## Policy Analysis Report: Amendment to National Commission for Homoeopathy Act, 2020
**1. Executive Summary:**
This report analyzes an amendment to the National Commission for Homoeopathy Act, 2020, specifically focusing on changes to the composition and term of office of Part-time Members within the commission. The amendment, published in the Gazette of India on June 14, 2022, substitutes the names of two Part-time Members and clarifies their term of office to be four years or until further orders, whichever is earlier, effective from the date of assumption of charge. This amendment aims to ensure the smooth functioning of the National Commission for Homoeopathy by clarifying the terms of appointment for specific roles.
**2. Introduction:**
This report provides an informative analysis of the notification S.O. 2716(E) issued by the Ministry of AYUSH, published in the Gazette of India on June 14, 2022. This notification pertains to amendments to the National Commission for Homoeopathy Act, 2020, based solely on the information provided within the given text.
**3. Policy Overview:**
* **Original Policy:** This amendment modifies the notification S.O 2694 E, dated the 5th July, 2021, which itself relates to the National Commission for Homoeopathy Act, 2020 (15 of 2020).
* **Core Objective(s):** The core objective of the overarching act, inferred from the text, is to regulate and develop the Homoeopathy system of medicine. The *specific amendment* aims to facilitate the efficient operation of the National Commission for Homoeopathy.
**4. Background and Rationale:**
This amendment likely addresses a need for clarification regarding the appointment and terms of service of Part-time Members within the National Commission for Homoeopathy. Specifically, the amendment substitutes existing members and explicitly defines the term of office for certain Part-time Members. This suggests a previous lack of clarity or a need for updated appointments within the Commission. The amendment ensures a consistent and defined period of service, contributing to the Commission's stability and effectiveness.
**5. Key Provisions / Changes:**
This notification introduces two key changes:
* **Substitution of Part-time Members:** The amendment replaces the names of two Part-time Members listed under clause (a) of subsection 4 of section 4 of the original notification. The new members and their designations are:
* Dr. Gautam Ash, Retired Professor, National Institute of Homoeopathy
* Dr. Hitesh G. Purohit, Principal, Malini Kishore Sanghvi Homoeopathic Medical College, Karjan, Vadodara
* **Term of Office Clarification:** A new paragraph (4) is inserted to define the term of office for the aforementioned Part-time Members. It states that their term shall be "four years or until further orders, whichever is earlier, with effect from the date of assumption of charge of the post."
The effect of these changes is to update the membership roster and explicitly define the duration of service for these specific Part-time Members, ensuring clarity and potentially promoting stability within the Commission.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by this amendment include:
* The National Commission for Homoeopathy and its members.
* The Ministry of AYUSH.
* Dr. Gautam Ash and Dr. Hitesh G. Purohit, the newly appointed Part-time Members.
* Homoeopathic medical colleges and institutions, especially the National Institute of Homoeopathy and Malini Kishore Sanghvi Homoeopathic Medical College.
* Potentially, other members of the Homoeopathy profession in India.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of AYUSH is the responsible agency, as evidenced by the notification.
* **Timelines/Procedures:** The amendment specifies that the term of office is effective "from the date of assumption of charge of the post." This implies a procedure for the new members to formally assume their roles. The term length is four years or until further notice.
* **Specific to Changes:** Dr. Gautam Ash and Dr. Hitesh G. Purohit would need to officially assume their roles for the amendment to be fully implemented.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these specific changes include:
* **Smooth Functioning of the Commission:** Clarifying the term of office for Part-time Members contributes to the efficient and stable operation of the National Commission for Homoeopathy.
* **Enhanced Expertise:** The appointment of a retired Professor from the National Institute of Homoeopathy and a Principal from a Homoeopathic Medical College ensures the Commission benefits from experienced and knowledgeable individuals in the field.
* **Clear Governance Structure:** Defining the term length promotes a clear governance structure and reduces potential ambiguity.
**9. Conclusion:**
The amendment to the National Commission for Homoeopathy Act, 2020, detailed in notification S.O. 2716(E), focuses on refining the composition and tenure of specific Part-time Members. By substituting members and explicitly stating their term of office, the amendment contributes to the efficiency and stability of the Commission, ultimately supporting the regulation and development of Homoeopathy in India. The changes, while specific, are significant for ensuring the Commission is well-equipped with qualified individuals operating under a clear governance framework.
