer,- The Principal Officer or any of the employees of the Government Approved Test Centre shall have working experience of at least ten years in the field of weight and measures.
(4) The Controller or officers authorised by him, shall inspect the premises of the test centre prior to making any recommendation for its approval, including the specification of its area of operation.
(5) The Controller, Legal Metrology shall be the Competent Authority to approve the Government Approved Test Centre who shall give such approval on recommendation of authorised Legal Metrology Officer after inspection of premises of Government approved Test centre.
(6) The Competent Authority shall grant approval under sub-rule (5), for one year and there after the same shall be renewed for a period of one year.138-4 GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 [ PART IV-A
(7) The Controller, Legal Metrology will issue a specific code number to each Government Approved Test Centre for easy identification and records.
(8) In case of non-fulfilling of eligibility conditions, the Controller, Legal Metrology shall reject the application and send a written communication to the applicant.
(9) Any person aggrieved by orders under sub-rule (8) may appeal to the Deputy Secretary, Food, Civil Supplies and Consumer Affairs within 30 days , whose decision shall be final.
(10) Certificate of approval granted to any Government Approved Test Centre may be suspended by Controller,
Legal Metrology if it fails to comply with any terms or conditions specified in these rules:
Provided that no such suspension shall be made except after giving to the Government
Approved Test Centre an opportunity of showing cause against the proposed action:
Provided further that the suspension shall be revoked on compliance of terms and conditions.
(11) The Controller or his Authorized Officer may visit and inspect the Government Approved Test Centre as and when required and the Principal Officer shall permit inspections and render all assistance for the purpose including the production of records with regard to verification of weights and measures.
(12) The Principal Officer shall submit a monthly report to the Controller, Legal Metrology with respect of the weights and measures verified by them, the fee collected, time taken for each testing and such other relevant information, as required.
(13) The Principal Officer, while verifying the weights and measures shall adopt the procedure laid down in the Legal Metrology (General) Rules, 2011.
(14) The certificate of approval granted may be cancelled by the Controller, Legal Metrology on the recommendation of the Authorized Officer if the circumstances are such that it cannot be reasonably expected
to function properly as a Government Approved Test Centre:
Provided that no certificate of recognition shall be cancelled except after giving an opportunity of being heard.
(15) Where the certificate of approval has been granted under sub-rule (5) or suspended under sub-rule (10) or cancelled under sub-rule (14), the Controller of Legal Metrology shall ensure that the information of such action has been given to the concerned Legal Metrology Officers of its area of operation.
(16) The Competent Authority may require Government Approved Test Centre to take out third party liability insurance sufficient to cover any claim for damage due to any lapses or violation of government instructions by such Government approved Test Centre.
(17) (a) All the Regional Reference Standard Laboratories functioning under the administrative control of the Department of Consumer Affairs shall be deemed to be Government Approved Test Centres and the provisions of these rules shall apply to such laboratories, as if they were Government Approved Test Centre.
(b) Such laboratories specified in clause (a) verify the weights and measures specified under the Legal Metrology (General) Rules, 2011 or as per the recommendations of the International Organization of Legal Metrology, at any location within India.
(18) The National Accreditation Board for Testing and Calibration Laboratories/ISO:IEC 17025:2017 accredited laboratories for calibration of weights and measures which are in conformity with the conditions specified in sub-rule (3) of rule 5 shall be eligible to be notified as Government Approved Test Centre subject to compliance of the provision of the Act and rules made there under;
(19) (a) The laboratories of National Test House functioning under the administrative control of the Department of Consumer Affairs shall be deemed to be Government Approved Test Centres.
(b) Such laboratories specified in clause (a) verify the weight and measures specified under the Legal Metrology (General) Rules, 2011 or as per the recommendations of the International Organization of Legal Metrology, at any location within India.PART IV-A ] GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 138-5
CHAPTER IV CERTIFICATE OF GOVERNMENT APPROVED TEST CENTRE
6. Duties of the Principal Officer and Government Approved Test Centre.-
(1) The Principal Officer of the test centre has the following responsibilities, namely:-
(a) to establish and operate the test centre as an independent unit;
(b) to ensure that the staff of the test centre carry out their duties independently;
(c) to inform the Controller, Legal Metrology of cessation of operation of test centre;
(d) to maintain the accuracy of testing equipment as per rules and directions issued from time to time;
(e) to maintain proper record of testing and certificates issued by Government Approved Test Centre;
(f) to record and redress grievances of customers in appropriate manner;
(g) to abide by the directions issued by Director OR Controller, Legal Metrology from time to time;
(h) to ensure that only weights or measures conforming to specification are stamped;
(i) to ensure that stamps which are verified are adequately protected against fraudulent use;
(j) to make sure that the weights and measures received for verification and stamping should be returned by Government Approved Test Centre after due verification (within fifteen days).
7. Fee for verification or re-verification. - (1) The fee to be collected by State Government Approved Test Centre for verification or reverification of weights and measures shall be the same as specified in The Gujarat Legal Metrology (Enforcement) Rules- 2011;
Provided that for the weights and measures of which the verification fees are not specified in the Gujarat Legal Metrology (Enforcement) Rules 2011, the fees prescribed in the Central Government Approved Test Centre rules shall be applicable.
(2) Any weight or measure rejected on verification shall be returned to the user for necessary repair and after repair the weight or measure maybe accepted for verification on payment of verification fee afresh.
8. Verification and Stamping. - (1) The Government Approved Test Centre after carrying out metrological evaluation of weights or measures and on being satisfied that the same conforms to specification laid down under the Act and Rules made thereunder shall stamp the same and also issue a certificate of verification as mentioned in Schedule IV.
(2) A certificate of verification shall also be issued by the test centre as a proof of verification.
(3) The verification certificate shall be issued through online portal of State Government only.
(4) The State Government Approved Test Centre shall not verify any weight or measure whose validity period of verification is lapsed and shall report such particulars of weight or measure to the concerned Legal Metrology Officer immediately.
(5) The State Government Approved Test Centre shall not verify any Non-standard weight or measure, namely any weight or measure which does not conform to the specifications, tolerances, etc as prescribed in The Legal Metrology (General) Rules, 2011.
(6) The Certificate of Verification issued by State Government Approved Test Centre shall remain valid for a period as specified in the Legal Metrology (General) Rules 2011 and shall be renewed for such period on payment of prescribed fee.
(7) The State Government Approved Test Centre shall not verify any weight or measure other than those, they are entitled.
(8) The Government Approved Test Centre shall also mark the year and its quarter of stamping on every verified weight or measure.
(9) The State Government Approved Test Centre shall procure the required Stamps from the Central Government Mint, Mumbai and get it approved from the Controller, Legal Metrology.138-6 GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 [ PART IV-A
9. Inspection of records.- Every Government Approved Test Centre shall keep and retain records for five calendar year from date of evaluation of weights or measures carried out by them. These records shall be produced by the test centre before the Controller, Legal Metrology or any officer authorized by him, as and when directed.
10. Place of verification.- The Test Centre shall carry out verification of weights or measures either in its authorised premises or within the territorial limit of the district, and in any part of the State in which the Government Approved Test Centre is permitted to Operate by Controller, Legal Metrology.
11. Supervision of Government Approved Test Centre.- The Controller, Legal Metrology or any other Authorized Legal Metrology Officer (not below the rank of assistant controller, legal metrology) may visit the test centre from time to time to examine whether the Government Approved Test Centers are running as per procedures laid down and instructions issued by the Government.
12. Liability.- The Principal Officer responsible for the test centre shall be liable to the Government for any loss, damage or any legal claims. Any kind of loss or damage should be compensated from the security deposited by Government Approved Test Centre.
13. Contents of Government Approved Test Centre certificate.- (1) Every certificate of approval issued by the Government shall contain the following information,-
(a) the number of the certificate;
(b) name of weights and measures for which Government Approved Test Centre has been approved;
(c) the mark or code assigned to the Government Approved Test Centre;
(d) a brief statement about Government Approved Test Centre;
(e) the special conditions, if any;
(f) period for which Government Approved Test Centre is approved;
(g) category/class of verification of weight or measure;
(h) range for verification of weight or measure
(i) contact number for consumer redressal;
(j) the complete address of the Government Approved Test Centre;
(k) the name and contact details of principal officer .
(2) Where any weights or measures are intended for a special use, the certificate of approval in relation to such weight or measure shall indicate the special use.
14. Mark to Government Approved Test Centre.- The verification mark shall contain the following particulars,
namely:-
(i) The legend "GUJ" and the code number assigned to the test centre in the upper half of semi circle;
(ii) Code letter for the quarter of the year and two digits for the year in the lower half of semi circle as mentioned in the Gujarat Legal Metrology (Enforcement) Rules, 2011.
15. Revocation of certificate of Government Approved Test Centre.- (1) A certificate of Government Approved Test Centre may be revoked if the Controller, Legal Metrology is satisfied on the recommendation of the authorised officer that the Government Approved Test Centre, no longer complies with the provisions specified or specifically violates the directions given by Controller, Legal Metrology, from time to time:
Provided that no such certificate shall be revoked unless the holder of such certificate has been given an opportunity of showing cause against the proposed action.
(2) Where the certificate of Government Approved Test Centre has been revoked, the verification work shall be
stopped by that Government Approved Test Centre immediately:
Provided that where, on such inspection, it is found that the verification of any such weights or measures are being conducted, the Controller, Legal Metrology may by order, prohibit the use of such weight or measure and initiate other appropriate penal action.PART IV-A ] GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 138-7
16. Suspension of certificate of Government Approved Test Centre.- (1) A certificate of Government Approved Test Centre for verification of specified weights and measures may be suspended by the Controller, Legal Metrology in the event of the following omission or failure on the part of the holder of such certificate, namely:-
(i) to verify the weights or measures in accordance with and for which the certificate relates, or
(ii) carrying out verification of Weights and measures not confirming the rules or standards specified in the Act and rule made thereunder; or
(iii) has contravened any Law or any provisions of the Act or any rule or order made thereunder, or any instructions issued by the State Government or Central Government; or
(iv) Issued certificate of verification to weights and measures which had not or has not been duly tested; or
(v) not complying with the conditions specified in the certificate:
Provided that no such suspension shall be made except after giving to the holder of the certificate an opportunity of showing cause against the proposed action.
(2) Every person whose State Government Approved Test Centre certificate of approval has been suspended shall, immediately after such suspension, stop functioning as such State Government Approved Test Centre and shall not resume business as such Government Approved Test Centre until the order of such suspension has been, or stands, vacated.
(3) The Competent Authority or his authorised officer, if he is satisfied, after making such inquiry as he may think fit, after the suspension of Certificate, that the holder of a State Government Approved Test Centre certificate of approval has contravened any of the points referred in sub-rule (1) or fail to supply the omissions pointed out or fail to pay the specified compounding fee, may cancel such Approval.
Provided that no such State Government Approved Test Centre certificate of approval shall be cancelled unless the holder thereof has been given a reasonable opportunity.
(4) Every State Government Approved Test Centre whose approval has been suspended or cancellation shall, after such suspension or cancelation, as the case may be, surrender such State Government Approved Test Centre certificate of approval to the authority by which such approval was issued.
(5) If on inspection, it is found that after cancellation of Certificate of Approval, the verification of any weights and measures is conducted, the Competent Authority or his authorised officer may by order, prohibit the use of such weights and measures and initiate appropriate penal action.
(6) Where any certificate has been suspended under sub-rule (1), the order of suspension shall be vacated unless the omission or failure, for which such suspension was made, has been complied within 30 days of order passed and the sum for compounding the offence has been deposited to the Government in the same form as prescribed for applying the Government Approved Test Centre.
17. Renewal of Certificate.- (1) The approval granted to Government Approved Test Centre may be renewed subsequently by the Controller of Legal Metrology for a period as may be specified by the Controller of Legal Metrology not exceeding two years at a time subject to the satisfactory functioning of the centre and on payment of such fees as prescribed.
(2) An application as per Schedule III for the renewal of the certificate shall be submitted to the at least thirty days prior to the expiry of the validity period.
18. Fees for application – (1) Every application for issuance of or renewal of or alteration in the certificate of approval of GOVERNMENT APPROVED TEST CENTRE shall be accompanied by copy of challan of application and a non-refundable processing fee of Rs.10,000/- deposited through online system.
(2) The Controller shall grant the certificate of approval after satisfying that the applicant has fulfilled all the requirements under these rules on payment of a fee of Rs. 2,00,000/- for one calendar year through online system.
(3) The same amount of fees shall be payable at the time of renewal of recognition for a period of one year in
respect of each weight or measure:
Provided that, an additional fees at half the rates mentioned in sub rule (1) of rule 18 shall be payable by the applicant, if he is permitted by the Controller, Legal metrology to make an application for the renewal of approval certificate within a period of one month after the date of expiry of validity of certificate of approval.138-8 GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 [ PART IV-A
(4) Government Approved Test Centre shall submit security deposit of Rupees 25,00,000/- for State and Rupees 10,00,000/- for District in the form of Fixed Deposites in any Scheduled Nationlized Bank in favour to Controller, Legal Metrology Department for each weight or measure for which application has been submitted.
This deposite shall be pledged to Government of Gujarat.
(5) A fee of Rupees Five thousand shall be applicable for an application specified in schedule VI for an alteration in any condition in certificate issued to government approved test centre as per schedule V except weight or measure which are to be stamped and verified and validity of period.
19. Expenditure on assessment or re-assessment or inspection of Government Approved Test Centre during the calendar year.- An annual inspection fees of Ten Thousand Rupees shall be borne by Government Approved Test Centre as the expenditure for the assessment or re- assessment or compulsory yearly inspection of Government Approved Test Centre.
20. Compounding of offences.- Where any Government Approved Test Centre is found to have contravened the provisions of the Act, rules made thereunder, the offences may be compounded in accordance with the Gujarat Legal Metrology (Enforcement) Rules, 2011.

Conditions of Certificate:
1. Applicants shall offer their premises for initial assessment/ re-assessment/inspection for Controller, Legal Metrology or his authorised officers, as and when required.
2. Instruments at the GATC need to be calibrated with valid verification/ calibration certificates and accuracies/ uncertainties in line with laid down Legal Metrology (General) Rules 2011 or OIML Recommendations and failure to the same will lead to suspension of GATC and further action as per Rules.
3. Government Approved Test Centre shall take out third party liability insurance sufficient to cover any claim for damage due to any lapses or violation of government instructions by such Government Approved Test Centre.
4. Approval granted shall be displayed in a conspicuous place in the premises where the GATC perform the function.
5. Applicants shall surrender the approval certificate in the event of closure of business and/ or suspension/ revocation of GATC.
6. GATC's are required to maintain traceability of the weights and measures certified by them. This may be available in soft/ hard form at the GATC and corresponding entries available on the Legal Metrology portal.
7. Any and all equipment received for calibration needs to acknowledge by a document linked to the same with such document being available in the GATC premises and/ or LM Portal.
8. Each weight and measure is required to be marked for uniqueness of certification by the GATC verifying the same.
Photographic evidence/ video of the verification of the weight or measure is to be maintained at the GATC and Legal Metrology portal.
9. The GATC must make an application for the renewal of its approval well in advance, before the expiry of its validity.
10. Any change in the organisation or qualified persons, shall be reported immediately to the Controller, Legal Metrology.
11. The GATC approval issued or renewed shall neither be saleable, assignable nor transferable.
12. The Controller or such other Officer authorized by him in this behalf may, if he has any reasonable cause to believe that the GATC has made any statement in, or in relation to, any application for the issue, renewal or continuance of the approval, which is incorrect or false in any material particular or the person(s)/ firm has failed to comply any of the conditions of the approval or has contravened any provisions of the Legal Metrology Act or any Rule or order or guidelines or direction made thereunder, suspend the approval, pending the completion of any inquiry against the holder of the GATC.138-16 GUJARAT GOVERNMENT GAZETTE, EX., 23-09-2026 [ PART IV-A a. Provided that, no such approval shall be suspended unless the holder thereof has been given a reasonable opportunity of showing cause against the proposed action b. Provided further that, during the suspension of the GATC, no verification of the weighing or measuring instrument shall be performed by the said GAТС.
13. The Controller or such other Legal Metrology Officer authorized by him in this behalf may, if he is satisfied, after making such inquiry as he may think fit, that the GATC has failed to comply any provisions of the Legal Metrology Act or any Rule or order made thereunder, revoke the approval:
a. Provided that, no such approval shall be revoked unless the holder thereof has been given a reasonable opportunity of showing cause against the proposed action.
14. Every condition prescribed after the issue of approval shall, be binding on the person(s)/ GATC to whom the approval has been granted.
