दिल्ली, 22 फरवरी, 2022 सा.का.जन. 144(अ).—अंतिेिीय िलयान [पंिीकरण और अन्य तकनीकी मुद्दे] जनयम, 2022 का मसौिा, जिस े केंद्र सरकार 2021 के अतं िेिीय िलयान अजधजनयम, 2021 (2021 का 24) के धारा 106 की उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती ह,ै इसके द्वारा प्रभाजवत होन े वाल े सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह;ै और एतद्द्वारा सूचना िी िाती ह ै दक उि मसौिे पर उस तारीख से तीस दिनों के बाि जवचार दकया िाएगा जिस तारीख को रािपत्र में प्रकाजित इस अजधसचू ना की प्रजतयां िनता को उपलब्ध कराई िाती ह;ैं इन मसौिा जनयमों पर आपजत्तयां या सुझाव, यदि कोई हों, जनिेिक (आईडब्ल्यूटी), पत् तन, पोत पररवहन और िलमाग ग मंत्रालय, कमरा नंबर 439, पररवहन भवन, 1-संसि माग,ग नई दिल्ली-110001 को या abhay.sarode@gov.in और uttam.mishra27@gov.in ईमेल द्वारा भारत के रािपत्र में प्रकाजित अजधसूचना की प्रजतयां, िनता को उपलब्ध कराने की तारीख स े30 दिनों की अवजध के भीतर संबोजधत दकया िा सकता ह;ैं कजित मसौिा जनयमों के संबंध में दकसी भी व्यजि से जवजनिष्ट अवजध के भीतर प्राप्त आपजत्तयों या सुझावों पर केन्द्र सरकार द्वारा जवचार दकया िाएगा। प्रारूप जनयम 1. संजिप्त नाम और प्रारंभ (1) इन जनयमों का संजिप्त नाम अंतिेिीय िलयान (कमीिल और यात्री स्ट्िान सुजवधा) जनयम 2022 ह ै (2) य ेरािपत्र में अपन ेअंजतम प्रकािन की तारीख से लाग ूहोंगे। 2. जवस्ट्तार और उपयोिन 1262 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) कोई भी अन्तििे ीय यांजत्रक रूप से चाजलत िलयान, जिसे अजधजनयम की धारा 17 के तहत पंिीकृत होना आवश्यक ह,ै दकसी भी यात्रा पर नहीं िाएगा या दकसी भी सवे ा के जलए उपयोग नहीं दकया िाएगा, िब तक दक उसके पास उसके संबंध में लाग ूपंिीकरण का प्रमाणपत्र न हो और जिसे अजधजनयम की धारा 24 के तहत प्रिान दकया गया हो। (2) वाजणज्य पोत पररवहन अजधजनयम, 1958 के तहत यांजत्रक रूप से चाजलत िलयान के संबंध में िारी रजिस्ट्री का प्रत्येक प्रमाणपत्र, अजधजनयम के तहत िारी दकए गए पंिीकरण के प्रमाणपत्र के रूप में मान्य और प्रभावी होगा और अजधजनयम के प्रासंजगक प्रावधान ऐसे िलयान के संबंध म ें लागू होंगे क्योंदक वे इन जवजनयमों और अजधजनयम के तहत पंिीकृत यांजत्रक रूप स ेचाजलत अन्तिेिीय िलयान पर लागू होते ह।ैं 3. पररभाषाए ं – (1) इन जनयमों म,ें िब तक दक संिभग से अन्यिा अपेजित न हो - (क) “अजधजनयम” का तात् पयग अन्तिेिीय िलयान अजधजनयम 2021 होगा। (ख) ”िांच” का तात्पयग िलयान, उसकी मिीनरी और बोड ग पर रखी वस्ट्तओंु की िांच तिा िलयान के ररकाडों का सत्यापन की प्रदिया ह ैजिसे पिं ीकरण के उद्देश्य के जलए पंिीकरण प्राजधकरण द्वारा दकया िाएगा। (ग) “प्रमुख पररवतगन अिवा संिोधन” का तात्पयग जनम्नजलजखत में से कोई भी ह;ै i) िलयान के सकल भार में 10 प्रजतित से अजधक का बिलाव ii) िलयान प्रकार में बिलाव iii) प्रणोिन प्रणाली/ मख्ु य इंजिन/ ईंधन प्रकार में बिलाव (घ) िलयान के मुख्य ड्राइंग का तात्पयग जनम्न जलजखत ह ै i) सामान्य व्यवस्ट्िा ii) मुख्य ढांचागत योिना िलयान का मध्य खंड, प्रोफाइल और डेक, िेल जवस्ट्तार iii) प्रणोिन प्रणाली सजहत मिीनरी लेआउट और ब्यौरा (2) प्रयुि िब्ि और अजभव्यजियां, िो इन जनयमों म ें पररभाजषत नहीं की गई ह ैं लेदकन अजधजनयम म ें पररभाजषत िब्िों और अजभव्यजियों का वही अि गहोगा िो उन्ह ेंअजधजनयम म ेंदिया गया ह।ै 4. पिं ीकरण हते ुआविे न यांजत्रक रूप से चाजलत दकसी अन्तििे ीय िलयान के पंिीकरण के जलए आवेिन प्रपत्र सं. 11 में िलयान के स्ट्वामी / एिेंट या माजलक या जनमागता द्वारा दकया िाएगा और इसम ें ऐसे जववरण िाजमल होंग े िो इन जनयमों के जनयम 7 द्वारा आवश्यक ह।ैं 5. पिं ीकरण की प्रदिया (1) राज्य म ें रजिस्ट्री के स्ट्िान पर पंिीकृत होने के इच्छुक अन्तिेिीय िलयान के स्ट्वामी / एिेंट या माजलक या जनमागता पंिीकरण के जलए एक आवेिन करेंग ेऔर संबंजधत पंिीकरण प्राजधकरण को प्रस्ट्तुत करेंगे (क) एक वक्त व् य दक इस अजधजनयम के उपबंधों और जनयमों का अनुपालन दकया गया ह;ै (ख) जनधागररत प्रपत्र संख य ा. 12 में यिा प्रयोज्य स्ट्वाजमत्व की घोषणा (ग) नए िलयान के जलए: i. िलयान के जनमातग ा (जनमागता प्रमाणपत्र) द्वारा हस्ट्तािररत एक प्रमाणपत्र जिसमें उजचत आयामों / जववरणों और िलयान के टनभार का एक सही ब्यौरा हो िैसा दक उसके द्वारा अनुमान लगाया गया िा और उस समय और स्ट्िान िहा ंिलयान का जनमागण दकया गया िा। ii. िलयान के अनुमोदित मुख्य ड्राइंग के साि सवेिण कताग द्वारा िारी िांच प्रमाणपत्र। iii. यदि कोई नया िलयान जनमागणाधीन ह ै तो जनमागता का प्रमाणपत्र िलयान के परू ा होने के पश्चात संबंजधत संगठन द्वारा िारी दकए िान े से पूवग िमा दकया िा सकता ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 3 (घ) प्रमुख पररवतगन अिवा संिोधन के अध्यधीन िलयानों के मामलों म ें जनमागता का प्रमाणपत्र और िांच प्रमाणपत्र, जिसे िलयान के अनुमोदित मुख्य ड्राइंग के साि सवेिणकताग द्वारा िारी दकया गया हो, िमा दकया िाए। (ड.) जबिी जलखत जिसके तहत उि िलयान की संपजत्त आवेिक को हस्ट्तांतररत दकया गया हो, उन्ह ें अपन े नाम पर पंिीकृत दकया िाना आवश्यक ह ै(परु ाने िलयान के जलए)। (च) नामोदद्दष्ट प्राजधकरण यदि सवेिण संबंधी िारी दकया गया प्रमाणपत्र का नकल अिवा सवेिण कताग द्वारा िारी कोई औपबंजधक प्रमाणपत्र। (छ) ऐसे िुल्क के भगु तान के साक्ष्य की चलान रसीि। (ि) बंधक संबंध ब्यौरा, यदि कोई हो। (2) अन्तििे ीय िलयानों [बीमा, िेयता की सीमा, िांच और िांच, सेवा प्रिाताओं और सेवा उपयोगकताओंग और संबद्ध मामलों के िाजयत्व] जनयम (2022) के अनुपालन में िारी दकए गए बीमा प्रमाणपत्र की प्रजतजलजप तत्काल प्रस्ट्तुत की िाएगी, िब िलयान को चलाने / व्यापार से पहले जनयमों के अनुसार बीमा दकया िाता ह।ै स्ट्पष्टीकरण उपयुगि उपजनयम- (2) के प्रयोिनों के जलए, पंिीकरण दकए िाने के बाि िलयान का बीमा दकया िाएगा और बीमा कंपनी को िलयान के पंिीकरण का प्रमाण, सवेिण का प्रमाण पत्र और बीमा कंपनी द्वारा अजनवाय ग ऐसे अन्य िस्ट्तावेिों सजहत पहचान िी िाएगी। (3) इन जनयमों के उद्देश्यों के जलए सवेिण प्रमाणपत्र की नकल नामोदद्दष्ट प्राजधकारी द्वारा िारी दकए िाने के तत्काल बाि िमा की िाएगी। (4) िलयान के पंिीकरण के जलए आवेिन प्राप्त होन े पर पंिीकरण प्राजधकारी ररकॉड ग और केंद्रीय डेटा बेस स े यह सुजनजश्चत करने के बाि दक उसी नाम पर कोई अन्य िलयान नहीं है, उस नाम को अनुमोदित करेगा जिसके जलए अनरु ोध दकया गया हऔै र एक बार नाम आवंरटत होने के बाि, पंिीकरण प्राजधकरण िलयान के जलए एक आजधकाररक नंबर भी आवंरटत करेगा, जिसे केंद्रीय डेटा बेस में ििग दकया िाएगा। बिते दक पंिीकरण प्राजधकारी आवेिन की प्राजप्त की जतजि को अिवा उसके चौिह दिनों के बाि आवेिक के नाम का अनुमोिन करेगा। (5) इन जनयमों के अनपु ालन में आवेिक द्वारा अपेजित जववरण और िस्ट्तावेि प्रस्ट्ततु करने के अध्यधीन, रजिस्ट्री के स्ट्िान पर पंिीकृत होने का हकिार ह,ै पंिीकरण प्राजधकारी आवेिक को प्रपत्र संख् या. 13 में जनधागररत प्रारूप में एक नोरटस िेगा, जिसमें िलयान के संबंध में िांच के समय और तारीख को सूजचत दकया िाएगा। (6) इन जनयमों के तहत िांच के उद्देश्य के जलए नामोदद्दष्ट प्राजधकारी अिवा संबंजधत राज्य सरकारों द्वारा जनयुि अिवा प्राजधकृत अन्य ऐसा कोई व्यजि: (क) ऐसी िांच के उद्देश्य के जलए िलयान अिवा इसके दकसी भाग अिवा इसमें लगी दकसी मिीनरी अिवा संगत दकसी वस्ट्तु की िांच कर सकता ह;ै (ख) िलयान के स्ट्वामी अिवा माजलक स े कोई भी ररकाड ग मागं सकता ह ै और िहां तक ऐसी िांच के उद्देश्य के जलए ऐसे ररकाडों का संबंध ह,ै उनकी िांच कर सकता ह;ै और (ग) ऐसी िांच के उद्देश्य के जलए यिा उपयुि सहायता प्राप्त कर सकता ह।ै (7) इस जनयम के तहत िांच के प्रयोिन के जलए, िलयान के, स्ट्वामी, माजलक और चालक िल का प्रत्येक सिस्ट्य िांच करन े के जलए सभी उजचत सुजवधाएं प्रिान करेगा और ऐसी िानकारी भी प्रस्ट्तुत करेगा िो उप-जनयम (6) के तहत अजधकार प्राप्त प्राजधकरण द्वारा आवश्यक हो। (8) यह सुजनजश्चत करन े पर दक आवेिक द्वारा इस जनयम के तहत समेदकत प्रदियाओं का अनपु ालन दकया गया है, पंिीकरण प्राजधकारी प्रपत्र संख्या 14 में यिा जनधागररत प्रारूप म ेंएक नक्कािी और अंकन नोट िारी करेगा। (9) जनयम 9 के अध्यधीन नक्कािी और अंकन नोट जनधागररत तरीके से िलयान पर नक्कािी और अंकन करन े के बाि पंिीकरण प्राजधकरण को वापस कर दिया िाएगा, जिसे एक सवेिक द्वारा प्रमाजणत दकया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (10) यह सुजनजश्चत करन े पर दक आवेिक ने इन जनयमों का अनुपालन दकया है, इस जनयम म ें वर्णगत रजिस्ट्री की आवश्यकताओं को परू ा करने में, पंिीकरण प्राजधकरण प्रपत्र संख्या 19 में ऐसे आवेिक द्वारा प्रिान दकए गए अन्तििे ीय पोत के जववरण को िि गकरेगा। 6. पिं ीकरण प्रमाणपत्र प्रिान करना (1) यदि दकसी अन्तिेिीय याजं त्रक रूप स े चाजलत िलयान के संबंध में, पंिीकरण प्राजधकारी,उपयुगि जनयम 6 म ें िी गई ऐसी िांच करने के बाि, उजचत समझे, तो और संतष्टु हो दक अजधजनयम के उपबंधों या इसके तहत बनाए गए दकसी भी जनयम का अनुपालन दकया गया है, तो आवेिक को प्रपत्र संख्या 17 के अनुसार पंिीकरण प्रमाणपत्र प्रिान करेगा, जिसम ें सवेिण प्रमाणपत्र या सवेिण के अनंजतम प्रमाणपत्र की नकल,जनमागता प्रमाणपत्र, जबिी का साधन जिसके द्वारा िलयान बेचा गया िा, और स्ट्वाजमत्व की घोषणा होगी। (2) पंिीकरण प्रमाणपत्र परंपरागत कागिी प्रमाणपत्र के स्ट्िान पर इलेक्रॉजनक रूप म ेंभी हो सकता ह।ै (3) िब तक उपयुगि उपजनयम (1) म ेंअन्यिा जवजनर्िष्टग नहीं दकया िाए, नामोदद्दष्ट प्राजधकारी (क) यांजत्रक रूप स े चजलत दकसी भी अन्तिेिीय िलयान, दकसी पत्तन अिवा पंिीकरण स्ट्िान के अलावा अन्य स्ट्िान पर जनर्मगत हो, िो पंिीकरण के प्रयोिन के जलए ऐसे दकसी पत्तन अिवा स्ट्िान तक अन्तििे ीय िलमागों के माध्यम स े उनकी पहली यात्रा की अनुमजत िे सकता ह;ै अिवा (ख) भारत में उस समय लागू दकसी कानून के अंतगगत पंिीकृत िलयान जिसके जलए इस अजधजनयम के अंतगगत उपबंध दकए गए ह,ै को अन्तिेिीय िलमागों में यात्रा करने की अनुमजत ि ेसकता ह;ै अिवा (ग) भारत के अलावा अन्य दकन्हीं िेिों के ऐस े कानूनों के तहत पंिीकृत यांजत्रक रूप से चजलत दकसी िलयान को समय-समय पर केन्द्रीय सरकार द्वारा यिा जवजनर्िष्टग जनबंधन व ितों के अध्यधीन अन्तििे ीय िलमागों में चलन े की अनुमजत िे सकता ह।ै (4) पंिीकरण प्रमाणपत्र को िारी करने को लंजबत रखत े हुए अजधजनयम की धारा 27 के अनुसार एक अनंजतम पंिीकरण प्रमाणपत्र िारी दकया िा सकता ह ै और पंिीकरण के अनंजतम प्रमाणपत्र की वैधता की अवजध के िौरान, स्ट्वामी, प्रचालन, माजलक या जनमागण याडग अजधजनयम के अध्याय V के तहत पिं ीकृत िलयान को पंिीकृत करने के जलए उठाए िाने वाल े सभी आवश्यक किमों को लाग ूकरेगा और उनका अनुपालन करेगा। (5) िलयान के स्ट्वामी या माजलक का यह कतगव्य होगा दक वह अजधजनयम और जनयमों के प्रवतगन म ें िाजमल प्राजधकारी द्वारा मांगे िाने पर पंिीकरण का प्रमाण पत्र या पंिीकरण का अनंजतम प्रमाण पत्र, िैसा दक मामला हो, प्रस्ट्ततु करे। (6) एक पंिीकरण प्राजधकारी दकसी भी अन्तिेिीय िलयान को पंिीकृत करन े से इनकार कर सकता है, यदि वह यांजत्रक रूप स े िोषपूण ग पाया िाता ह,ै या यदि आवेिक पंिीकरण के जलए आवेिन म ें दकए गए दकसी भी बयान के समिनग म ें संतोषिनक सबूत प्रस्ट्तुत करने में जवफल रहता ह,ै बिते दक िहां पंिीकरण प्राजधकरण दकसी भी अन्तिेिीय यंत्र चाजलत िलयान को पंिीकृत करने से इनकार करता ह,ै तो यह आवेिक को जलजखत रूप में एक बयान प्रस्ट्ततु करेगा जिसमें इस तरह के इनकार के कारण िाजमल होंगे। 7. प्रमाणपत्र की नकल (1) प्राजधकारी जिसने पंिीकरण प्रमाणपत्र िारी दकया है, वह राज्य सरकार द्वारा जनधागररत िुल्कों के भुगतान के अध्यधीन खोए हुए, नष्ट या जवकृत प्रमाणपत्र को प्रजतस्ट्िाजपत करने के जलए पंिीकरण के प्रमाणपत्र का एक नकल िारी करेगा। (2) बिते दक प्रमाणपत्र की ऐसा कोई नकल िारी नहीं की िाएगी यदि: (क) खोए प्रमाणपत्र के मामल े में पंिीकरण करने वाले प्राजधकारी की संतुजष्ट के जलए यह साजबत नहीं हो दक उि प्रमाणपत्र को ढंढू न े के जलए सभी संभव उपाय कर जलए गए ह;ैं (ख) जवनष्ट प्रमाणपत्र के मामले में ऐसा प्राजधकारी उजचत िांच के बाि संतुष्ट नहीं हो िाए दक प्रमाणपत्र वास्ट्तव म ें जवनष्ट हो गया ह;ै और (ग) जवकृत प्रमाणपत्र के मामले म ेंस्ट्वामी ऐसे प्राजधकारी को वह प्रमाणपत्र दिखाता ह।ै (3) प्रमाणपत्र के प्रत्येक नकल के पृष्ठ पर लाल स्ट्याही से ‘नकल’ िब्ि का स्ट्टाम्प जलखा होगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 5 (4) मूल प्रमाणपत्र की प्राजप्त होने पर दकसी नकल प्रमाणपत्र के िारी होने के बाि नकल प्रमाणपत्र को िारीकताग प्राजधकारी को वापस दकया िाएगा िो उि प्रमाणपत्र को रद्द करेगा और इसे ररकाड गकरेगा। 8. यांजत्रक रूप स ेचाजलत िलयानों का मार्किंग (1) िहां इस अध्याय के तहत एक अन्तििे ीय िलयान पंिीकृत दकया गया ह,ै पंिीकरण प्राजधकारी ऐसे िलयान को जनर्िष्टग करेगा, जिसे उस पर स्ट्पष्ट रूप से पंिीकरण जचह्न, रजिस्ट्री बंिरगाह और इस जनयम में प्रिान दकए गए ऐस े िलयान का नाम िाजमल ह।ै (2) प्रत्येक पंिीकृत िलयान में इसके ढांचे पर जनम्नजलजखत पहचान जचह्न होंग े - (क) यांजत्रक रूप से चाजलत िलयान के प्रत्येक धनुष और स्ट्टन ग पर िलयान का नाम अंदकत दकया िाएगा और बािों / िलयानों के मामले म ेंिो स्ट्व-चाजलत नहीं ह,ैं प्रत्येक धनषु पर नाम और आजधकाररक संख्या अंदकत की िाएगी; (ख) पंिीकरण सख्ं या और पंिीकरण का वषग मख्ु य अजधरचना और / या इंिन रूम बल्कहडे या अन्तििे ीय िलयानों म ें मुख्य बीम पर अंदकत दकया िाएगा। (ग) रजिस्ट्री स्ट्िल अिवा बंिरगाह का नाम स्ट्टन/ग रांसोम पर अंदकत होगा। (3) पहचान जचह्न को 25 जममी चौडे प्रत्येक अिर के साि न् यूनतम 200 जममी x 150 जममी (ऊंचाई x चौडाई) से कम नहीं जलखा िाएगा और इसे काली पष्ठृ भूजम पर या हल्के रंग की पृष्ठभूजम पर गहरे रंग म ें नक्कािीिार / जचजह्नत / वल्े ड े दकया िाएगा। (4) अन्तिेिीय िलयानों के पिं ीकरण जचह्नों को इसके मुख्य बीम या दकसी भी स्ट्िायी बल्कहडे पर एक प्रमुख स्ट्िान पर नक्कािीिार / जचजह्नत दकया िाएगा। (5) इसके अजतररि, प्रत्यके िलयान को जचजत्रत दकया िाएगा और एक जनजश्चत बोडग पर प्रिर्िगत दकया िाएगा, ऊपरी डेक पर जनम्नजलजखत िानकारी प्रिर्िगत की िाएगी - (क) सकल टनभार; (ख) याजत्रयों की अजधकतम अनुमेय संख्या; (ग) स्ट्वामी का नाम; (घ) अंजतम नवीकरण सवेिण जतजि; (ड.) कागो िलयानों के मामल े में भारयुि प्रारूप और पणू गभार । 9. पररवतनग ों और सिं ोधनों का पिं ीकरण (1) कोई भी पररवतनग या संिोधन िो िलयान की िढृ ता, जस्ट्िरता या सुरिा को महत्वपणू ग रूप से प्रभाजवत करता है, नाजमत प्राजधकरण के पूवग अनुमोिन के जबना नहीं दकया िाएगा। (2) िब दकसी अन्तििे ीय िलयान को इतना बिल दिया िाता है,िो उसके या पंिीकरण के प्रमाणपत्र म ें ििग जववरण स े संबंजधत जववरणों के अनरूु प नहीं हो तो; दफर िलयान का स्ट्वामी, 30 दिनों के भीतर, उस स्ट्िान के पंिीकरण प्राजधकारी को सवेिण के संबंजधत प्रमाणपत्र के साि इस तरह के पररवतगन / संिोधनों की एक ररपोटग िगे ा िहां िहाि पंिीकृत ह।ै (3) उपयुगि उप-जनयम (2) के तहत ररपोट,ग प्रपत्र स.ं 15 म ें की िाएगी और इसमें पररवतगन या संिोधनों के संबंध म ें जववरण िाजमल होंग ेऔर ररपोटग के समय िलयान के संबंध म ेंलाग ूपंिीकरण के प्रमाणपत्र के साि होंगे। (4) उप-जनयम (2) के तहत ररपोटग प्राप्त होने पर और राज्य सरकार द्वारा अजधसूजचत जनधागररत िुल्क के भुगतान पर पंिीकरण प्राजधकारी, या तो पररवतगन को पंिीकृत करने का कारण बनगे ा या जनिेि िगे ा दक िलयान को नए जसरे स े पंिीकृत दकया िाए। (5) प्राजधकारी यह तय करन े म ें दक क्या पंिीकरण के प्रमाण पत्र म ें पररवतगन या संिोधन ििग दकए िाएंग े या क्या अन्तििे ीय िलयान को एक नया पंिीकरण दकया िाना चाजहए, जनम्नजलजखत जवचारण द्वारा जनिेजित दकया िाएगा-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) िब कभी भी िलयान के ढांचे में कोई सामग्री पररवतगन अन्तिेिीय िलयान की लंबाई या चौडाई या गहराई को प्रभाजवत करता ह ै या िहा ं भी एक सहायक इंिन को हटाने के अलावा सजहत प्रणोिन के साधनों म ें पररवतगन होता है, तो िलयान को नए पंिीकरण की आवश्यकता होगी। (ख) िहां पररवतगन म ें केवल संलग्न स्ट्िान के आयामों म ें पररवतगन, पपू या डेकहाउस आदि के अलावा या हटान े या अन्य समान पररवतगनों की स्ट्वीकृजत या अस्ट्वीकृजत या चालक िल के स्ट्िान म ें पररवतनग िाजमल है, पंिीकरण प्राजधकरण इस तरह के पररवतगन को पंिीकरण के प्रमाणपत्र म ें ििग करने की अनुमजत ि े सकता है, बित े यह जनर्िष्टग प्राजधकरण द्वारा सत्याजपत दकया गया हो दक िलयान की जस्ट्िरता इस प्रकार खतरे म ेंनहीं ह।ै (6) िहां पंिीकरण प्राजधकरण जनििे िेता ह ै दक िलयान को नए जसरे से पंिीकृत दकया िाए, यह या तो िलयान को पररवर्तगत के रूप म ें वर्णगत करने वाला एक अनंजतम प्रमाणपत्र प्रिान करेगा या मौिूिा प्रमाणपत्रों पर पररवतगन के जववरण का समिगन करेगा। (7) उपयुगि उप-जनयम (6) के तहत दिया गया कोई भी अनंजतम प्रमाणपत्र या समिनग उसकी तारीख से नब्ब े (90) दिनों की अवजध के जलए मान्य होगा, जिस अवजध के भीतर माजलक िलयान को नए जसरे स े पंिीकृत करन े के जलए सभी आवश्यक किम उठाएगा। 10. रजिस्ट्री का हस्ट्तातं रण यदि दकसी अन्तिेिीय यांजत्रक रूप से चाजलत िलयान का स्ट्वामी िलयान के पंिीकरण के प्रमाणपत्र में ििग पते पर जनवास करना या व्यवसाय करना बंि कर िते ा ह,ै तो वह पते के पररवतगन के तीस (30) दिनों के भीतर, अपन े नए पत े के बारे म ें पंिीकरण प्राजधकरण को सूजचत करेगा जिसके द्वारा पंिीकरण का प्रमाणपत्र प्रिान दकया गया िा, या यदि नया पता उसी राज्य के भीतर दकसी अन्य पंिीकरण प्राजधकरण के अजधकार िेत्र म ें है, और साि ही पंिीकरण के प्रमाणपत्र को पंिीकरण प्राजधकारी को अग्रेजषत करेगा तादक नया पता उस पर िि गदकया िा सके। (1) िहां मूल पंिीकरण प्राजधकरण के अलावा कोई अन्य पंिीकरण प्राजधकरण ऐसी कोई प्रजवजष्ट करता है, तो वह मूल पंिीकरण प्राजधकरण को नए पते के बारे में बताएगा। (2) िहा ं पंिीकरण को स्ट्िानांतररत करन े की मंिा ह ै वहां, िलयान के स्ट्वामी या माजलक द्वारा प्रपत्र संख् या. 16 म ें एक आवेिन को उस राज्य के पंिीकरण प्राजधकारी को प्रस्ट्ततु करन े पर दकसी अन्तिेिीय यांजत्रक रूप से चाजलत िलयान की रजिस्ट्री को एक राज्य म ेंएक स्ट्िान स े िसू रे राज्य म ें िसू रे स्ट्िान पर स्ट्िानांतररत दकया िा सकता ह।ै (3) उपयुगि उप-जनयम (3) के अनसु ार ऐस े आवेिन की प्राजप्त होने पर पंिीकरण प्राजधकारी उस स्ट्िान के पंिीकरण प्राजधकारी को जवजधवत रूप से जलजखत रूप में अजधसूजचत करेगा िहां िलयान मलू रूप से पिं ीकृत है, िो एक पखवाडे के भीतर या उससे पहले इस तरह के हस्ट्तांतरण के जलए कोई आपजत्त या अन्यिा सूजचत करेगा। (4) िलयान के संबंध म ें पंिीकरण के प्रमाण पत्र आवेिन के साि रजिस्ट्री के इजच्छत स्ट्िान के पंिीकरण प्राजधकारी को दिए िाएंगे। (5) उप-जनयम (3) और जनधागररत िुल्क के तहत आवेिन प्राप्त होने पर, रजिस्ट्री के इजच्छत स्ट्िान का पंिीकरण प्राजधकारी अपनी रजिस्ट्टर बही में,िलयान से संबंजधत सभी जववरणों को ििग करेगा और िलयान के संबंध में पंिीकरण का एक नया प्रमाणपत्र प्रिान करेगा और आग ेसे ऐसे िलयान को रजिस्ट्री के नए स्ट्िान पर पंिीकृत माना िाएगा। 11. िलयान का हस्ट्तातं रण (1) यदि दकसी िलयान को दकसी व्यजि को स्ट्िानांतररत कर दिया िाता ह,ै चाह े वह राज्य के भीतर जनवासी हो या नहीं, तो हस्ट्तांतरणकता ग और हस्ट्तांतररती पंिीकरण प्राजधकारी को हस्ट्तांतरण की संयुि ररपोटग बनाएंगे, जिसके अजधकार िेत्र के भीतर हस्ट्तांतरणकताग रहता ह ै या ऐसे हस्ट्तांतरण के तीस दिनों के भीतर व्यवसाय करता है, साि ही चालान या िमा रसीि के साि-साि इस तरह के हस्ट्तांतरण के जलए राज्य सरकार द्वारा जनधागररत िुल्क का भुगतान करता ह।ै (2) िलयान के संबंध में पंिीकरण का प्रमाणपत्र भी उप-जनयम (1) में जनर्िष्टग ररपोटग के साि सौंप दिया िाएगा तादक स्ट्वाजमत्व के हस्ट्तांतरण का जववरण उस पर ििग दकया िा सके। बिते दक िब रजिस्ट्री के हस्ट्तांतरण में एक राज्य सरकार से िसू रे राज्य सरकार को स्ट्िानांतरण िाजमल होता है, तो आवेिन प्रपत्र संख् या. 16 में दकया िाएगा िैसा दक जनयम 11 के उप-जनयम (3) म ेंउपबंध दकया गया ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 7 (3) हस्ट्तांतरण की जस्ट्िजत म,ें पंिीकरण प्राजधकारी, केंद्रीय डेटाबेस म ें हस्ट्तांतररती के सािसाि- हस्ट्तांतरणकता ग का जववरण ििग करेगा। 12. पिं ीकरण को रद्द दकया िाना िब दकसी भी पंिीकृत अन्तििे ीय िलयान को लापता, नष्ट, खोया हुआ और पररत्यि घोजषत दकया िाता ह ै या सेवा के जलए स्ट्िायी रूप से अयोग्य घोजषत कर दिया िाता ह,ै तो िलयान का माजलक ऐसी घटना के पंद्रह (15) दिनों के भीतर उस स्ट्िान िहां उि िलयान का पंिीकरण हुआ ह,ै वहां अन्तिेिीय िलयान के रजिस्ट्रार को इस तथ्य की ररपोटग करेगा। उस मामले म ें िहा ं स्ट्वामी यह तय करता ह ै दक एक पंिीकृत अन्तििे ीय िलयान को स्ट्िैप या जवघरटत या जविेिों म ें बेचा िाना ह,ै इस तरह के तथ्य को स्ट्िैपपंग या जवघरटत करने या जनष्पादित करन े के िरूु होने स े कम से कम पंद्रह (15) दिन पहले उस प्राजधकरण को सूजचत दकया िाना चाजहए। िलयान का पंिीकरण प्रमाणपत्र भी इस अजधजनयम की धारा 32 के अनुसार पंिीकरण रद्दीकरण के जलए प्राजधकारण को सौंपा िाएगा। 13. यांजत्रक रूप स ेचाजलत अन्तििे ीय िलयान अिवा िये र का रेहन (1) यांजत्रक रूप से चाजलत अन्तििे ीय िलयान अिवा िेयर का रेहन – (क) एक पंिीकृत अन्तििे ीय यांजत्रक रूप से चाजलत िलयान या उसमें एक जहस्ट्सा या ऋण को अन्य मूल्यवान जवचारण हते ु एक प्रजतभूजत के रूप में रखा िा सकता है, और प्रजतभूजत बनाने वाला जलखत (जिसे रेहन कहा िाता ह)ै जनधागररत प्रपत्र (प्रपत्र सं. 18) म ें होगा, और इस तरह के जलखत को सौंपने पर रजिस्ट्री के अन्तिेिीय यांजत्रक रूप से चाजलत िलयानों के बंिरगाह का पंिीकरण प्राजधकरण इसे पंिीकरण बही म ें िि ग करेगा और रजिस्ट्री के प्रमाणपत्र म ें इस े संलग्न दकया िाएगा। (ख) रेहन को पंिीकरण प्राजधकारी द्वारा उस िम म ें िि ग दकया िाएगा जिस म ें वे उस उद्देश्य के जलए उसे प्रस्ट्तुत दकए िाते ह,ैं और पंिीकरण प्राजधकरण, अपन े तहत ज्ञापन द्वारा, प्रत्येक रेहन पर सूजचत करेगा दक यह उसके द्वारा उस ररकॉडग के दिन और घंटे को बताते हुए िि गदकया गया ह।ै (2) रेहन के जनवगहन की प्रजवजष्ट- िहां एक पंिीकृत रेहन का जनवगहन दकया िाता ह,ै पंिीकरण प्राजधकारी, रेहन जवलेख के सौंपने पर, उसके साि लगाए गए रेहन धन की रसीि के साि, जवजधवत हस्ट्तािररत और सत्याजपत, पंिीकरण की बही में इस आिय से एक प्रजवजष्ट करेगा दक रेहन का जनवगहन दकया गया है, और उस प्रजवजष्ट पर संपजत्त, यदि कोई हो, बनाई िा रही ह ै िो रेहन को पाररत दकया गया ह,ै तो वह उस व्यजि में जनजहत होगा जिसमें (हस्ट्तिेप करने वाले कृत्यों और पररजस्ट्िजतयों के संबंध म,ें यदि कोई हो) तो यह जनजहत होगा, यदि रेहन नहीं लगाया गया । (3) रेहन की प्रािजमकता- यदि एक ही अन्तििे ीय यंत्र चाजलत िलयान या िेयर के संबंध में िि ग एक से अजधक रेहन ह,ै तो रेहनधारकों को दकसी भी अजभव्यि, अनरु ोध या रचनात्मक नोरटस के बाविूि, उस तारीख के अनुसार प्रािजमकता होगी जिस पर प्रत्येक रेहन पंिीकरण बही म ेंििग दकया गया ह ैऔर प्रत्येक रेहन की तारीख के अनुसार नहीं। (4) रेहनधारक को स्ट्वामी नहीं माना िाता ह-ै जसवाय इसके दक िहां तक रेहनयिु अन्तिेिीय याजं त्रक रूप से चाजलत िलयान या िेयर को रेहन ऋण के जलए एक प्रजतभूजत के रूप में उपलब्ध कराने के जलए आवश्यक हो, रेहनधारक को अपन े रेहन के कारण, अन्तिेिीय याजं त्रक रूप स े चाजलत िलयान या िेयर का स्ट्वामी नहीं माना िाएगा, और न ही रेहन को इसका स्ट्वामी माना िाएगा। (5) रेहनधारक के अजधकार - (क) िहा ं एक अन्तिेिीय यंत्र चाजलत िलयान या िेयर का केवल एक पंिीकृत रेहन है, वह रेहनयुि अन्तििे ीय यांजत्रक रूप से चाजलत िलयान को बेचकर रेहन के तहत िेय राजि की वसूली करन े का हकिार होगा। (ख) अिवा उच्च न्यायालय से संपकग दकए जबना िेयर। बित े इस उप-धारा में जनजहत कोई बात रेहनधारक को उच्च न्यायालय में िेय राजि की वसूली करने से नहीं रोकेगी, िैसा दक नीचे उप-धारा (ख) में उपबंजधत ह।ै (ग) िहा ं एक अन्तिेिीय यांजत्रक रूप से चाजलत िलयान या िेयर के िो या िो स े अजधक पंिीकृत रेहन हैं, व े उच्च न्यायालय म ें रेहन के तहत िेय राजि की वसूली करन े के हकिार होंगे, और जडिी पाररत करत े समय या उसके बाि उच्च न्यायालय जनिेि िे सकता ह ै दक रेहन अन्तिेिीय यांजत्रक रूप से चाजलत िलयान या िेयर जडिी के जनष्पािन में बेचा िाए।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) दकसी अन्तििे ीय यांजत्रक रूप से चाजलत िलयान या िेयर का प्रत्येक पंिीकृत रेहन िो रेहन के तहत िेय राजि को प्राप्त करने का इरािा रखता है, िो ऊपर दिए गए खडं (क) के तहत रेहन अन्तिेिीय यांजत्रक रूप से चाजलत िलयान या िेयर बेचकर रेहन के तहत िेय राजि की वसूली करन े का इरािा रखता है, रजिस्ट्री के अन्तिेिीय यांजत्रक रूप स े चाजलत िलयानों के बंिरगाह के पंिीकरण प्राजधकरण को ऐसी जबिी से संबंजधत पंद्रह दिनों की अजग्रम सूचना िेगा। (ड.) खंड (घ) के तहत नोरटस के साि उस िलयान पर उनके रोिगार के संबंध म ें चालक िल को िये सभी मििरू ी और अन्य राजियों के भुगतान का प्रमाण होगा। (6) रेहन दिवाजलयापन से प्रभाजवत नहीं होता- एक अन्तिेिीय यत्रं चाजलत पोत या िेयर का एक पंिीकृत रेहन ऐस े बंधक के ररकॉडग की तारीख के बाि रेहनिार द्वारा दकए गए दिवाला के दकसी भी कायग से प्रभाजवत नहीं होगा, इसके बाविूि दक रेहनकताग, अपन े दिवाजलयापन के प्रारंभ म,ें अन्तििे ीय यंत्र रूप स े चाजलत िलयान या उसके कब्ि े वाला िेयर आिेि या जनिेप, या उसके प्रजतजष्ठत स्ट्वामी िा, और रेहन को दिवाजलया या दकसी भी रस्ट्टी या संपजत्त भागी के अन्य लेनिारों के दकसी भी अजधकार, िावे या ब्याि के जलए तरिीह िी िाएगी। (7) रेहन का हस्ट्तांतरण— (क)एक अन्तिेिीय यांजत्रक रूप से चाजलत िलयान या िेयर का एक पंिीकृत रेहन दकसी भी व्यजि को हस्ट्तांतररत दकया िा सकता ह ै और हस्ट्तांतरण को प्रभाजवत करन े वाला जलखत जनधागररत प्ररूप म ें या उसके पास के रूप म ें पररजस्ट्िजतयों की अनुमजत के रूप में होगा, और ऐसे जलखत को दिए िान े पर, पंिीकरण प्राजधकरण इसे अन्तिेिीय यांजत्रक रूप से चाजलत िलयान या िेयर के रेहन के रूप में हस्ट्तांतरणकताग का नाम पंिीकरण बही में ििग करके इस े ररकाडग करेगा और अपन े हाि के तहत ज्ञापन द्वारा, हस्ट्तांतरण के जलखत पर सूजचत करें दक यह ररकॉडग के दिन और घटं े को बताते हुए उसके द्वारा ििग दकया गया ह।ै (ख) जिस व्यजि को ऐसा कोई रेहन हस्ट्तांतररत दकिा। स्ट्पष्टीकरण 1: दकसी िलयान DRAFT RULES 1. Short Title Commencement (1) These Rules shall be called the Inland Vessels (Registration and other Technical issues) Rules 2022. (2) They shall come into force on the date of their final publication in Official Gazette. 2. Scope and Application (1) Any inland mechanically propelled vessel, which is required to be registered under Section 17 of the Act shall not proceed on any voyage or be used for any service, unless it has a certificate of registration in force in respect thereof and granted under Section 24 of the Act. (2) Every certificate of registry issued in respect of a mechanically propelled vessel under the Merchant Shipping Act, 1958, shall be valid and effective as a certificate of registration issued under the Act and the relevant provisions of the Act shall apply in relation to such vessel as they apply to an inland mechanically propelled vessel registered under these regulations and the Act.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. Definitions (1) In these rules, unless the context otherwise requires,-- – (a) “Act” means Inland Vessels Act 2021(24 of 2021). (b) ”enquiry” means the process of inspection of the vessel, her machinery and articles on board as well as and verification of records of the vessel by the registering authority for the purpose of registration. (c) “Major conversion or modification” means any of the following; i) Change in Gross Tonnage of the vessel by more than ten per centum ii) Change of vessel type iii) Change of propulsion system/ main engines/ type of fuel (d) Main Drawings of the vessel means the following: i) General Arrangement ii) Main Structural plans: Midship section, Profile and Decks, Shell expansion iii) Machinery layout and details including propulsion system (2)Words and expressions used and not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act. 4. Application for registration An application for registration of an inland mechanically propelled vessel shall be made by the owner/agent or master or builder of the vessel in Form No. 11 and shall contain such particulars as required by Rule 7 of these Rules. 5. Procedure for registration (1) The owner/agent or master or builder of an inland vessel wishing to have it registered at a place of registry in the State shall make an application for registration and submit to the concerned Registering Authority: (a) A statement that the provisions of the Act and these rules have been complied with; (b) A declaration of ownership – in the prescribed Form No. 12, as applicable (c) For new vessel: i. a certificate signed by the builder (builder’s certificate) of the vessel containing a true account of the proper dimensions/particulars and of the tonnage of the vessel as estimated by him and the time and the place where the vessel was built. ii. Inspection certificate issued by the surveyor along with along with approved main drawings of the vessel. iii. In case of a new vessel under construction the builder’s certificate may be submitted forthwith upon issue by the respective organization after the completion of the vessel. (d) In the case of vessels subjected to major conversion or modification , builder’s certificate and inspection certificate issued by the surveyor along with approved main drawings of the vessel. (e) The instrument of sale under which the property of the vessel was transferred to the applicant who requires it to be registered in his name, (for second hand vessel). (f) A duplicate of the certificate of survey if issued by the designated authority or provisional certificate of survey issued by the Surveyor (g) Challan receipt evidencing payment of such fees (h) Details of mortgage, if any. (2) Copy of certificate of insurance, issued in compliance with the Inland Vessels [Insurance, Limitation of Liability, Inquiry and Investigations, Obligations of Service Providers and Service Users and Allied Matters] Rules (2022) shall be submitted forthwith, when the vessel is insured as per Rules before plying/trading. Explanation: For the purposes of sub-rule (2) above, the vessel shall be insured after registration is done and insurance company is given the identity including the proof of registration of the vessel, certificate of survey and such other documents mandated by the insurance company.[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 23 (3) For the purposes of these Rules, the Duplicate of Certificate of Survey shall be submitted forthwith when issued by the designated authority. (4) The Registering Authority on receipt of the application for registration of the vessel, shall approve the name that has been requested for, only after ensuring from records and Central Data Base that there is no other vessel in the same name and once the name is allotted, the Registering Authority shall also allot an official number for the vessel, which shall be recorded in the Central Data Base Provided that the Registering authority shall communicate the approval of name to the applicant on or after fourteen days from the date of receipt of the application. (5)Subject to submission of the requisite details and documents by the Applicant in compliance with these Rules, is entitled to be registered at the place of registry, the Registering Authority shall give a notice to the applicant in format as prescribed in Form No. 13, informing the time and date of the enquiry in respect of the vessel. (6) For the purpose of enquiry under these rules, the designated authority or such other person appointed or authorised by the respective State Governments may: (a) inspect the vessel or any part thereof or any machinery therein or any article therein relevant to the purpose of such enquiry; (b) call for any record from the owner or master of the vessel and examine it in so far as such records are relevant for the purpose of such enquiry and (c) have such assistance as it deems fit for the purpose of such inspection (7) For the purpose of enquiry under this Rule, the owner, the master and every member of the crew of the vessel shall provide all reasonable facilities for conducting the enquiry and shall also furnish such information as may be required by the authority empowered under sub-rule (6). (8)Upon ascertaining that the procedures enumerated under this Rule have been complied with by the applicant, the Registering Authority shall issue a carving and marking note in the format as prescribed in Form No. 14. (9) Subject to Rule 9, the carving and marking note shall be returned to the Registering Authority after carrying out the carving and marking on the vessel in the prescribed manner, which shall be certified by a Surveyor. (10) Upon ascertaining that the applicant has complied with these Rules, in completing the requirements for registry as described in this Rule, the Registering Authority shall enter the particulars of the inland vessel as provided by such applicant in Form No. 19. 6. Grant of certificate of registration (1) If, in respect of any inland mechanically propelled vessel, the registering authority, after making such inquiry as provided in Rule 6 above , thinks fit, is satisfied that the provisions of the Act or of any rules made hereunder have been complied with, shall grant to the applicant thereof a certificate of registration as per Form No. 17retaining the duplicate of Certificate of Survey or provisional certificate of Survey, builders certificate, instrument of sale by which the vessel was sold, and the declaration of ownership. (2) The certificate of registration may also be in electronic form , in place of conventional paper certificate. (3)Notwithstanding anything contained in sub-rule (1) above, the designated authority may: (a) permit any mechanically propelled inland vessel, built at any place other than a port or place of registry, to make her first voyage through the inland waters to any such port or place for the purpose of registration; or (b) permit the vessel registered under any law for the time being in force in India for which provisions have been made under this Act to conduct voyage within the inland waters; or (c) permit any mechanically propelled vessel registered under such laws of countries other than India to ply within the inland waters, subject to terms and conditions as may be specified by the Central Government, from time to time. (4) A provisional certificate of registration may be issued in accordance with Sec 27 of the Act pending issuance of the certificate of registration and during the period of validity of the provisional certificate of registration, the owner, operator, master or construction yard shall implement and comply with all necessary steps to be taken to have the vessel registered under Chapter V of the Act. (5) It shall be the duty of the owner or master of the inland vessel to produce Certificate of Registration or provisional certificate of registration as the case may be on demand by authority engaged in the enforcement of Act and rules.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) A registering authority may refuse to register any inland vessel, if she is found to be mechanically defective, or if the applicant fails to furnish satisfactory evidence in support of any of the statements made in the application for registration, provided that where the registering authority refuses to register any inland mechanically propelled vessel, it shall furnish to the applicant a statement in writing containing the reasons for such refusal. 7. Duplicate of the certificate (1) The authority which has issued the certificate of registration, shall issue a duplicate of the certificate of registration to replace a certificate lost, destroyed or mutilated, subject to payment of such fees as prescribed by the State Government. (2) Provided that no such duplicate certificate shall be issued unless: (a) in the case of a certificate lost, it is proved to the satisfaction of the Registering Authority that all measures possible for tracing out the certificate have been exhausted; (b) in the case of a certificate destroyed, such authority is satisfied after due enquiry that the certificate has actually been destroyed; and (c) in the case of mutilated certificate, the owner delivers up such certificate to such authority. (3) Every duplicate of the certificate shall, on the face of it, be stamped with the word ‘Duplicate’ in red ink. (4) Subsequent to the issuance of a duplicate certificate, if the original certificate is found, the latter shall be delivered up to the issuing authority that shall cancel the certificate and record the same. 8. Marking of Inland mechanically propelled vessels (1) Where an inland vessel has been registered under this Chapter, the registering authority shall assign to such vessel, to be displayed thereon conspicuously registration mark comprising of registration number, port of registry and name of such Vessel as provided in this Rule. (2) Every registered vessel shall bear the following identification marks on its hull;- (a) Name of vessel shall be inscribed on each bow and stern of the mechanically propelled vessel And in the case of barges/vessels which are not self- propelled , the name and official number shall be inscribed on each bow; (b) Registration number and year of registration shall be inscribed on the main superstructure and /or engine room bulkhead or main beam in the inland vessels. (c) Place or Port of registry shall be inscribed on the stern / transom. (3) The identification mark shall be inscribed not less than 200mm x 150mm (height x breadth) with each letter 25mm wide and shall be carved/marked/welded in light colour on a dark background or in a dark colour on a light background. (4) Inland Vessels registration marks shall be carved / marked on its main beam or any permanent bulkhead at a prominent place. (5) Additionally, every vessel shall be painted and displayed on a fixed board, exhibited on the upper deck, the following information; (a) Gross tonnage; (b) maximum permissible number of passengers ; (c) name of the owner ; (d) date of last renewal survey. (e) loaded draft and deadweight tonnes in case of cargo vessels. 9. Registration of alterations and modifications (1) No alteration or modification which significantly affects the strength, stability or safety of the vessel shall be made without the prior approval of the Designated Authority. (2) When an inland vessel is so altered, as not to correspond with the particulars relating to her or the description entered in the certificate of registration; then the owner of the vessel shall, within 30 days, make a report of such alteration/modifications to the registering authority of the place where the vessel is registered, along with the respective certificate of survey.[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 25 (3) The report under sub-rule (2) above, shall be made in Form No. 15 and shall contain particulars with respect to the alteration or modifications and shall be accompanied by the certificate of registration in force in respect of the vessel at the time of the report. (4) The registering authority, on receipt of the report under sub-rule (2)and on payment of the prescribed fee as notified by the state government, shall either cause the alteration to be registered or direct that the vessel be registered anew. (5) The registering authority in deciding whether alteration or modifications will be entered in the certificate of registration or whether the inland vessel should be registered a new shall be guided by the following considerations:- (a) Whenever any material alteration is made in the hull affecting the length or breadth or depth of the inland vessel or wherever there is alteration in the means of propulsion including addition of removal of an auxiliary engine the vessel shall require new registration. (b) Where the alteration consists merely of a change in the dimensions of enclosed space, the addition or removal of poop or deckhouse etc. or an allowance or disallowance or crew space of other similar change, the registering authority may allow such alteration to be entered into the certificate of registration, provided it is verified by the designated Authority that the stability of the vessel is not endangered thereby. (6) Where the registering authority directs that the vessel be registered anew, it shall either grant a provisional certificate describing the vessel as altered or endorse the particulars of the alteration on the existing certificates. (7) Any provisional certificate granted or endorsement made under sub-rule (6) above shall be valid for a period of Ninety (90) days from the date thereof, within which period the owner shall cause all necessary steps to be taken to have the vessel registered anew. 10. Transfer of registry (1) If the owner of an inland mechanically propelled vessel ceases to reside or carry on business at the address recorded in the certificate of registration of the vessel, he shall, within thirty (30) days of the change of address, intimate his new address to the registering authority by which the certificate of registration was granted, or if the new address is within the jurisdiction of another registering authority within the same State, to that registering authority, and shall at the same time forward the certificate of registration to the registering authority in order that the new address may be entered thereon. (2) Where a registering authority other than the original registering authority makes any such entry, it shall communicate the new address to the original registering authority. (3) The registry of an inland mechanically propelled vessel may be transferred from one place in a State to another place in another State, on submission of an application in Form No. 16 by the owner or master of the vessel to the registering authority of the State to which the registration is intended to be transferred. (4) On receipt of such application as per sub-rule (3) above, the registering authority shall duly notify the registering authority of the place where the vessel is originally registered, in writing, who shall communicate no objection or otherwise to such transfer within a fortnight or earlier. (5) The certificates of registration in respect of the vessel shall be delivered up to the registering authority of the intended place of registry along with the application. (6) On receipt of the application under sub- rule (3) and the prescribed fee, the registering authority of the intended place of registry shall enter in its register book, all the particulars relating to the vessel and grant a fresh certificate of registration in respect of the vessel and henceforth such vessel shall be considered as registered at the new place of registry. 11. Transfer of vessel (1) If a vessel is transferred to any person, whether resident within the State or not, the transferor and the transferee shall make joint report of the transfer to the registering authority within whose jurisdiction the transferee resides or carries on business within thirty days of such transfer along with a challan or deposit receipt evidencing payment of fees as prescribed by the state government for such transfer. (2) The certificate of registration in respect of the vessel shall also be surrendered along with the report referred to in sub-rule (1) in order that the particulars of the transfer of the ownership may be entered thereon. Provided that when transfer of registry involves transfer from one State Government to another, application shall be made in Form No. 16as provided in sub – rule (3) of Rule 11. (3) In the event of transfer, the registering authority shall record the details of the transferor as well as the transferee in the Central Data Base.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 12. Cancellation of Registration When any registered inland vessel is declared missing, destroyed, lost, abandoned or has been rendered permanently unfit for service, the owner of the vessel shall report the fact to the Registrar of Inland Vessels of the place where the vessel is registered within fifteen (15) days of occurrence of such event. In the case where the Owner decides that a registered inland vessel is to be scrapped or dismantled or sold abroad, such fact is to be reported to that authority at least fifteen (15) days in advance of commencement of scrapping or dismantling or executing such sale. The certificate of registration of the vessel shall also be surrendered to that Authority for cancellation of registration according to Section 32 of the Act. 13. Mortgage of mechanically propelled inland vessel or share (1) Mortgage of inland mechanically propelled vessel or share – (a) A registered inland mechanically propelled vessel or a share therein, may be made a security for a loan or other valuable consideration, and the instrument creating the security (called mortgage) shall be in the prescribed form (Form no 18), and on the production of such instrument the Registering Authority of the inland mechanically propelled vessels port of registry shall record it in the Book of Registration and endorse the same in the Certificate of Registry. (b) Mortgages shall be recorded by the Registering Authority in the order in time in which they are produced to him for that purpose, and the Registering Authority shall, by memorandum under his hand, notify on each mortgage that it has been recorded by him stating the day and hour of that record. (2) Entry of discharge of mortgage– Where a registered mortgage is discharged, the Registering Authority shall, on the production of the mortgage deed with a receipt for the mortgage money endorsed thereon, duly signed and attested, make an entry in the Book of Registration to the effect that the mortgage has been discharged, and on that entry being made the estate, if any, which passed to the mortgagee shall vest in the person in whom (having regard to intervening acts and circumstances, if any) it would have vested, if the mortgage had not been made. (3) Priority of mortgages-- If there are more mortgages than one recorded in respect of the same inland mechanically propelled vessel or share, the mortgagees shall, notwithstanding any express, implore or constructive notice, have priority according to the date on which each mortgage is recorded in the Book of Registration and not according to the date of each mortgage itself. (4) Mortgagee not deemed to be owner– Except in so far as may be necessary for making a mortgaged inland mechanically propelled vessel or share available as a security for the mortgage debt, the mortgagee shall not, by reason of his mortgage, be deemed to be the owner of the inland mechanically propelled vessel or share, nor shall the mortgagor be deemed to have ceased to be owner thereof. (5) Rights of Mortgagee– (a) Where there is only one registered mortgagee of an inland mechanically propelled vessel or share, he shall be entitled to recover the amount due under the mortgage by selling the mortgaged inland mechanically propelled vessel (b) or share without approaching the High Court. Provided that nothing contained in this sub-section shall prevent the mortgagee from recovering the amount so due in the High Court as provided in sub-section (b) below. (c) Where there are two or more registered mortgagees of an inland mechanically propelled vessel or share they shall be entitled to recover the amount due under the mortgage in the High Court, and when passing a decree or thereafter the High Court may direct that the mortgaged inland mechanically propelled vessel or share be sold in execution of the decree. (d) Every registered mortgagee of an inland mechanically propelled vessel or share who intends to recover the amount due under the mortgage by selling the mortgaged inland mechanically propelled vessel or share under clause (a) above shall give, an advance notice of fifteen days relating to such sale to the Registering Authority of the inland mechanically propelled vessels port of registry. (e) The notice under clause (d) above shall be accompanied with the proof of payment of all wages and other amounts due to crew in connection with their employment on that vessel. (6) Mortgage not affected by insolvency– A registered mortgage of an inland mechanically propelled vessel or share shall not be affected by any act of insolvency committed by the mortgagor after the date of the record of such mortgage, notwithstanding that the mortgagor, at the commencement of his insolvency, had the inland mechanically propelled vessel or share in his possession, order or disposition, or was the reputed owner thereof, and the mortgage shall be preferred to any right, claim or interest therein of the other creditors of the insolvent or any trustee or assignee on their behalf.[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 27 (7) Transfer of mortgages— (a) A registered mortgage of an inland mechanically propelled vessel or share may be transferred to any person and the instrument effecting the transfer shall be in the prescribed form or as near thereto as circumstances permit, and on the production of such instrument, the Registering Authority shall record it by entering in the Book of Registration the name of the transferee as mortgagee of the inland mechanically propelled vessel or share and shall, by memorandum under his hand, notify on the instrument of transfer that it has been recorded by him stating the day and hour of the record. (b) The person to whom any such mortgage has been transferred shall enjoy the same right of preference as was enjoyed by the transferor. Explanation 1: Instrument creating a mortgage of a vessel or a share therein shall be in Form No. 18. Explanation 2: Instrument creating a transfer of a mortgage or a share therein shall be in Form No. 19. Explanation 3: Instrument creating the discharge of mortgage shall be in Form No. 20. [F.
