अजधसचू ना नई ददल्ली, 22 फरवरी, 2022 सा.का.जन. 155(अ).—अंतदिे ीय जलयान [प्रदषू ण की रोकथाम और जनयंत्रण] जनयम 2022 का मसौदा, जजसे केंद्र सरकार 2021 के अंतदिे ीय जलयान अजधजनयम (2021 का 24) के धारा 106 की उप-धारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए बनान े का प्रस्ट्ताव करती ह,ै इसके द्वारा प्रभाजवत होने वाले सभी व्यजियों की जानकारी के जलए प्रकाजित दकया जाता ह;ै और एतद्द्वारा सचू ना दी जाती ह ै दक उि मसौदे पर उस तारीख से तीस ददनों के बाद जवचार दकया जाएगा जजस तारीख को राजपत्र म ेंप्रकाजित इस अजधसूचना की प्रजतयां जनता को उपलब्ध कराई जाती हैं; इन मसौदा जनयमों पर आपजत्तयां या सुझाव, यदद कोई हों, जनदेिक (आईडब्ल्यूटी), पत् तन, पोत पररवहन और जलमाग ग मंत्रालय, कमरा नंबर 439, पररवहन भवन, 1-संसद माग,ग नई ददल्ली-110001 को या abhay.sarode@gov.in और uttam.mishra27@gov.in ईमेल द्वारा भारत के राजपत्र में प्रकाजित अजधसूचना की प्रजतयां, जनता को उपलब्ध कराने की तारीख स े30 ददनों की अवजध के भीतर संबोजधत दकया जा सकता ह;ैं कजथत मसौदा जनयमों के संबंध में दकसी भी व्यजि से जवजनदष्ट अवजध के भीतर प्राप्त आपजत्तयों या सुझावों पर केन्द्द्र सरकार द्वारा जवचार दकया जाएगा। प्रारूप जनयम 1. सजिप्त नाम और प्रारंभ (1) इन जनयमों का संजिप्त नाम अन्द्तदेिीय जलयान [प्रदषू ण की रोकथाम और जनयंत्रण] जनयम (2022) ह।ै (2) ये राजपत्र म ेंअपन े अंजतम प्रकािन की तारीख से लाग ूहोंगे। 1308 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. पररभाषाए:ं (1) इन जनयमों म,ें जब तक दक संदभग से अन्द्यथा अपेजित न हो - (क) “अजधजनयम” से अंतदेिीय जलयान (अजधजनयम), (2021) (2021 का 24) अजभप्रेत ह.ै (ख) "जवद्यमान जलयान" या "जवद्यमानअंतदिे ीय जलयान" से अजभप्रेत ह ै ऐसा कोई भी अतं देिीय जलयान जो नया अंतदेिीय जलयान नहीं ह,ै जो जनयम 3 के उप-जनयम (1) के खंड के अंतगगत प्रदान की गई पररभाषा की अजधकाररता के अधीन आता ह;ै (ग)"नए अन्द्तदिे ीय जलयान" का अथ गअजधजनयम की धारा 3 (म) के तहत पररभाजषत दकसी भी यांजत्रक रूप से चाजलत अन्द्तदिे ीय जलयान से ह।ै (घ) "प्रमुख पररवतनग अथवा आिोधन" से जनम्नजलजखत म ेंसे कोई भी अजभप्रेत ह;ै क) जलयान के सकल टन भार में 10 प्रजतित स ेअजधक पररवतगन ख) जलयान के प्रकार में पररवतगन ग) प्रणोदन प्रणाली/मख्ु य इंजन/ईंधन के प्रकार में पररवतनग ङ) "नए अंतदेिीय जलयान" स े अजभप्रते ह ै कोई भी अतं देिीय जलयान जजसका पेंदा रखा गया ह ै या जो इन जनयमों के प्रवृत्त होने की तारीख को या उसके पश्चात् जनमाणग के समान चरण म ेंह;ै च) "सहयोगी जलयान" समान योजना से उसी याडग म ेंजनर्ममत जलयान ह;ै छ) "िेत्र" का अजभप्रेत ऐसे दकसी भी अतं देिीय जल िेत्र से है, जजसे राज्य सरकार, अजधसूचना द्वारा, जनम्नजलजखत अजधकतम महत्वपूण गलहर ऊंचाई मानदंडों के आधार पर, ित्रे 1, ित्रे 2 और िेत्र 3 घोजषत कर सकती ह:ै (i) िेत्र 1 का अजभप्रेत ह ै एक ऐसा िेत्र (िेत्र 2 या िेत्र 3 के अलावा) जहा ं अजधकतम महत्वपणू ग लहर ऊंचाई 2.0 मीटर से अजधक नहीं ह।ै (ii) ित्रे 2 का अजभप्रेत ह ै एक ऐसा िेत्र (िेत्र 3 के अलावा) जहां अजधकतम महत्वपूण ग लहर ऊंचाई 1.2 मीटर से अजधक नहीं ह।ै (iii) ित्रे 3 का अजभप्रेत ह ैऐसा िेत्र जहां अजधकतम महत्वपूण ग लहर ऊंचाई 0.6 मीटर से अजधक नहीं ह।ै (2) प्रयुि िब्दों और अजभव्यजियों, जो इन जनयमों म ें पररभाजषत नहीं की गई ह,ैं का वही अथ ग होगा जो उन्द्ह ें अजधजनयम में जवजनर्ददष्ट दकया गया ह।ै 3. अतं दिे ीय जलयान: इन जनयमों के प्रयोजन के जलए अंतदेिीय जलयानों को जनम्नजलजखत श्रेजणयों के अनुसार वगीकृत दकया जाएगा: (1) जो जलयान श्रणे ी क म ेंआते ह,ैं वे जनम्नजलजखत में से दकसी एक प्रकार के डेकनुमा जलयान होंग:े (क) जलयान जो [लम्बाई में 24 मीटर] से अजधक ह;ैं (ख) जलयान अथवा रो-रो यात्री फेरी जो [50] से अजधक यात्री ल ेजाते ह;ैं (ग) दसू रे जलयानों को खींचन ेमें सिम ऐसे सभी जलयान, जजनकी बोलाडग पुल िमता [10 टन] स ेअजधक ह;ै (घ) कागो के रूप में थोक में पेरोजलयम माल, रसायन अथवा तरलीकृत गैसों को वहन करने के जलए जडजाइन और जनमागण दकए गए जलयान; (ड.) खतरनाक माल वहन करन े वाले जलयान। श्रेणी क जलयानों को सवेिण के अंतगगत और दकसी वगीकरण सोसाइटी, जो अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ की सदस्ट्य ह,ै की अपेिाओं के अनसु ार जडजाइन, जनर्ममत और अनरु जित दकया जाएगा,[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (2) श्रेणी 'ख' के जलयान श्रेणी क अथवा श्रेणी ग से जभन्न ह।ैं श्रेणी ख के जलयानों को दकसी वगीकरण सोसाइटी, जो अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ (आईएसीएस) की सदस्ट्य है, के सवेिण के अतं गतग जडजाइन, जनर्ममत और अनुरजित दकया जाएगा,दकसी वगीकरण सोसाइटी के सवेिण के अतं गतग जडजाइन और जनर्ममत जो दक अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ की सदस्ट्य ह ै और जो अजभजहत प्राजधकारी के सवेिण के अंतगतग अनरु जित दकया जाएगा, (3) श्रेणी 'ग' जलयान लंबाई म ें10 मीटर से कम ह।ैं श्रेणी ग जलयानों को दकसी वगीकरण सोसाइटी, जो अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ (आईएसीएस) की सदस्ट्य ह,ै के सवेिण के अंतगगत जडजाइन, जनर्ममत और अनुरजित दकया जाएगा अथवा अजभजहत प्राजधकारी द्वारा उपयुि समझे गए जडजाइन, जनमागण और सवेिण के जलए जनधागररत मानकों के अनुसार जनर्ममत दकया जाएगा और अजभजहत प्राजधकारी के सवेिण के अंतगगत अनरु जित दकया जाएगा। 4. अनपु ालन की सीमा (1) सभी मौजूदा जलयान इन जनयमों के प्रवृत्त होन े से पूवग जवद्यमान आवश्यकताओं का पालन करेंग;े बिते दक जवद्यमान अंतदिे ीय जलयान जजनमें बडे पररवतगन या आिोधन होते ह,ैं नाजमत प्राजधकारी द्वारा उजचत और व्यावहाररक माने जाने की सीमा तक इन जनयमों म ेंजनर्ददष्ट आवश्यकताओं का पालन करेंगे। बिते दक जवद्यमान अतं देिीय जलयानों को इन जनयमों में जनर्ददष्ट प्रदषू ण की रोकथाम के जलए पररचालन उपायों का पालन करना ह;ै तथा (2) सभी नए अंतदेिीय जलयानों के स्ट्वामी, संचालक या मास्ट्टर, यह सुजनजश्चत करेंग े दक जलयान का जनमागण, अनुरिण और संचालन प्रदषू ण की रोकथाम और जनयंत्रण की आवश्यकताओं और मानकों के अनुसार दकया गया है, जैसा दक इन जनयमों के अंतगगत उपबंजधत दकया गया ह,ै और यह दक जलयान अपनी आिजयत सेवा के जलए उपयुि ह।ै 5. प्रमाणीकरण (1) दकसी भी अंतदेिीय जलयान को जनर्ददष्ट प्राजधकारी द्वारा अजधजनयम के अतं गतग पररकजल्पत प्रदषू ण जनवारण प्रमाणपत्र, जजसे जलयान के साथ ल े जाना चाजहए,या व े प्रमाणपत्र जो प्रकृजत म ें पररचालन या प्रदियात्मक ह,ैं जजनका अंतदेिीय जलयान को इन जनयमों के अंतगगत अनुपालन करना आवश्यक ह,ै तब तक जारी नहीं दकया जाएगा, जब तक दक ऐसा जलयानअंतदिे ीय जलयान की भौजतक जडजाइन या सुजवधाओं सजहत प्रदषू ण की रोकथाम और जनयंत्रण की आवश्यकताओं और मानकों का अनुपालन नहीं करता ह।ै (2) प्रदषू ण की रोकथाम और जनयत्रं ण के जारी दकए जान े वाल े अनुपालन प्रमाणपत्र का प्रारूप अतं देिीय जलयान अजधजनयम 2021 के िेत्राजधकार म ेंहोगा और इन जनयमों को इन जनयमों की अनुसूची III में समाजवष्ट दकया गया ह।ै (3) अंतदेिीय जलयान (सवेिण और प्रमाणन) जनयम, 2022 के अनुसार दकए जा रह े सवेिणों के अधीन, प्रदषू ण की रोकथाम और जनयंत्रणके अनुपालन के प्रमाणपत्र की अजधकतम वैधता पांच (5) वषग होगी। 6. उपकरण मानक और मागदग िनग : जलयान पर ल ेजाने वाले उपकरण और मिीनरी, भारतीय मानक ब्यूरो / अंतरागष्ट्रीय मानक संगठन के तहत होनी चाजहए 7. सामान्द्य दाजयत्व (1) यह सुजनजश्चत करनास्ट्वामी या पररचालक की जजम्मेदारी ह ै दक जलयान को, अजधजनयम की धारा 54 के अनुसार उपबंजधतजलयानों स े उत्पन्न सभी कचरे को तट की सुजवधाओं में जनपटान के जलए उजचत रूप से सुसजित और अनुरजित ह।ै (2) इन जनयमों म ें उपबंजधत अनसु ार,एक प्रदर्मित आपात जस्ट्थजत के अजतररि, दकसी भी प्रदषू क का अंतदिे ीय जलमागग में जनवगहनजनजषद्ध ह ै और अजधजनयम की धारा 3 के खंड (पी) और (जडे सी) के जलए अनुसूची I में जनर्ददष्ट रसायन और पदाथ गइस उद्देश्य के जलए खतरनाक रसायन और आपजत्तजनक पदाथ ग होंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) चालक दल और याजत्रयों को, प्लेकाड ग या अन्द्य सूचना मोड द्वारा, उपयुगि जनवगहन जनषेधों के बारे म ें सूजचत दकया जाएगा और उन्द्ह ें उन स्ट्थानों के बारे में भी सूजचत दकया जाएगा जहां वे अपने द्वारा उत्पन्न कचरे या प्रदषू क कोजलयान पर संग्रहीत कर सकते ह।ैं (4) अजधजनयम की धारा 98 के अतं गगत प्रदत्त िजियों के आधार पर, और अजधजनयम की धारा 111 के अधीन; जैव जवजवधता, जलीय जीवन और पयागवरण की रिा और संरिण के प्रयोजनों के जलए; और अंतदेिीय जलयानों के नौवहन के कारण होने वाल े नुकसान को कम करने के जलए;पाररजस्ट्थजतक रूप से संवेदनिील िेत्रों और/या संरजित िेत्रों के रूप म ें अजधसूजचत िेत्रों से गुजरने वाले सभी अंतदिे ीय जलयानों को पयागवरण (संरिण) अजधजनयम, 1986 (1986 का अजधजनयम सख्ं या 29), जीवन (सरं िण) अजधजनयम, 1972 (1972 का अजधजनयम संख्या 53) और भारत में लागू ऐस े अन्द्य िासी कानूनके अतं गतग केंद्रीय सरकार द्वारा जनधागररत लागू मानदडं ों और मानकों का पालन करना होगा। (5) उपरोि उप-जनयम (4) के प्रयोजन के जलए, दकसी भी अंतदिे ीय जलयान से प्रदषू कों के आकजस्ट्मक ररसाव की जस्ट्थजत म;ें ऐसे जलयान का स्ट्वामी, पररचालक या मास्ट्टर संबंजधत राज्य सरकारों के अजधकार िेत्र म ें नाजमत अजधकाररयों और पयागवरण (सरं िण) अजधजनयम, 1986 (1986 का अजधजनयम संख्या 29) के अतं गतग स्ट्थाजपत राज्य या केंद्रीय प्रदषू ण जनयंत्रण बोडों को सूजचत करेगा। स्ट् पष्ट ीकरण: पहले से हो चुके प्रदषू ण या जजसके होने की सभं ावना ह,ै ऐसे प्रदषू ण के प्रभाव को कम करन े के उद्देश्य से; संबंजधत नाजमत प्राजधकारी या राज्य या केंद्रीय प्रदषू ण जनयत्रं ण बोड ग द्वारा इस तरह के ररसाव या जनवगहन को रोकने के जलए आवश्यक उपाय करने के जलए स्ट्वामी, पररचालक या मास्ट्टर का मागगदिगन करन े के जलए संयुि प्रयास दकया जाएगा और इस प्रकार प्रदषू ण जनयंत्रण सुजनजश्चत दकया जाएगा। 8. कचरा (1) कचरे को जनपटान दकनारे पर जनधागररत स्ट् थान पर दकया की इकाईमें छोडा जाएगा और कचरे को जलयान पर जमा रखन े के जलए उपयिु व्यवस्ट्था की जाएगी। जनयमों के इस खंड के प्रयोजन के जलए दकनारे पर जनधागररत स्ट् थल सुजवधा का अजभप्रेत एक स्ट्थानीय भडं ारण सुजवधा (पात्र, जडब्ब े आदद) ह,ै जो टर्ममनल/स्ट्थानीय प्राजधकरण या टर्ममनल/स्ट्थानीय प्राजधकरण/राज्य सरकार द्वारा कचरा एकत्र करन े के जलए अजधकृत इकाई द्वारा प्रदान की जाती ह।ै स्ट्पष्टीकरण: उपरोि उप-जनयम (1) के अंतगगत अजनवायग व्यवस्ट्था, स्ट्थानीय अजधकाररयों द्वारा संचालन के िेत्र के जलए उपयुि के रूप में लाग ूदकया जा सकनेवाली जविेष आवश्यकताओं के पालन से आवश्यक रूप से जभन्न होगी। (2) दस मीटर या उससे अजधक लंबाई के प्रत्येक अंतदेिीय जलयान में कूडा-करकट के जनपटान की आवश्यकताओं के बारे में चालक दल और याजत्रयों को सूजचत करने वाली तजख्तयां प्रदर्मित होंगी। (3) पचास या उससे अजधक व्यजियों को ले जान े के जलए प्रमाजणत प्रत्येक अंतदिे ीय जलयान में कचरा प्रबंधन योजना होगी और कचरा ररकॉडग बुक या कचरे के जनपटान के वैकजल्पक तरीके को बनाए रखना होगा।चार घंटे या उसस े कम की यात्रा करनेवालेजलयानको कचरा ररकॉड गबुक बनाए रखने की आवश्यकता स ेछूट दी जा सकती ह।ै (4) उपरोि उप-जनयम (3) के अंतगगत अजनवायग कचरा प्रबंधन योजना: (क) जलयान पर उपकरण के उपयोग के जलए प्रदियाओं सजहत कचरे के सग्रं ह, भंडारण, प्रसंस्ट्करण और जनपटान के जलए प्रदियाएं प्रदान करें; तथा (ख) योजना को पूरा करन े के प्रभारी व्यजि को नाजमत करें। 9. ईंधन म ेंसल्फर की मात्रा समुद्री ईंधन तले , समुद्री डीजल, समुद्री गैस तले या गैस तले का उपयोग करने वाल े जलयानों को यह सुजनजश्चत करना चाजहए दक अंतदेिीय जलयानों में उपयोग दकए जाने वाल े दकसी भी समुद्री ईंधन तले या डीजल की सल्फर सामग्री 0.5% m/m से अजधक नहीं होनी चाजहए।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 10. इंजन उत्सजनग (1) 130 दकलोवाट और उससे अजधक के समुद्री डीजल इंजन, जो इन जनयमों के प्रवृत्त होने के पश्चात् जनर्ममत जलयानों पर स्ट्थाजपत दकए गए ह,ैं नाइरोजन ऑक्साइड के उत्सजगन के जलए जनम्नजलजखत सीमाओं का पालन करेंगे (एनओ 2 के कुल भाररत उत्सजगन के रूप म ेंगणना), जहां n = रेटेड इंजन की गजत (प्रजत जमनट िैंकिाफ्ट पररिमण): i. 14.4 जी/केडब्ल्यूएच जब एन (n)130 आरपीएम से कम ह;ै ii. 44 · n(-0.23) g/kWh जब एन (n) 130 या अजधक लेदकन 2,000 आरपीएम से कम ह;ै iii. 7.7 g/kWh जब एन (n) 2,000 आरपीएम या अजधक ह।ै या समकि भारत स्ट्टेज मानक। (2) राज्य सरकार, अजधसूचनाओं के माध्यम से, जनर्ददष्ट पाररजस्ट्थजतक रूप स े संवेदनिील िेत्रों में, उपरोि उप-जनयम (1) में जनर्ददष्ट सीमाओं म ेंऔर कटौती कर सकती ह।ै 11. तले /तलै ीय अपजिष्ट (1) जलयान और उसके याजत्रयों और चालक दल की सुरिा को प्रभाजवत करने वाली आपात जस्ट्थजत को छोडकर, दकसी भी तेल या तैलीय अपजिष्ट/जबल्ज जमजश्रतजल को पानी में नहीं छोडा जाएगा, जसवाय इसके दक उप-जनयम (2) में उपबंजधत दकए गए सभी उपबधं ों का पालन दकया जाता ह ैऔर जलयान पर रखी गई सामग्री को बाद में एक उपयुि तटीय जनधागररत स्ट् थल म ेंछोडा जाना ह ै और जलयान पर ऐस े सभी जनवगहनों का ररकॉड ग और रसीद को न्द् यूनतम3 महीने की अवजध के जलए बनाए रखा जाएगा। (2) तेल या तैलीय जमश्रण के जनवगहन की ितें जनम्नानुसार होंगी। i. जलयानजनयत माग गपर चल रहा ह;ै ii. तेल जमश्रण को इन जनयमों की अनुसूची III के भाग I की आवश्यकताओं को पूरा करने वाले तले द़िल्टररग उपकरण के माध्यम स ेसंसाजधत दकया जाता ह;ै iii. जबना तनुकरण के उत्प्रवाह की तेल सामग्री 15 भाग प्रजत जमजलयन से अजधक नहीं ह;ै iv. तेल टैंकरों पर कागो पंप रूम जबल्ज में तेल जमश्रण उत्पन्न नहीं होता ह;ै तथा v. तेल टैंकरों के मामले म ेंतले जमश्रण, तेल कागो अविषे ों के साथ जमजश्रत नहीं ह।ै (3) प्रत्येक 'अंतदेिीय जलयान अनुसूची II के भाग II में जनर्ददष्ट िमता के एक होल्ल्डग टैंक या समकि व्यवस्ट्था स े सुसजित होगा। जवद्यमानजलयानों को इन जनयमों के लाग ू होन े की तारीख से दो वष ग के भीतर इस आवश्यकता का पालन करना होगा। 12. मजलन जल (1) अंतदेिीय जलमागों में मजलन जल का जनवगहन जनजषद्ध ह।ै (2) सभी नए अंतदेिीय जलयानों के जलए, जहां मजलन जल उत्पन्न होता ह,ै जलयान पर आरुढ़ व्यजियों की संख्या के जलए पयागप्त िमता का एक उपयुि मजलनन जल िोधन संयंत्र प्लांट/बायो-डाइजेस्ट्टर लगानाअजनवायग ह।ै (3) उपरोि उप जनयम (2) के अंतर्मवष्ट होते हुए भी, सभी अंतदेिीय जलयानों में पयागप्त िमता का एक होल्ल्डग टैंक होगा, जजसमेंजलयान पर उत्पन्न समस्ट्त मजलन जल को बाद में एक तटीयस्ट्वागतइकाई में जनवगहन के जलए भंडाररत करेगा। जवद्यमानजलयानों को इन जनयमों के लागू होन े के दो वषग के भीतर इस अपेिा का पालन करना चाजहए। 13. प्रजतदषू क रंगों का उपयोग (1) प्रजतदषू क रंगों में पयागवरण के जलए हाजनकारक ऑगनग ोरटन यौजगकों का उपयोग जनजषद्ध ह।ै 14. इन जनयमों के अतं गतग सविे ण: (1) प्रत्येक अंतदेिीय जलयान इस उप जनयम के (क) से (ङ) म ें जनर्ददष्ट सवेिणों के अधीन होगा। जवद्यमान जलयान इस उप जनयम के (ख) स े(ङ) में जनर्ददष्ट सवेिणों के अधीन होंगे।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) जलयान को सेवा में जनयुि करन े से पहल े या जनयम 6 के अंतगगत आवश्यक प्रमाण पत्र देने से पहले एक प्रारंजभक सवेिण पहली बार जारी दकया जाना आवश्यक, जजसमें इसकी संरचना, उपकरण, प्रणाली, प्रणाली, व्यवस्ट्था और सामग्री का पूरा सवेिण अंतर्मवष्ट होगा तादक यह सुजनजश्चत दकया जा सके दक ऐसी संरचना, उपकरण, प्रणाली, प्रणाली, व्यवस्ट्था और सामग्री इन जनयमों की अपेिाओं का पणू ग रूप से अनपु ालन करती ह।ै (ख) पांच वषग स े अजधक के अतं राल पर एक नवीनीकरण सवेिण होगा, और यह नवीनीकरण सवेिण यह सुजनजश्चत करेगा दक संरचना, उपकरण, प्रणाली, प्रणाली, व्यवस्ट्था और सामग्री इन जनयमों की आवश्यकताओं का पूरी तरह स े अनुपालन करती ह।ै (ग) सवेिण प्रमाण पत्र की प्रत्येक वषगगांठ की तारीख से पहले या बाद म ें तीन महीन े के भीतर एक वार्मषक सवेिण आयोजजत दकया जाएगा, जजसमें खंड (क) म ें संदर्मभत संरचना, उपकरण, प्रणाली, व्यवस्ट्था और सामग्री का एक सामान्द्य जनरीिण िाजमल ह,ै तादक यह सुजनजश्चत हो सके दक इन जनयमों के उपबंधों के अनसु ार उनका रखरखाव दकया गया हऔै र व ेजलयान की पृष्ांदकत दकए जाएंगे। (घ) जब भी महत्वपूण ग मरम्मत या नवीनीकरण दकया जाता ह,ै पररजस्ट्थजतयों के अनुसार, एक सामान्द्य अथवा आंजिक अजतररि सवेिणदकया जाएगा और ऐसा सवेिण यह सुजनजश्चत करने के जलए होगा दक आवश्यक मरम्मत या नवीनीकरण प्रभावी ढंग स े दकया गया ह,ै और ऐसी सामग्री और कारीगरी मरम्मत या नवीनीकरण सभी प्रकार स े संतोषजनक ह ैंऔर यह दक जलयान सभी प्रकार से इन जनयमों की अपेिाओं का अनुपालन करता है। (2) इन जनयमों के उपबंधों को लाग ू करन े के प्रयोजन से जलयानों का सवेिण नाजमत प्राजधकारी या उसके द्वारा मान्द्यता प्राप्त संगठन द्वारा दकया जाएगा। (3) जब सवेिक यह जनधागररत करता ह ैदक जलयान या उसके उपकरण की जस्ट्थजत प्रमाणपत्र के जववरण के साथ पयागप्त रूप से मेल नहीं खाती ह ै अथवा समुद्री पयागवरण को नुकसान का अनुजचत खतरा उत्पन्न दकए जबना जलयान सेवा के जलए उपयुि नहीं ह,ै तो ऐसी जस्ट्थजत म ें सवेिक या प्राजधकृत व्यजि तुरंत यह सुजनजश्चत करेगा दक सुधारात्मक कारगवाई की गई ह ैऔर जनयत समय म,ें नाजमत प्राजधकारी को भी सूजचत करेगा। बिते दक यदद ऐसी सुधारात्मक कारगवाई नहीं की जाती ह,ै तो प्रमाणपत्र वापस ले जलया जाएगा और नाजमत प्राजधकारी को तत्काल अजधसूजचत दकया जाएगा। (4) जलयान के दकसी भी सविे ण के पूरा होन े के बाद, ऐसे उपकरण और प्रणाली के सीधे प्रजतस्ट्थापन को छोडकर, जनर्ददष्ट प्राजधकारी की मंजूरी के जबना, ऐसे सवेिण म ें िाजमल संरचना, उपकरण, प्रणाली, दफरटग्स, व्यवस्ट्था या सामग्री म ें कोई बदलाव नहीं दकया जाएगा। (5) जब भी दकसी जलयान के साथ कोई दघु गटना होती ह ै या उसमें कोई दोष पाया जाता ह ै जो जलयान की अखंडता या इन जनयमों के अंतगगत उसके उपकरण की दिता या पणू गता को काफी प्रभाजवत करता है, तो जलयान का मास्ट्टर या स्ट्वामीयथािीघ्र नाजमत अजधकारी को अजधसूजचत करेगा। प्रमाण पत्र जारी करने कादाजयत्व रखनेवाला प्राजधकारी, यह जनधागररत करने के जलए दक एक जवस्ट्तृत सवेिण आवश्यक ह ै या नहीं, सवेिक या अजधकृत व्यजि द्वारा जांच आरंभ करवाएगा। 15. प्रमाण पत्र जारी करना या उसकी पजु ष्ट (1) जनयम 15 के अंतगगत दकसी भी जनवगहन स ेबचने के जलए सरु जित व्यवस्ट्था प्रदान की जाएगी। (4) 15 पीपीएम जबल्ज सेपरेटर में, फीड को जबल्ज से ऑयल जबल्ज वाटर और इमल्सीफाइड जबल्ज वाटर म ें बदलने, या तेल और पानी से हवा में बदलने से 15 पीपीएम से अजधक तले वाल ेदकसी भी जमश्रण का जलयान पर उत्सजगन नहीं होगा। (5) प्रणाली को पररचालन म ें लान े के जलए न्द्यूनतम ध्यान दने े की अपिे ा होगी।इंजन कि में जबल्जहोन े की जस्ट्थजत में, जबल्ज सेपरेटर के कायगरतसभी जहस्ट्से, जजनके िजतग्रस्ट्त होन े की संभावना है, रखरखाव के जलए आसानी से सुलभ होंगे। 15 पीपीएम जबल्ज अलाम:ग- (1) 15 पीपीएम जबल्ज अलामग समुद्री पयागवरण की जस्ट्थजतयों में जंग का जवरोध करेगा। (2) कोई भी जवद्युत उपकरण जो 15 पीपीएम जबल्ज अलामग का जहस्ट्सा ह,ै उसे खतरे से मुि िेत्र में रखा जाएगा। (3) एक पीपीएम जडस्ट्प्ल े प्रदान दकया जाएगा। जनमागता के जनदिे ों के अनुसार जलयान Short Title Commencement (1) These Rules shall be called the Inland Vessels [Prevention and Containment of Pollution] Rules 2022. (2) They shall come into force on the date of their final publication in Official Gazette. 2. Definitions (1) In these rules, unless the context otherwise requires,-- (a) “Act” means the Inland Vessels Act of 2021(24 of 2021 (b) “Existing vessel” or “existing inland vessel” means any inland vessel which is not any new inland vessel that falls within the ambit of the definition provided under clause (e ) of sub-rule (1) of Rule 3 (c) “inland vessel” means any mechanically propelled inland vessels as defined under section 3(y) of the Act d) “Major conversion or modification” means any of the following; a) Change in Gross Tonnage of the vessel by more than ten per centum b) Change of vessel type c) Change of propulsion system/ main engines/ type of fuel e) “New Inland vessel” means any inland vessel whose keel is laid or which is at a similar stage of construction on or after the date of coming in to force of these Rules f) “sister vessel” is a vessel built from the same plans at the same yard g) “Zone” means any such inland water area, as the State Government may, by notification, declare, depending on the following maximum significant wave height criteria, as Zone 1, Zone 2 and Zone 3, these rules: (iv) Zone 1 means an area (other than Zone 2 or Zone 3) where the maximum significant wave height does not exceed 2.0 metres. (v) Zone 2 means an area (other than Zone 3) where the maximum significant wave height does not exceed 1.2 metres. (vi) Zone 3 means an area where the maximum significant wave height does not exceed 0.6 metres. (2) Words and expressions used and not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Inland Vessels.- For the purpose of these rules, Inland vessels shall be classified as per the following categories: - (1) The vessels which fall in Category A are decked vessels of any of the following types. (a) Cargo vessels that are more than 24 m in length (b) Vessels that carry more than 50 passengers on board. (c) All vessels equipped for towing other vessels, having a bollard pull capacity exceeding 10tonnes. (d) Vessels carrying petroleum goods, chemicals or liquefied gases in bulk as cargo, (e) Vessels carrying dangerous goods. Category A vessels shall be designed, constructed and maintained under the survey and requirements of a classification society, who is a member of the International Association of Classification Societies (2) Category B vessels are those which are not Category A or Category C Category B vessels shall be designed, constructed and maintained according to the survey of a classification society, which is a member of International Association of the Classification Societies Further designed and constructed under the survey of classification society, which is a member of the International Association of Classification Societies and maintained under the survey of the Designated Authority14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) Category C vessels are vessels of length less than 10 metres Category C vessels shall be designed, constructed and maintained under the survey of a classification society, which is a member of the International Association of Classification Societies, and standards prescribed for design, construction and survey considered appropriate by the Designated Authority and maintained under the survey of the Designated Authority. Design and Construction not covered by these rules, the Designated Authority may apply the rules of International Association of Classification Societies. 4. Threshold of Compliance (1) All existing vessels shall, comply with the requirements existing prior to coming into force of these rules Provided that the existing inland vessels that undergo major conversion or modification shall comply with the requirements specified in these rules, as far as it is considered reasonable and practicable by the Designated Authority. Provided that existing inland vessels are to comply with the operational measures for prevention of pollution specified in these rules (2) The owner, operator or master of all new inland vessel, shall ensure that the vessel is constructed, maintained and operated under the requirements and standards for pollution prevention and containment, as provided under these rules and the vessel is suitable for its intended service. 5. Certification (1) No inland vessel shall be issued with the Prevention of Pollution Certificate envisaged under the Act by the Designated Authority, unless such vessel complies with requirements and standards for pollution prevention and containment including the physical design of the inland vessel or facilities that the inland vessel must carry, or those which are operational or procedural in nature, which the inland vessel is required to comply with, under these Rules (2) The format of the Certificate of compliance for Prevention and containment of Pollution to be issued under the purview of the Inland Vessels Act 2021 and these Rules is included in Schedule III of these Rules. (3) Subject to surveys being carried out in accordance with the Inland Vessels (Survey and Certification) Rules, 2022, the maximum validity of a Certificate of compliance of Prevention and containment of Pollution shall be five (5) years. 6. Equipment Standards and Guidance Equipment and types of machinery are required to be carried on board, shall be under Bureau of Indian Standards / International Organisation of Standards 7. General Responsibilities (1) It is the responsibility of the owner or operator to ensure that the vessel is properly equipped and maintained to dispose of all vessel generated waste to shore facilities as provided in accordance with Section 54 of the Act. (2) Except in the case of a demonstrated emergency, the discharge into an inland waterway of any pollutant, as indicated in these rules, is prohibited and the chemicals and substance specified in Schedule Ishall be the hazardous chemicals and obnoxious substances for the purpose of clause (p) and (zc) of Section 3 of the Act. (3) The crew and passengers shall be notified, by placards or another information mode, of the above mentioned discharge prohibitions and they shall be informed on the locations where garbage or pollutants, which they generate, may be stored on board. (4) By virtue of powers conferred under Section 98 of the Act, and subject to Section 111 of the Act; for the purposes of protecting and preserving biodiversity, aquatic life and environment; and to minimize the damage caused by navigation of inland vessels; all inland vessels passing through areas notified as ecologically sensitive areas and / or protected areas shall comply with the applicable norms and standards,[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 15 as prescribed by the Central Government under Environment (Protection) Act, 1986 (Act No. 29 of 1986), the Wild Life (Protection) Act, 1972 (Act No. 53 of 1972) and such other governing laws in force in India. (5) For the purpose of sub-rule (4) above, in the event of any accidental spill of pollutants from any inland vessels; the owner, operator or master of such vessel shall inform the jurisdictional designated authorities of respective State Governments, and the State or Central Pollution Control Boards established under the Environment (Protection) Act, 1986 (Act No. 29 of 1986). Explanation: For the purpose of mitigating the effects of pollution that is already caused or is likely to be caused; joint efforts shall be adopted by the respective designated authority or the State or Central Pollution Control Board to guide the owner, operator or master to carry out necessary measures to prevent such spill or discharge and thereby to ensure pollution containment. 8. Garbage (1) Garbage shall be discharged to shore facilities and suitable arrangements for the retention of garbage on board shall be provided. Shore reception facility for the purpose of this section of the rules means a local storage facility (receptacles, bins etc.) provided by the terminal/local authority or an entity authorised by the terminal/local authority/state government to collect the garbage. Explanation: Arrangements mandated under sub-rule(1) above, shall be varied as necessary to comply with special requirements which may be applied by local authorities for the area of operation as appropriate. (2) Every inland vessel of 10m or more in length shall display placards informing the crew and passengers of the disposal requirements of garbage. (3) Every inland vessel certified to carry 50persons or more shall carry a garbage management plan and maintain a garbage record bookers alternative method of logging the disposal of garbage. The requirement to maintain a garbage record book may be waived for a vessel engaged on a voyage of four hours or less. (4) The garbage management plan mandated under sub-rule (3) above shall: (a) provide procedures for the collection, storage, processing and disposal of garbage, including procedures for the use of equipment onboard; and (b) designate the person in charge of carrying out the plan. 9. Sulphur content of Fuel Vessels using marine fuel oil, marine diesel, marine gas oil or gas oil must ensure that the sulphur content of any marine fuel oil or diesel used onboard inland vessels must not exceed 0.5% m/m 10. Engine Emissions (1) Marine Diesel Engines of 130 kW and above which are installed on vessels constructed on or after coming into effect of these Rules, shall comply with the following limits for the emission of nitrogen oxides (calculated as the total weighted emission of NO2), where n = rated engine speed (crankshaft revolutions per minute): i. 14.4 g/kWh when n is less than 130 rpm; ii. 44 · n(-0.23) g/kWh when n is 130 or more but less than 2,000 rpm; iii. 7.7 g/kWh when n is 2,000 rpm or more. OR Equivalent Bharat Stage standards. (2) The state government may, through notifications, stipulate further reductions to the limits specified in sub-rule (1) above, in designated ecologically sensitive areas. 11. Oil/Oily Waste (2) Except in an emergency affecting the safety of the vessel and its passengers and crew, no oil or oily waste/bilge mixture water shall be discharged overboard, except when all the provisions provided in sub- rule (2),are followed and material which is retained onboard is to be subsequently discharged to a suitable16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] reception facility ashore and a record of all such discharges shall be kept onboard, and the receipt shall be kept for a minimum duration of 3 months. (2) Conditions for discharge of oil or oily mixtures shall be as follows. i. the vessel is proceeding en route; ii. the oily mixture is processed through and oil filtering equipment meeting the requirements of Part I of Schedule III of these Rules; iii. the oil content of the effluent without dilution does not exceed 15 parts per million; iv. the oily mixture does not originate in the cargo pump room bilges on oil tankers; and v. the oil mixture, in case of oil tankers, is not mixed with oil cargo residues. (3) Every' inland vessel shall be equipped with a holding tank or equivalent arrangement of capacity as specifiedin Part II of Schedule II. Existing vessels shall comply with this requirement within two years of the date of coming into force of these Rules. 12. Sewage (1) The discharge of sewage into inland waterways is prohibited. (2) All new inland vessels where sewage is generated are to be provided with an appropriate sewage treatment plant / bio-digester of such capacity sufficient for the number of persons on board. (3) Notwithstanding sub-rule (2) above, all inland vessels shall have a holding tank of adequate capacity to store all sewage generated on board, for subsequent discharge into a shore reception facility. Existing vessels should comply with this requirement within two years of coming into force of these Rules. 13. Use of Antifouling Paints (1) The use of environmentally harmful organotin compounds in antifouling paints is prohibited. 14. Surveys under these Rules: (1) Every inland vessel shall subject it to the surveys specified in (a) to (e) of this sub rule. Existing vessels shall be subject to surveys specified in (b) to (e) of this sub-rule. (a) an initial survey before the vessel is put in service or before the Certificate required under Rule 6,is issued for the first time, which shall include a complete survey of its structure, equipment, systems, fittings, arrangements and material so as to ensure that such structure, equipment, systems, fittings, arrangements and material fully comply with the requirements of these rules. (b) a renewal survey at an intervals not exceeding five years, , and the renewal survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with the requirements of these rules. (c) an annual survey shall be conducted within three months before or after each anniversary date of the Certificate, including a general inspection of the structure, equipment, fittings, arrangements and materials referred to in clause (a) to ensure that they have been maintained in accordance with the provisions of these Rules, and that they remain satisfactory for this service for which the vessel is intended; and to ensure that the equipment and the associated pump and piping systems, including oil discharge monitoring and control systems, oily-water separating equipment and oil filtering systems, where fitted, fully comply with the requirements of these rules and are in good working order: Provided that such annual surveys shall be endorsed on the Certificate issued under Rule 6. (d) an additional survey, either general or partial, according to the circumstances, shall be made whenever important repairs or renewals are made and such survey shall be such as to ensure that necessary repairs or renewals have been effectively made, that the material and workmanship of such repairs or renewals are in all respects satisfactory and that the vessel complies in all respects with the requirements of these rules.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 17 (2) Surveys of vessels for the purposes of enforcement of the provisions of these rules shall be carried out by the Designated Authority or an Organization recognized by it. (3) When the surveyor determines that the condition of the vessel or its equipment does not correspond substantially with the particulars of the Certificate or is such that, the vessel is not fit for service without presenting an unreasonable threat of harm to the marine environment, such surveyor or authorised person shall immediately ensure that corrective action is taken and shall also, in due course, notify the Designated Authority. Provided that if such corrective action is not taken, the Certificate shall be withdrawn and the Designated Authority shall be notified immediately. (4) After any survey of the vessel has been completed, no change shall be made in the structure, equipment, systems, fittings, arrangements or material covered by such survey, without the sanction of the Designated Authority except the direct replacement of such equipment and fittings. (5) Whenever an accident occurs to a vessel or a defect is discovered which substantially affects the integrity of the vessel or the efficiency or completeness of its equipment as covered by these rules, the master or owner of the vessel shall report at the earliest opportunity to the Designated Authority responsible for issuing the Certificate, who shall cause investigations to be initiated by the surveyor or the authorised person to determine whether a detailed survey is necessary. 15. Issue, or endorsement of certificate. (1) On satisfactory completion of the initial or renewal survey under Rule 15 the certifying authority shall issue a Certificate of compliance of Prevention of and containment of Pollution as per Form 26 annexed to these Rules. SCHEDULE - II Part -I Prescription for oily mixture treatment equipment for Inland vessel Oil filtering equipment (15 ppm bilge, separator):- (1) The 15 ppm bilge separator shall be strongly constructed and suitable for vessel's use bearing in mind its intended location on the vessel. (2) It shall, if intended to be fitted in locations where flammable atmospheres may be present, comply with the relevant safety regulations, for such spaces. (3) The 15 ppm bilge separator shall be so designed that it functions automatically. However, safe arrangements to avoid any discharge in case of malfunction shall be provided. (4) Changing the feed to the 15 ppm bilge separator from bilge to oil bilge water to emulsified bilge water, or from oil and water to air shall not result in the discharge overboard of any mixture containing more than 15ppm of oil. (5) The system shall require the minimum of attention to bring it into operation. In the case of engine room bilges, there shall be no need for any adjustment to valves and other equipment to bring the system into operation. The equipment shall be capable of operating for at least twenty-four hours of normal duty without attention. (6) All working parts of the 15 ppm bilge separator which are likely to be damaged shall be easily accessible for maintenance. 15 ppm bilge alarm: - (1) The 15 ppm bilge alarm shall resist corrosion in the conditions of the marine environment. (2) Any electrical equipment which is part of the 15 ppm bilge alarm shall be placed in a non-hazardous area.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 21 (3) A ppm display shall be provided. Onboard testing according to manufacturer's instructions shall be carried out. (4) The response time, that is the time which elapses between an alteration in the sample being supplied to the 15 ppm bilge alarm and the ppm display shall not exceed five seconds. (5) The 15 ppm bilge alarm shall record date, time and alarm status and operating status of the15 ppm bilge separator. The recording device shall also store data for at least eighteen months. (6) The accuracy of the 15 ppm bilge alarms shall be checked at renewal survey according tothe manufacturer's instructions. The calibration certificate for the 15 ppm bilge alarm, certifying date of last calibration check, shall be retained on board for inspection purpose.
