“अजधजनयम” स े अंतिेिीय िलयान (अजधजनयम), (2021) (2021 का 24) अजभप्रेत ह.ै (ख) "अन्द्तिेिीय पोत" का अि ग अजधजनयम की धारा 3 (म) के तहत पररभाजषत दकसी भी यांजत्रक रूप स े चाजलत अन्द्तििे ीय िलयान स े ह।ै (ग) “िोन” स े अजभप्रेत ह ै ऐसा अंतिेिीय िल ित्रे , िो राज्य सरकार इन जनयमों के जलए जनम्नजलजखत अजधकतम उल्लेखनीय तरंग ऊंचाई मानिण्ड पर जनभगर करत े हुए, िोन 1, िोन 2 और िोन 3 के रूप म ें अजधसूचना द्वारा िो उन्द्ह ें अजधजनयम म ेंजवजनर्िष्टग दकया गया ह।ै 3. अतं िेिीय िलयान: इन जनयमों के प्रयोिन के जलए अंतिेिीय िलयानों को जनम्नजलजखत श्रेजणयों के अनुसार वगीकृत दकया िाएगा: (1) िो िलयान श्रणे ी क म ेंआते ह,ैं वे जनम्नजलजखत म ें स े दकसी एक प्रकार के डेकनुमा िलयान होंग:े (क) िलयान िो [लम्बाई म ें24 मीटर] स े अजधक ह;ैं (ख) िलयान अिवा रो-रो यात्री फेरी िो [50] से अजधक यात्री ल ेिाते ह;ैं (ग) खींच कर ले िान े के जलए सजित सभी िलयान, जिनकी बोलाडग पलु िमता [10 टन] स ेअजधक ह;ै (घ) कागो के रूप म ें िोक म ें पेरोजलयम माल, रसायन अिवा तरलीकृत गैसों को वहन करने के जलए जडिाइन और जनमागण दकए गए िलयान; (ड.) वगीकरण सोसाइटी संघ (आईएसीएस) की सिस्ट्य ह,ै के सवेिण के अतं गतग जडिाइन, जनर्मगत और अनरु जित दकया िाएगा अिवा अजभजहत प्राजधकारी द्वारा उपयिु समझे गए जडिाइन, जनमागण और सवेिण के जलए जनधागररत मानकों के अनुसार जनर्मगत दकया िाएगा और अजभजहत प्राजधकारी के सवेिण के अतं गतग अनुरजित दकया िाएगा। 4. न्द्यनू तम चालक िल (1) प्रत्येक अन्द्तिेिीय िलयान म ें इन जनयमों के अधीन यिा जनधागररत ऑन-बोडग पर न्द्यूनतम चालक िल होगी। (2) प्रत्येक अन्द्तिेिीय िलयान पर लाग ू न्द्यनू तम चालक िल को सवेिणकता ग द्वारा सवेिण के प्रमाणपत्र म,ें िलयान के प्रकार और आकार, इसके प्रचालन ित्रे , इंिन िमता और ऐसे अन्द्य कारकों के अनुसार, िैसा भी मामला हो, ििग की िाएगी, िो समय-समय पर केंद्र सरकार द्वारा जनिेजित दकए िा सकत े ह।ैं (3) प्रत्येक स्ट्व-चाजलत अन्द्तििे ीय िलयान म ें प्रचालनाधीन होने पर बोड ग पर न्द्यनू तम जनम्नजलजखत चालक िल होगा: डेक चालक िल िीटी 500< 500≤ िीटी 1600< िीटी ≥1600 (क) एक मास्ट्टर (क) एक मास्ट्टर जिसके पास (क) एक मास्ट्टर जिसके पास इनलैंड मास्ट्टर श्रेणी1 इनलैंड मास्ट्टर श्रेणी 3 / इनलैंड मास्ट्टर संचाजलत दकया िाएगा। (5) 425 दकलोवाट स े अनजधक कुल प्रणोिन िजि के दकसी भी स्ट्व-चाजलत अन्द्तििे ीय िलयान को माना िाएगा दक उसने मास्ट्टर और इंिीजनयर की अपिे ाओं का अनुपालन दकया ह,ै बिते दक इस तरह के िलयान म,ें उसके मास्ट्टर और इंिीजनयर के रूप म,ें एक व्यजि हो, जिसके पास उपयुि श्रेणी के िोनों प्रमाण पत्र हों। (6) जवजनर्िष्टग प्राजधकारी उपयिुग उप-जनयम (3) म ें जवजहत उच्च आिेि की न्द्यूनतम चालक िल जनर्िष्टग कर सकता ह ै यदि अन्द्य कारक िैसे दक िलयान के व्यापार के स्ट्वरूप, यात्रा के दिनों की संख्या के जलए िीवन, संपजत्त, पयागवरण और अन्द्तििे ीय िलमागों की सुरिा के जहत म ेंइस तरह के अजतररि चालक िल की आवश्यकता होती ह।ै 5. परीिकों की जनयजु ि तिा परीिा केन्द्द्रों को स्ट्िापना (1) अजधजनयम की धारा 36 के अनुपालन म,ें संबंजधत राज्य सरकार द्वारा जनयुि मख्ु य परीिक, योग्यता के ऐसे प्रमाण पत्र प्राप्त करन े के इच्छुक व्यजियों की परीिा लेन े और उन्द्ह ें योग्यता प्रमाण पत्र िारी करन े के जलए उत्तरिायी होगा। (2) मुख्य परीिक को संबंजधत राज्य सरकार द्वारा जनयिु परीिकों की उपयुि संख्या द्वारा सहायता प्रिान की िाएगी। (3) ऐसे परीिा केन्द्द्रों पर लागू परीिा केन्द्द्रों, मानिण्डों और मानकों की सूची और परीिाओं या मूल्यांकनों के आयोिन को संबंजधत राज्य सरकार द्वारा समय-समय पर िारी पररपत्रों द्वारा जवजनिष्ट दकया िाएगा। (4) प्रत्येक परीिा केंद्र, स्ट्िानीय आवश्यकताओं के मूल्यांकन के आधार पर जवजभन्न ग्रेडों के जलए अपने परीिा कायगक्रम की घोषणा करेगा, परीिा की पयागप्त आवृजत्त सुजनजित करेगा तादक अभ्यर्िगयों को आवेिन करन े की जतजि स े परीिा म ें बैठने के जलए छह माह से अजधक समय तक इंतिार न करना पडे। (5) दकसी भी व्यजि को मख्ु य परीिक के रूप म ें जनयुि नहीं दकया िाएगा िब तक दक वह योग्यता और अनुभव संबंधी जनम्नजलजखत अपिे ाओं म ेंसे दकसी एक को परू ा नहीं करता ह:ै (क) महाजनिेिक िलयान पररवहन द्वारा िारी दकए गए मास्ट्टर (एफिी) अिवा एमईओ श्रणे ी-I योग्यता का एक प्रमाण पत्र जिसके पास पोत/राज्य समुद्री बोडों/महाजनिेिक िलयान पररवहन/पत्तनों पर 'सर्टगदफकेरटड आदफसर' के रूप म ेंकम से कम 8 वषों के अनुभव हो; (ख) महाजनिेिक िलयान पररवहन द्वारा िारी दकए गए मास्ट्टर (एफिी) अिवा एमईओ श्रणे ी-II योग्यता का एक प्रमाण पत्र जिसके पास पोत/राज्य समुद्री बोडों/महाजनिेिक िलयान पररवहन/पत्तनों पर 'सर्टगदफकेरटड आदफसर' के रूप म ेंकम से कम 10 वषों के अनुभव हो; (ग) एसएससी और उससे अजधक की िैजिक अहतग ा के साि-साि एक अन्द्तिेिीय िलयान मास्ट्टर क्लास-I अिवा अन्द्तिेिीय इंिीजनयर प्रमाण पत्र के साि-साि अन्द्तििे ीय पोतों पर 'सर्टगदफकेरटड आदफसर' के रूप म ें कम स े कम 20 वषों की सेवा की हो, जिनम ें स े कम स े कम 5 वषग एक मास्ट्टर/मख्ु य इंिीजनयर की िमता म ें होन े चाजहए। (घ) कम स े कम 20 वषों के नौकायन अनुभव के साि एक मास्ट्टर (एनसीवी) अिवा एमईओ श्रेणी III (एनसीवी सीईओ) प्रमाण पत्र धारक हो, जिसम ें स े कम से कम 5 वषग मास्ट्टर / मख्ु य अजभयतं ा की िमता म ें होने चाजहए।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ङ) उपयुगि (क), (ख) (ग) अिवा (घ) म ें उजल्ल जखत अहतग ा धारक हो और दकसी संस्ट्िान या जवभाग म ें संकाय या परीिक के रूप म ें अनुभव प्राप् त हो/ या सिम प्राजधकारी/महाजनिेिक िलयान पररवहन/एमएमडी द्वारा अनुमोदित हो। स्ट्पष्टीकरण: संकाय या परीिक के रूप म ें अनुभव के कायगकाल को ऊपर दिए गए खडं (क), (ख) (ग) और (घ) के तहत अपेजित जिपबोडग/अन्द्तििे ीय िलयान अनुभव की जलए जगना िा सकता ह।ै (6) एक मुख्य परीिक जनम्नजलजखत कतगव्यों का जनवगहन करेगा; (क) राज्य म ेंयोग्यता प्रमाण-पत्र के जवजभन्न ग्रडे ों के जलए परीिाओं के समग्र आयोिन का पयवग ेिण करना। (ख) योग्यता प्रमाण-पत्रों के जवजभन्न ग्रडे ों को समग्र रूप से िारी करने का पयगवेिण करना। (ग) राज्य में योग्यता प्रमाण-पत्र के जवजभन्न ग्रडे ों के जलए परीिा की आवृजत्त और अनुसूची जनधागररत करना। (7) दकसी भी व्यजि को एक परीिक के रूप म ें जनयुि नहीं दकया िाएगा िब तक दक वह योग्यता और अनुभव की जनम्नजलजखत अपिे ाओं म ेंसे एक अपेिा को पूरा नहीं करता ह:ै (क) िलयान पररवहन महाजनिेिक द्वारा िारी दकए गए रांसपोटग मास्ट्टर (एफिी) या एमईओ श्रणे ी I योग्यता के एक प्रमाण पत्र धारक हो तिा पोत/ राज्य समुद्री बोडों/ डीिी जिपपंग / बंिरगाहों पर 'सर्टगदफकेरटड आदफसर' के रूप म ेंकम से कम 5 वषग का अनुभव हो; (ख) िलयान पररवहन महाजनिेिक द्वारा िारी दकए गए रासं पोटग मास्ट्टर (एफिी) या एमईओ श्रणे ी II योग्यता के एक प्रमाण पत्र धारक हो तिा पोत/ राज्य समुद्री बोडों/ डीिी जिपपंग / बंिरगाहों पर 'सर्टगदफकेरटड आदफसर' के रूप म ेंकम से कम 7 वषग का अनुभव हो; (ग) एसएससी और उससे अजधक की िैजिक अहतग ा के साि-साि एक ‘अंतरागज्ि ीय िलयान मास्ट्टर श्रणे ी-I' अिवा 'इनलडैं इंिीजनयर' प्रमाण पत्र के साि-साि अन्द्तिेिीय पोतों पर 'सर्टगदफकेरटड आदफसर' के रूप में कम से कम 15 वषों की सेवा की हो, जिनमें से कम स ेकम 5 वषग एक मास्ट्टर/मुख्य इंिीजनयर की िमता में होन े चाजहए। (घ) कम स े कम 15 वषों के नौकायन अनुभव के साि एक मास्ट्टर (एनसीवी) अिवा एमईओ श्रेणी III (एनसीवी सीईओ) प्रमाण पत्र धारक हो, जिसम ें स े कम से कम 5 वषग मास्ट्टर / मख्ु य अजभयतं ा की िमता म ें होने चाजहए। (ङ) उपयिुग (क), (ख) (ग) अिवा (घ) म ें उजल्ल जखत अहतग ा धारक हो और दकसी संस्ट्िान या जवभाग म ें संकाय या परीिक के रूप म ें अनभु व प्राप् त हो/ या सिम प्राजधकारी/महाजनिेिक िलयान पररवहन/एमएमडी द्वारा अनुमोदित हो। स्ट्पष्टीकरण: संकाय या परीिक के रूप म ें अनुभव के कायगकाल को ऊपर दिए गए खडं (क), (ख) (ग) और (घ) के तहत अपेजित जिपबोड/गअन्द्तििे ीय िलयान अनुभव की जलए जगना िा सकता ह।ै (8) एक परीिक जनम्नजलजखत कतगव्यों का जनवगहन करेगा, नामत:- (क) दकसी परीिा केन्द् द्र पर योग्यता प्रमाण-पत्र के जवजभन्न ग्रेडों के जलए परीिाओं का आयोिन तिा उनका पयगवेिण करना। (ख) योग्यता प्रमाण-पत्रों के जवजभन्न ग्रडे ों को िारी करना। (ग) उन व्यजियों का मल्ू यांकन करना िो परीिाओं म ें बैठे और जिन्द् होंन े प्रजििण कायगक्रम म ें भाग जलया ह ै और सफल उम्मीिवारों की सूची मुख्य परीिक को भेिना।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (घ) मुख्य परीिक को अपने कतगव्यों और उत्तरिाजयत्वों के जनवगहन में सहायता करना। (9) इस जनयम और अजधजनयम की धारा 37 (1) के प्रयोिन के जलए, संबंजधत राज्य सरकारें, परीिकों द्वारा मुख्य परीिक को उपलब् ध कराई की गई ररपोटग का मल्ू यांकन कर सकती ह।ै 6. सिमता प्रमाणपत्र िारी दकया िाना (1) दकसी भी उम्मीिवार को इन जनयमों के तहत योग्यता प्रमाण पत्र प्रिान नहीं दकया िाएगा िब तक दक वह न्द्यूनतम अंक या कुल अंक, िैसा भी मामला हो, प्राप्त नहीं करता ह;ै जिन्द् ह ें उसे एक सफल उम्मीिवार घोजषत करने के जलए अपेजित न्द्यूनतम प्राप् ताकं के रूप में जनणगय जलया िाता ह।ै (2) योग्यता प्रमाण पत्र के प्रत्येक ग्रेड के जलए परीिा में एक जलजखत और मौजखक परीिा िाजमल होगी; िो परीिा के प्रत्येक ग्रेड के जलए पाठ्यक्रम पर आधाररत होगा, िैसा दक सिम प्राजधकारी द्वारा समय-समय पर पररपत्रों के रूप म ेंिारी दकया िा सकता ह।ै (3) उपयुगि उप-जनयम (2) इन जनयमों के तहत िारी 'सेवा प्रमाण पत्र' िारी करने पर लागू नहीं होता ह।ै (4) जनम्नजलजखत ग्रेड के जलए 'योग्यता प्रमाण पत्र' िारी दकया िा सकता ह,ै अिागत:् (क) डेक जवभाग- (i) मास्ट्टर श्रणे ी 1 प्रमाण पत्र (ii) मास्ट्टर श्रणे ी 2 (iii) मास्ट्टर श्रेणी 3 / 'सेरंग' प्रमाण पत्र (ख) इंिन जवभाग- (i) इन्द्लडैं इंिीजनयर प्रमाण पत्र (ii) इंिन ड्राइवर श्रणे ी 1 (iii) इंिन ड्राइवर श्रेणी 2 प्रमाण पत्र 7. मास्ट्टर और डेक जवभाग (1) अंतरागज्ि ीय िलयान मास्ट्टर क्लास 1, मास्ट्टर क्लास 2 और मास्ट्टर क्लास 3 / 'सेरंग' के रूप म ें योग्यता प्रमाण पत्र प्रिान करन े के जलए परीिा, परीिक द्वारा संबंजधत राज्य सरकार म ें ऐस े स्ट्िानों पर तिा ऐसी जतजियों पर आयोजित की िाएगी िो परीिा केंद्र द्वारा प्रकाजित की िा सकती ह।ैं (2) परीिा के जलए प्रत्येक आविे न को इन जनयमों म ें संलग्न प्रपत्र 25 के साि-साि उनम ें उजल्लजखत िस्ट्तावेिों की प्रजतयों सजहत भर कर प्रस्ट्तुत दकया िाएगा, और इस तरह के आवेिन के साि-साि आवश्यक सहायक िस्ट्तावेिों को जनयम 9, जनयम 10, जनयम 11, जनयम 13, जनयम 14 और जनयम 15 म ें यिा जवस्ट्तृत, उम्मीिवार की पात्रता का पता लगाने के जलए अपेजित ह;ैं जिन्द्ह ें परीिा केंद्र पर जनधागररत जतजि के अनसु ार प्रस्ट्ततु दकया िाएगा, िैसा दक संबंजधत परीिा केंद्रों या जवजनर्िष्टग प्राजधकारी द्वारा घोजषत दकया िा सकता ह।ै (3) एक िलयान के मास्ट्टर के सामान्द्य उत्तरिाजयत्वों और प्राजधकार को अनुलग्नक-1 म ेंििागया गया ह।ै 8. अन्द्त िेिीय िलयान के मास्ट्टर श्रणे ी-1 प्रमाणन के जलए न्द्यनू तम अपिे ाए:ं (1) मास्ट्टर श्रेणी-1 प्रमाणन के जलए प्रत्येक अभ्यिी:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) इन जनयमों के अंतगगत िारी अन्द्तििे ीय िलयान के मास्ट्टर क्लास 2 के रूप म ें योग्यता का एक वधै प्रमाण पत्र प्राप्त हो। (ख) जद्वतीय श्रणे ी मास्ट्टर के बाि 3 वषों की न्द्यनू तम ऑनबोड ग सेवा की हो, जिसम ें से एक वषग, कम स े कम 500 िीटी के िलयान म ें 12 माह के जलए I-V के जद्वतीय श्रणे ी मास्ट्टर (िलयान के प्रभारी) के रूप म ें काय ग दकया हो। (ग) आईडब्ल्यूएआई/जवजनर्िष्टग प्राजधकारी पेनलबद्ध एमबीबीएस जचदकत्सा अजधकारी/ जिला सरकारी स्ट्वास्ट््य केंद्र के जचदकत्सा अजधकारी/नगरपाजलका द्वारा अनमु ोदित जचदकत्सक द्वारा प्रपत्र संख्या 23 म ें उनकी िारीररक स्ट्वास्ट््य के संबंध म ेंएक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करें। (घ) मास्ट्टर श्रणे ी 1 के जलए अनुमोदित प्रारंजभक पाठ्यक्रम म ें सफलतापूवगक भाग जलया ह,ै जिसे सिम प्राजधकारी द्वारा अनुमोदित दकया िाएगा; और मास्ट्टर श्रणे ी 1 के जलए प्रारंजभक पाठ्यक्रम की न्द्यूनतम पाठ्यक्रम अवजध, जवषयवस्ट्तु और संरचना सिम प्राजधकारी द्वारा अनमु ोदित प्रजििण कायगक्रमों के अनुसार होगी, जिस े समय-समय पर दििाजनिेिों या पररपत्रों के रूप म ें िारी दकया िा सकता ह।ै (ङ) सिम प्राजधकारी द्वारा अनमु ोदित अन्द्तििे ीय िलयानों के जलए चार मलू भूत सरु िा पाठ्यक्रमों को पूरा दकया हो, नामत: (i) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ii) उत्तरिीजवता तकनीकों म ें प्रवीणता (पीएसटी) (iii) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर) (iv) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) और (v) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सरु िा प्रजििण। (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे ित्रे के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनिष्ट अपेिाओं के अलावा अन्द्य अपिे ाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै 9. अन्द्त िेिीय िलयान के मास्ट्टर श्रणे ी 2 के प्रमाणन के जलए न्द्यनू तम अपिे ाए:ं (1) मास्ट्टर श्रेणी-2 प्रमाणन के जलए प्रत्येक अभ्यिी: (क) इन जनयमों के अंतगतग िारी मास्ट्टर क्लास 3 के रूप म ेंयोग्यता का एक वैध प्रमाण पत्र प्राप्त करेगा। (ख) 36 माह की न्द्यनू तम सेवा की हो जिसम ें स े 12 माह सेरागं के रूप म ेंहोनी चाजहए। (ग) आईडब्ल्यूएआई/जवजनर्िष्टग प्राजधकारी पेनलबद्ध एमबीबीएस जचदकत्सा अजधकारी/ जिला सरकारी स्ट्वास्ट््य केंद्र के जचदकत्सा अजधकारी/नगरपाजलका द्वारा अनमु ोदित जचदकत्सक द्वारा प्रपत्र संख्या 23 म ें उनकी िारीररक स्ट्वास्ट््य के संबंध म ेंएक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करेगा। (घ) मास्ट्टर श्रणे ी 2 के जलए अनुमोदित प्रारंजभक पाठ्यक्रम म ें सफलतापूवगक भाग जलया ह,ै जिसे सिम प्राजधकारी द्वारा अनुमोदित दकया िाएगा; और मास्ट्टर श्रणे ी 2 के जलए प्रारंजभक पाठ्यक्रम की न्द्यनू तम पाठ्यक्रम[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 अवजध, जवषयवस्ट्तु और संरचना, सिम प्राजधकारी द्वारा अनुमोदित प्रजििण कायगक्रमों के अनुसार होगी, जिस े समय-समय पर दििाजनिेिों या पररपत्रों के रूप म ें िारी दकया िा सकता ह।ै (ङ) सिम प्राजधकारी द्वारा अनमु ोदित अन्द्तििे ीय िलयानों के जलए चार मलू भूत सरु िा पाठ्यक्रमों को पूरा दकया हो, नामत: (i) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ii) उत्तरिीजवता तकनीकों म ें प्रवीणता (पीएसटी) (iii) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर) (iv) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) और (v) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सरु िा प्रजििण। (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे ित्रे के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनिष्ट अपेिाओं के अलावा अन्द्य अपिे ाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै 10. अन्द्त िेिीय िलयान के मास्ट्टर श्रणे ी 3/सरे ागं के प्रमाणन के जलए न्द्यनू तम अपिे ाए ं (1) मास्ट्टर श्रेणी-3/सेरांग प्रमाणन के जलए प्रत्येक अभ्यिी: (क) भारत का नागररक होगा; (ख) आय ु बीस वष ग स े कम नहीं हो। (ग) जचदकत्सीय रूप स े स्ट्वस्ट््य हो तिा आईडब्ल्यूएआई/जवजनर्िष्टग प्राजधकारी पने लबद्ध एमबीबीएस जचदकत्सा अजधकारी/ जिला सरकारी स्ट्वास्ट््य केंद्र के जचदकत्सा अजधकारी/नगरपाजलका द्वारा अनुमोदित जचदकत्सक द्वारा प्रपत्र संख्या 23 म ें उनकी िारीररक स्ट्वास्ट््य के संबंध म ें एक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करेगा। (घ) मास्ट्टर श्रणे ी 3/ सेरागं के जलए अनुमोदित प्रारंजभक पाठ्यक्रम म ें सफलतापूवगक भाग जलया ह,ै जिसे सिम प्राजधकारी द्वारा अनुमोदित दकया िाएगा; और मास्ट्टर श्रणे ी 3/ सरे ांग के जलए प्रारंजभक पाठ्यक्रम की न्द्यूनतम पाठ्यक्रम अवजध, जवषयवस्ट्तु और संरचना, सिम प्राजधकारी द्वारा अनुमोदित प्रजििण कायगक्रमों के अनुसार होगी, जिसे समय-समय पर दििाजनिेिों या पररपत्रों के रूप म ें िारी दकया िा सकता ह।ै I-V पर कम स े कम 36 माह की न्द्यूनतमक सेवा की हो। (ङ) सिम प्राजधकारी द्वारा अनमु ोदित अन्द्तििे ीय िलयानों के जलए चार मलू भूत सरु िा पाठ्यक्रमों को पूरा दकया हो, नामत: (i) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ii) उत्तरिीजवता तकनीकों म ें प्रवीणता (पीएसटी) (iii) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर) (iv) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) और10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सरु िा प्रजििण। (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे ित्रे के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनर्िष्टग अपिे ाओं के अलावा अन्द्य अपेिाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै (3) अन्द्तिेिीय िलयानों म ें सवे ारत मौिूिा सेरंगों को सेरंग के रूप म ें सेवा करन े की अनुमजत िी िाएगी और नए प्रजििण कायगक्रम को करन े के जलए अजधकतम 2 वषग का समय दिया िाएगा। 11. इन जनयमों के अजधसजू चत होन े स े पवू ग, मौििू ा लस्ट्क र/ डेक कमचग ाररयों के जलए अन्द्त ििे ीय िलयान के मास्ट्टर श्रणे ी- 3/सरे ागं के प्रमाणन के जलए न्द्यनू तम अपिे ाएं (1) इन जनयमों के अजधसूजचत होने से पूवग अन्द्त िेिीय िलयान में सेवा प्रारंभ करने वाले लस्ट्क र/ डेक कमगचाररयों के प्रमाणन के जलए जनम्न वत जनयम लागू होंग;े (क) केंद्रीय / राज्य द्वारा मान्द्यता प्राप्त बोडग स ेआठवीं किा उत् तीणग होगा। (ख) पहिं ी/अग्रं ेिी/ राज्य की ित्रे ीय भाषा पढ़ने और जलखन े में सिम होगा। (ग) जनम्नजलजखत न्द्यूनतम सेवा मानिंडों म ेंसे दकसी एक को परू ा करेगा। (i) कम से कम 500 िीटी के अन्द्तिेिीय िलयानों या समुद्री िहािों पर चार साल की सेवा अिवा (ii) कम से कम 24 मीटर लंबाई के िलयान पर पांच वषग, अिवा (iii) कम से कम 15 मीटर लंबाई के िलयान पर छह वषग, अिवा (iv) ऐसे अभ् यिी जिन्द्होंने 5 वषग या उससे अजधक समय तक रिा, पुजलस, प्रांतीय सिस्त्र कांस्ट्टेबुलरी या अन्द्य अधगसैजनक बलों के िलयानों पर सेवा की हो। (घ) को कम से कम एक वष ग की सेवा की हो िो सेवा हल्े म्समैन या सहायक मास्ट्टर (डेक) या सीक्यूनी के रूप म ेंहो, (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे ित्रे के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनर्िष्टग अपिे ाओं के अलावा अन्द्य अपेिाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै 12. रेटटंग रूट के माध्य म स ेनए प्रविे कताओंग के जलए अन्द्त ििे ीय िलयान के मास्ट्टर श्रणे ी-3/सरे ागं के प्रमाणन हते ु न्द्यनू तम अपिे ाएं– (1) मौिूिा लस्ट् कर/ डेक कमगचाररयों/ िनरल पपगस रेटटंग सजहत रेटटंग रूट के माध् यम से नए प्रवेिकतागओं को जनम्न वत न्द् यनू तम अपेिाओं को पूरा करना होगा; (क) केंद्रीय / राज्य सरकार द्वारा मान्द्यता प्राप्त बोड गसे िसवीं किा उत् तीणग की हो। (ख) राज्य सरकार द्वारा मान्द् यताप्राप्त नेिनल इन्द्ल डैं नेवीगेिन इंस्ट्ट ीट्यूट, पटना अिवा इसी प्रकार के संस्ट् िान में सफलतापूवगक िनरल पपगस रेटटंग पाठ्यक्रम पूरा दकया हो। (ग) अन्द्तििे ीय िलयानों अिवा समुद्री िलयान पर कम स े कम तीन वष ग की सेवा की हो िो सेवा हल्े म्समैन या सहायक मास्ट्टर (डेक) या सीक्यूनी के रूप म ेंहोगी,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे ित्रे के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनर्िष्टग अपिे ाओं के अलावा अन्द्य अपेिाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै 13. केजडट रेपनगं रूट के माध्य म स े नए प्रविे कताओंग के जलए अन्द्त िेिीय िलयान के मास्ट्टर श्रणे ी-3/सरे ागं के प्रमाणन हते ु न्द्यनू तम अपिे ाए–ं (1) केजडट रेपनगं रूट के माध् यम स े नए प्रवेिकतागओं को जनम्न वत न्द् यनू तम अपेिाओं को परू ा करना होगा; (क) ऐस ेअभ् यिी जिन्द् होंन े केंद्रीय / राज्य सरकार द्वारा मान्द्यता प्राप्त बोडग स ेबारहवीं किा उत् तीणग की हो। (ख) राज्य सरकार द्वारा अनमु ोदित दकसी भी प्रजििण संस्ट्िान, िो सिम प्राजधकारी द्वारा अनुमोदित प्रजििण कायगक्रमों का संचालन करता ह,ै से अन्द्तिेिीय िलयान कैडेट प्रजििण सफलतापूवगक पूरा दकया हो। (ग) अन्द्तिेिीय िलयानों अिवा समुद्री िलयान पर कम से कम िो वषग की सेवा की हो, बिते दक कुल सेवा 'ऑनबोड ग वेसल स्ट् रक्च ड ग रेपनंग प्रोग्राम' के अनरूु प 'इनलैंड वेसल केजडट एप्रेंरटसजिप' के रूप में जनष्पादित की गई हो, जिसे ररकॉडग बुक म ें सत्याजपत दकया गया हो और राज्य सरकार द्वारा अनुमोदित या आयोजित दकया गया हो, िो सिम प्राजधकरण द्वारा अनमु ोदित अपेजित प्रजििण कायगक्रमों का संचालन करता ह ै और राज्य के अन्द्तििे ीय िलयानों/ बंिरगाह म ें चलने वाले िलयानों पर योग्य मास्ट्टर क्लास 1/2/3/ सेरंग की जनगरानी के तहत कम स े कम छह तक सेवा की हो। (2) इस जनयम म ें दकसी बात के होत े हुए भी, राज्य सरकार अन्द्तिेिीय िल के दकसी जविषे िेत्र के जलए यिा अजनवायग, उपयुगि उप-जनयम (1) में जवजनर्िष्टग अपिे ाओं के अलावा अन्द्य अपेिाओं को जनधागररत कर सकती ह,ै जिसके जलए सुरजित नौवहन या अन्द्तिेिीय िलयान के प्रचालन को सजु नजित करन े के जलए उि अपेिाओं का अनुपालन करना आवश्यक ह।ै (3) इन जनयमों के तहत प्रिान दकए गए सिमता प्रमाण पत्र, प्रपत्र संख् या 24 म ें िारी दकया िाने वाले सेवा प्रमाण पत्र के समान ही प्रभावी होगा। 14. अजभयाजं त्रकी जवभाग (1) 'इनलैंड इंिीजनयर' प्रमाण पत्र, इंिन ड्राइवर श्रेणी 1 प्रमाण पत्र, इंिन ड्राइवर श्रणे ी 2 के रूप म ें सिमता प्रमाण पत्र प्रिान करन े के जलए परीिा, परीिक द्वारा संबंजधत राज्य सरकारों के अधीन परीिा स्ट्िलों पर, ऐसी जतजियों को आयोजित की िाएगी िो परीिा केंद्र द्वारा प्रकाजित की िाएंगी। (2) परीिा के जलए प्रत्येक आविे न को इन जनयमों म ें संलग्न प्रपत्र 25 के साि-साि उनम ें उजल्लजखत िस्ट्तावेिों की प्रजतयों सजहत भर कर प्रस्ट्तुत दकया िाएगा, और इस प्रकार के आवेिन के साि-साि आवश्यक सहायक िस्ट्तावेि, अभ् यिी की पात्रता का जनधागरण करने लगान े के जलए अपेजित ह;ैं जिन्द्ह ेंपरीिा केंद्र पर जनधागररत जतजि से पूवग प्रस्ट्तुत दकया िाएगा, िैसा दक संबंजधत परीिा केंद्रों या जवजनर्िष्टग प्राजधकारी द्वारा घोजषत दकया िा सकता ह।ै 15. अन्द्त ििे ीय िलयान के अजभयतं ा के प्रमाणन के जलए न्द्य ूनतम अपिे ाए:ं (1) अन्द्त िेिीय िलयान के अजभयंता हते ु प्रमाणन के जलए प्रत्य ेक अभ् यिी : (क) एसएससी और इससे अजधक की िैजिक योग् यता के साि अन्द्त िेिीय िलयान अजधजनयम के अंतगतग इंिन ड्राइवर श्रेणी 1 सिमता प्रमाण पत्र धारक हो।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) प्रिम श्रणे ी इंिन चालक सिमता प्राप् त करने के बाि 750 दकलोवाट से अजधक प्रणोिन िजि वाले िलयानों पर 3 वषग की न्द्यूनतम ऑनबोड ग सेवा की हो, जिसमें से एक वष ग आई-वी के प्रिम श्रणे ी इंिन चालक (इंिन कि प्रभारी) के रूप म ेंहोना चाजहए। (ग) आईडब्ल्यूएआई/जवजनर्िष्ग ट प्राजधकरण द्वारा पैनलबद्ध एमबीबीएस मेजडकल प्रैजक्टिनर/जिला सरकार के स्ट्वास्ट््य केंद्र/नगरपाजलका द्वारा अनुमोदित जचदकत् सा अजधकारी स े प्रपत्र संख् या 23 में अपनी िारीररक स्ट् वस्ट्ि ता के बारे म ेंएक जचदकत्सा प्रमाण पत्र प्रस्ट्तुत करेगा। (घ) अन्द्तिेिीय िलयान इंिीजनयर के जलए अनुमोदित प्रारंजभक पाठ्यक्रम, जिसे सिम प्राजधकारी द्वारा दकया िाएगा, में सफलतापूवगक भाग जलया हो। (ङ) सिम प्राजधकारी द्वारा अनुमोदित अन्द्तिेिीय िलयानों के जलए चार मूलभतू सुरिा पाठ्यक्रमों को पूरा दकया हो, नामत: (i) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ii) उत्तरिीजवता तकनीकों म ें प्रवीणता (पीएसटी) (iii) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर) (iv) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) (v) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सरु िा प्रजििण। 2) इस जनयम के प्रयोिनािग, अन्द्तििे ीय िलयान इंिीजनयर के जलए प्रारंजभक पाठ्यक्रम की न्द्यूनतम पाठ्यक्रम अवजध, जवषयवस्ट् तु और संरचना, सिम प्राजधकारी द्वारा समय-समय पर दििाजनिेि या पररपत्रों के रूप में िारी की िाएगी। 16. अन्द्त िेिीय िलयान के इंिन ड्राइवर श्रणे ी 1 के प्रमाणन के जलए न्द्य नू तम अपिे ाए:ं (1) अन्द् तििे ीय िलयान के इंिन ड्राइवर श्रणे ी 1 के प्रमाणन के जलए प्रत्य ेक अभ् यिी जनम्न वत योग्य ता धारक हो: (क) अभ् यिी के पास अन्द् तििे ीय िलयान अजधजनयम के तहत वधै जद्वतीय श्रणे ी इंिन ड्राइवर, सीओसी होना चाजहए। 36 माह की न्द् यनू तम सेवा की हो जिसमें से 12 माह जद्वतीय श्रणे ी इंिन ड्राइवर के रूप में की होनी चाजहए। (ख) आईडब्ल्यूएआई/जवजनर्िष्ग ट प्राजधकरण द्वारा पैनलबद्ध एमबीबीएस मेजडकल प्रैजक्टिनर/जिला सरकार के स्ट्वास्ट््य केंद्र/नगरपाजलका द्वारा अनुमोदित जचदकत् सा अजधकारी से प्रपत्र संख् या 23 में अपनी िारीररक स्ट् वस्ट् िता के बारे म ेंएक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करेगा। (ग) इंिन ड्राइवर क्ल ास-1 के जलए अनुमोदित प्रारंजभक पाठ्यक्रम, जिसे सिम प्राजधकारी द्वारा दकया िाएगा, में सफलतापूवगक भाग जलया हो। (घ) आईडब्ल्यूएआई अिवा डीिीएस अिवा राज्य सरकार द्वारा अनुमोदित अन्द्तिेिीय िलयानों के जलए चार मूलभतू सुरिा पाठ्यक्रमों को पूरा दकया हो, नामत: (i) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ii) उत्तरिीजवता तकनीकों म ें प्रवीणता (पीएसटी) (iii) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर)[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 (iv) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) (v) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सरु िा प्रजििण। (2) इस जनयम के प्रयोिनाि,ग इंिन ड्राइवर क्ल ास-1 के जलए प्रारंजभक पाठ्यक्रम की न्द्यनू तम पाठ्यक्रम अवजध, जवषयवस्ट् तु और संरचना, सिम प्राजधकारी द्वारा समय-समय पर दििाजनिेि अिवा पररपत्रों के रूप यिा जवजनर्िष्ग ट की िाएगी। 17. अन्द्त िेिीय िलयान के इंिन ड्राइवर श्रणे ी 2 के प्रमाणन के जलए न्द्य नू तम अपिे ाए:ं क) आय ु21 वषग स े कम नहीं होनी चाजहए। ख) एक माह की अवजध का प्रारंजभक पाठ्यक्रम परू ा दकया हो और वैध पाठ्यक्रम पणू गता प्रमाण पत्र होना चाजहए। ग) आईडब्ल्यूएआई/जवजनर्िष्ग ट प्राजधकरण द्वारा पनै लबद्ध एमबीबीएस मेजडकल प्रैजक्टिनर/जिला सरकार के स्ट्वास्ट््य केंद्र/नगरपाजलका द्वारा अनुमोदित जचदकत् सा अजधकारी स े प्रपत्र संख् या 23 म ें अपनी िारीररक स्ट् वस्ट् िता के बारे म ें एक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करेगा। घ) अन्द्त िेिीय िलयानों पर कम स े कम 36 माह की सेवा की हो। ङ) अन्द्तिेिीय िलयानों पर सेवारत मौिूिा इंिन ड्राइवर श्रणे ी 2 को इंिन ड्राइवर क्लास 2 के रूप म ें सेवा करन े की अनुमजत िी िाएगी और नए प्रजििण कायगक्रम म ें भाग लने े के जलए अजधकतम 2 वषग का समय दिया िाएगा 18. सेवा का प्रमाण पत्र (1) कोई भी अभ् यिी जिसन े 5 वषग की अवजध के जलए तटरिक, भारतीय नौसेना या जनयजमत सेना के दकसी िलयान के मास्ट् टर, अिवा इंिीजनयर के रूप म ें सेवा की हो, उसे मास्ट्टर क्लास 1, मास्ट्टर क्लास 2, मास्ट्टर क्लास 3/सेरंग, इनलडैं इंिीजनयर, इंिन ड्राइवर क्लास 1 अिवा इंिन ड्राइवर क्लास 2 के रूप म ें सेवा का प्रमाण पत्र प्रिान दकया िा सकता ह,ै िो सेवा दकए गए िलयान के आकार और सिम प्राजधकारी द्वारा मान्द्यता प्राप्त दकसी भी संस्ट्िान के चार मूलभतू सुरिा पाठ्यक्रमों सजहत प्रासंजगक प्रारंजभक पाठ्यक्रम के सफलतापूवगक पूण ग दकए िाने पर जनभगर करता ह।ै (2) जिन उम्मीिवारों को उपरोि उप-जनयम (1) का अनुपालन करत े ह,ैं उन्द्ह ें जलजखत परीिा स े छूट िी िाएगी, लेदकन मौजखक परीिा को उत् तीण ग करना अजनवाय ग होगा: बिते दक, अभ् यिी द्वारा िमा दकए गए तटरिक, भारतीय नौसेना अिवा जनयजमत सेना द्वारा िारी दकए गए सिमता के सगं त प्रमाण पत्रों को, जवजनर्िष्ग ट प्राजधकरण द्वारा सत्याजपत दकया िाएगा। 19. दकसी अन्द्तििे ीय िलयान को 'िनरल पपसग रेटटंग' के रूप म ेंकायग्रग हण करन ेहते ुन्द्य ूनतम अपिे ाएं: (1) 'िनरल पपगस रेटटंग' के रूप में प्रमाणन हते ु प्रत् येक अभ् यिी जनम्न वत योग् यता धारक होगा: (क) भारत का नागररक होगा। (ख) 18 वषग स ेकम आयु नहीं होगी। (ग) अन्द्तिेिीय िलयान के मौिूिा डैक/इंिन कर्मगयों के जलए कम स े कम आठवीं किा उत्तीण् ग की हो तिा नए प्रवेिार्िगयों के मामले म ें कम से कम िसवीं किा उत्तीतणग की हो; (घ) वह आईडब्ल्यूएआई/जवजनर्िष्ग ट प्राजधकरण द्वारा पैनलबद्ध एमबीबीएस मेजडकल प्रैजक्टिनर/जिला सरकार के स्ट्वास्ट््य केंद्र/नगरपाजलका द्वारा अनुमोदित जचदकत् सा अजधकारी से प्रपत्र संख् या 23 म ें अपनी िारीररक स्ट् वस्ट्ि ता के बारे म ें एक जचदकत्सा प्रमाण पत्र प्रस्ट्ततु करेगा।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ङ) यदि नया प्रवेिकताग, -ने 'िनरल पपगस रेटटंग' के जलए संबंजधत पाठ्यक्रमों को आयोजित करने वाल े दकसी संस्ट् िान से प्रवेिन प्रजििण पणू ग दकया हो, जिसे सिम प्राजधकरण द्वारा अनुमोदित दकया गया हो। (च) यदि मौिूिा डैक/इंिन कर्मगयों; ने दकसी अन्द्तिेिीय िलयान पर सहायक डैक/इंिन कमी के रूप में कम से कम 2 वष ग पणू ग कर जलए हों और डैक संभालन े के जलए मास्ट् टर श्रेणी 1/2/3 अिवा इंिीजनयर/ इंिन ड्राइवर श्रेणी 1/2 स े इंिन चलाने के जलए प्रवीणता प्रमाण पत्र प्राप् त दकया ह,ै जिसके अंतगगत उसन े सहायक डैक/इंिन कमी के रूप में जपछल ेछह माह तक प्रजििण प्राप् त दकया ह ै बिते दक, मौिूिा डैक/इंिन कर्मगयों को 'िनरल पपगस रेटटंग' म ें संपररवतनग के जलए एक अनुमोदित संपररवतनग पाठ्यक्रम करना अपेजित होगा और इस प्रकार के संपररवतनग पाठ्यक्रम को सिम प्राजधकरण द्वारा अनुमोदित दकया िाएगा। आईडब्ल्यूएआई अिवा डीिीएस अिवा राज्य सरकार द्वारा अनुमोदित अन्द्तिेिीय िलयानों के जलए चार मलू भूत सुरिा पाठ्यक्रमों को पूरा दकया हो, नामत: (क) प्रारंजभक प्रािजमक जचदकत्सा (ईएफए) (ख) उत्तरिीजवता तकनीकों म ेंप्रवीणता (पीएसटी) (ग) व्यजिगत सुरिा और सामाजिक उत्तरिाजयत्व (पीएसएसआर) (घ) अजग्न जनवारण और अजग्निमन (एफपीएफएफ) (ङ) जवजनर्िष्टग सुरिा कतगव्यों (एसटीएसडीएसडी) के साि नाजवकों के जलए सुरिा प्रजििण। इस जनयम के प्रयोिनािग, 'िनरल पपगस रेटटंग' में संपररवतनग पाठ्यक्रम के जलए न्द्यूनतम पाठ्यक्रम की अवजध, जवषयवस्ट् तु और संरचना, सिम प्राजधकारी द्वारा समय-समय पर दििाजनिेि अिवा पररपत्रों के रूप में िारी की िाएगी। अन्द्तििे ीय िलयान पर सेवारत मौिूिा रेटटंग् स/ लस्ट् करों को रेटटंग् स/ लस्ट् करों के रूप में काय ग करने की अनुमजत िी िाएगी तिा नए प्रजििण कायक्रग म करन ेके जलए कम स ेकम 2 वषग का समय दिया िाएगा। 20. सिम प्राजधकारी को िानकारी प्रिान करना (1) राज्य सरकार, संबंजधत प्राजधकारी द्वारा तीस (30) दिनों से अनजधक के जनयजमत अंतराल पर िारी दकए गए, प्रिान दकए गए, रद्द दकए गए या जनलंजबत दकए गए प्रमाणपत्रों संबंधी आंकडों और जववरणों के ब् योरे तिा ऐसी अन्द्य रटप्पजणयों के रािपत्र : असाधारण 15 वह िलयान की उजचत सुरिा और िलयान के रखरखाव के जलए उत् तरिायी ह,ै जिसम ें िलयान म ें मौिूि सभी व्यजियों को काय ग सौंपने सजहत जनम्न वत िाजमल ह:ैं  जनगरानी रखना  रखरखाव संबंधी आयोिना तिा अनुवती कायगवाही  आपातकालीन उपाय तिा अभ् यास  कागो प्रचालन  िलयान के सुरजित संचालन के जलए सभी सगं त कायग। मास्ट्टर यह सुजनजित करेगा दक चालक िल, िलयान और पयागवरण के सवोत्तम जहत के मद्देनिर प्रिषू ण-रोधी और सरु िा उपायों सजहत पररणामी िघु गटनाओं/घटनाओं को कम करने के जलए सभी आपातकालीन प्रदक्रयाएं आयोिनाबद्ध की िाए,ं और उन्द् ह ें उजचत आयोिना, प्रजििण और अभ्यास के माध्यम स े बनाए रखा िाए। वह सुजनजित करेगा दक सभी िीवनरिक और सुरिा उपकरणों को हर समय जनयमों के अनुसार उजचत ढंग स े रखा िाए। मास्ट्टर कंपनी को उन सभी त्रुरटयों और अन्द्य मामलों की िानकारी प्रिान करन े के जलए उत् तरिायी ह ैिो िलयान के सुरजित संचालन को प्रभाजवत कर सकते ह ैं अिवा प्रिषू ण का खतरा पिै ा कर सकते ह ैं और उनका जनराकरण सुजनजित करने तिा यह सजु नजश् चत करन े दक सभी िलयानों प्रचालन हते ु उन्द् ह ें लागू दकया िाए, इस प्रयोिनािग कंपनी की सहायता की आवश्यकता होती ह।ै जनम्न वत द्वारा िारी दकए गए जनयमों और जवजनयमों के अनुसार मास्ट्टर िलयान के जलए उत् तरिायी ह:ै • राष्ट्रीय प्राजधकरणों • राज्य सरकारों/समुद्री बोडों • क्ल ाजसदफकेिन सोसाइरटयां और उसे पररजस्ट्िजतयों के अनुसार उजचत जनणगय लेन े का परू ा अजधकार ह।ै मास्ट्टर हर समय सुरजित नौवहन, चालक िल के साि संबंध, खानपान और कल्याण, बेहतर अनुिासन, चालक िल के प्रििनग प्रजििण का मूल्यांकन, पररजचतता और काम करने के मनोबल के जलए उत् तरिायी ह।ै मास्ट्टर, ऑन-बोडग पर सभी आवश्यक िानकाररयां और संपकग बनाने के जलए उत् तरिायी ह।ै वह कंपनी, माजलकों के साि-साि चाटगसग का DRAFT RULES 1. Short Title Commencement (1) These Rules shall be called the Inland Vessels (Design and Construction) Rules 2022. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. Definitions (1) In these rules, unless the context otherwise requires- (a) “Act” means Inland Vessels Act 2021(24 of 2021). (b) “inland vessel” means any mechanically propelled inland vessels as defined under section 3(y) of the Act. (c) “zone” means any such inland water area, as the State Government may, by notification, declare, depending on the following maximum significant wave height criteria, as Zone 1, Zone 2 and Zone 3, for these rules: a. Zone 1 means an area (other than Zone 2 or Zone 3) where the maximum significant wave height does not exceed 2.0 metres: b. Zone 2 means an area (other than Zone 3) where the maximum significant wave height does not exceed 1.2 metres: c. Zone 3 means an area where the maximum significant wave height does not exceed 0.6 metres: (d) “Gross Tonnage of a vessel” is the Gross tonnage calculated as per the International Tonnage Convention-1969. (e) Total power of Engines kW is the total power of propulsion engines (2) Words and expressions used and not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Inland vessels For the purpose of these rules, Inland vessels shall be classified as per the following categories: - (1) The inland vessels, which fall in Category A are decked vessels of any of the following types. (a) Cargo vessels which are more than 24 m in length (b) Passenger vessels or Ro-Ro passenger ferries which carry more than 50 passengers on board. (c) All vessels equipped for tow, having a bollard pull capacity exceeding10 t. (d) Vessels designed and built to carry petroleum goods, chemicals or liquefied gases bulk as cargo. (e) Vessels carrying dangerous goods. Category A vessels shall be designed, constructed and maintained under the survey and requirements of a classification society, who is a member of the International Association of Classification Societies (2) Category ‘B’ vessels not covered under Category ‘A’ or Category ‘C’. (2) The minimum manning applicable to each inland vessel, shall be recorded by the Surveyor in the Certificate of Survey, in accordance with the type and size of the vessel, its operating area, engine capacity and such other factors as may be directed from time to time by the Central Government , as the case may be. (4) Every non self-propelled inland vessel defined Section 3 (y) (ii) of the Act of less than 15m length shall be manned by minimum one General Purpose Rating and every non self-propelled craft of 15m or more in length shall be manned by minimum two General Purpose Ratings (5) Any self-propelled inland vessel of total propulsion power not exceeding 425 kW shall be deemed to have complied with the requirements of master and engineer provided that such vessel has, as her master and engineer, a person possessing both certificates of appropriate class. (6) The Designated Authority may specify minimum manning of higher order than prescribed in sub-rule (3) above if other factors like nature of trade of the vessel, length of voyage necessitate such additional manning, in the interest of Safety of life, property, environment and the inland waterways. 5. Appointment of Examiners & Examination Centres (1) In compliance with Section 36 of the Act, the Chief Examiner appointed by the respective State Government shall be responsible for the Examination and issue of Certificate of Competency to the persons desirous of obtaining such Certificates of Competency.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25 (2) The Chief Examiner shall be assisted by suitable number of Examiners appointed by the respective State Government. (3) The list of Examination Centres, norms and standards applicable to such Examination Centres and the conduct of examinations or assessments shall be specified by the respective State Government by circulars issued from time to time. (4) Each Examination center shall announce its Examination schedule for various Grades based on the assessment of local needs, ensuring adequate frequency of the examination so that the candidates do not have to wait for more than 6 months to appear in the examination from the date of application. (5) No person shall be appointed as Chief Examiner unless he fulfils one of the following requirements of qualification and experience: (a) Possesses a Ministry of Transport Master (FG) or M.E.O. Class I Certificate of Competency issued by Director General of Shipping with minimum 8 years experience as Certificated Officer on ships/ State Maritime Boards/ DG Shipping/ Ports ; (b) Possesses a Ministry of Transport First Mate (FG) or MEO Class II Certificate of Competency issued by Director General of Shipping with minimum 10 years experience as Certificated Officer on ships/ State Maritime Boards/ DG Shipping/ Ports; (c) Possesses academic qualification of SSC and above along with an Inland Vessel Master Class I or Inland Engineer Certificate with a minimum of 20 years of service onboard inland vessels as Certificated Officer of which at least 5 years must be in the capacity of a master / Chief engineer. (d) Possesses a Master (NCV) or MEO Class III (NCV CEO) Certificate with a minimum of 20 years of sailing experience of which at least 5 years must be in the capacity of Master/ Chief Engineer (e) Possesses a qualification as in (a), (b) (c) or (d) above and experience as a faculty or examiner in an Institute or Department of/or approved by Competent Authority/ DG Shipping/ MMD. Explanation: The tenure of experience as faculty or examiner may be counted towards shipboard/inland vessel experience required under clause (a), (b) (c) and (d) above. (6) A Chief Examiner shall discharge the following duties; (a) Supervise overall conduct of examinations for various grades of Certificate of Competency in the State. (b) Supervise overall issuance of various grades of certificates of competency. (c) Fix the frequency and schedule of examination for various grades of certificate of competency in State. (7) No person shall be appointed as an Examiner unless he fulfils one of the following requirements of qualification and experience: (a) Possesses a Ministry of Transport Master (FG) or M.E.O. Class I Certificate of Competency issued by Director General of Shipping with minimum 5 years experience as Certificated Officer on ships/ State Maritime Boards/ DG Shipping/ Ports ; (b) possesses a Ministry of Transport First Mate (FG) or MEO Class II Certificate of Competency issued by Director General of Shipping with minimum 7 years experience as Certificated Officer on ships/ State Maritime Boards/ DG Shipping/ Ports ; (c) Possesses academic qualification SSC and above along with an Inland Vessel Master Class I or Inland Engineer Certificate with a minimum of 15 years of service onboard inland vessels as Certificated Officer of which at least 5 years must be in the capacity of a master / Chief engineer.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (d) Possesses a Master (NCV) or MEO Class III (NCV CEO) Certificate with a minimum of 15 years of sailing experience of which at least 5 years must be in the capacity of Master/ Chief Engineer. (e) Possesses a qualification as in (a), (b) (c) or (d) above and experience as a faculty or examiner in an Institute or Department of/or approved by Competent Authority/ DG Shipping/ MMD. Explanation: The tenure of experience as faculty or examiner may be counted towards shipboard/inland vessel experience required under clause (a), (b) (c) and (d) above. (8) An Examiner shall discharge the following duties; namely:- (a) Supervise and conduct examinations for various grades of Certificate of Competency at an examination centre. (b) Issuance of various grades of certificates of competency. (c) evaluate the persons who have undergone exams and training programmes and to report the list of successful candidates to the chief examiner. (d) Assist Chief Examiner in discharge of his duties and responsibilities. (9) For the purposes of this Rule and Section 37 (1) of the Act, the respective State Governments may evaluate the report provided by examiners to the Chief Examiner. 6. Issuance of Certificate of Competency (1) No candidate shall be granted a Certificate of Competency under these Rules unless he secures minimum marks or aggregate marks, as the case may be; which is decided to be the minimum mark required to declare him or her as a successful candidate. (2) The examination for each grade of Certificate of Competency shall comprise of a written and oral examination; which shall be based on the syllabus for each grade of examination, as may be issued by the Competent Authority in the form of circulars from time to time. (3) The sub-rule (2) above does not apply to issuance of Certificate of Service issued under these Rules. (4) A Certificate of Competency may be issued for the following grades, namely: (a) Deck Department- (i) Master Class 1 Certificate (ii) Master Class 2 (iii) Master Class 3 / Serang Certificate (b) Engine Department- (i) Inland Engineer Certificate (ii) Engine Driver Class 1 (iii) Engine Driver Class 2 Certificate 7. Master and Deck Department (1) Examination for the grant of Certificate of Competency as inland vessel Master Class 1, Master Class 2 and Master Class 3 / Serang shall be held by the examiner at the places of examination in the respective State Government on such dates as may be published by the examination centre. (2) Every application for examination shall be filled and submitted in Form 25 appended to these rules together with copies of documents stated therein and such application along with the supporting documents required for ascertaining eligibility of the candidate detailed in Rule 9, Rule 10, Rule 11, Rule 13, Rule 14 and Rule 15 herein; shall be submitted at the examination centre as per the scheduled date as may be declared by the respective examination centres or the designated authority.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 (3) The general responsibilities and authority of Master of a vessel are indicated in Annex 1. 8. Minimum requirements for certification of Master Class 1 of an inland vessel: (1) Every candidate for certification as Master Class 1 shall: (a) Hold a valid Certificate of Competency as Master Class 2 of an inland vessel issued under these rules. (b) have a minimum onboard service of 3 years after 2nd Class Master, out of which one year as 2nd Class Master (in-charge of the vessel) of I-V for minimum 12 months in vessels not less than 500 GT. (c) Produce a medical certificate as to his physical fitness in Form No. 23from an IWAI/ Designated Authority empanelled MBBS medical practitioner / medical officer of district government health centre/municipality approved doctor. (d) Have successfully attended approved Preparatory Course for Master Class 1, which shall be approved by the competent authority ; and the minimum course duration, contents and structure of the Preparatory Course for Master Class 1 shall be as per the training programmes approved by the competent authority, which may be issued as guidelines or circulars, from time to time. (e) Have completed the four basic safety courses for inland vessels approved by competent authority namely: (i) Elementary First Aid (EFA) (ii) Proficiency in survival techniques (PST) (iii) Personal safety and social responsibility (PSSR) (iv) Fire Prevention and Fire Fighting (FPFF) and (v) Security Training For Seafarers With Designated Security Duties (STSDSD) (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. 9. Minimum requirements for certification of Master Class 2 of an inland vessel: (1) Every candidate for certification as Master Class 2 shall: (a) be in possession of valid Master Class 3/Serang Certificate of Competency issued under these rules. (b) have a minimum service of 36 Months out of which 12 Months should be as Serang. (c) Shall produce a medical certificate as to his physical fitness in Form No. 23from an IWAI / Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. (d) Have successfully attended approved Preparatory Course for Master Class 2, which shall be approved by the competent authority; and the minimum course duration, contents and structure of the Preparatory Course for Master Class 2 shall be as per the training programmes approved by the competent authority, which may be issued as guidelines or circulars, from time to time. (e) Have completed the four basic safety courses for inland vessels approved by competent authority namely: (i) Elementary First Aid (EFA) (ii) Proficiency in survival techniques (PST)28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) Personal safety and social responsibility (PSSR) (iv) Fire Prevention and Fire Fighting (FPFF) and (v) Security Training For Seafarers With Designated Security Duties (STSDSD) (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. 10. Minimum requirements for certification of Master Class 3/Serang of an inland vessel: (1) Every candidate for certification as Master Class 3/Serang shall be: (a) A Citizen of India (b) Not less than twenty one years of age (c) Medically fit and produce a medical certificate as to his physical fitness in Form No. 23 from an IWAI /Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. (d) Have successfully attended approved Preparatory Course for Master Class 3/Serang, which shall be approved by the competent authority; and the minimum course duration, contents and structure of the Preparatory Course for Master Class 3/Serang shall be as per the training programmes approved by the competent authority, which may be issued as guidelines or circulars, from time to time. Must have minimum service of 36 Months on I-Vs (e) Have completed the four basic safety courses for inland vessels approved by competent authority namely: (i) Elementary First Aid (EFA) (ii) Proficiency in survival techniques (PST) (iii) Personal safety and social responsibility (PSSR) (iv) Fire Prevention and Fire Fighting (FPFF) and (v) Security Training For Seafarers With Designated Security Duties (STSDSD) (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. (3) Existing Serangs serving on Inland Vessels shall be allowed to serve as Serangs and given maximum 2 years of time to undergo new training program 11. Minimum requirements for certification of Master Class 3/Serang of an inland vesselfor existing Lascars/Deck Hands prior to enactment of these Rules (1) For the purposes of certification of Lascars/Deck Hands, who have started services in inland vessels before the enactment of these rules), the following shall apply; (a) Shall be 8th class pass from a board recognized by Central/State (b) Be able to read and write Hindi/English/ Regional Language of the State (c) Meeting any one of the following minimum service criteria (i) Four years of service on Inland vessels or sea going vessels of not less than 500 GT or[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29 (ii) Five years on vessels of not less than 24 m in length or (iii) Six years on vessel not less than 15 m in length, or (iv) such candidates who have served on the vessels of Defence, Police, ProvincialArmedConstabulary or other Paramilitary forces for 5 years or more. (d) should have performed at least one year of which service shall be as helmsman or an Assistant Master (Deck) or Seacunny, (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. 12. Minimum requirements for certification of Master Class 3/Serang of an inland vessel for New Entrants Through Rating Route – (1) For the purposes of certification of new entrants through rating route, including existing Lascars/Deck Hands/General Purpose Rating shall meet the following requirements; (a) Passed 10th class examination from board recognized by Central / State Government. (b) Successfully completed General Purpose Rating Course at National Inland Navigation Institute, Patna or similar training establishment approved by the State (c) Have minimum three years of services on Inland vessels or sea going vessels out of which one year of the service shall be as helmsman or as Seacunny. (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. 13. Minimum requirements for certification of Master Class 3/Serang of an inland vessel for New Entrants Through Cadet Training Route – (1) For the purposes of certification of new entrants through cadet training route, shall meet the following requirements; (a) Such candidates who have passed class 12th class examination from board recognised by the Central Government or the State Government. (b) Successfully completed Inland Vessel Cadets Training from any training institute approved by the State Government, which conducts training programmes approved by the Competent Authority (c) Shall have two years of services on Inland vessels or sea going vessels provided the total service has been performed as Inland Vessel cadet apprentice with onboard vessel Structured Training Program verified in record book and approved or conducted by the State Government, which conducts the requisite training programmes approved by the Competent Authority and should have performed at least six months watch keeping service under qualified Master Class 1/2/3/Serang on board the vessel plying in the port/Inland vessels of the State. (2) Notwithstanding anything contained in this Rule, the State Government may stipulate requirements, other than those specified in sub-rule (1) above, as mandatory for any particular area of inland water, which requires compliance with the said requirements to ensure safe navigation or operation of inland vessel. (3) A certificate of service which shall be issued in Form no. 24shall have the same effect as a certificate of competency granted under these Rules.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 14. Engineering Department (1) Examination for the grant of certificate of competency as Inland Engineer Certificate, Engine Driver Class 1 Certificate, Engine Driver Class 2 shall be held by the examiner at the places of examination in the respective State Governments, on such dates as may be published by the examination centre. (2) Every application for examination shall be filled and submitted in Form No. 25appended to these rules together with copies of documents stated therein and such application along with the supporting documents required for ascertaining eligibility of the candidate, shall be submitted at the examination centre before the scheduled date as may be declared by the respective examination centres or the designated authority. 15. Minimum requirements for certification of Engineer of an Inland vessel: (1) Every candidate for certification as Inland Vessel Engineer shall be: a) In possession of Engine Driver Class 1 Competency Service issued under the Inland Vessels Act along with academic qualification SSC and above b) There should be minimum onboard service of 3 years on vessels having propulsion power more than 750 kW, after 1st Class Engine Driver competency out of which one year as 1st Class Engine Driver (Engine room in-charge) of I-V . c) Shall produce a medical certificate as to his physical fitness in Form No. 23from an IWAI / Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. d) Shall have successfully attended approved Preparatory Course for Inland Vessel Engineer, which shall be approved by Competent Authority. e) Have completed the four basic safety courses for inland vessels approved by the Competent Authority namely: (i) Elementary First Aid (EFA) (ii) Proficiency in survival techniques (PST) (iii) Personal safety and social responsibility (PSSR) (iv) Fire Prevention and Fire Fighting (FPFF) (v) Security Training For Seafarers With Designated Security Duties (STSDSD) 2) For the purpose of this Rule, the minimum course duration, contents and structure of the Preparatory Course for Inland Vessel Engineer shall be issued by the Competent Authority as guideline or circulars, from time to time. 16. Minimum requirements for certification of Engine Driver Class 1 of an inland vessel: (1) Every candidate for certification as Engine Driver Class 1 shall: (a) Candidates must be in possession of valid 2nd Class Engine Driver, COC issued under the IV Act. Minimum service of 36 Months out of which 12 Months should be as 2nd Class Engine Driver. (b). Produce a medical certificate as to his physical fitness in Form No. 23from an IWAI / Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. (c) have successfully attended approved Preparatory Course for Engine Driver Class1, which shall be approved by the Competent Authority. (d) have completed the four basic safety courses for inland vessels approved by IWAI or DGS or State Government namely: (i) Elementary First Aid (EFA)[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31 (ii) Proficiency in survival techniques (PST) (iii) Personal safety and social responsibility (PSSR) (iv) Fire Prevention and Fire Fighting (FPFF) (v) Security Training For Seafarers With Designated Security Duties (STSDSD) (2) For the purpose of this Rule, the minimum course duration, contents and structure of the Preparatory Course for Engine Driver Class 1 shall be as may be specified by the Competent Authority as guideline or circulars, from time to time. 17. Minimum requirements for certification of Engine Driver Class 2 of an inland vessel: a) Age should not be less than 21 years. b) Must have completed preparatory course of 1 month duration and to possess valid Course Completion Certificate. c) Produce a medical certificate as to his physical fitness in Form No. 23. from an IWAI/ Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. d) Must have minimum service of 36 Months on I-Vs. e) Existing Engine Driver Class 2 serving on Inland Vessels shall be allowed to serve as Engine Driver Class 2 and given maximum 2 years of time to undergo new training program 18. Certificate of Service (1) A candidate who has served as a master, or as an engineer of a vessel of the Coast Guard, Indian Navy or regular Army for a period of 5 years may be granted a certificate of service as a Master Class 1, Master Class 2,Master Class 3/serang, Inland Engineer, Engine driver Class1 or Engine driver Class2 depending on the size of vessel served and on successful completion of relevant preparatory course including the four basic safety courses from any institute recognized by the Competent Authority. (2) Candidates who are found to have complied with sub-rule (1) above, shall be exempted from written examination, but will be required to qualify the oral examination: Provided that relevant certificates of competence issued by the Coast Guard, Indian Navy or regular Army submitted by the applicant, shall be verified by the Designated Authority. 19. Minimum requirements to join as General Purpose Rating of an inland vessel: (1) Every candidate for certification as General Purpose Rating shall: (a) be a citizen of India (b) be not less than 18 years of age (c) have passed minimum 8th class for existing Deck/Engine Hands of inland vessel and passed minimum 10th for new entrants; (d) produce a medical certificate as to his physical fitness in Form No. 23from an IWAI/ Designated Authority empanelled MBBS medical practitioner/ medical officer of district government health centre/municipality approved doctor. (e) If new entrant, –have completed approved induction training for General Purpose Ratings at any institute conducting the respective training courses, which is approved by the Competent Authority (f) If Existing Deck/Engine Hand; have completed minimum 2 years as assistant Deck/Engine Hand on an Inland Vessel and have obtained a Certificate of Proficiency from a Master Class 1/2/3 for Deck Hand or from Engineer/Engine Driver Class 1/2 for Engine Hand under whom he has completed last six months of training as assistant deck/engine hand.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided that, the existing Deck/Engine Hands will be required to undergo an approved conversion course to General Purpose Rating and such Conversion Course is to be approved by the Competent Authority. Have completed the four basic safety courses for inland vessels approved by IWAI or DGS or State Government namely: a) Elementary First Aid (EFA) b) Proficiency in survival techniques (PST) c) Personal safety and social responsibility (PSSR) d) Fire Prevention and Fire Fighting (FPFF) e) Security Training For Seafarers With Designated Security Duties (STSDSD) For the purpose of this Rule, the minimum course duration, contents and structure of the conversion course to General Purpose Rating shall be as may be issued by the Competent Authority as guideline or circulars, from time to time. Existing ratings/lascars serving on Inland Vessels shall be allowed to serve as ratings/lascars and given minimum 2 years of time to undergo new training program. 20. Reporting to Competent Authority (1) The State Government shall report and update the Competent Authority with the information on data and details of certificates issued, granted, cancelled or suspended or such other remarks, made by the respective authority at regular intervals of not more than thirty (30) days. [F. No. IWT-11011/91/2021-IWT] SUNIL KUMAR SINGH, Adviser (Statistics) [Annex 1] MASTER'S RESPONSIBILITIES / AUTHORITY The Master has overall responsibility on board the vessel. Assistance from the Company will be given as advice only, leaving the final decision and responsibility with the Master. He is responsible for proper ship safety and maintenance of the vessel including assigning tasks to all persons on board including:  Watch keeping  Maintenance planning and follow-up  Emergency measures and drills  Cargo operations  All tasks relevant to safe ship operation. The Master shall ensure that all emergency procedures are defined and maintained through planning, training and drills in view to minimize the consequences if accidents / incidents should occur, including anti-pollution and safety measures, in the best interest of crew, vessel and environment. He has to ensure that all lifesaving and safety equipments are kept in a proper order according to regulations at all times. The Master is responsible to report to the Company all defects and other matters which could affect the safe operation of the ship or could present a risk of pollution, and which require the assistance of the Company to ensure that they are rectified and implemented on board of all vessels concerned.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 33 The Master is responsible for the vessel in accordance with rules and regulations issued by :  National authorities  State Governments/ Maritime Boards  Classification societies and has full Authority to take the proper decision according to the circumstances. The Master is responsible for the safe navigation at all times, crew relation, catering and welfare, good discipline, evaluation of crew performance training, familiarisation and working morale The Master is responsible for all necessary reporting and liaisons on board. He represents the Company, the owners as well as the charterers, and is the reporting line to the Company, owners, charterers, and any third party if required. The Master is responsible for accounting of the vessel, chest, provisions, control of purchasing, and if necessary to report any discrepancy. One of his main functions is to keep himself professionally up to date, to provide his experience to the ship's staff in a way to increase experience and professional updating. The Master is responsible for the feedback line of data from the ship to the company or any third party, as described in further subjects. As a summary we could say that: The Master is responsible for the seaworthiness, navigation, cargo and maintenance of his vessel, according to all mandatory regulations. He is responsible to identify all defects, to report them to the Company, to the Classification Society, to any third party if relevant, and, if this is not possible, to handle them directly on board. The Master will assist the shore based management with information. A good communication between both parties is, in this matter, vital. The Master is responsible for all reporting obligations on board.
