और एतद्द्वारा द्वारा यह सूचना िी िाती ह ैदक उि मसौिा जनयमों पर उस तारीख स े तीस दिन की समाजि के पश्चात जवचार दकया िाएगा, जिस तारीख को इस अजधसूचना की प्रजतयां, आजधकाररक रािपत्र म ें प्रकाजित रूप म,ें िनता को उपलब्ध करा िी िाती ह;ैं 7900 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] इन मसौिा जनयमों पर आपजत्तयां या सुझाव, यदि कोई हों, तो जनिेिक (आईडब्ल्यूटी), पत्तन, पोत पररवहन और िलमाग ग मंत्रालय, कमरा संख्या 547, पररवहन भवन, 1-संसि माग,ग नई दिल्ली-110001 को या ईमेल द्वारा ajay.sirohi@nic.in और uttam.mishra27@gov.in पर ऊपर जनर्िगष्ट अवजध के भीतर भेिे िा सकते ह;ैं सिं ोजधत मसौिा 1. 1) इन जनयमों को अंतिेिीय पोत (पंिीकरण और अन्य तकनीकी मुद्दे) (प्रथम संिोधन) जनयम, 2024 कहा िा सकता ह।ै (2) य ेआजधकाररक रािपत्र में अपने अंजतम प्रकािन की तारीख से लागू होंगे। 2. अंतिेिीय पोत (पंिीकरण और अन्य तकनीकी मुद्दे) जनयम, 2022 ((जिसे यहां इसके बाि उि जनयम कहा िाएगा) म,ें जनयम 3 के खंड (ग) के बाि, जनम्नजलजखत स्ट्पष्टीकरण अतं :, स्ट् थाजपत दकया िाएगा, अथागत ् – “स्ट्पष्टीकरण. - इस उप-जनयम के प्रयोिन के जलए, 24 मीटर से अजधक के पोतों के सकल टन भार की गणना िहािों के टन भार माप पर अंतराष्ट्रग ीय कन्वेंिन, 1969 के अनुसार की िाएगी, िबदक 24 मीटर से कम के पोतों के सकल टन भार की गणना व्यापाररक नौवहन (पोतों के टन भार माप) जनयम, 1991 के जनयम 2 के अनुसार की िाएगी।” 3. जनयम 4 म,ें िब्ि और संख्या “इन जनयमों के जनयम 7” के स्ट्थान पर िब्ि, सख्ं या और कोष्ठक “इन जनयमों के जनयम 5 के उप-जनयम (1)” प्रजतस्ट्थाजपत दकए िाएंगे। 4. उि जनयम के जनयम 5 के उपजनयम (1) म,ें - i. खंड (ई) के स्ट्थान पर जनम्नजलजखत उपजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् - “(ई) माजलक या मास्ट्टर द्वारा स्ट्वयं सत्याजपत जबक्री के िस्ट्तावेि की प्रजत जिसके तहत पोत का स्ट्वाजमत्व आवेिक को हस्ट्तांतररत दकया गया था, िो चाहता ह ैदक यह उसके नाम पर पंिीकृत हो (सेकंड हडैं िलयान के जलए);”। ii. खण्ड (च) के स्ट्थान पर जनम्नजलजखत उपजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- “(च) स्ट्वामी या मास्ट्टर द्वारा स्ट्व-सत्याजपत सवेिण प्रमाणपत्र की प्रजत, यदि वह जनर्िष्टग प्राजधकारी द्वारा िारी दकया गया हो या सवेिक द्वारा िारी अनंजतम सवेिण प्रमाणपत्र;”। 5. उि जनयम के जनयम 6 के उपजनयम (1) म ेंजनम्नजलजखत उपजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथातग ्:- “(1) यदि दकसी अतं िेिीय यंत्रचाजलत िलयान के संबंध म ें पिं ीकरण प्राजधकारी, जनयम 5 के अधीन अपेजित िांच करने के पश्चात् संतष्टु ह ै दक अजधजनयम या उसके अधीन बनाए गए दकसी जनयम के उपबंधों का अनुपालन दकया गया ह,ै तो वह आवेिक को इन जनयमों के साथ संलग्न प्ररूप 8 में पंिीकरण प्रमाणपत्र प्रिान करेगा, जिसमें सवेिण प्रमाणपत्र या अनंजतम सवेिण प्रमाणपत्र, जबल्डर प्रमाणपत्र, िलयान को बेचने के जलए स्ट्वामी या मास्ट्टर द्वारा स्ट्व- प्रमाजणत जवक्रय जलखत और स्ट्वाजमत्व की घोषणा की प्रजतयां सरु जित रखी िाएंगी।” 6. उि जनयम के जनयम 8 के उपजनयम (3) म ेंजनम्नजलजखत उपजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् - “(3) पहचान जचह्न को गहरे रंग की पृष्ठभूजम पर हल्के रंग में या हल्के रंग की पृष्ठभूजम पर गहरे रंग में उकेरा या जचजह्नत या वेल्ड दकया िाएगा और इसका आकार इस प्रकार होगा: (क) 20 मीटर स े अजधक लंबाई वाल े िलयानों के जलए, जचह्न का आकार 200 जममी x 150 जममी (ऊंचाई x चौडाई) स े कम नहीं होगा, जिसमें प्रत्येक अिर 25 जममी चौडा होगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ख) 10 मीटर स े 20 मीटर के बीच की लंबाई वाल े िलयानों के जलए, जचह्न का आकार 150 x 120 जममी (ऊंचाई x चौडाई) से कम नहीं होगा, जिसमें प्रत्येक अिर 25 जममी चौडा होगा। (ग) 5 मीटर से 10 मीटर के बीच की लंबाई वाले िलयानों के जलए, जचह्न का आकार 100 जममी x 75 जममी (ऊंचाई x चौडाई) से कम नहीं होगा, जिसमें प्रत्येक अिर 20 जममी चौडा होगा। (घ) 5 मीटर से कम लंबाई वाले िलयानों के जलए, जचह्न का आकार 50 मीटर x 40 जममी ऊंचाई x चौडाई से कम नहीं होगा, जिसमें प्रत्येक अिर 15 जममी चौडा होगा। 7. उि जनयमों के प्ररूप 2 में, क्रम संख्या 9 म ें- i. क्रम संख्या (घ) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत ् - “घ) नए िलयानों के जलए माजलक या मास्ट्टर द्वारा स्ट्वयं सत्याजपत जबल्डर के प्रमाण पत्र की प्रजत;”. ii. क्रम संख्या (ङ) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत् - “ङ) माजलक या मास्ट्टर द्वारा स्ट्वयं सत्याजपत जबक्री जवलेख की प्रजत (सेकेंड हडैं िलयानों के जलए);” 8. उि जनयमों के प्ररूप 12 म,ें क्रम संख्या 8 म ें- i. क्रम संख्या (घ) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत ् - “घ) नए िलयानों के जलए माजलक या मास्ट्टर द्वारा स्ट्वयं सत्याजपत जबल्डर के प्रमाण पत्र की प्रजत;”. ii. क्रम संख्या (ङ) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, अथागत ् - “ङ) माजलक या मास्ट्टर द्वारा स्ट्वयं सत्याजपत जबक्री जवलेख की प्रजत (सेकेंड हडैं िलयानों के जलए);”. [फा. सं. आईडब् ल् यटू ी-11011/91/2021- आईडब्ल् यटू ी (7)] डॉ. कमला कांत नाथ, सलाहकार (सांजख्यकी) MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 5th December, 2024 G.S.R. 753(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 21, section 22, sub-sections (1) and (2) of section 23, sub-section (2) of section 24, sub- section (2) of section 27, subsection (2) of section 29, sub-section (1) of section 32, sub-sections (2) of section 33 read with clauses (n) to (x) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government proposes to amend the Inland Vessels (Registration and other Technical Issues) Rules, 2022 notified by the Government of India in the Ministry of Ports, Shipping and Waterways vide number G.S.R. 421(E) dated the 7th June, 2022 and hereby publish as required by sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021) for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 251, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at ajay.sirohi@nic.in and uttam.mishra27@gov.in within the period specified above; Draft Amendment 1. 1) These rules may be called as the Inland Vessels (Registration and other Technical Issues) (First Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Inland Vessels (Registration and Other Technical Issues) Rules, 2022 ((hereinafter referred to as the said rules), after the clause (c) of rule 3, the following explanation shall be inserted, namely. - “Explanation. - For the purpose of this sub-rule, Gross Tonnage of vessels above 24 meters shall be calculated according to International Convention on Tonnage Measurement of Ships, 1969 whereas Gross Tonnage of vessels less than 24 meters shall be calculated according to Rule 2 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991.” 3. In rule 4, for the word and number “Rule 7 of these Rules”, the words, number and brackets “sub- rule (1) of rule 5 of these rules” shall be substituted. 4. In rule 5 of the said rules, in sub-rule (1). - i. for clause (e), the following sub-rule shall be substituted, namely. - “(e) copy of the instrument of sale self-attested by the owner or master under which the title of the vessel was transferred to the applicant who requires it to be registered in his name (for second hand vessel);”. ii. for clause (f), the following sub-rule shall be substituted, namely. - “(f) copy of certificate of survey self-attested by the owner or master if issued by the designated authority or the provisional certificate of survey issued by the Surveyor;”. 5. In rule 6 of the said rules, in sub-rule (1), the following sub-rule shall be substituted, namely. - “(1) If, in respect of any inland mechanically propelled vessel, the registering authority, after making such enquiry as required under rule 5, is satisfied that the provisions of the Act or of any rules made thereunder have been complied with, shall grant to the applicant thereof a certificate of registration in Form No. 8 appended to these rules retaining the copies of the certificate of survey or provisional certificate of survey, builders certificate, instrument of sale by which the vessel was sold self-attested by the owner or master, and the declaration of ownership.” 6. In rule 8 of the said rules, in sub-rule (3), the following sub-rule shall be substituted, namely. - “(3) The identification mark shall be carved or marked or welded in light colour on a dark background or in a dark colour on a light background and its size shall be as follows:[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (a) For vessels of length more than 20 meters, the size of the mark shall not be less than 200mm x 150mm (height x breadth) with each letter 25mm wide. (b) For vessels of length between 10 metres and 20 meters, the size of the mark shall not be less than 150 X 120 mm (height x breadth) with each letter 25mm wide. (c) For vessels of length between 5 metres and 10 metres, the size of the mark shall not be less than 100mm X 75 mm (height x breadth) with each letter 20 mm wide. (d) For vessels of length less than 5 metres, the size of the mark shall not be less than 50m x 40 mm height x breadth) with each letter 15mm wide.” 7. In Form 2 of the said rules, in serial no 9. - i. For serial number (d), the following shall be substituted, namely. - “d) copy of builder’s certificate for new vessels self-attested by the owner or master;”. ii. For serial number (e), the following shall be substituted, namely. - “e) copy of instrument of sale self-attested by the owner or master (for second hand vessels);”. 8. In Form 12 of the said rules, in serial no 8. - i. For serial number (d), the following shall be substituted, namely. - “d) copy of builder’s certificate for new vessels self-attested by the owner or master;”. ii. For serial number (e), the he following shall be substituted, namely. - “e) copy of instrument of sale self-attested by the owner or master (for second hand vessels);”. [F.
