L.-33004/99 सी.जी.-डी.एल.-अ.-12092024-257111 CG-DxLx-xEG-I1D2H0x9x2x0 24-257111 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3581] नई ददल्ली, बृहस्ट्प जतवार, जसतम्ब र 12, 2024/भाद्र 21, 1946 No. 3581] NEW DELHI, THURSDAY, SEPTEMBER 12, 2024/BHADRA 21, 1946 वस्ट्र मरं ालय आदेि नई ददल् ली, 12 जसतम्ब र, 2024 का.आ. 3916(अ).—भारतीय मानक ब्यरू ो अजधजनयम, 2016 (2016 का 11) की धारा 17 और धारा 25 की उपधारा (3) के साथ पठित धारा 16 की उप धारा (1) और (2) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केंद्र सरकार का मत ह ै दक सावविजनक जहत में ऐसा दकया िाना आवश् यक ह ै और भारतीय मानक ब्यूरो से परामिव करने के बाद, एतद्द्वारा, जनम्नजलजखत आदिे दकया िाता है, नामत :- 1. सजं िप्त िीर्कव और प्रारंभ – (1) इस आदिे को प्रोटेजटटव टेटसटाइल्स गणु वत् ता जनयंरण (नॉन-डोमेजस्ट्टक फनीचर हते ु अपहोलस्ट् टडव कंपोजिट्स) आदेि, 2024 कहा िाएगा। (2) यह, इसके िासकीय रािपर में प्रकाजित होन े की जतजथ स ेलागू होगा। 2. प्रयोज्य ता - यह आदेि जनम्न जलजखत पर लाग ूहोगा – (क) इस आदिे के अनुबंध के रूप म ें संलग् न अनुसूची के कॉलम (2)में जनर्दवष्ट सामान या वस्ट्तओंु पर लाग ू होगा । परंत ु यह, जनयावत के जलए बने सामानों या वस्ट्तुओं पर लागू नहीं होगा। (ख) अपहोल्स्ट् टडव कंपोजिट्स या फैजिक जिसका कच् ची सामग्री या रोल् स के रूप म ें व् यापार दकया िाता ह ै अथवा नॉन-डोमेजस्ट्टक फनीचर के संयोिन के रूप म ेंप्रयोग दकया िाता ह:ै 5866 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते दक नॉन-डोमेजस्ट्टक फनीचर, जिसमें अपहोस्ट् टड व फैजिक को तैयार उत् पाद के भाग के रूप में प्रयोग दकया गया ह,ै के संयोिन का व् यापार करने वाल े उद्योग(जवजनमावण या आयातक) को 31 माचव 2025 तक इस आदेि से छूट रहगे ी। 3. मानक जचह्न का अजनवाय वउपयोग - उि अनुसूची के कॉलम (2) में जनर्दष्टव सामान या वस्ट्त ु उसके कॉलम (3) म ें जनर्दवष्ट सदिृ भारतीय मानक के अनरूु प होंगी और उन पर भारतीय मानक ब्यूरो (अनरूु पता आकलन) जवजनयम, 2018 की अनुसूची-II की योिना-I के अनुसार भारतीय मानक ब्यूरो से प्राप् त लाइसेंस के तहत मानक जचह्न अंदकत होगा। 4. प्रमाणन और प्रवतनव प्राजधकारी - भारतीय मानक ब्यूरो उि अनुसूची के कॉलम (2) म ें जनर्दवष्ट सामानों या वस्ट्तुओं के संबंध म ेंप्रमाणन और प्रवतनव प्राजधकारी होगा। अनसु चू ी भारतीय मानक क्र.स.ं सामान या वस्ट्तएु ं भारतीय मानक का िीर्कव (आईएस) (1) (2) (3) (4) नॉन डोमेजस्ट्टक फनीचर हते ु वस्ट् र - नॉन डोमेजस्ट्टक फनीचर हते ु प्रयोग आईएस 15768 : 1 प्रयोग दकए िान े वाल े दकए िाने वाले अपहोस्ट् टडव कंपोजिट्स की 2008 अपहोस्ट् टड वकंपोजिट्स ज्व लन स ेप्रजतरोधक िमता – जवजनदेिन नोट: (1) अनुसूची के प्रयोिनों के जलए, यह स्ट्पष्ट दकया िाता ह ै दक भारतीय मानक ब्यरू ो द्वारा भारतीय मानक अजधजनयम, 2016 (2016 का 11) की धारा 2 के खंड (17) के उपबंधों के अनुसार समय-समय पर स्ट्थाजपत और प्रकाजित भारतीय मानकों का नवीनतम संस्ट्करण, ऐसे प्रकािन की तारीख से लागू होगा। (2) इस आदेि के संबंध में ‘नॉन-डोमेजस्ट्टक फनीचर’ की पठरभार्ा के जलए भारतीय मानक ब् यूरो द्वारा िारी आईएस 15768 : 2008 स ेदेखा िाएगा। (3) इस आदिे के प्रयोिन और प्रभाव िेर हते ु, कोई भी उद्योग या फमव िो घरेल ू प्रयोिनों हते ु अपहोस्ट् टडव फनीचर का जनमावण या उसका संयोिन करना चाहता है, उस े आईएस 15768 : 2008 के तहत इस आिय की स्ट् वघोर्णा करनी होगी दक ‘उनके उत् पाद घरेल ू आवश् यकताओं के जलए बनाए गए ह।ैं ’ यह घोर्णा अनुपालन के प्रयोिनों हते ु पयावप् त मानी िाएगी। (4) यह आदेि ददनांक 12 जसतंबर 2024 की अजधसूचना संख्य ा स.आ.3896(अ) के द्वारा भारत के रािपर, असाधारण के भाग II, खंड 3, उप-खंड (ii) म ें प्रकाजित प्रोटेजटटव टेटस टाइल् स (गुणवत् ता जनयंरण) संिोधन आदेि, 2024 के क्रम म ेंिारी दकया िाता ह।ै [फा. स.ं 6/1/2021-आरएंडडी (पाटव-3)] रािीव सटसेना, संयटु त सजचव[भाग II—खण् ड 3(ii)] भारत का रािपर : असाधारण 3 MINISTRY OF TEXTILES ORDER New Delhi, the 12th September, 2024 S.O. 3916(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary so to do in the public interest and after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:- 1. Short title and commencement.– (1) This Order may be called the Protective Textiles Quality Control (Upholstered Composites used for Non-Domestic Furniture) Order, 2024. (2) It shall come into force on the date of its publication in the Official Gazette. 2. Application – This Order shall apply to :- (a) goods or articles specified in column (2) of the Schedule annexed to this Order, but shall not apply to such goods or article meant for export; (b) upholstered composites or fabric traded as raw material or rolls or used in assembly of non-domestic furniture : Provided that the industry dealing with the assembly of non - domestic furniture (manufacturing or importing) , wherein upholstered fabric is used as part of the finished furniture product shall be exempted from this Quality Control Order till 31st March 2025. 3. Compulsory use of Standard Mark. – The goods or article specified in column (2) of the said Schedule shall conform to the corresponding Indian Standard specified in column (3) thereof and shall bear the Standard Mark under a licence from the Bureau in accordance with Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 4. Certification and enforcement authority. – The Bureau shall be the certifying and enforcing authority in respect of the goods or article specified in column (2) of the said Schedule. SCHEDULE Indian Standard Sl. No. Goods or article Title of Indian Standard (IS) (1) (2) (3) (4) Upholstered Textiles - Resistance to ignition of composites used for 1 IS 15768 : 2008 upholstered composites used for non- non-domestic domestic furniture – Specification furniture Note: (1) For the purposes of the Schedule, it is clarified that the latest version of Indian Standards established and published by the Bureau from time to time in accordance with the provisions of clause (17) of section 2 of the Bureau of Indian Standards Act, 2016 (11 of 2016), shall apply from the date of such publication. (2) Definition of “non- domestic furniture” with regards to this Order is to be referred from the standard IS 15768:2008 issued by Bureau of Indian Standards. (3) For the purpose and scope of this Order, any industry or firms who wish to manufacture or assemble upholstered furniture for domestic purposes shall have to give a Self- Declaration under IS 15768: 2008 that ‘their products are meant for domestic requirements’. This declaration is deemed sufficient for compliance purposes. (4) This Order issues in continuation to the Protective Textiles (Quality Control) Amendment Order, 2024 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub – Section (ii), vide notification number S.O. 3896 (E) dated 12th September 2024.
