(1) इन जनयमों का संजक्षप्त नाम जनिःिल्ु क और अजनिायय बाल जिक्षा का अजधकार (संिोधन) जनयम, 2024 ह।ै (2) ये सरकारी रािपत्र में उनके प्रकािन की तारीख को लाग ूहोंगे। 2. जनिःिुल्क और अजनिायय बाल जिक्षा का अजधकार जनयम, 2010 में, भाग 5 के पश्चात जनम्नजलजखत भाग अंतिःस्ट्र्ाजपत दकया िाएगा, अर्ायत्:- “भाग 5 क- कजतपय मामलों म ेंपरीक्षा और रोका िाना 16 क. रीजत और ितें जिनके अध् यधीन दकसी बालक को रोका िा सकता है- (1) प्रत्येक िक्षै जणक िर्य के अंत पर पांचिीं कक्षा और आठिीं कक्षा म ेंजनयजमत परीक्षा होगी। 8258 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) उप-जनयम (1) म ें जनर्ियष्ट, जनयजमत परीक्षा के संचालन के पश्चात्, यदि कोई बालक समय-समय पर यर्ा अजधसूजचत, प्रोन्नजत मानिण्ड को पूरा करन े में असफल रहता ह,ै तो उसे पररणाम घोजर्त होने की तारीख से िो मास की अिजध के भीतर पनु िः परीक्षा के जलए अजतररक्त अनुिेि तर्ा अिसर दिया िाएगा। (3) यदि उप-जनयम (2) म ें जनर्ियष्ट पुन: परीक्षा म ें उपजस्ट्र्त होने िाला बालक, प्रोन्नजत के मानिण्ड को पूरा करन े में पुनिः असफल रहता ह,ै यताजस्ट्र्जत, पांचिीं कक्षा या आठिीं कक्षा म ेंरोक दिया िाएगा। (4) बालक को रोके रखन े के िौरान, कक्षा जिक्षक बालक के सार्-सार्, यदि आिश्यक हो तो, बालक के माता-जपता का भी मागयिियन करेगा तर्ा जनधारय ण के जिजभन्न चरणों पर अजधगम के अंतरालों की पहचान करने के पश्चात ् जििेर्ज्ञीय इनपुट प्रिान करेगा। (5) स्ट्कूल का प्रमुख उन बालकों की सूची बनाएगा िो रोके गए ह ैं तर्ा ऐसे बालकों को जििेर्ज्ञीय इनपुट के जलए प्रिान दकए गए उपबंधों तर्ा पहचाने गए अजधगम के अंतरालों के संबंध में उनकी प्रगजत पर व्यजक्तगत रूप से मॉनीटरी करेगा। (6) बालक के समग्र जिकास को पाने के जलए परीक्षा और पुन: परीक्षा सक्षमता-आधाररत परीक्षाएं होंगी तर्ा न दक याि करने और प्रदियात्मक कौिल पर आधाररत होंगी। (7) दकसी भी बालक को तब तक दकसी स्ट्कूल स ेनहीं जनकाला िाएगा िब तक िह प्रारंजभक जिक्षा पूरी नहीं कर लते ा।” [फा. स.ं 1-3/2017-ईई-4/आईएस-3] अजनल कुमार ससंघल, अपर सजचि रटप्पण.— मूल जनयम, भारत के रािपत्र, भाग-II, खंड-3, उपखंड (i), तारीख 9 अप्रलै , 2010 म ें अजधसूचना संखयांक सा.का.जन. 301(अ) तारीख 8 अप्रैल, 2010, द्वारा प्रकाजित दकए गए र् े तर्ा अंजतम बार अजधसूचना संखयांक सा.का.जन. 1302(अ), तारीख 17 अ‍त ूबर, 2017 द्वारा संिोजधत दकए गए र् े और भारत के रािपत्र, भाग-II, खंड-3, उपखंड (i), तारीख 17 अ‍ तूबर , 2017 को प्रकाजित हुए र्े। MINISTRY OF EDUCATION (Department of School Education and Literacy) NOTIFICATION New Delhi, the 16th December, 2024 G.S.R. 777(E).— In exercise of the powers conferred by clause (fa) of sub-section (2) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the Central Government hereby makes the following rules further to amend the Right of Children to Free and Compulsory Education Rules, 2010, namely :— 1. (1) These rules may be called the Right of Children to Free and Compulsory Education (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Right of Children to Free and Compulsory Education Rules, 2010, after Part V, the following Part shall be inserted, namely: - “PART VA- EXAMINATION AND HOLDING BACK IN CERTAIN CASES 16A. Manner and conditions subject to which a child may be held back . — (1)There shall be regular examination in the fifth class and in the eighth class at the end of every academic year.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) After the conduct of regular examination, referred to in sub- rule (1), if a child fails to fulfil the promotion criteria, as notified from time to time, he shall be given additional instruction and opportunity for re- examination within a period of two months from the date of declaration of results. (3) If the child appearing in the re-examination referred in sub -rule (2), fails to fulfil the promotion criteria again, he shall be held back in fifth class or eighth class, as the case may be. (4) During the holding back of the child, the class teacher shall guide the child as well as the parents of the child, if necessary, and provide specialised inputs after identifying the learning gaps at various stages of assessment. (5) The Head of the school shall maintain a list of children who are held back and personally monitor the provisions provided for specialised inputs to such children and their progress with respect to the identified learning gaps. (6) The examination and re-examination shall be competency-based examinations to achieve the holistic development of the child and not be based on memorisation and procedural skills.
