(1) इन जनयमों को अतं िेिीय िलयान (सवेक्षण और प्रमाणन) (प्रथम संिोधन) जनयम, 2025 कहा िाए। (2) य ेजनयम सरकारी गिि म ेंइसके अतं जम प्रकािन की तारीख स े प्रवृत् त होंगे। 2. अंतिेिीय िलयान (सवेक्षण और प्रमाणन) जनयम, 2022 (जिसे इसम ें इसके बाि उि जनयम कहा िाएगा) म,ें जनयम 2 के उपजनयम (1) के खडं (घ) के पश्चात ्जनम्नजलजखत स्ट्पष्टीकरण अतं ःस्ट्थाजपत दकया िाएगा, अथागत:् - “स्ट्पष्टीकरण.- इस उप-जनयम के प्रयोिन के जलए, 24 मीिर स े अजधक सकल िनभार वाले िलयानों की गणना अंतरागष्‍टर ीय पोत िनभार माप कन्‍दवेंिन, 1969 के अनुसार की िाएगी, िबदक 24 मीिर स ेकम सकल िनभार वाल ेिलयानों के संबंध म ें गणना वाजणजययक पोत पररवहन (पोतों का िन भार माप) जनयम, 1991 के जनयम 2 के अनसु ार की िाएगी।" 3. उि जनयमों के जनयम 8 के उप-जनयम (1) म ें- i. खंड (ख) म,ें "अंतिेिीय िलयान सवेक्षण प्रमाणपत्र" िब्िों के स्ट्थान पर "सवेक्षण प्रमाणपत्र" िब्ि प्रजतस्ट्थाजपत दकया िाएगा; ii. खंड (ग) के जलए, जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत् - "सवेक्षण प्रमाणपत्र की पांि वर्ग की वैधता अवजध के िौरान ड्राई डॉक या िलयानों के तल के बाहर के जस्ट्लपवे म ें कम स े कम िो जनरीक्षण; बिते दक ऐस े दकन्‍दहीं िो जनरीक्षणों के बीि का अंतराल छत्तीस माह स े अजधक न हो; परंतु इसके अलावा, ड्राई डॉक या जस्ट्लपवे म ें एक जनरीक्षण के बिले म ें एक िल सवेक्षण की अनुमजत िी िा सकती ह,ै यदि जनम्नजलजखत म ें स ेकोई भी ितग परू ी होती ह:ै (i) िलयान 20 वर्ग स ेकम परु ाना का ह;ै (ii) िलयान का प्रिालन खारे पानी म ें नहीं दकया गया ह।ै " 4. उि जनयमों के जनयम 10 म:ें i. उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत्। - “(1) िलयान के वार्र्गक सवेक्षण म ें यह पुजष्ट करने के जलए दक वे संतोर्िनक जस्ट्थजत म ें ह ैं और उस सेवा के जलए उपयुि ह ैंजिसके जलए िलयान को जलया गया ह,ै इस जनयम के उप-जनयम (2) में जनर्िगष्ट मिों का सामान्‍दय जनरीक्षण िाजमल होगा।” ii. उप-जनयम (2) में, उप-खंड (ञ) के बाि, जनम्नजलजखत उप-खडं अंतस्ट्थ ागजपत दकया िाएगा, अथागत ् - “(ि) रेजडयो और नौिालन उपकरण।” 5. उि जनयमों के जनयम 11 का लोप दकया िाएगा। 6. उि जनयमों के जनयम 12 के उप-जनयम (1) म,ें िब्ि और अंक "जनयम 9" के स्ट्थान पर, िब्ि और अंक "जनयम 10" प्रजतस्ट्थाजपत दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 7. उि जनयमों के जनयम 22 म,ें उप-जनयम (4) को हिा दिया िाएगा। 8. उि जनयमों के जनयम 23 के स्ट्थान पर, जनम्नजलजखत जनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत्: - "सवेक्षक के पि पर जनयुजि के जलए अहतग ाएं - अतं िेिीय िलयानों के सवेक्षक के पास जनम्नजलजखत म ेंस ेकोई भी अहतग ा और अनुभव होना िाजहए- (क) समुरी या यांजत्रक या जवद्युत इंिीजनयर या नौसेना वास्ट्तुकार (आर्कगिेक्ि ), जिसके पास नौवहन महाजनिेिक, भारत सरकार द्वारा िारी दकया गया प्रथम या जद्वतीय श्रेणी मोिर/स्ट्िीम पररवहन मंत्रालय (एमओिी) प्रमाण-पत्र या भारत सरकार द्वारा मान्‍दयता प्राप्त समकक्ष प्रमाण-पत्र हो और समुर म ेंजनयजमत आवािाही करने वाल ेिलयानों या वगीकरण सोसारियों या पोत जनमागण याडों या प्रजतजित अंतरराष्ट्रीय नौवहन कंपजनयों या रायय पत्तन जवभाग या रायय समुरी बोड गया नौवहन महाजनिेिालय या वाजणजययक समुरी जवभाग या रायय अंतििे ीय िलमाग गप्राजधकरण या अंतििे ीय िल पररवहन जनिेिालय या समकक्ष म ेंप्रथम योग्यता प्रमाण-पत्र के बाि 5 वर् ग का अनुभव हो; (ख) मास्ट्िर मेररनर (जविेि िाने वाला) जिसके पास नौवहन महाजनिेिक, भारत सरकार द्वारा िारी मास्ट्िर प्रमाणपत्र या समकक्ष अंतरराष्ट्रीय प्रमाणपत्र प्राप्त करने के बाि नौिालन या समुरी प्रजिक्षण या समुरी सवेक्षण म ें 5 वर् ग का अनुभव हो; अथवा (ग) समुरी इंिीजनयर अजधकारी श्रणे ी- III [तिीय यात्रा िलयान (एनसीवी) के जनकि - नौवहन महाजनिेिक द्वारा िारी मुख्य अजभयंता अजधकारी] प्रमाण-पत्र या मास्ट्िर (तिीय यात्रा िलयान के जनकि) प्रमाण-पत्र और नौिालन म ें न्‍दयूनतम 10 वर् गका अनुभव जिसम ेंस ेकम स ेकम 3 वर् गका अनुभव मास्ट्िर या मुख्य अजभयंता के रूप म ेंऔर 5 वर् ग का अनुभव वगीकरण सोसाइरियों या पोत जनमाणग याड ग या प्रजतजित अंतरराष्ट्रीय नौवहन कंपजनयों या रायय पत्तन जवभाग या रायय समुरी बोड गया नौवहन महाजनििे ालय या वाजणजययक समुरी जवभाग या रायय अंतिेिीय िलमाग ग प्राजधकरण या अंतिेिीय िल पररवहन जनिेिालय या समकक्ष म ें हो; अथवा (घ) नौसेना वास्ट्तुकला में मलू जडग्री के साथ समुर म ें िाने वाले जनयजमत िलयानों या वगीकरण सोसाइरियों या पोत जनमागण याडग या प्रजतजित अतं रराष्ट्रीय नौवहन जनगमों या रायय पत्तन जवभाग या रायय अंतििे ीय िलमाग ग प्राजधकरण या अंतिेिीय िल पररवहन जनिेिालय या समकक्ष म ें 7 वर् ग का अनुभव; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 536, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at dsiwt-psw@gov.in and uttam.mishra27@gov.in within the period specified above; Draft Amendment 1. (1) These rules may be called as the Inland Vessels (Survey and Certification) (First Amendment) Rules, 2025. (2) These rules shall come into force on the date of their final publication in Official Gazette. 2. In the Inland Vessels (Survey and Certification) Rules, 2022 (hereinafter referred to as the said rules), after clause (d) of sub-rule (1) of rule 2, the following explanation shall be inserted, namely. - “Explanation. - For the purpose of this sub-rule, Gross Tonnage of vessels above 24 meters shall be calculated according to International Convention on Tonnage Measurement of Ships, 1969 whereas Gross Tonnage of vessels less than 24 meters shall be calculated according to Rule 2 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991.” 3. In sub-rule (1) of rule 8 of the said rules. – i. In clause (b), for the words “Inland Vessel Certificate of Survey”, the words “certificate of survey” shall be substituted; ii. In clause (c), the following shall be substituted, namely. – “a minimum of two inspections in dry dock or slipway, of the outside of the vessel’s bottom, carried out during the five year period of validity of the certificate of survey; Provided the interval between any two such inspections shall not exceed thirty-six months; Provided further that one in water survey may be allowed in lieu of one inspection in dry dock or slipway, in case any of the following conditions are satisfied: (i) the vessel is less than 20 years of age; (ii) the vessel is not operating in saline water.” 4. In rule 10 of the said rules: i. In sub-rule (1), the following shall be substituted, namely. – “(1) The annual survey of the vessel shall include a general inspection of the items specified in sub-rule (2) of this rule to confirm that they are in satisfactory condition and fit for the service for which the vessel is intended.” ii. In sub-rule (2), after sub-clause (j), the following sub-clause shall be inserted, namely. – “(k) radio and navigation equipment.” 5. Rule 11 of the said rules shall be omitted. 6. In sub-rule (1) of rule 12 of the said rules, for the word and figure “rule 9”, the word and figure “rule 10” shall be substituted.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 7. In rule 22 of the said rules, sub-rule (4) shall be omitted. 8. In rule 23 of the said rules, the following rule shall be substituted namely. – “Qualifications for appointment as Surveyor. - A surveyor of inland vessels shall possess any of the following qualifications and experience- (a) Marine or Mechanical or Electrical Engineer or Naval Architect in possession of First or Second class Motor/Steam Ministry of Transport (MOT) Certificate issued by Director General of Shipping, Government of India or equivalent certificate recognized by the Government of India and 5 years of experience after first certificate of competency either in sea going regular vessels or Classification Societies or Ship Building yards or reputed International Shipping Companies or State Port Department or State Maritime Board or Directorate General of Shipping or Mercantile Marine Department or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; (b) Master Mariner (Foreign Going) with 5 years of sailing experience or experience in maritime training or marine survey after having obtained master’s certificate issued by Director General of Shipping, Government of India or equivalent international certificate; or (c) Marine Engineer Officer Class III [Near Coastal Voyage Vessel (NCV) - Chief Engineer Officer] Certificate or Master (Near Coastal Voyage Vessel) certificate issued by the Director General of Shipping with minimum 10 years of sailing experience of which at least 3 years experience in the capacity of Master or Chief Engineer and 5 years of experience in Classification Societies or Ship Building yards or reputed International Shipping Companies or State Port Department or State Maritime Board or Directorate General of Shipping or Mercantile Marine Department or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; or (d) a basic degree in Naval Architecture with 7 years experience in sea going regular vessels or Classification Societies or Ship Building yards or reputed International Shipping Corporations or State Port Department or State Inland Waterways Authority or Inland Water Transport Directorate or equivalent; (e) Diploma in ship building with 15 years experience in sea going regular vessels or Classification Societies or reputed Ship Building yards or reputed International Shipping Corporations or State Port Department or State Inland Waterways Authority Inland Water Transport Directorate or equivalent.” 9. Rule 24 shall be omitted. 10. In Annexure to Form No. 2 of the said rules, in the table, in the column relating to Firefighting item, for words and brackets “Fire Pumps (Mech)”, the word, brackets and symbol “Fire Pumps (Mech)/(Electrical)” shall be substituted. 12. In Form No. 4 and 5 of the said rules: i. after the words “Name of the Engineer or Engine Driver “wherever they occur, for the words “Maters COC Grade”, the words “Engineer or Engine Driver COC Grade” shall be substituted; ii. for the words “Signed by Chief Surveyor”, the words “Signed by Surveyor” shall be substituted. 13.
