The following Act of the Gujarat Legislature, having been assented to by the Governor on the 23rd September, 2026 is hereby published for general information.

GUJARAT ACT NO. 13 OF 2026. (First published, after having received the assent of the Governor, in the “Gujarat Government Gazette”, on the 23rd September, 2026).

AN ACT further to amend certain enactments to enhance trust-based governance for ease of living and doing business.

It is hereby enacted in the Seventy-seventh Year of the Republic of India as follows:-

1. (1) This Act may be called the Gujarat Ease of Doing Business Act, 2026. Short title and commencement.

(2) It shall come into force on such date as the State Government may, by

notification in the Official Gazette, appoint.

2. The enactments mentioned in column (4) of the Schedule are hereby amended to the Amendment of certain enactments. extent and in the manner mentioned in column (5) thereof.

Savings. 3. (1) The amendment or repeal by this Act of any enactment shall not affect, –

(a) any other enactment in which the amended or repealed enactment has been applied, incorporated or referred to; or

(b) the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired, accrued or incurred or any remedy or proceeding in respect thereof, or any release or discharge of, or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing; or

(c) any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed, or recognised or derived by, in or from any enactment hereby amended or repealed.

(2) The amendment or repeal by this Act of any enactment shall not revive or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not now existing or in force.

(1) (2) (3) (4) (5) Services) Act, 2013. “(2) The Grievance Redressal Officer shall ensure that the complainant is informed in writing either through electronic means, or text message or any other means of communication, the manner in which the grievance is redressed.”.

(B) In section 10, for sub-section (2), the following sub-section shall be substituted, namely:- “(2)(a) When the Grievance Redressal Officer does not give decision within the prescribed time frame, complaint filed by a person shall get auto- escalated as an appeal to the Designated Authority;

(b) Any person aggrieved by the decision of the concerned Grievance Redressal Officer may, within thirty days from the receipt of such decision, prefer an appeal to the Designated

Authority:

Provided that the Designated Authority may admit the appeal filed after the expiry of thirty days if it is satisfied that the complainant was prevented by sufficient cause from filing the appeal in time.”.

(C) In section 11, for sub-section (1), the following sub-

section shall be substituted, namely: - “(1)(a) When the Designated Authority does not give decision within the prescribed time frame, the complaint filed by a person shall get auto- escalated as an appeal to the State Appellate Authority;

(b) Any person aggrieved by the decision of the Designated Authority may within thirty days from the receipt of such decision, prefer an appeal to the State

Appellate Authority:

Provided that the State Appellate Authority may admit the appeal after the expiry of thirty days if it is satisfied that the complainant was prevented by sufficient cause from filing the appeal in time.”.

establishment commences its business, whichever is later, the employer of every shop and establishment shall submit an application for registration in such form and in such manner together with such fees and accompanied by such self-declaration and self-certified documents as may

Provided that nothing contained hereinabove shall apply to the shops and establishments already having valid registration under the Gujarat Shops and Establishments Act, 1948 (Bom. LXXIX of 1948) until the expiry of their registration.

(2) On receipt of the application along with the documents and the fees, the shop or establishment shall be registered in the register of establishments in such manner as may be prescribed and a registration certificate shall be issued in a prescribed form to the employer within the prescribed time limit. The registration certificate shall be produced whenever it is demanded by the Inspector.”.

(B) For section 9, the following section shall be substituted,

namely:- “9. It shall be the duty of every employer to Notice of inform in such form and in such manner as change in may be prescribed, any change in any of the particulars. particulars specified in the application submitted under section 6 within such period, after the change has taken place, as may be prescribed. On receiving such notice and the prescribed fees along with the self- declaration of the applicant and self- certified documents as may be prescribed, the change in the register of establishments shall be made in accordance with such notice and a fresh registration certificate shall be issued.”.

(C) In section 28, in the proviso, the words “by the Inspector” shall be deleted.

(D) In section 35, for sub-section (1), the following sub-section shall be substituted, namely:- “(1) Any shop or establishment may remain open 24

hours on any day of the week:

Provided that, the worker shall be allowed to work in accordance with the provisions of sections 12, 14, 16 and 18 of this Act.”.
