ऄजधजनयम, 2021 (2021 का 20) की धारा 46 की ईप धारा (1) द्वारा प्रदत् त िजतियय का ईपयोग करत े ुएए म जो ससे सभी व् यजतियय के सूचनाथ,ग जजनके ईससे प्रभाजवत होने की संभावना ह, एतद्द्वारा प्रकाजित दकया जाता ह; ज सा दक ईक्त धारा की ईप धारा (1) द्वारा ऄपेजषितत ह और एतद्द्वारा यह सूचना दी जाती ह दक ईक्त प्रारूप यह ऄजधसूचना प्रकाजित करन े वाले भारत के िासकीय राजपत्र की प्रजतयााँ जनसाधारण को ईपलब् ध कराए के तीस ददन की ऄवजध की समाजि पर जवचार दकया जाएगा; आन प्रारूप जनयम के संबंध म अषितेप या सुझाव, यदद कोइ हो, जनधागररत ऄवजध के दौरान, ईसे महाजनेदेिक, दीपस्ट् तंभ और दीपपोत जनदेिालय, ए-13, सेक्ट र – 24, नोएडा, यह राजपत्र म ईनके प्रकािन की जतजथ से लाग ूहोगा । 2. पररभार्ाएं : (1) आस जनयम म , जब तक दक जवर्य की ऄ‍यथा अवश्यकता न हो, (क) “ऄजधजनयम” ऄथागत समुद्री नौचालन सहायता ऄजधजनयम, 2021; (ख) “महाजनदेिालय” ऄथागत समुद्री नौचालन सहायता महाजनदेिालय; (ग) “जनदेिालय” ऄथागत समुद्री नौचालन सहायता जनदिे ालय; (घ) “महाजनदेिक” ऄथागत महाजनदिे क, समुद्री नौचालन सहायता महाजनदेिालय ; (ङ) “जनदेिक” ऄथागत जनदेिक, समुद्री नौचालन सहायता महाजनदिे ालय ; (च) “जजला” ऄथागत महाजनदेिालय के प्रभावी कायगकुिलता के ईद्देश्य हते ु एक जजल ेके रूप म एक जनधागररत षितेत्र; (छ) “तायगपथ” ऄथागत पत् तन सीमा के बाहर नौगम् य जल ; (ज) “सामा‍ य नौचालन सहायता” ऄथागत के‍ दीय सरकार द्वारा घोजर्त एक नौचालन सहायता । (झ) “जवरासती दीपस्ट् तंभ” ऄथागत िासकीय गजट के माध् यम से ऄजधसूजचत के‍ द्रीय सरकार द्वारा नाजमत एक दीपस्ट्त ंभ; (ञ) “अइ ए एल ए” ऄथागत आंटरनेिनल एसोजसएिन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऑथीररटीज; (ट) “अइ ए एल ए डब् ल् य ू डब्ल् य ू ए” ऄथागत वल्ड ग वाइड एकडेमी ऑफ आंटरनेिनल ससोजसएसन ऑफ मरीन एड्स टू नेवीगेिन अथॉररटीज; (ठ) “प्रजिषितण संस्ट्थ ान” ऄथागत समुद्री नौचालन प्रजिषितण संस्ट्थ ान । (2) समुद्री नौचालन सहायता ऄजधजनयम, 2021, सामा‍ य जवत् तीय जनयम, 2017 (यथा संिोजधत) और सरकारी लेखा जनयम, 1990 (यथा संिोजधत) म प्रयुतिय िब्द एवं व्याख्या जो पररभाजर्त न की गइ हो और ऄजधजनयम म पररभाजर्त दकए गए ह , का आस ऄजधजनयम म क्रमिः समान तात्पयग प्रदान दकया गया ह। समद्रु ी नौचालन सहायता महाजनदेिालय 3. महाजनदेिक का सगं ठन : (1) भारत सरकार पत् तन, पोत पररवहन और जलमागग मंत्रालय के माध् यम से पोत यातायात सेवा सजहत समुद्री नौचालन सहायता स ेसंबंजधत मामल के जलए जनयंत्रक प्राजधकारी होगा। (2) महाजनदेिक द्वारा ऄजधजनयम के खंड 5 के ऄनुसार पोत यातायात सेवा सजहत समुद्री नौचालन सहायता के संदभ ग म समुद्री नौचालन सहायता के प्रजिषितण और प्रमाणन स े संबंजधत रा्‍र ीय और ऄंतराग्‍र ीय दाजयत् व को पूरा दकया जाएगा। (3) महाजनदेिक द्वारा ऄजधजनयम के ऄध् याय IV, खंड 8 और 9 के ऄनुसार सामा‍ य नौचालन सहायता के जवकास, स्ट् थापना, ऄनुरषितण और प्रबंधन का प्रयोग दकया जाएगा। (4) महाजनदेिक द्वारा समुद्री नौचालन सहायता (प्रजिषितण और प्रमाणन), जनयम, 2021 और समुद्री नौचालन सहायता (प्रजिषितण सस्ट्ं थान का प्रत् यापन), जनयम 2021 ऄजधजनयम के ऄध् याय VII, खंड 18, 19 और 20 के ऄनुसार पोत यातायात सेवा सजहत समुद्री नौचालन सहायता के कार्तमक का प्रजिषितण और प्रमाणन सजहत प्रजिषितण सस्ट्ं थान के प्रत् यायन का प्रयोग महाजनदेिक द्वारा दकया जाएगा। (5) महाजनदेिक का मख्ु यालय नौचालन सहायता महाजनदेिालय, नोएडा होगा। के‍द्र ीय सरकार द्वारा स्ट् वीकृत ऄजधकारी और कमगचारी महाजनदेिक के सहायक ह गे। (6) महाजनदेिालय की प्रभावी कायग पद्धजत हते ु, भारत के संपणू ग समुद्री तट को जचज‍हत करत े ुएए समुद्री नौचालन सहायता के जजले के रूप म जनम्न ानुसार पररभाजर्त दकया गया ह :[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 क्र.स.ं जजल ेका नाम जजल ेका षितत्रे ाजधकार गुजरात राज्य का भाग - ऄंतराग्‍र ीय सीमा रेखा (अइ बी एल) से ऄषितांि 1 गांधीधाम 22°24’ई तक तटीय खंड और द्वीप का जहस्ट्स ा। गुजरात राज्य का जहस्ट्स ा और के‍ द्र िाजसत प्रदेि दीव 22°24’ई to 21°45’ई 2 जामनगर तक ऄषितांि के मध् य खंड और द्वीप समूह, जजसम कच् छ की खाडी और खम् बात की खाडी का षितेत्र सजम्मजलत ह। गुजरात राज्य , महारा्‍र राज्य और के‍ द्र िाजसत प्रदिे दमन का जहस्ट्स ा - 21°45’ 3 मुम् बइ ई से 16°30’ ई तक ऄषितांि के मध् य तटीय खडं और द्वीप समूह। महारा्‍र राज्य , गोवा राज्य और कनागटक राज्य का जहस्ट्स ा - 16°30’ ई से 4 गोवा 12°45’ ई ऄषितांि के मध् य तटीय खंड और द्वीप समूह । केरल राज्य और के‍ द्र िाजसत प्रदेि लषितद्वीप - 12°45’ ई से 08°17’ ई ऄषितांि 5 कोच् ची के मध् य तटीय खंड और द्वीप समूह। म‍न ार की खाडी सजहत तजमलनाडु राज्य और के‍ द्र िाजसत प्रदेि पांजडचरे ी के के 6 च ‍ नइ मध् य तटीय खडं और द्वीप। 13°27’ई से 18° 12’ई ऄषितांि के मध् य अ‍ र प्रदेि राज्य के तटीय खंड और द्वीप 7 जविाखापत् तनम समूह । अ‍ र प्रदेि राज्य , ईडीसा राज्य और पजचिमम बगं ाल का जहस्ट्स ा - 18°12’ई 8 कोलकाता ऄषितांि से ऄंतराग्‍र ीय सीमा रेखा (अइ बी एल) के मध् य तटीय खंड और द्वीप समूह। 9 पोटग ब् लेयर संपूणग रूप से के‍ द्र िाजसत प्रदेि ऄडं मान और जनकोबार द्वीप समूह। रटप्‍प्‍ ण ी : क. स्ट् थानीय लाभ, तकनीकी जस्ट्थरता और प्रिासजनक समीचीनता के अधार पर नौचालन सहायता का प्रिासन जभ‍ न हो सकता ह, जजसे समय - समय पर महाजनदेिक द्वारा ऄजधसूजचत दकया जाएगा। ख. तकनीकी प्रगजत और व् यापार जवकास के अधार पर, जजल के षितेत्राााजधकार का पुनर्तवतरण अवश् यक हो सकता ह, जजसे महाजनदेिक द्वारा के‍ द्रीय सरकार की पूव ग ऄनमु जत पर दक्रयाज‍वत और ऄजधसूजचत दकया जाएगा। 7. जनरीषितण, जनगरानी, संचालन और तकनीकी जस्ट्थरता और प्रिासजनक सुजवधा के जलए दो ऄथवा दो स े ऄजधक जजल को समूहीकृत दकया जाएगा, और जजसका नेतृत् व ईप महाजनदेिक कर गे। 8. प्रत् यके जजल े के कायागलय को समुद्री नौचालन सहायता जनदेिालय के रूप म नाजमत दकया जाएगा। ईप- जनयम 8 म ईपरोक्त दकसी भी बात के होत े ुएए भी गांधीधाम के ऄजतररक्त प्रत् यके जजल े का प्रिासजनक प्रभार और जनयंत्रण, जनदेिक को प्रत् यायोजजत दकया जाएगा, जो संबंजधत जजल े की नौचालन सहायता के सामा‍ य प्रिासन के जलए ईत् तरदायी होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 9. गांधीधाम जजल,े जजस म पोत यातायात सेवा की स्ट् थापना ह, के प्रिासजनक प्रभार और जनयंत्रण, ईप महाजनदेिक प्रत य् ायोजजत दकया जाएगा, जो ऄपने जजल े के पोत यातायात सेवा सजहत नौचालन सहायता के सामा‍ य प्रिासन हते ु महाजनदिे क के प्रजत ईत् तरदायी ह गे। 4. समद्रु ी नौचालन प्रजिषितण सस्ट्ं थ ान और ईसका पररसर : (1) समुद्री नौचालन सहायता और पोत यातायात सेवा हते ु प्रजिषितण प्रदानगी से संबंजधत कोलकाता म एक प्रजिषितण संस्ट्थ ान होगा। (2) प्रजिषितण सस्ट्ं थान से संबंजधत सभी मामल के जलए महाजनदेिक जजम् मेदार ह गे। (3) महाजनदेिक, ईप –जनयम (2) के ऄधीन संदर्तभत ससी जजम् मेदारी(य ) को ईस ऄजधकारी को प्रत् यायोजजत कर सकते ह,ैं जो जनदेिक के पद से नीचे के स्ट्त र का न हो। (4) के‍ द्रीय सरकार, भारत के ऄ‍ य स्ट् थान पर, कुिल षितमता जनमाणग के एक भाग के रूप म प्रजिषितण संस्ट्थ ान के ईपग्रह पररसर की स्ट् थापना कर सकती ह। (5) प्रजिषितण संस्ट् थान को नौचालन सहायता और पोत यातायात सेवा के षितेत्र म व ज क जवकास के साथ बन े रहने के जलए ऄनुसंधान और जवकास गजतजवजधय का संचालन करना होगा। . 5. महाजनदेिक के कतव्ग य : महाजनदेिक जनम्न जलजखत कतगव् य के जनवगहन के जलए जजम् मेदार ह गे :- (1) नौचालन सहायता के प्रमुख के रूप म प्रिासजनक, तकनीकी, जवत् तीय और व धाजनक कायक का जन्‍प ादन। (2) ऄजधजनयम के प्रावधान का दक्रया‍ वयन। (3) समुद्री नौचालन सहायता स ेसंबंजधत सभी मामल के संदभग म भारत सरकार को परामिग की प्रदानगी। (4) समुद्री नौचालन सहायता (लखे ा और जवत् तीय िजतिय) जनयम, 2021 के ऄनुसार समुद्री नौचालन सहायता िुल् क का प्रबंधन । (5) समुद्री नौचालन सहायता की के‍ द्रीय दीपस्ट् तंभ सलाहकार सजमजत के सदस्ट् य सजचव की भूजमका का जनवगहन। (6) आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऄथॉररटीज (अइ ए एल ए) म एक रा्‍र ीय सदस्ट्य के रूप म प्रजतजनजधत् व करना। (7) पोत यातायात सेवा सजहत समद्रु ी नौचालन सहायता से संबंजधत रा्‍र ीय और ऄतं राग्‍र ीय संगठन के साथ संपकग । (8) समुद्री नौचालन सहायता से सबं ंजधत ऄंतराग्‍र ीय सम् मेलन और संजधय को दक्रयाज‍वत करना, जजसम भारत एक पषित ह। (9) समुद्री नौचालन सहायता के जवकास और प्रजिषितण स े संबंजधत मामल के संदभ ग म जद्वपषितीय ऄथवा बुएपषितीय समझौता ज्ञापन/ दिे के साथ सहयोग ज्ञापन म सजम्मजलत होना। (10) नौचालन सरु षिता पत् तन सजमजत (एन एस पी सी) के सदस्ट् य के रूप म भूजमका का जनवगहन; (11) ऄंडमान और जनकोबार तथा लषितद्वीप समूह सजहत भारत के समुद्रीय तट के स्ट् थानीय नौचालन सहायता का जनरीषितण करना। (12) स्ट् थानीय नौचालन सहायता के प्रावधान और जवस्ट् तार के संदभग म राज्य सरकार, राज्य समुद्री बोडग, प्रमुख और लघु पत् तन , मत् स्ट् य जवभाग और ऄ‍ य सहयोगी संगठन को परामि गप्रदानगी। (13) के‍ द्रीय सरकार के जनदेिानुसार, भुगतान के अधार पर, संबंजधत पोत यातायात सेवा प्रदाता के ऄनुरोध पर जवजि्‍ट पोत यातायात सेवा का प्रबंधन और प्रचालन । (14) समुद्री नौचालन सहायता के षितेत्र म परीषितण तल के जवकास सजहत जवकजसत हो रही प्रौद्योजगदकय पर ऄनुसंधान, जवकास और ऄगं ीकरण। (15) समुद्री षितेत्र सजहत भारत के समुद्री तट पर सामा‍ य नौचालन सहायता की योजना, जवकास, जन्‍प ादन और प्रबंधन करना। (16) समुद्री नौचालन सहायता का ऄनुकूलीकरण । (17) सामा‍ य नौचालन सहायता का ऄबाजधत प्रचालन की सुजवधा प्रदानगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (18) अइ ए एल ए मानक के ऄनरूु प जन्द्‍ ट सटीकता सजहत सामा‍ य नौचालन सहायता की जनबागध ईपलब् धता सुजनजचिमत करना। (19) सांस्ट् कृजतक, ि जषितक और पयगटन ईद्देश् य हते ु जवरासती दीपस्ट् तभं से संबंजधत योजना, जवकास, जन्‍प ादन और प्रबंधन । (20) समुद्री षितेत्र के साथ भारत की समुद्रीय तट रेखा सजहत पोत यातायात सेवा के साथ समुद्री नौचालन सहायता के संवधगनाथग जोजखम मल्ू यांकन नीजत का जनमागण करना। (21) नौचालन सहायता और पोत यातायात सेवा के षितेत्र म षितमता जनमागण हते ु एक रा्‍र ीय प्रजिषितण योजना का जवकास और प्रबंधन करना। (22) नौचालन सहायता और पोत यातायात सेवा कार्तमक और ईनके प्रजिषितण की जस्ट्थजत से संबंजधत रा्‍र ीय डाटा बैंक का प्रबंधन करना। (23) नौचालन सहायता और पोत यातायात सेवा कार्तमक का प्रजिषितण और प्रमाणन । (24) प्रजिषितण सगं ठन का प्रत् यायन और ऄनुवतल लेखा परीषिता। (25) के‍ द्रीय सरकार के जनदेिानुसार तायगपथ म पोताविेर् को जचज‍हत करना। (26) नौचालन सहायता महाजनदेिालय स े संबंजधत मामल के संबंध म के‍ द्रीय सरकार को अवजधक रूप म ऄवगत कराना। (27) के‍ द्रीय सरकार द्वारा समय समय पर सजपे जाने वाले ऄ‍ य कायग । 6. महाजनदेिक की िजतियया ं: महाजनदेिक का ऄजधकार: (1) के‍ द्रीय सरकार के जनयम के ऄधीन जवभाग के प्रमुख के रूप म प्रिासजनक, तकजनकी, जवत् तीय और व धाजनेक कायक हते ु िजतिय का प्रयोग कर ग।े (2) पत् तन, पोत पररवहन और जलमागग मंत्रालय द्वारा समय- समय पर प्रत् यायोजजत िजतियय का प्रयोग कर गे। (3) ऄजधजनयम के दायरे म अतं ररक कायग प्रचालन हते ु अदेि, जनयमावली, सूचना, एसओपी, ऄनुदेि जारी कर गे। (4) समुद्री नौचालन सहायता िल्ु क के संग्रहण और लौटाने के संदभग म दर और पद्धजत की समीषिता सजहत प्रावधान को दक्रयाज‍व त कर गे। (5) ऄध् यषित के परामिग पर समुद्री नौचालन सहायता की के‍ द्रीय सलाहकार सजमजत की ब ठक का अयोजन करना और समुद्री नौचालन सहायता (के‍ द्रीय सलाहकार सजमजत पद्धजत), जनयम 2021 के ऄनुसार के‍द्र ीय सलाहकार सजमजत की ब ठक म ईपजस्ट्थत होने वाल ेगर – िासकीय सदस्ट्य को यात्रा व् यय स्ट्व ीकृत कर गे। (6) अइ ए एल ए के तत्व ाधान म अयोजजत होन े वाल े सम् मेलन , कायगिालाओं , संगोजिय , सभाओ , सेजमनार और प्रजिषितण कायगक्रम म भागीदारी हते ु के‍ द्रीय सरकार की पूवग ऄनुमजत पर प्रजतजनजध मडं ल को नामांदकत कर गे। (7) पोत यातायात सेवा सजहत समुद्री नौचालन सहायता से संबंजधत मामल के संदभग म जद्वपषितीय और बुएपषितीय ऄंतराग्‍र ीय मंच म प्रजतजनजधत्व करने हते ु के‍ द्रीय सरकार की पूवग ऄनुमजत पर प्रजतजनजध मडं ल को नाजमत कर गे। (8) समुद्री नौचालन सहायता और ऄ‍ य ईभरते पररदश्ृ य से संबंजधत जवर्य पर जहतधारक की ब ठक का अयोजन करना। (9) “स्ट् थानीय” नौचालन सहायता का जनरीषितण और नौचालन सहायता के संबंध म स्ट्थ ानीय प्राजधकारण से अवश् यक जानकारी की प्राजि और तत्प श् चात :- (क) यदद दकसी प्रकार की जवसंगजत पाए जान े पर ईपचारी ईपाय के सुझाव की प्रदानगी। (ख) लागत के भगु तान के ऄनुरोध पर नौचालन सहायता की मरम् मत का कायग अरंभ करना। (10) समुद्री नौचालन सहायता के षितत्रे म जवकजसत हो रही प्रौद्योजगकी के साथ बन े रहन े के जलए ऄनुसंधान और जवकास से संबंजधत योजनाओं को स्ट् वीकृजत प्रदान करना। (11) सामा‍ य नौचालन सहायता के जवकास, जन्‍प ादन और प्रबंधन हते ु योजनाओं को स् वीकृजत प्रदान करना।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (12) समुद्री नौचालन सहायता के प्रचालन म हस्ट्त षितेप ऄथवा ब् यवधान डालन े वाली गजतजवजधय को अवश् यक समझे जाने पर प्रजतबंजधत करन े की कारगवाइ प्रारंभ करना। (13) सांस्ट् कृजतक, ि जषितक और पयगटन ईद्देश् य हते ु जवरासती दीपस्ट्त भं के जव कास, प्रचालन, ऄनुरषितण और प्रबधं न हते ु योजनाओं को स्ट् वीकृत (14) संभाजवत दीपस्ट् तंभ म पयगटन को बढावा देने के जलए योजनाओं को स्ट् वीकृजत प्रदान करना। (15) नौचालन सहायता / पोत यातायात सेवा कार्तमक के प्रजिषितण प्रदान करन े करन े वाली संस्ट्थ ाओं से प्रजिषितण से संबंजधत जानकारी की मांग करना। (16) समुद्री नौचालन सहायता (प्रजिषितण और प्रमाणन) जनयम, 2021 और समुद्री नौचालन सहायता (प्रजिषितण संस्ट् थान का प्रत् यायन) जनयम, 2021 के ऄनुसार मा‍ यता, प्रजिषितण और प्रमाणन से संबंजधत मामल का जनपटान। (17) प्रजिषितण और प्रमाणन से संबंजधत मामल के संदभग म अइ ए एल ए / अइ ए एल ए डब्ल् यू डब् ल् य ू ए के साथ समझौता ज्ञापन / संस्ट् थापन प्रलखे म सजम्मजलत होना। (18) के‍ द्रीय सरकार की पूवग ऄनुमजत पर, समय-समय पर के‍ द्रीय सरकार द्वारा जनधागररत मानदंड के ऄनुसार सामा‍ य नौचालन सहायता, जवरासती दीपस्ट्त ंभ और पोत यातायात सेवा के जवकास, प्रचालन और ऄनुरषितण हते ु पेिेवर सेवाओं और बाह्य व्य वस्ट् था जनिजतिय को िाजमल करना । (19) नौचालन सहायता / पोत यातायात सेवा के कार्तमक के प्रजिषितण और प्रमाणन से संबंजधत कायग के जनवगहन हते ु संकाय और संसाधन की बाह्यस्ट् त्रोत व् यवस्ट् था। (20) समुद्री नौचालन सहायता महाजनदेिालय के ध् वज कोड, प्रतीक और कार्तमक की वदल कोड का जनधागरण। (21) पोताविेर् का जचज‍हत करने संबंधी योजनाओं की स्ट् वीकृती । (22) के‍ द्र सरकार की पूवग ऄनुमजत पर, सामा‍ य नौचालन सहायता की Aids to Navigation (Duties of Director General) Rules, 2021, which the Central Government proposes to make, in exercise of the powers conferred by sub-section (1) of section 46 of the Marine Aids to Navigation Act, 2021 (20 of 2021), are hereby published, as required by sub-section (1) of the said section, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Gazette of India in which this notification is published, are made available to the public; Objections or suggestions, if any, to these draft rules may be addressed to the Director General, Directorate of Lighthouses and Lightships, Ministry of Ports Shipping and Waterways, A-13, Sector 24, Noida - 201301, or by email at noida-dgll@nic.in, within the period specified above; The objections or suggestions which may be received from any person with respect to the said draft rules, within the period so specified will be considered by the Central Government.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 Draft Rules Preliminary 1. Short title and commencement: (1) These rules may be called the Marine Aids to Navigation (Duties of Director General) Rules, 2021. (2) It shall come into force from the date of their publication in the Official Gazette. 2. Definitions: (1) In these rules, unless the content otherwise requires, (a) ―Act‖ means Marine Aids to Navigation Act, 2021; (b) ―Directorate General‖ means the Directorate General of Marine Aids to Navigation; (c) ―Directorate‖ means Directorate of Marine Aids to Navigation; (d) ―Director General‖ refers to Director General of Aids to Navigation; (e) ―Director‖ means the Director of Aids to Navigation; (f) ―District‖ means an area demarcated as a district for the purposes of effective functioning of the Directorate General; (g) ―fairways‖ means navigable waters outside port limits; (h) ―General aid to navigation‖ means an aid to navigation declared by the Central Government. (i) ―heritage lighthouse‖ means a lighthouse designated by the Central Government through notification in the Official Gazette; (j) ―IALA‖ means International Association of Marine Aids to Navigation and Lighthouse Authorities; (k) ―IALA WWA‖ means World Wide Academy of International Association of Marine Aids to Navigation and Lighthouse Authorities; (l) ―Training Institute‖ means the Marine Navigation Training Institute. (3) Words and expressions used but not defined in this rules and defined in the Marine Aids to Navigation Act 2021, General Financial Rules, 2017 (as amended) and Government Accounting Rules, 1990 (as amended) will have the same meanings respectively assigned to them in that Act. Directorate General of Marine Aids to Navigation 3. Organisation of the Director General: (1) The Government of India through Ministry of Ports, Shipping and Waterways shall be the controlling authority for matters pertaining to Marine Aids to Navigation including Vessel Traffic Services. (2) The national and international obligations pertaining to Marine Aids to Navigation and Training & Certification on Marine Aids to Navigation including Vessel Traffic Service, shall be fulfilled by the Director General in accordance with Section 5 of the Act. (3) The development, establishment, maintenance and management of general aids to navigation shall be exercised by the Director General in accordance with Chapter IV, Sections 8 and 9 of the Act. (4) Training & Certification of personnel on Marine Aids to Navigation including Vessel Traffic Service as well as Accreditation of Training Organisations, shall be exercised by the Director General in accordance with the Marine Aids to Navigation (Training and Certification) Rules, 2021 and Marine Aids to Navigation (Accreditation of Training Organisations) Rules, 2021 framed under the ambit of Chapter VIII, Sections 18, 19 and 20 of the Act. (5) Headquarters of the Director General shall be the Directorate General of Aids to Navigation at Noida. The Director General will be assisted by officers and staff as sanctioned by the Central Government. (6) For the purpose of effective functioning of directorate general, the entire coastline of India shall be demarcated and defined as Districts of Marine Aids to Navigation as below: Sr.No Name of District Jurisdiction of the District Part of State of Gujarat – Costal stretches and Islands between International 1 Gandhidham Border Line (IBL) to Latitude 22°24’N. Part of State of Gujarat, State of Maharashtra and Union Territory of Daman 3 Mumbai – Coastal stretches and Islands between Latitude from 21°45’N to 16°30’N.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Part of State of Maharashtra, State of Goa and State of Karnataka - Coastal 4 Goa stretches and Islands between Latitude from 16°30’N to 12°45’N. State of Kerala and Union Territory of Lakshadweep - Coastal stretches and 5 Kochi Islands between Latitude from 12°45’N to 08°17’N. Coastal stretches and Islands of State of Tamil Nadu and Union Territory of 6 Chennai Pondicherry including Gulf of Mannar Coastal stretches and Islands of State of Andhra Pradesh between Latitude 7 Visakhapatnam from 13°27’N to 18° 12’N Part of State of Andhra Pradesh, State of Orissa and West Bengal – Coastal 8 Kolkata Stretches and Islands between Latitude from 18°12’N to International Border Line (IBL). 9 Port Blair Entire Union Territory of Andaman and Nicobar Islands Note: a. The administration of certain aids to navigation might vary depending upon locational advantage, technical sustainability and administrative expediency, which shall be notified by the Director General from time to time. b. Based on to the technological advancement and trade development, further redistribution of jurisdiction of districts might be necessary, which shall be implemented and notified by the Director General, with prior approval of the Central Government. (7) Two or more Districts shall be grouped as zone for inspection, monitoring, operational & technical sustainability and administrative expediency, and shall be headed by the Deputy Director General. (8) The office of each district will be designated as Directorate of Marine Aids to Navigation. Notwithstanding anything contained above in sub-rule 8, the administrative charge and control of each District, except Gandhidham, shall be delegated to the Director, who shall be responsible to the Director General for the general administration of Aids to Navigation of respective district. (9) The administrative charge and control of Gandhidham District, having a Vessel Traffic Service setup, shall be delegated to the Deputy Director General who will be responsible to the Director General for the general administration of Aids to Navigation including vessel traffic services in his district. 4. Marine Navigation Training Institute and its campuses: (1) There shall be a Training Institute at Kolkata to impart training on Marine Aids to Navigation and Vessel Traffic Services. (2) The Director General shall be responsible for all matters pertaining to the Training Institute. (3) The Director General may delegate such responsibility(ies) referred to under sub-rule (2) to the officer not below the rank of Director. (4) As a part of skilled capacity building, the Central Government may establish satellite campuses of the Training Institute at other locations in India. (5) The Training Institute shall undertake Research & Development activities in the field of aids to navigation and vessel traffic services to remain abreast with the global developments. 5. Duties of Director General: The Director General shall be responsible for discharging the following duties:- (1) Executing administrative, technical, financial and statutory functions as head of the Directorate General of Aids to Navigation. (2) Implementing provisions of the Act. (3) Advising the Government of India for all matters related to Marine Aids to Navigation. (4) Managing the Marine Aids to Navigation Dues in accordance with the Marine Aids to Navigation (Accounting and Financial Power) Rules, 2021. (5) Discharging the role of Member Secretary to the Central Advisory Committee on Marine Aids to Navigation. (6) Representing as a national member at International Association of Marine Aids to Navigation and Lighthouse Authorities (IALA). (7) Liaisoning with national and international organisations on matters pertaining to Marine Aids to Navigation including Vessel Traffic Services.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (8) Implementing International Conventions and Treaties pertaining to Marine Aids to Navigation, to which India is a party. (9) Entering into bilateral or multilateral memorandum of understanding/ memorandum of association with the countries on the matters related with development of Marine Aids to Navigation and training. (10) Discharging the role of Member of Navigational Safety in Ports Committee (NSPC); (11) Inspecting Local Aids to Navigation along the coastline of India including Andaman & Nicobar and Lakshadweep Islands. (12) Advising State Government, State Maritime Boards, Major and Minor Ports, Department of Fisheries and other sister organisations on the provision and improvement of Local Aids to Navigation. (13) Managing and operating of certain Vessel Traffic Service, at the request of respective Vessel Traffic Service provider on payment basis, as per the direction of Central Government. (14) Researching, developing and adopting of evolving technologies including development of test beds in the field of Marine Aids to Navigation. (15) Planning, developing, executing and managing General Aids to Navigation along the coast line of India including the maritime zones. (16) Harmonising operation of Marine Aids to Navigation. (17) Facilitating unobstructed functioning of General Aids to Navigation. (18) Ensuring uninterrupted availability of General Aids to Navigation with specified accuracy as per IALA standards. (19) Planning, developing, executing and managing Heritage Lighthouses for cultural, educational and tourism purposes. (20) Formulating risk assessment policy for augmentation of Marine Aids to Navigation including Vessel Traffic Services along the coast line of India including the maritime zones. (21) Developing and managing a national training plan for capacity building in the field of Aids to Navigation and Vessel Traffic Service. (22) Managing national data bank of Aids to Navigation and Vessel Traffic Service personnel and their status on training. (23) Training and certification of Aids to Navigation and Vessel Traffic Service personnel. (24) Accreditation of training organisations and follow-up audits. (25) Marking of wrecks in fairways as per the direction of Central Government. (26) Undertaking periodical appraisal to the Central Government on matters related to the Directorate General of Aids to Navigation. (27) Any other duties as may be assigned by the Central Government from time to time. 6. Powers of Director General: The Director General shall be entitled to: (1) Exercise administrative, technical, financial and statutory functions as the Head of the Department as vested under the rules of Central Government. (2) Exercise the delegated powers issued by the Ministry of Port, Shipping and Waterways from time to time. (3) Issue orders, manuals, notices, SoPs, instructions for internal functioning under the ambit of the Act. (4) Implement the provisions of Marine Aids to Navigation dues including review of rates and modalities for collection and refund. (5) Convene the meeting of Central Advisory Committee on Marine Aids to Navigation on the advice of chairman and to sanction travel expenses to non-official members to attend Central Advisory Committee on Marine Aids to Navigation Meetings in accordance with Marine Aids to Navigation (Central Advisory Committee Procedural) Rules, 2021. (6) Nominate delegations to participate in the conferences, workshops, symposium, seminars and trainings organised under the aegis of IALA with the prior approval of the Central Government. (7) Nominate delegations to represent in the bilateral and multilateral international forums on the matters related to Marine Aids to navigation including vessel traffic service with the prior approval of the Central Government. (8) Convene meetings of stakeholders on the matters related to Marine Aids to Navigation and other related emerging scenarios. (9) Inspect any ―local‖ aids to navigation and seek required information from the local authority pertaining to respective Aids to Navigation and subsequently:- (a) Suggest corrective action, in case of any discrepancy observed. (b) Undertake restoration of Aids to Navigation service on request against payment of such cost. (10) Sanction schemes pertaining to research and development to remain abreast with the evolving technologies in the field of Marine Aids to Navigation. (11) Sanction schemes for development, execution and management of General Aids to Navigation. (12) Initiate such action as may be necessary to restrict activities which interfere or obstruct the operation of aids to navigation. (13) Sanction schemes for development, operation, maintenance and management of heritage lighthouses for cultural, educational and tourism purposes.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (14) Sanction schemes for promotion of tourism at potential lighthouses. (15) Seek information on the training status of Aids to Navigation/ Vessel Traffic Service personnel from the respective providers of such training. (16) Deal with matters pertaining to accreditation, training and certification in accordance with Marine Aids to Navigation (Training and Certification) Rules, 2021and Marine Aids to Navigation (Accreditation of Training Organisations) Rules, 2021. (17) Enter into memorandum of understanding/ memorandum of association with IALA / IALA WWA in the matters pertaining to training and certification. (18) Engage professional services and outsourced manpower for development, operation and maintenance of General Aids to Navigation, Heritage Lighthouse and Vessel Traffic Service with the prior approval of the Central Government, as per the norms prescribed by the Central Government from time to time. (19) Outsource faculty and resources for discharging the functions pertaining to training & certification of Aids to Navigation/ Vessel Traffic Service personnel. (20) Administer the flag code, emblem and uniform code of personnel of the Directorate General of Marine Aids to Navigation. (21) Sanction schemes for marking of wrecks. (22) Release of foreign exchange for import of essential items & services for establishment and maintenance of General Aids to Navigation, subject to prior approval of scheme by the Central Government. 7. Power to Delegate: The Director General may delegate any of his powers under these rules or any of the powers delegated to the Director General under the Act or otherwise, to his officers by general or special order in writing, subject to such restrictions, limitations and conditions, if any.
