NOTIFICATION Sachivalaya, Gandhinagar, 18th September, 2026 THE LEGAL METROLOGY ACT, 2009.
No. GTH/2026/13/FCSCAD/MSM/e-file/5/2025/1808/D:- The following draft of rules which is proposed to be issued after consultation with the Central Government, under sub-section (1) of section 53 of the Legal Metrology Act, 2009 (1 of 2010) as required to publish under sub-section (4) of section 53 of the said Act for inviting objections and suggestions from all persons likely to be affected thereby and notice is hereby given that, the said draft of rules will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of its publication in Official Gazette.
2. Any objection or suggestion which may be received by the Principal Secretary to the Government of Gujarat, Food, Civil Supplies, and Consumer Affairs Department, Sachivalaya, Gandhinagar from any person with respect to the said draft on or before the expiry of the aforesaid period will be considered by the Government.
DRAFT NOTIFICATION THE LEGAL METROLOGY ACT, 2009.
NO: GTH/2026/13/FCSCAD/MSM/e-file/5/2025/1808/D: - In exercise of the powers conferred by sub-section (1) of
section 53 of the Legal Metrology Act, 2009 (1 of 2010), the Government of Gujarat hereby makes the following rules further to amend the Gujarat Legal Metrology (Enforcement) Rules, 2011 (hereinafter referred to the said rule), namely:
1. (1) These rules may be called the Gujarat Legal Metrology (Enforcement) (2nd Amendment) Rules, 2026.
(2) They shall extend to the whole of the State of Gujarat.
(3) They shall come into force on the date of publication in the Official Gazette.
2. In the Gujarat Legal Metrology (Enforcement) rules, 2011, in rule 2 after clause (c) the following clause shall be inserted, namely: - ‘(ca) “improvement notice” means an improvement notice issued under the Act;’.” IV-A Ex.-137 137-1137-2 GUJARAT GOVERNMENT GAZETTE, EX., 22-09-2026 [ PART IV-A
3. In the said rules, for rule 11, the following rule shall be substituted, namely: -
11. Registration of manufacturer, repairer and dealer of Weights and Measures:
(1) Every manufacturer, repairer or dealer in weights or measures shall make an application for the issue of a registration certificate to the Controller of Legal Metrology or such other officer as may be authorized by him in this behalf, in the appropriate form as prescribed in Schedule II:
Provided that no registration certificate shall be required by a manufacturer for repairing a weight
or measure manufactured by him and used in a State other than the State of manufacture of the same:
Provided further that the manufacturer shall inform, in advance, the concerned Legal Metrology Officer about the repairing.
(2) Every registration certificate issued to a manufacturer, repairer or dealer shall be on the basis of self- declaration, without any inspection prior to the issue of the certificate, in the appropriate form as prescribed in Schedule III.
(3) The fee payable for a new registration certificate, or for alteration of or addition to any condition of a registration certificate, shall be as specified in Schedule IV, and an application shall be made in the form as prescribed in Schedule XII.
(4) The Controller or such other officer as may be authorized by him in this behalf shall maintain a register of certified manufacturers, dealers and repairers in the form as prescribed in Schedule V.
(5) Every new manufacturer, repairer or dealer certified under the Act and these rules shall maintain such workshop, equipment, tools, registers, etc., as the case may be, as per the terms and conditions of the Registration Certificate.
(6) Every registration certificate issued under this Act shall be displayed in a conspicuous place in the premises where the business is carried out.
(7) A registration certificate issued under this Act shall not be saleable, transferable or inheritable.
(8) The basic minimum requirements for technical personnel working with a certified manufacturer and repairer shall be as prescribed in Schedule VI.
(9) All certified manufacturers shall have tools and equipment in their production workshop as per TABLE F prescribed under Schedule VI.
(10) Every manufacturer, repairer or dealer shall comply with all rules and provisions applicable to every weight or measure under the Act and rules made thereunder.
5. In the said rules, in rule 12, the following shall be substituted namely: -
(i) For the title of rule 12 and for the sub-rule (1), the following shall be substituted, namely: - “12. Suspension and revocation of certificate granted:
(1) The Controller or such other officer authorized by him in this behalf may, if he has any reasonable cause to believe that the certified manufacturer, repairer or dealer has made any statement in, or in relation to, any application for the issue of the registration certificate which is incorrect or false in any material particular, or has contravened any provision of the Act or any rule or order made thereunder, suspend such registration certificate pending the completion of any inquiry against the certified manufacturer, repairer or dealer :
Provided that no such certificate shall be suspended unless the certified manufacturer, repairer or
dealer thereof has been given a reasonable opportunity of showing cause against the proposed action:
Provided further that where the inquiry referred to in this sub-rule is not completed within a period of three months from the date of suspension of a certificate, such suspension shall, on the expiry of the period aforesaid, stand vacated.”.
(ii) in sub-rules (2), (3), (4) and (5), for the words “license”, “licensee” and “cancel or cancellation”, wherever they occur, the words “Registration Certificate”, “person” and “revoke or revocation”, respectively, shall be substituted.PART IV-A ] GUJARAT GOVERNMENT GAZETTE, EX., 22-09-2026 137-3
6. In the said rules, in rule 13, for the word “license”, wherever it occurs, the words “Registration Certificate” shall be substituted.
7. In the said rules, in rule 24, for the words “five thousand rupees”, the words “one lakh rupees” shall be substituted.
8. In the said rules, after rule 24, the following rule 24 A shall be inserted, namely: - “24 A. Improvement Notice for Contravention of rules - An Improvement Notice shall be issued by the Controller or any other Legal Metrology Officer authorized by the controller in accordance with sub-section (6) of section 15 of the Act and shall be in the form prescribed in Schedule XV.
Where a person fails to comply with an Improvement Notice issued for non- compliance with the Act and the rules made thereunder, such person shall be served with compounding notice by the Controller or any other Legal Metrology Officer authorized by the him for compounding of the offence in accordance with rule 26 of the principal rules, and such notice shall be in the form prescribed in Schedule XVI.”.
9. In the said rules, in SCHEDULE – I, the following Serial Number shall be inserted, namely: - “Sr. No. Commodity Whether declaration to be expressed in terms of weight, Measure, or number or two or more of them.

CONDITIONS OF REGISTRATION CERTIFICATE
1. The person in whose favour this registration certificate is issued shall. -
(a) Comply with all the relevant provisions of the Act and Rules for the time being in force;
(b) Not encourage or countenance any infringement of the provisions of the Act or the Rules amended from time to time;
(c) Exhibit this registration certificate in some conspicuous part of the premises to which it relates;
(d) Comply with any general or special directions that may be given by the Controller of legal metrology;
(e) Cessation of the registration certificate in the event of closure of business and/ or cancellation of registration certificate;
(f) Present the weights, measures, weighing or measuring instruments manufactured and meant for use within the State, to the legal metrology officer for verification and stamping before sale.
(g) Shall be-having tools and equipment in their production workshop as prescribed.
2. Every condition prescribed after the issue of this registration certificate shall if notified in the Official Gazette, be binding on the persons to whom the registration certificate has been granted.

(a) comply with all the relevant provisions of the Act and rules for the time being in force;
(b) not encourage or countenance any infringement of the provisions of the Act or the rules, as amended from time to time;
(c) exhibit this registration certificate in a conspicuous part of the premises to which it relates;
(d) comply with any general or special directions that may be given by the Controller of Legal Metrology;
(e) cease to use the registration certificate in the event of closure of business and/ or cancellation of registration certificate;
(f) present the weights, measures, weighing or measuring instruments, as the case may be, duly repaired, to the Legal Metrology Officer for undertaking verification and stamping as specified in rule 14 before delivery to the user.
2. (b) not encourage or countenance any infringement of the provisions of the Act or the Rules amended from time to time;
(c) exhibit this registration certificate in a conspicuous part of the premises to which it relates;
(d) comply with any general or special directions that may be given by the Controller of legal metrology;
(e) cease to use the registration certificate in the event of closure of business and/ or cancellation of registration certificate;

2. Every condition prescribed after the issue of this registration certificate shall if notified in the Official Gazette, be binding on the persons to whom the registration certificate has been granted.

SCHEDULE VI (See rule 11(8)(9)) BASIC MINIMUM REQUIREMENTS FOR MANUFACTURER AND REPAIRER
(1) The workshop of the repairer/manufacturer shall not be situated in a residential premise.137-14 GUJARAT GOVERNMENT GAZETTE, EX., 22-09-2026 [ PART IV-A
(2) The workshop shall have a minimum area of 50 sq. m. and shall be preferably be located on the ground floor or in the basement. However, a workshop shall be permitted above ground floor if a lift is provided in the building and is in working condition.
(3) Minimum experience required:
The technical person required for a repairer and manufacturer to repair/manufacture electronic balances may be a diploma holder in Electronic / Electrical / Instrumentation Engineering from a Government recognized institute or hold a Government recognized ITI electronic / electrical / instrumentation trade certificate.
(4) All technical persons of the manufacturer or repairer shall be issued a photo ID by them, and their photographs shall also be affixed in the certificate itself. Only such authorised technical persons shall present the weights and measures to the concerned Legal Metrology Officer for verification and stamping.
(5) (a) The equipment and machineries required for repairing mechanical weighing instruments shall be as per Table A
(b) The equipment and machineries required for repairing electronic weighing instruments shall be as per Table B
(c) All repairers shall be required to keep loan sets as per Table C for repairing of mechanical weighing instruments.
(d) All repairers shall be required to keep loan sets as per Table D for repairing of electronic weighing instruments.
(e) All repairers shall be required to keep test weights and measures as per Table Е.
(f) All manufacturers shall be required to keep tools and accessories as per Table F in their production workshop.
