(1) इन जनयमों को अंतिेिीय िलयान (चालकिल और यात्री आवास) (प्रथम संिोधन) जनयम, 2024 कहा िा सकेगा। (2) य ेआजधकाररक रािपत्र म ेंउनके अंजतम प्रकािन की जतजथ स े लाग ू होंगे। 2. अंतिेिीय िलयान (चालकिल और यात्री आवास) जनयम, 2022 (यहां बाि में उि जनयम के रूप म ें संिर्भगत) म ें जनयम 2 के खडं (ग) के पश् चात् जनम्नजलजखत स्ट् पष्ट ीकरण अतं :स्ट्थ ाजपत दकया िाएगा, नामत:- “स्ट्पष्टीकरण. - इस उप-जनयम के प्रयोिन के जलए, 24 मीटर स े अजधक के िलयानों के सकल टन भार की गणना पोतों के टनभार माप पर अतं रागष्ट्रीय कन्वेंिन, 1969 के अनुसार की िाएगी, िबदक 24 मीटर स े कम के िलयानों के सकल टनभार की गणना वाजणज्य नौवहन (पोतों के टनभार माप) जनयम, 1991 के जनयम 2 के अनुसार की िाएगी।” 3. उि जनयमों के जनयम 20 के उप-जनयम (1) म ेंअंक ‘‘0.60’’ के जलए, अंक ‘‘0.36’’ प्रजतस्ट्थ ाजपत दकया िाएगा। 4. उि जनयमों के जनयम 23 के उप-जनयम (3) म ें जनम्नजलजखत उप-जनयम प्रजतस्ट् थाजपत दकया िाएगा, नामत:- “(3) 15 जमनट स े अजधक और 60 जमनट या उसस े कम की यात्राओं पर चलन े वाल े अंतिेिीय िलयानों को अतं िेिीय िलयान (जडिाइन और जनमागण जनयम), 2024 म ें िी गई जस्ट्थरता आवश्यकताओं के अनरूु प, 50% याजत्रयों हते ु बैिन े की व्यवस्ट्था प्रिान करने की आवश्यकता ह;ै बिते दक सामान्य पररचालन म ेंगजत और त्वरण के कारण खड ेरहना करिन न हो।” 5. उि जनयमों के जनयम 24 म ें i. उप-जनयम (1) म ें जनम्नजलजखत उप-जनयम प्रजतस्ट् थजपत दकया िाएगा, नामत: - ‘‘पहुचं , एकत्रीकरण, गजलयारे तक पहुचं और जनकास के जलए न्यूनतम 750 जमलीमीटर चौडाई के उपयिु स्ट्पष्ट स्ट्थान की अनुमजत िी िाएगी।’’ ii. उप-जनयम (4) म,ें अंक ‘‘1600’’ के जलए अंक ‘‘1300’’ प्रजतस्ट्थ ाजपत दकया िाएगा; iii. उप-जनयम (5) म,ें क) अंक ‘‘680’’ के जलए अंक ‘‘650’’ प्रजतस्ट् थाजपत दकया िाएगा; ख) अंक ‘‘310’’ के जलए अंक ‘‘230’’ प्रजतस्ट् थाजपत दकया िाएगा; iv. उप-जनयम (6) म,ें अंक ‘‘620’’ के जलए अंक ‘‘480’’ प्रजतस्ट् थाजपत दकया िाएगा; 6. उि जनयमों के जनयम 26 के उप-जनयम (6) म,ें- i. िब् िों ‘‘अथवा व् यजिगत इकाई प्रकार’’ को जवलोजपत दकया िाएगा; ii. खंड (ख) म,ें जनम्नजलजखत परंतकु अंत:स्ट्थ ाजपत दकया िाएगा, नामत:- “बिते दक जवजनर्िगष्ट प्राजधकारी द्वारा 300 िी.टी. स े कम विन वाले श्रेणी क िलयानों को मामला-िर- मामला आधार पर उपरोि आवश्यकता स े छूट िी िा सकती ह।ै ” 6. उि जनयमों के जनयम 31 म,ें उप-जनयम (4) म,ें अंक ‘‘30’’ के जलए अंक ‘‘60’’ प्रजतस्ट् थाजपत दकया िाएगा। [फा.स.ंआईडब्ल् यटू ी-11011/91/2021-आईडब् ल् यूटी(5)] डॉ. कमला कान्ता नाथ, सलाहकार (सांख्यिकी) MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi , the 5th December, 2024 G.S.R. 752(E).— In exercise of the powers conferred by sub-sections (1) of Section 7 and Section 80 read with clauses (zv) and (zza) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government proposes to amend the Inland Vessels[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (Crew and Passenger Accommodation) Rules, 2022 notified by the Government of India in the Ministry of Ports, Shipping and Waterways vide number G.S.R. 423(E) dated the 7th June, 2022 and hereby publish as required by sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021) for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 251, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at ajay.sirohi@nic.in and uttam.mishra27@gov.in within the period specified above; Draft Amendment 1. (1) These rules may be called as the Inland Vessels (Crew and Passenger Accommodation) (First Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Inland Vessels (Crew and Passenger Accommodation) Rules, 2022 (hereinafter referred to as the said rules), after clause (c) of rule 2, the following explanation shall be inserted, namely. – “Explanation. - For the purpose of this sub-rule, Gross Tonnage of vessels above 24 meters shall be calculated according to International Convention on Tonnage Measurement of Ships, 1969 whereas Gross Tonnage of vessels less than 24 meters shall be calculated according to Rule 2 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991.” 3. In sub-rule (1) of rule 20 of the said rules, for the figure “0.60”, the figure “0.36” shall be substituted. 4. In sub-rule (3) of rule 23 of the said rules, the following sub-rule shall be substituted, namely. – “(3) Inland vessels operating on voyages of more than 15 minutes and upto 60 minutes or less need to provide seating for 50 % of passengers, in accordance with the stability requirements given in Inland Vessels (Design and Construction Rules), 2024; Provided that the motions and accelerations in all normal operation would not make standing difficult.” 5. In rule 24 of the said rules: i. In sub-rule (1), the following sub-rule shall be substituted, namely. – “Suitable clear space shall be allowed for access, assembly, corridor access and escape with a minimum width of 750 millimetres being provided.” ii. in sub-rule (4), for the figure “1600”, the figure “1300” shall be substituted; iii. in sub-rule (5), i. for the figure “680”, the figure “650” shall be substituted; ii. for the figure “310”, the figure “230” shall be substituted;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] iv. in sub-rule (6), for the figure “620”, the figure “480” shall be substituted. 6. In sub-rule (6) of rule 26 of the said rules: i. the words “or individual unit type” shall be omitted; ii. in clause (b), the following proviso shall be inserted, namely. – “Provided that an exemption from the above requirement may be given, on a case-to-case basis by the Designated Authority to Category A vessels of less than 300 GT.” 7. In rule 31 of the said rules, in sub-rule (4), for the figure “30”, the figure “60” shall be substituted. [F.
