No. 3 भाग IV PART IV राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI कायाला य मण्डलायक्ु त [िनगणना िाखा (रािस्ट्व)] अजधसचू ना दिल्ली, 6 अप्रलै , 2026 फा. स.ं 36 (146)/िनगणना/ मडं लायक्ु त /2025/983.—दिनांक. 06.04.2026 भारत सरकार गृह मंत्रालय की अजधसूचना संख्या 2/1/60 — िुडल-2 दिनांक 20 अप्रैल, 1960 के साथ पठित िनगणना अजधजनयम, 1948 के जनयम, 1990 के जनयम 8(ii) म ें प्रित्त िजियों का प्रयोग करत े हुए राष्ट्रीय रािधानी क्षत्रे , दिल्ली सरकार के उपराज्यपाल राष्ट्रीय रािधानी क्षत्रे , दिल्ली म ेंरहने वाले व्यजियों को उनस े भारत की िनगणना 2027 स े संबंजधत पछू े गय े प्रश्नों के बारे म ेंसही व् स्ट्पष्ट सूचना प्रिान करने के जनिेि िते े ह।ै िनगणना आंकडों का प्राथजमक स्रोत ह ै िो मकान की जस्ट्थजत, सुजवधाओं और संपजत्तयों, िनसांजख्यकी, साक्षरता, धम,ा आर्थाक गजतजवजध, प्रवासन, प्रिनन क्षमता आदि जनम्नतम प्रिासजनक इकाइयों तक अथाात ग्रामीण क्षेत्रों म ें गांवों और िहरी क्षेत्रों म ेंनगरों/वाडों तक उपलब्ध होता ह।ै इसका व्यापक उपयोग केंद्र/राज्य/सघं राज्य क्षेत्रों की सरकारों द्वारा योिना जनमाणा , नीजत जनधाारण और प्रभावी सावािजनक प्रिासन के जलए दकया िाता ह।ै इसके अजतठरि, िनगणना आंकडों का उपयोग ससं िीय, जवधानसभा, पंचायतों 2450 DG/2026 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] और अन्य स्ट्थानीय जनकायों के जनवााचन क्षेत्रों के पठरसीमन और आरक्षण के जलए भी दकया िाता ह।ै अतः, िनता स े अपेक्षा की िाती ह ैदक व े िनगणना काया म ेंसहयोग करें और सही िानकारी प्रिान करें। िनगणना अजधजनयम, 1948 के कुछ महत्वपूणा प्रावधान, अथाात् धारा 8, 9, 10, अजधजनयम धारा 11 के तहत जनधााठरत िंडों का सारांि और िनगणना अजधजनयम, 1948 (अजधजनयम संख्या 37 ऑफ 1948) की धारा 15 और िनगणना जनयम 1990 के तहत जनरीक्षण के जलए अनुपलब्ध और साक्ष्य में स्ट्वीकाया नहीं िनगणना अजभलेखों को िनता की िानकारी के जलए नीचे पुनः प्रस्ट्तुत दकया गया ह।ै (i) धारा 8:-प्रश्नों का पछू ा िाना और उत्तर िेन े की बाध्यता- (1) िनगणना अजधकारी उस स्ट्थानीय क्षत्रे की सीमा म,ें जिसके जलए जनयुजि की गई ह ै सभी व्यजियों स े ऐस े सभी प्रश्न पछू सकेगा जिन्ह ेंपछू ने के जलए, उसे केन्द्रीय सरकार द्वारा इस जनजमत्त िारी और रािपत्र म ेंप्रकाजित दकए गए अनुिेिों द्वारा, जनदिष्ट दकया िाए। (2) ऐसा प्रत्येक व्यजि, जिससे उपधारा (1) के अधीन कोई प्रश्न पछू ा िाता ह,ै अपनी सवोत्तम िानकारी या जवश्वास के अनुसार उस प्रश्न का उत्तर िने े के जलए वैध रूप स ेआबद्ध होगा: परंतु कोई भी व्यजि अपन ेपठरवार के दकसी स्त्री सिस्ट्य का नाम बताने के जलए आबद्ध नहीं होगा और कोई भी स्त्री अपने पजत या मृत पजत का अथवा ऐसे दकसी अन्य व्यजि का नाम बताने के जलए आबद्ध नहीं होगी जिसका नाम बताने के जलए वह रूद़ि द्वारा जनजिद्ध की गई हो। (ii) धारा 9:-अजधभोगी प्रवेि करने और संख्यांक लगान े िेना- दकसी गृह, अहाते, िलयान या अन्य स्ट्थान का अजधभोग करन ेवाला प्रत्येक व्यजि, िनगणना अजधकाठरयों को उसम ें ऐसा प्रवेि करन े िने े की अनुज्ञा िेगा जिसकी वे िनगणना के प्रयोिनो के जलए अपेक्षा करें तथा िो ििे की रूद़ियों को ध्यान म ेंरखते हुए युजियिु हों, और वह उनको ऐसे अक्षरो, जचन्हों या संख्यांकों स ेिो िनगणना के प्रयोिनों के जलए आवश्यक हों, उस स्ट्थान को अंदकत करने की, या उनको उस स्ट्थान पर लगान े िेन े की अनुज्ञा िगे ा। (iii) धारा 10:-अजधभोगी या प्रबन्धक द्वारा अनुसूची का भरा िाना- (1) ऐसे आिेिों के अधीन रहते हुए, िैसे िनगणना आयिु इस जनजमत्त िारी करे, िनगणना अजधकारी, ऐसे स्ट्थानीय क्षत्रे म ें जिसके जलए उसकी जनयजु ि की गई ह,ै दकसी जनवासगहृ म ें या दकसी वाजणजज्यक अथवा औद्योजगक स्ट्थापन के प्रबंधक या दकसी अजधकारी के पास एक अनुसूची, िनगणना करने के समय, यथाजस्ट्थजत, ऐसे गृह या उसके दकसी भाग म ें सहवाजसयों, या ऐसे प्रबंधक या अजधकारी के अधीन जनयोजित व्यजियों के बारे म,ें ऐसे गृह या उसके दकसी जवजनर्िाष्ट भाग के अजधभोगी द्वारा या ऐसे प्रबंधक या अजधकारी द्वारा उसम ेऐसी जवजिजष्टयां, िसै ी िनगणना आयिु जनदिष्ट करे, भरन े के प्रयोिन के जलए रख सकेगा या रखवा सकेगा। (2) िब ऐसी अनुसूची इस प्रकार रख िी िाए तब, यथाजस्ट्थजत, उि अजधभोगी, प्रबधं क या अजधकारी, पूवोि समय पर, यथाजस्ट्थजत, ऐस े गृह या उसके दकसी भाग के सहवाजसयों या उसके अधीन जनयोजित व्यजियों के संबंध म,ें उस े अपनी सवोत्तम िानकारी या जवश्वास के अनुसार भरेगा या भरवाएगा और उस पर अपने हस्ट्ताक्षर करेगा, और िब उससे ऐसी अपेक्षा की िाए तब वह इस प्रकार भरी गई और हस्ट्ताक्षठरत अनुसूची, िनगणना अजधकारी को या ऐस े व्यजि को जिसे िनगणना अजधकारी जनदिष्ट करे, पठरित्त करेगा। (iv) धारा 11:-िाजस्ट्तया ं (1) - (क) कोई ऐसा िनगणना अजधकारी या िनगणना करने म ेंसहायता िेने के जलए जवजधपूवाक अपेजक्षत कोई ऐसा व्यजि, िो इस अजधजनयम या इसके अधीन बनाए गए दकसी जनयम द्वारा उस पर अजधरोजपत दकसी कताव्य का पालन करने स े इंकार करेगा या कोई ऐसा व्यजि िो दकसी ऐसे कतव्या का पालन म ें अन्य व्यजि को प्रजतबंजधत या बाजधत करेगा, या (कक) कोई ऐसा िनगणना अजधकारी या िनगणना करन े म ें सहायता िेने के जलए जवजधपूवका अपेजक्षत कोई ऐसा व्यजि, िो इस अजधजनयम या इसके अधीन बनाए गए दकसी जनयम के अनुसार उस पर अजधरोजपत दकसी कताव्य का पालन करन े म ें या उसको दिए गए दकसी आिेि के पालन करने म ें युजियिु तत्परता बरतन े म ें अपक्षे ा करेगा, या कोई ऐसा व्यजि िो दकसी ऐसे कताव्य का पालन करने म ें या दकसी ऐसे आिेि का पालन करने म ें अन्य व्यजि को प्रजतबंजधत या बाजधत करेगा, या (घ) कोई ऐसा व्यजि, िो िनगणना अजधकारी द्वारा उससे पछू े गए दकसी ऐस े प्रश्न का, जिसका उत्तर िेन े के जलए वह धारा 8 द्वारा वैध रूप स ेआबद्ध ह,ै सािय जमथ्या उत्तर िगे ा, या अपनी सवोत्तम िानकारी या जवश्वास के अनुसार उत्तर िेन े स े इंकार करेगा, या[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (ङ) दकसी गृह, अहाते, िलयान या अन्य स्ट्थान का अजधभोग करने वाला कोई ऐसा व्यजि, िो िनगणना अजधकारी को उसम ें ऐसा युजियुि प्रवेि करने िेने स े इंकार करेगा िैसा दक वह धारा 9 द्वारा अनुज्ञा िने े के जलए अपेजक्षत ह,ै या (च) कोई ऐसा व्यजि, िो दकन्ही ऐसे अक्षरो, जचन्हों, या संख्याकं ों को, जिन्ह ें िनगणना के प्रयोिनों के जलए अंदकत दकया या लगाया गया ह,ै हटाएगा, जमटाएगा, पठरवर्तात करेगा, या उन्ह ेंनुकसान पहुचं ाएगा, या (छ) कोई ऐसा व्यजि, जिससे धारा 10 के अधीन अनुसूची भरने की अपेक्षा की गई हो, िानत े हुए और जबना पयााप्त हते ुक के उस धारा के उपबंधों का अनुपालन करन े म ेंअसफल रहगे ा, उसके अधीन कोई जमथ्या जववरणी िेगा, या (ि) कोई ऐसा व्यजि, िो िनगणना कायाालय म ें अजतचार करेगा, या िुमााने स,े िो एक हिार रुपय े तक का हो सकेगा, िंडनीय होगा और भाग (क) के अधीन दकसी िोिजसजद्ध की ििा म ें कारावास स े भी, िो तीन वि ा का हो सकेगा, िडं नीय होगा।] (2) िो कोई उपधारा (1) के अधीन दकसी अपराध का िष्प्ु प्रेरण करेगा, वह िुमाान े स,े िो एक हिार रूपए तक का हो सकेगा, िडं णीय होगा। (v) धारा 15:-िनगणना के अजभलेखों का जनरीक्षण नहीं दकया िा सकेगा और न वे साक्ष्य म ेंग्राह्य होंग-े दकसी भी व्यजि को, िनगणना अजधकारी द्वारा उस हजै सयत म ें अपने कताव्य के जनवाहन म ें तैयार की गई दकसी पुस्ट्तक, रजिस्ट्टर या अजभलेख का, अथवा धारा 10 के अधीन पठरित्त दकसी अनुसूची का, जनरीक्षण करने का अजधकार नहीं होगा, और भारतीय साक्ष्य अजधजनयम, 2023 (2023 का 47) म ें दकसी प्रजतकूल बात के होत े हुए भी, दकसी ऐसी पुस्ट्तक, रजिस्ट्टर, अजभलेख या अनुसूची म ें की कोई भी प्रजवजष्ट दकसी ऐसे काय ा या लोप के जलए, िो इस अजधजनयम के अधीन अपराध बनता ह ैइस अजधजनयम या दकसी अन्य जवजध के अधीन दकए गए अजभयोिन स े जभन्न दकसी भी प्रकार की दकसी जसजवल कायावाही म ें अथवा दकसी िांजडक कायावाही म ें साक्ष्य के रूप म ें ग्राह नहीं होगी। उपरोि अंि सामान्य िानकारी के जलए दिए गए ह;ैं दकसी भी जवसंगजत की जस्ट्थजत म,ें अजधजनयम और जनयमों के प्रावधान प्रभावी होंगे। jk"Vªh; jkt/kkuh {k=s fnYyh ds mijkT;iky ds vkns'k ls rFkk muds uke ij] नीरि सेमवाल, सजचव (रािस्ट्व जवभाग) OFFICE OF THE DIVISIONAL COMMISSIONER [Revenue Department, (Census Branch)] NOTIFICATION Delhi, the 6th April, 2026 F.No. 36 (146)/Census/Div-Comm/2025/983.—Dated: 06.04.2026-In exercise of the powers conferred by Rule 8 (ii) of Census Rule, 1990, of the Census Act, 1948, read with the Govt. of India, Ministry of Home Affairs' Notification No. 2/1/60-Judl.Il dated the 20 April, 1960, the Lt. Governor of National Capital Territory of Delhi hereby directs the public residing in the National Capital Territory of Delhi, to cooperate in furnishing accurate and unambiguous information in respect of the question that may be put to them in respect of Census of India 2027. The Census is the primary source of data up to the lowest administrative units, i.e. villages in rural areas and town/wards in urban areas on Housing Condition; Amenities & Assets, Demography, Literacy, Religion, Economic Activity, Migration, Fertility etc. It is widely used for planning and formulation of policies and effective Public Administration by the Central/State/UT Governments. Apart from this, Census data are used for delimitation and reservation of Constituencies for4 DELHI GAZETTE : EXTRAORDINARY PART IV] Parliamentary, Assembly, Panchayats and other Local Bodies. Thus, the public are to cooperate in census taking and provide the correct information. Some of the important provisions in the Census Act, 1948 namely Section 8, 9, 10 along with an extract of penalties prescribed under section 11 of the Act and also records of census not open to inspection nor admissible in evidence under Section 15 of the Census Act, 1948 (Act no. 37 of 1948) and Census Rule 1990 are hereby reproduced below for the information of public. (i) Section 8:- Asking of questions and obligation to answer. (1) A census-officer may ask all such questions of all persons within the limits of the local area for which he is appointed as, by instructions issued in this behalf by the Central Government and published in the Official Gazette, he may be directed to ask. (2) Every person of whom any question is asked under sub-section (1) shall be legally bound to answer such question to the best of his knowledge or belief: Provided that no person shall be bound to state the name of any female member of his household, and no woman shall be bound to state the name of her husband or deceased husband or of any other person whose name she is forbidden by custom to mention. (ii) Section 9:- Occupier to permit access and affixing of numbers. Every person occupying any house, enclosure, vessel or other place shall allow census-officers such access thereto as they may require for the purposes of the census and as, having regard to the customs of the country, may be reasonable, and shall allow them to paint on, or affix to, the place such letters, marks or numbers as may be necessary for the purposes of the census. (iii) Section 10:- Occupier or manager to fill up schedule. (1) Subject to such orders as the Census Commissioner may issue in this behalf, a census-officer may, within the local area for which he is appointed, leave or cause to be left a schedule at any dwelling- house or with the manager or any officer of any commercial or industrial establishment, for the purpose of its being filled up by the occupiers of such house or of any specified part thereof or by such manager or officer with such particulars as the Census Commissioner may direct regarding the inmates of such house or part thereof, or the persons employed under such manager or officer, as the case may be, at the time of the taking of the census. (2) When such schedule has been so left, the said occupier, manager or officer, as the case may be, shall fill it up or cause it to be filled up to the best of his knowledge or belief so far as regards the inmates of such house or part thereof or the persons employed under him, as the case may be, at the time aforesaid, and shall sign his name thereto and, when so required, shall deliver the schedule so filled up and signed to the census-officer or to such person as the census-officer may direct. (iv) Section 11:-Penalties. (1) - (a) Any census-officer or any person lawfully required to give assistance towards the taking of census who refuses to perform any duty imposed upon him by this Act or any rule made thereunder, or any person who hinders or obstructs another person in performing any such duty, or (aa) any census-officer or any person lawfully required to give assistance towards the taking of a census who neglects to use reasonable diligence in performing any duty imposed upon him or in obeying any order issued to him in accordance with this Act or any rule made thereunder, or any person who hinders or obstructs another person in performing any such duty or obeying any such order, or;[PART IV DELHI GAZETTE : EXTRAORDINARY 5 (d) any person who intentionally gives a false answer to, or refuses to answer to the best of his knowledge or belief, any question asked of him by a census-officer which he is legally bound by section 8 to answer, or (e) any person occupying any house, enclosure, vessel or other place who refuses to allow a census- officer such reasonable access thereto as he is required by section 9 to allow, or (f) any person who removes, obliterates, alters, or damages any letters, marks or numbers which have been painted or affixed for the purposes of the census, or (g) any person who, having been required under section 10 to fill up a schedule, knowingly and without sufficient cause fails to comply with the provisions of that section, or makes any false return there under, or (h) any person who trespasses into a census office, shall be punishable with fine which may extend to one thousand rupees and in case of a conviction under part (a) shall also be punishable with imprisonment which may extend to three years. (2) Whoever abets any offence under sub-section (1) shall be punishable with fine which may extend to one thousand rupees. (v) Section 15:- Records of census not open to inspection nor admissible in evidence. No person shall have a right to inspect any book, register or record made by census-officer in the discharge of his duty as such, or any schedule delivered under section 10, and notwithstanding anything to the contrary in the Bharatiya Sakshya Adhiniyam, 2023(47 of 2023), no entry in any such book, register, record or schedule shall be admissible as evidence in any civil proceeding whatsoever or in any criminal proceeding other than a prosecution under this Act or any other law for any act or omission which constitutes an offence under this Act.
