(2021 का 24) के धारा 106 की उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए बनान े का प्रस्ट्ताव करती ह,ै इसके द्वारा प्रभाजवत होने वाल े सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह;ै और एतद्द्वारा सूचना िी िाती ह ै दक उि मसौि े पर उस तारीख से तीस दिनों के बाि जवचार दकया िाएगा जिस तारीख को रािपत्र म ेंप्रकाजित इस अजधसूचना की प्रजतयां िनता को उपलब्ध कराई िाती ह;ैं इन मसौिा जनयमों पर आपजत्तयां या सुझाव, यदि कोई हों, जनिेिक (आईडब्ल्यूटी), पत् तन, पोत पररवहन और िलमाग ग मंत्रालय, कमरा नंबर 439, पररवहन भवन, 1-संसि माग,ग नई दिल्ली-110001 को या abhay.sarode@gov.in और uttam.mishra27@gov.in ईमेल द्वारा भारत के रािपत्र में प्रकाजित अजधसूचना की प्रजतयां, िनता को उपलब्ध कराने की तारीख स े30 दिनों की अवजध के भीतर संबोजधत दकया िा सकता ह;ैं कजित मसौिा जनयमों के संबंध में 1. संजक्षप्त नाम और प्रारंभ (1) इन जनयमों का संजक्षप्त नाम अंतिेिीय िलयान (सवेक्षण और प्रमाणन)जनयम 2022 ह ै (2) य ेरािपत्र में अपन ेअंजतम प्रकािन की तारीख से लाग ूहोंगे। 2. पररभाषाए:ं (1) इन जनयमों म,ें िब तक दक संिभग से अन्द्यिा अपेजक्षत न हो - (क) “अजधजनयम” से अंतििे ीय िलयान (अजधजनयम), (2021) (2021 का24) अजभप्रेत ह.ै (ख) "अतं िेिीय िलयान" का अि ग ह ै दकसी भी यांजत्रक रूप स े चाजलत अंतिेिीय िलयान िसै ा दक अजधजनयम की धारा 3 (वाई) के तहत पररभाजषत दकया गया ह।ै (2) "वतगमानिलयान" या "वतमग ान अंतिेिीय िलयान" का अजभप्रेत ह ै कोई भी अंतिेिीय िलयानिो कोई नया अंतििे ीय िलयाननहीं ह ैिो जनयम 3 के उप-जनयम (3) के अंतगतग प्रिान की गई पररभाषा की अजधकाररता के अधीन आता ह।ै (3) “नया अंतिेिीय िलयान" का अि ग ह ै कोई भी अंतिेिीय िलयान जिसकी कील रखी गई ह ै या िो जनयमों के लाग ू होन े की तारीख को या उसके बाि जनमागण के समान चरण म ेंह।ै (4) "प्रमुख पररवतगन अिवा आिोधन" स े जनम्नजलजखत म ेंस े कोई अजभप्रेत ह;ै क) िलयान के सकल टन भार म ें10 प्रजतित स ेअजधक पररवतगन ख) िलयान के प्रकार का पररवतगन ग) प्रणोिन प्रणाली/मख्ु य इंिनों/ईंधन के प्रकार म ें पररवतगन (2) प्रयुि िब्िों और अजभव्यजियों, िो इन जनयमों म ें पररभाजषत नहीं की गई ह,ैं का वही अि ग होगा िो उन्द्ह ें अजधजनयम म ें जवजनर्िष्टग दकया गया ह।ै 3. पररचालन के क्षत्रे (1) राज्य सरकार अजधकतम महत्वपूण ग लहर ऊंचाई मानिडं के आधार पर अंतिेिीय िल क्षेत्रों को क्षत्रे 1, क्षत्रे 2 और क्षत्रे 3 के रूप म ेंवगीकृत कर सकती ह,ै िैसा दक नीच े जनधागररत दकया गया ह।ै (2) इसजलए िलयानों का सबस े करिन क्षत्रे म ें सेवा के जलए जडिाइन, जनमागण और रखरखाव दकया िाएगा, जिसम ें पररचाजलत करन े का वह इरािा रखता ह।ै (i) क्षत्रे 1 का अजभप्रेत ह ैएक ऐसा क्षत्रे (क्षत्रे 2 या क्षत्रे 3 के अलावा) िहां अजधकतम महत्वपूणग लहर ऊंचाई 2.0 मीटर स े अजधक नहीं ह।ै (ii) क्षत्रे 2 का अजभप्रेत ह ैएक ऐसा क्षत्रे (क्षत्रे 3 के अलावा) िहा ं अजधकतम महत्वपूण ग लहर ऊंचाई 1.2 मीटर स े अजधक नहीं ह।ै (iii) क्षत्रे 3 का अजभप्रेत ह ैऐसा क्षत्रे िहां अजधकतम महत्वपूण गलहर ऊंचाई 0.6 मीटर स े अजधक नहीं ह।ै 4. सवक्षे ण का प्रमाणपत्र (1) अजधजनयम के िायरे के अंतगगत िारी दकए िाने वाल े सवेक्षण के प्रमाणपत्र और प्रासंजगक प्रपत्रों के प्रारूप इन जनयमों के पररजिष्ट I के अनुसार होंगे। (2) सवेक्षण के प्रमाणपत्र म ें यह जनर्िष्टग दकया िाएगा दक अतं िेिीय िलयानपररचालन के दकसी जविेष क्षत्रे के जलए उपयुि ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (3) एक यांजत्रक रूप स े चाजलत अंतिेिीय िलयान दकसी भी यात्रा पर आगे नहीं बढेगा या दकसी सेवा के जलए उपयोग नहीं दकया िाएगा िब तक दक उसके पास सेवा के प्रकार और पररचालन के जलए इजछित क्षत्रे के जलए सवेक्षण का वैध प्रमाणपत्र न हो। (4) सवेक्षण का प्रमाणपत्रइन जनयमों म ें जनर्िष्टग आवजधक सवेक्षणों को पूरा करने सजहत जनर्िष्टग प्राजधकारी द्वारा जनर्िष्टग दकसी भी ित ग के अधीन5 वषग की अवजध के जलए वैध रहगे ा। (5) जनर्िष्टग प्राजधकारी के िलयान के सवेक्षण का प्रमाणपत्र समाप्त होन े और यिासंभव िीघ्र नवीनीकरण दकए िान े की तारीख के बीच के अंतराल के िौरान यांजत्रक रूप स े चाजलत िलयान को यात्रा पर आग े बढने की अनुमजत िे सकता ह।ै 5. ररकॉड ग दकए िान े वाल े जडिाइन, जनमाणग , सिं ोधन या पररवतनग के अनपु ालन का प्रमाणन। (1) अजभजहतप्राजधकरण या अजधकृत व्यजि यह सुजनजित करेंग े दक अंतिेिीय िलयान, िो अंतिेिीय िलयान(जडिाइन और जनमागण) जनयम 2022 द्वारा िाजसत ह,ैं उि जनयमों के अनपु ालन म ें ह।ैं (2) अजभजहतप्राजधकरण या अजधकृत व्यजि यह सुजनजित करेंग े दक अंतिेिीय िलयान, िो अजधजनयम स े पहल े अंतिेिीय िल म ें जनर्मगत और जनयोजित ह,ैं अजधजनयम स े पहले प्रचजलत कानूनों और मानकों के अनुपालन म ेंह:ैं बिते दक अजभजहतप्राजधकारी या अजधकृत व्यजि यह सुजनजित करें दक मौिूिा िलयान िो बडे पररवतगन या आिोधन स े गुिर चुके ह,ैं अंतिेिीय िलयान (जडिाइन और जनमागण) जनयम, 2022 का अनुपालन करते ह,ैं िहां तक इस े अजभजहतप्राजधकारी द्वारा उजचत और व्यावहाररक माना िाता ह।ै (3) वतगमान जनयम के उप-जनयम (1) और उप-जनयम (2) के अधीन, संबंजधत राज्य सरकार के अजभजहतप्राजधकारी या अजधकृत व्यजि जनमाणग , जडिाइन, संिोधन या पररवतगन, िैसा भी मामला हो, सवेक्षण के प्रमाणपत्रअजधजनयम के अंतगगत िारी दकए गए म ेंऔर इन जनयमों के अनुसार अनुपालन के संबंध म ेंप्रमाणीकरण को ररकॉड ग करेंगे। (4) एक िलयान का सवेक्षण उस राज्य के अजभजहतप्राजधकारी के सवेक्षक द्वारा दकया िा सकता ह ै जिसम ें वह पररचालन कर रहा ह,ैहालांदक इस े कहीं और पंिीकृत दकया िा सकता ह।ै 6.अतं ििे ीय िलयान: इन जनयमों के प्रयोिन के जलए अंतिेिीय िलयानों को जनम्नजलजखत श्रेजणयों के अनुसार वगीकृत दकया िाएगा: (1) िो िलयान श्रणे ी क म ेंआते ह,ैं वे जनम्नजलजखत म ें स े दकसी एक प्रकार के डेकनुमा िलयान होंग:े (क) िलयान िो [लम्बाई में 24 मीटर] स े अजधक ह;ैं (ख) िलयान अिवा रो-रो यात्री फेरी िो [50] स े अजधक यात्री ल ेिाते ह;ैं (ग) खींच कर ले िान े के जलए सजित सभी िलयान, जिनकी बोलाडग पलु क्षमता [10 टन] स ेअजधक ह;ै (घ) कागो के रूप म ें िोक म ें पेरोजलयम माल, रसायन अिवा तरलीकृत गैसों को वहन करने के जलए जडिाइन और जनमागण दकए गए िलयान; (ङ) अजधजनयम म ेंपररभाजषत के अनुसार खतरनाक सामान का वहन करनेवाले िलयान। श्रेणी क िलयानों को सवेक्षण के अंतगगत और दकसी वगीकरण सोसाइटी, िो अन्द्तराष्ट्रग ीय वगीकरण सोसाइटी संघ (आईएसीएस) की सिस्ट्य ह,ै की अपेक्षाओं के अनुसार जडिाइन, जनर्मगत और अनुरजक्षत दकया िाएगा, (2) श्रेणी 'ख' के िलयान श्रेणी क अिवा श्रेणी ग स े जभन्न ह।ैं श्रेणी ख के िलयानों को दकसी वगीकरण सोसाइटी, िो अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ (आईएसीएस) की सिस्ट्य ह,ै के सवेक्षण के अंतगगत जडिाइन, जनर्मगत और अनरु जक्षत दकया िाएगा,दकसी वगीकरण सोसाइटी के सवेक्षण के अंतगगत4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जडिाइन और जनर्मगत िो दक अन्द्तरागष्ट्रीय वगीकरण सोसाइटी संघ (आईएसीएस) की सिस्ट्य ह ै और िो अजभजहत प्राजधकारी के सवेक्षण के अतं गगत अनुरजक्षत दकया िाएगा, (3) श्रेणी 'ग' िलयान लंबाई म ें 10 मीटर स े कम ह।ैं श्रेणी ग िलयानों को दकसी वगीकरण सोसाइटी, िो अन्द्तराष्ट्रग ीय वगीकरण सोसाइटी संघ (आईएसीएस) की सिस्ट्य ह,ै के सवेक्षण के अतं गतग जडिाइन, जनर्मगत और अनरु जक्षत दकया िाएगा अिवा अजभजहत प्राजधकारी द्वारा उपयुि समझे गए जडिाइन, जनमागण और सवेक्षण के जलए जनधागररत मानकों के अनुसार जनर्मगत दकया िाएगा और अजभजहत प्राजधकारी के सवेक्षण के अंतगगत अनरु जक्षत दकया िाएगा। 7. सवक्षे ण अनिु सं ाओं पर कारगवाई (1) िब अजभजहत प्राजधकारी यह जनधागररत करता ह ै दक िलयान या उसके उपकरण की जस्ट्िजत प्रमाणपत्र के ब्यौरों के साि पयागप्त रूप स े मले नहीं खाती ह ै या दक िलयान,िलयानया उसम ें सवार व्यजियों को खतरे के डाल े जबना सेवा म ें जनयुि करने के जलए उपयुि नहीं ह,ै तो यह सुधारात्मक कारगवाई सुजनजित करेगा। (2) उप-जनयम (1)म ें जनधागररत जस्ट्िजत म,ें अजभजहतप्राजधकारी िोष या कमी की प्रकृजत के आधार पर िलयान को सेवा म ें रखने की अनुमजत िे सकता ह,ै बिते दक एक जनधागररत अवजध के भीतर स्ट्वामी या प्रबंधक द्वारा सवेक्षण के िौरान जनधागररत सुधारात्मक कारगवाई की िाती ह।ै 8.सवक्षे ण के प्रकार (1) संरचना, मिीनें, िीवन रक्षक उपकरण, रेजडयो संस्ट्िापन, अजििमन और अन्द्य उपकरण नीच े जनर्िष्टग सवेक्षणों के अधीन होंगे: (a) िलयान को सेवा म ेंरखन े स े पहले एक प्रारंजभक सवेक्षण। (b) सवेक्षण के अंतििे ीय िलयानप्रमाणपत्र की प्रत्येक वषगग ांि की तारीख स े पहल े या बाि म ें तीन महीन े के भीतर एक वार्षगक सवेक्षण। (c) अंतिेिीय िलयानसुरक्षा प्रमाणपत्र की वैधता की पांच वषग की अवजध के िौरान दकए गए िलयान के तल के बाहर के कम स े कम िो जनरीक्षण, बिते दक ऐसे दकन्द्हीं िो जनरीक्षणों के बीच का अंतराल ित्तीस महीने स े अजधक न हो। (d) नवीनीकरण सवेक्षण पांच वष गस े अजधक के अंतराल पर नहीं हो। (e) एक अजतररि सवेक्षण, िो या तो सामान्द्य या पररजस्ट्िजतयों के अनुसार आंजिक एक जनरीक्षण ह,ैइस े िांच के पररणामस्ट्वरूप मरम्मत के बाि या िब भी कोई महत्वपणू ग मरम्मत या नवीनीकरण दकया िाता ह,ै दकया िाना ह।ै (2)उप-जनयम (1) म ें उजल्लजखत सवेक्षणों म ेंजनम्नजलजखत िाजमल होंगे। (a) इस उप-जनयम के खंड (ख), (ग) और (घ) म ेंिाजमल के अलावा संरचना, मिीनरी और उपकरण; (b) अजि सुरक्षा प्रणाली और उपकरण, िीवन रक्षक उपकरण और व्यवस्ट्िाए,ं िलयान िजनत नौवहन उपकरण, यदि लाग ू हो तो पायलटों के जलए आरोहण के साधन, और अन्द्य उपकरण; (c) सुरक्षा उपकरण योिनाए,ं समुद्री प्रकािन, रोिनी, आकार, ध्वजन संकेत और आपिा संकेत बनाने के साधन; तिा (d) िलयान के रेजडयो इंस्ट्टॉलिे न। 9. प्रारंजभक सवक्षे ण: (1) प्रारंजभक सवेक्षण म ें जनम्नजलजखत िाजमल होंग:े (क) पूणग जनरीक्षण, और िहां आवश्यक हो, उप-जनयम (2) स े जनयम 9 म ें जनर्िष्टग मिों का परीक्षण,यह सुजनजित करन े के जलए दक संरचना, बॉयलर और अन्द्य िबाव वाजहकाओं की व्यवस्ट्िा, सामग्री, स्ट्कैनललंग और कारीगरी, उनके[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 उपकरण, स्ट्टीयररंग जगयर और संबंजधत जनयंत्रण प्रणाली, जवद्युत स्ट्िापनाओं व अन्द्य उपकरणों सजहत मुख्य और सहायक मिीनरी प्रासंजगक आवश्यकताओं का अनपु ालन करती ह,ैं और संतोषिनक जस्ट्िजत म ें ह ैं और उस सेवा के जलए उपयुि ह ैंजिसके जलए िलयान आिजयत ह।ै (ख) जनम्नजलजखत मिों का सत्यापन: i) िलयान पर फ्रीबोडग के जनिान और ड्राफ्ट के जनिान का सत्यापन। ii) िलयान के स्ट्वीकृत टन भार की गणना का सत्यापन। iii) अनुमोदित सुरक्षा उपकरण योिना का सत्यापन। iv) िलयान के अनुमोदित जस्ट्िरता जववरण और लिान जनयमावली (यदि लागू हो) का सत्यापन। (2)जवद्यमानिलयानों के जलए, इन जनयमों के अंतगगत सवेक्षण प्रमाणपत्र िारी करन े स े पहले बारह महीनों के भीतर िलयान के तल के बाहर का जनरीक्षण दकया िाएगा। 10. वार्षकग सवक्षे ण: (1) िलयान के वार्षगक सवेक्षण म ें यह पुजष्ट करन े के जलए दक व े संतोषिनक जस्ट्िजत म ें ह ैं और उस सेवा के जलए उपयिु ह ैं जिसके जलए िलयान आिजयत ह,ै उप-जनयम (2) स े जनयम 9 में जनर्िष्टग वस्ट्तओंु का एक सामान्द्य जनरीक्षण िाजमल होगा। (2) वार्षगक सवेक्षण के समय सवेक्षक जनम्नजलजखत की कुिल जस्ट्िजत के संबंध म ेंस्ट्वय ं को संतष्टु करेगा: (a) फ्रीबोडग और सुपरस्ट्रक्चर डेक पर हचै व,े वेंरटलेटर और एयर पाइप कोलमंग, एक्सपोज्ड केलसंग, स्ट्काईलाइट्स, डेकहाउस और कंपेजनयनवेि, सुपरस्ट्रक्चर बल्कहड्े स, साइड स्ट्कटल्स और डेडलाइट्स, सभी बंि उपकरणों के साि। (ख) स्ट्टील हचै कवर की मौसम की िकडन सुजनजित करन े के साधन। (ग) वाल्व के साि स्ट्कूपर और सैजनटरी जडस्ट्चाि;ग (घ) गाडग रेल और बुलवाकग; (ङ) बंिरगाहों, गैंगवे और िीवन रेखा को मुि करना; (च) फ्रीबोडग के जनिान; (ि) मिीन ेंऔर स्ट्टीयररंग यंत्रों का सामान्द्य परीक्षण; (ि) वेंट पाइलपंग। (झ) अजििमन उपकरण (ञ) िीवन रक्षक उपकरण 11. नवीनीकरण सवक्षे णों के बीच मध्यवती डॉककंग सवक्षे ण: (1) समुद्री बंिरगाहों और 20 वषग और उससे अजधक आयु के अन्द्य िलयानों म ें चलने वाल े िलयानों की िांच ड्राईडॉक या जस्ट्लपवे म ेंकी िाएगी: तिाजप, 20 वषग स े कम आय ु के िलयानों और समुद्री बंिरगाहों म ें पररचालन के जलए िल सवेक्षण की स्ट्वीकृजत पर जवचार दकया िा सकता ह।ै तिाजप, सतं ोषिनक आतं ररक िांच के अधीन 20 वषग और उससे अजधक आय ु के िलयानों और बंिरगाहों म ेंपररचालन नहीं करने वाल े िलयानों के जलए इस आवश्यकता स ेिूट पर भी जवचार दकया िा सकता ह।ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 12. नवीनीकरण सवक्षे ण: (1) नवीनीकरण सवेक्षण म ें उप-जनयम (2) स े जनयम 9 में उजल्लजखत संरचना, मिीनों और उपकरण का परीक्षण, िब आवश्यक हो, परीक्षणों के साि होगा, तादक यह सुजनजित दकया िा सके दक सवेक्षण के प्रमाणपत्र स े संबंजधत आवश्यकताओं का अनुपालन दकया िाता ह,ै और यह दक व े संतोषिनक जस्ट्िजत म ें ह ैं और उस सेवा के जलए उपयुि ह ैं जिसके जलए िलयान आिजयत ह।ै (2) नवीनीकरण सवेक्षण में एक िाचाँ भी िाजमल होगी दक सवेक्षण के प्रमाणपत्र स े संबंजधत आवश्यकताओं म ें जनर्िष्टग सभी प्रमाणपत्र, ररकॉडग बुक, पररचालन जनयमावली और अन्द्य जनिेि और िस्ट्तावेि िलयान पर ह।ैं (3) नवीकरण सवेक्षण के प्रयोिनों के जलए, नवीकरण सवेक्षण के जहस्ट्स े के रूप म ेंड्राईडॉक या जस्ट्लपवे म ेंपानी के नीच े के जहस्ट्सों की िांच की िाएगी। (4) इसके अजतररि, प्रणोिकतख्ते को हटाकर जनरीक्षण दकया िाएगा, और सवेक्षक नवीनीकरण सवेक्षण द्वारासंतुजष्टकरेगा दक प्रोपेलर िाफ्ट सजहत स्ट्टनग जगयर अछिी जस्ट्िजत म ें ह ै और कवर की गई पांच वषग की अवजध के जलए सेवा योग्य जस्ट्िजत म ेंरहगे ा। (5) अन्द्य प्रणोिन प्रकारों के मामल े म,ें सवेक्षक यह आकलन करेगा दक रखरखाव या सर्वगलसंग की आवश्यकता ह ै या नहीं, दकसी भी मामले म ें जनमातग ा की सलाह का पालन दकया िाएगा। (6)प्रकाि जवस्ट्िापन और गरुु त्वाकषगण के अनुिध्ै य ग केंद्र म ें दकसी भी पररवतगन को सत्याजपत करने के जलए सभी यात्री िलयानों को नवीनीकरण सवक्षे ण म ें हल्के सवेक्षण के अधीन दकया िाएगा।िब भी स्ट्वीकृत जस्ट्िरता िानकारी की तलु ना म,ें प्रकाि जवस्ट्िापन स े 2 प्रजतित स े अजधक जवचलन या गरुु त्वाकषगण के अनुिैध्य ग केंद्र स े 1 प्रजतित स े अजधक जवचलन पाया िाता ह,ै िलयान को दफर स े झुकाया िाना चाजहए। 13.अजतररि सवक्षे ण: (1) िब भी दकसी िलयान के साि कोई िघु गटना होती ह ै या कोई िोष पाया िाता ह ै िो िलयान की सुरक्षा या अखंडता या उसके उपकरण की िक्षता या पणू गता को प्रभाजवत करता ह,ै तो मास्ट्टर या स्ट्वामी को यिािीघ्र अजभजहत प्राजधकारी को एक सूचना िने ी चाजहए। (2) उसके पि च ात अजभजहत प्राजधकारी को यह जनधागररत करन े के जलए एक िांच िुरू करनी चाजहए दक क्या जविेष प्रमाणपत्र पर लाग ू जनयमों द्वारा एक सवेक्षण आवश्यक ह।ै (3) यह अजतररि सवेक्षण, िो पररजस्ट्िजतयों के अनुसार सामान्द्य या आंजिक हो सकता ह,ै यह सुजनजित करने के जलए दकया िाना चाजहए दक मरम्मत और कोई नवीनीकरण प्रभावी ढंग स े दकया गया ह ै और यह दक िलयान और उसके उपकरण उस सेवा के जलए उपयुि ह ैंजिसके जलए िलयान आिजयत ह।ै 14.सवक्षे ण के बाि जस्ट्िजतयों का अनरु क्षण प्रत्येक अंतििे ीय िलयानका स्ट्वामी या मास्ट्टर यह सुजनजित करेगा दक: (1) िलयान और उसके उपकरणों की जस्ट्िजत को सवेक्षण के प्रमाणपत्र के उपबंधों के अनुरूप बनाए रखा िाता ह ै तादक यह सुजनजित दकया िा सके दक िलयानहर तरह स,े िलयान पर मौिूि व्यजियों या पयागवरण के जलए खतरे के जबना पररचाजलत करन े के जलए उपयिु रहगे ा; (2) िलयान के दकसी भी सवेक्षण के पूरा होने के बाि, अजभजहत प्राजधकारी या उसकी ओर स े काय ग करन े वाल े दकसी मान्द्यता प्राप्त सगं िन के अनुमोिन के जबना संरचनात्मक व्यवस्ट्िा, मिीनें, उपकरण और सवेक्षण म ें िाजमल अन्द्य मिों म ें कोई महत्वपूणग पररवतनग नहीं दकया िाएगा; तिा (3) िब भी िलयान म ें कोई िघु गटना होती ह ै या कोई िोष पाया िाता ह,ै जिसम ें स े कोई भी िलयान की सुरक्षा या उसके िीवन रक्षक उपकरणों या अन्द्य उपकरणों की िक्षता या पूणगता को प्रभाजवत करता ह,ै तो तत्काल अजभजहत प्राजधकारी सेअिवा उसकी ओर स े काय ग करने वाले एक मान्द्यता प्राप्त संगिन स े एक सवेक्षण के जलए अनरु ोध दकया िाना चाजहए।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 15. प्रमाणपत्र िारी करना या उसकी पजु ष्ट (1) एक प्रारंजभक या नवीनीकरण सवेक्षण के बाि, सवेक्षक तत्कालप्रपत्र2 म ें जनधागररत प्रपत्र म ें यह जनर्िष्टग करत े हुए आवेिक कोएक घोषणा िारी करेगा दक एक िलयान प्रासंजगक आवश्यकताओं और इन जनयमों और अजधजनयम के उपबंधों का अनुपालन करता ह।ै (2) राज्य सरकार या उसके द्वारा मान्द्यता प्राप्त प्राजधकरण, यदि संतष्टु हो दक उपरोि उप-जनयम (1) के अंतगगत प्रस्ट्तुत घोषणा के संबंध म ें इस अजधजनयम के सभी उपबंधों का अनुपालन दकया गया ह,ै और राज्य सरकार द्वारा जनधागररत िुल्क के भुगतान की प्राजप्त पर उनके द्वारा सवेक्षण का प्रमाणपत्र (पररजिष्ट-1 िेख)ें िारी दकया िाएगा। (3) उपरोि उप-जनयम (1) म ें उपबंजधत प्रमाणपत्र उपकरण और िलयान सूचना के एक ररकॉड ग द्वारा पूररत होगा (अनुबंध 1 स े प्रपत्र2 िेख)ें िो स्ट्िायी रूप स े संलि रहगे ा। (4) उपरोि उप-जनयम (2) के होते हुए भी, वह सवेक्षणकताग जिसने सवेक्षण दकया और उपरोि उप-जनयम (1) म ें जनर्िष्टग घोषणा िारी की, एक आवेिन के आधार पर प्रपत्र 3 पर सवेक्षण का एक अनंजतम प्रमाणपत्र प्रिान कर सकता ह,ै िो साि दिनों स े अनाजधक अवजध के जलए वैध होगा या, पृष्ाकं न द्वारा, सवेक्षण के प्रचजलत प्रमाणपत्र की वैधता को साि दिनों स े अनाजधक अवजध के जलए बढा िेगा। (5) यांजत्रक रूप स े चाजलत कोई भी अंतिेिीय िलयान, जिसे ऊपर उप-जनयम (4) म ें वर्णगत सवेक्षण या समिगन का अनंजतम प्रमाणपत्र िारी दकया गया ह,ै सवेक्षण का प्रमाणपत्र िारी होने तक समय-समय पर पररपत्रों, आिेिों या जनिेिों के माध्यम स े अजभजहत प्राजधकारी द्वारा िारी की िा सकने वाली ितों के अधीन, यात्रा या सेवा म ें उपयोग के जलए, अस्ट्िायी रूप स े आग े बढ सकता ह।ै 16. प्रमाणपत्रों की अवजध और वधै ता (1) सवेक्षण का प्रमाणपत्रजिस अवजध के जलए िारी दकया िाएगा वह पांच वष ग स े अजधक नहीं होगी, बिते दक वार्षगक पूरा करन े के जलए पष्ृ ाकं न दकए िा रह े हों। (2) िब नवीनीकरण सवेक्षण, वतमग ानप्रमाणपत्र की समाजप्त जतजि स े तीन महीने के भीतर पूरा हो िाता ह,ै तो नया प्रमाणपत्र नवीनीकरण सवेक्षण के पूरा होने की तारीख स े वतगमानप्रमाणपत्र की समाजप्त की तारीख स े पांच वषग तक वैध होगा। । (3) िब नवीकरण सवेक्षण वतगमान प्रमाणपत्र की समाजप्त जतजि के तीन महीने स े अजधक समय के भीतर नहीं पूरा दकया िाता ह,ै तो नया प्रमाणपत्र नवीनीकरण सवेक्षण के परू ा होन े की तारीख स े वतगमान प्रमाणपत्र की समाजप्त की तारीख स े पांच वषग स ेअनजधक अवजध तक वैध होगा। (4) िब नवीनीकरण सवेक्षण वतगमान प्रमाणपत्र की समाजप्त की तीरीख स े तीन महीन े पहले या बाि म ें परू ा होता ह,ै तो नया प्रमाणपत्रनवीनीकरण सवक्षे ण के समापन की तारीख स े पांच वषग स े अजधक की तारीख तक वैध नहीं होगा। (5) िहा ं नवीकरण सवेक्षण पूरा हो गया ह ै और वतगमान प्रमाणपत्रकी समाजप्त जतजि से पहल े अतं िेिीय िलयानपर नया प्रमाणपत्र िारी नहीं दकया िा सकता अिवा रखा नहीं िा सकता ह,ै अजभजहतप्राजधकारी या उसकी ओर स े काय ग करन े वाला एक मान्द्यता प्राप्त संगिन वतगमान प्रमाणपत्रकीपुजष्ट करेगा और इस तरह के एक प्रमाणपत्र को एक अन्द्य अवजध के जलए वैध माना िाएगा, िो समापन की तारीख स े साि दिनों से अजधक की नहीं होगी। (6) िहा ं एक िलयानके प्रमाणपत्र की समय सीमा उस समय समाप्त हो िाती ह,ै िब वह सवेक्षण की जस्ट्िजत म ें नहीं ह,ै अजभजहत प्राजधकारी पररजस्ट्िजतयों पर जवचार करते हुए प्रमाणपत्र की वैधता की अवजध को 3 महीने स े अनजधक वजध के जलए बढा सकता ह।ै (7) ड्राई-डॉककंग सुजवधाओं की अनपु लब्धता के कारण असाधारण पररजस्ट्िजतयों के मामले म,ें राज्य सरकार प्रमाणपत्र को 6 महीने स े अनजधक अवजध के जलए जवस्ट्ताररत करने पर जवचार कर सकती ह।ै (8) उपरोि उप-जनयम (5) के अंतगगत िारी दकया गया प्रमाणपत्र जनम्नजलजखत म ें स े दकसी भी जस्ट्िजत म ें वैध नहीं होगा:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) िहा ं प्रासंजगक सवेक्षण और जनरीक्षण इन जनयमों के अंतगगत जनर्िष्टग अवजध के भीतर पूरा नहीं दकया िाता ह;ै या (b) िहा ं प्रमाणपत्र इन जनयमों की आवश्यकताओं के अनुसार पृष्ांदकत नहीं ह;ै या (c) िहा ं िलयानपंिीकरण स े वापस ले जलया गया ह।ै 17. प्रमाणपत्रों के जलएप्रपत्र प्रमाणपत्र और उपकरण और िानकारी का ररकॉडग इन जनयमों के पररजिष्ट म ें दिए गए नमूने के अनरूु प तैयार दकया िाएगा। 18. प्रमाणपत्रों की उपलब्धता जनयम 16 के अंतगगत िारी प्रमाणपत्रिांच के जलए सिैव िलयान पर आसानी स े उपलब्ध होंगे। 19.सवक्षे ण के प्रमाणपत्र की अवजध इन जनयमों के उपबंधों के अंतगतग िारी दकया गया कोई भी सवेक्षण प्रमाणपत्र अजधजनयम के अध्याय IV म ें जनजहत सवेक्षण के प्रमाणपत्र की ितों के अधीन होगा। 20. नाम का पररवतनग (1) िहा ं एक ऐस े िलयान के नाम म ें पररवतगन आवश्यक ह,ै जिसके संबंध म ें अजधजनयम के अंतगगत सवेक्षण का प्रमाणपत्र प्रिान दकया गया िा, िलयान का स्ट्वामी या मास्ट्टर सवेक्षण के प्रमाणपत्र म ें िि ग िलयान के नाम म ें पररवतगन के जलए एक आवेिन के साि सवेक्षण का प्रमाणपत्र उस प्राजधकारी को अग्रेजषत करेगा, जिसन े प्रमाणपत्र िारी दकया िा। (2) उप-जनयम (1) के अंतगतग उपबंजधत आवेिन प्रपत्र संख्या 9 म ें होगा और उसम ेंआवश्यक जववरण िाजमल होंगे। (3) अजभजहत प्राजधकारी या प्राजधकृत अजधकारी, स्ट्वय ं या दकसी अन्द्य अजधकारी के माध्यम स े उजचत िांच के बाि इस बात की संतुजष्ट करेगा दक नया नाम दकसी अन्द्य िलयान को आवंरटत नहीं दकया गया ह ै और सवेक्षण के प्रमाणपत्र म ें आवश्यक पररवतनग का उजचत कारण ह,ै िो उसके बाि बिले हुए नाम को िलयान पर तरािने/जचजननत करने की उजचत प्रदिया के बाि और पंिीकरण प्रमाणपत्र और पंिीकरण की पुस्ट्तक म ें पंिीकरण प्राजधकारी द्वारा दकए गए उजचत पररवतगनों के बाि स्ट्वामी को वापस कर दिया िाएगा। 21. अतं िेिीय िलयान काराज्य द्वारा जनरीक्षण (1) दकसी अन्द्य राज्य सरकार के अजधकार क्षत्रे के अिं र एक बिं रगाह (अतं िेिीय बंिरगाह या प्रमुख/लघु तटीय बंिरगाहों) म ें प्रत्येक िलयान का सत्यापन करने के जलए जनरीक्षण के उद्देश्य के जलए अजभजहतअजधकारी या ऐसी सरकार द्वारा जवजधवत अजधकृत अजधकाररयों द्वारा जनरीक्षण कर यह सुजनजित दकया िाए दक इन जनयमों के अंतगगत िारी प्रमाणपत्र वैध ह।ैं राष्ट्रीय िलमागग म ें होन े पर आईडब्ल्यूएआई के जनयमों के अनुसार आईडब्ल्यूएआईके अजधकाररयों द्वारा भी दकसीिलयान का सवेक्षण दकया िा सकता ह।ै सामान्द्य रूप स े बंिरगाहों या आईडब्ल्यूएआई द्वारा ऐसा कोई जनरीक्षण जपिल े जनरीक्षण की समाजप्त की जतजि के िह महीने के भीतर नहीं दकया िाना चाजहए। (2) ऐस े प्रमाणपत्र, यदि वैध पाए िाते ह,ैं उन्द्ह ें तब तक स्ट्वीकार दकया िाएगा, िब तक दक यह मानन े के जलए स्ट्पष्ट आधार न हों दक िलयान या उसके उपकरण की जस्ट्िजत दकसी भी प्रमाणपत्र के जववरण के साि पयागप्त रूप स े मेल नहीं खाती ह ैया िलयान सेवा के जलए उपयिु नहीं ह।ै (3) ऊपर उप-जनयम (2) म ें जनर्िष्टग पररजस्ट्िजतयों म ें या िहां एक प्रमाणपत्र की समय सीमा समाप्त हो गई ह ै या वह वैध नहीं रह गया ह,ै जनरीक्षण करन े वाला अजधकारी यह सुजनजित करन े के जलए किम उिाएगा दक िलयान बंिरगाह को तब तक नहीं िोडेगा िब तक दक वह आग े नहीं बढ सकता, िब तक वह अगल े जनर्िष्टग बंिरगाह के जलए नहीं िा रहा हो, या िलयान या उस पर सवार व्यजियों के जलए जबना कोई खतरा उत्पन्नदकए, एक उपयुि मरम्मत याड ग तक िाने के उद्देश्य स े बंिरगाह िोड ि।ें[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 22. आजधकाररक लॉग बकु (1) िलयान के मास्ट्टर और इंिीजनयर/चालक इन जनयमों म ें जनर्िष्टग प्रपत्र संख्या 8 में एक आजधकाररक लॉग बुक रखेंग ेऔर आवश्यकतानुसार उस लॉग बुक म ेंऐसी प्रजवजष्टयां करेंग े या करवाएंगे। (2) एक आजधकाररक लॉग बुक म ें अंतिेिीय िलयानके मास्ट्टर, इंिीजनयर/चालक या प्रभारी अजधकारी द्वारा एक प्रजवजष्ट की िाएगी: क) उस घटना के बाि जितनी िल्िी हो सके, जिससे वह संबंजधत ह;ै तिा ख) घटना और उसके होन े की तारीख और समय। (3) आजधकाररक लॉग बुक म ें मास्ट्टर या प्रभारी अजधकारी द्वारा एक प्रजवजष्ट की िाएगी और अजभजहत प्राजधकारी द्वारा उस पर हस्ट्ताक्षर दकए िाएंगे और जनरीक्षण के पररणाम और की गई कारगवाई, यदि कोई हो, को बताते हुए िलयान का कोई भी जनरीक्षण दकया िाएगा। (4) जनधागररत िल्ु क के भुगतान पर जनर्िष्टग प्राजधकारी द्वारा आजधकाररक लॉग बुक की आपूर्त ग की िाएगी। (5) आजधकाररक लॉग बुक पत्तन प्राजधकरण की संपजत्त ह ैऔर इस ेिीक स े बनाए रखा िाएगा। (6) आजधकाररक लॉग बुक िलयान के वार्षगक सवेक्षण के समय सत्यापन के जलए प्रस्ट्तुत की िानी चाजहए। (7) जनरीक्षण करन े वाला अजधकारी 'आजधकाररक लॉग बुक' म ें एक प्रजवजष्ट करेगा। 23. सवक्षे क के रूप म ेंजनयजु ि के जलए अहतग ाएं: अंतिेिीय िलयानों के एक सवक्षे क के पास जनम्नजलजखत म ें स ेकोई भी अहतग ा और अनुभव होना आवश्यक ह:ै (a) मरीन/मैकेजनकल/इलेजक्रकल इंिीजनयर/नौसेना वास्ट्तुकार जिसके पास न्द्यूनतम प्रिम/जद्वतीय श्रेणी मोटर/स्ट्टीम एमओटी प्रमाणपत्र हो, जिसे भारत प्रजिक्षण/समद्रु ी सवेक्षण म ें अनुभव के साि जिलपंग के महाजनिेिक, भारत सरकार द्वारा िारी मास्ट्टर सर्टगदफकेट या समकक्ष अंतरराष्ट्रीय प्रमाणपत्र प्राप्त करने के बाि,अिवा (c) एमईओ श्रणे ीIII मास्ट्टर या माजलक के जववेक के अनुसार, सामान्द्य िलयान के लॉग से अलग या एकसाि रखा िा सकता ह ैतादक सभी मामलों म ें आजधकाररक लॉग बुक म ेंररि स्ट्िान को जवजधवत भरा िा सके। 3.इस पुजस्ट्तका को जवजधवत रखने का महत्व, और सभी प्रजवजष्टयों को उजचत समय पर और किोरता स े जवजधवत रूप म ें तैयार करन े का महत्व, बहुत अजधक सख्ती स े स्ट्वामी पर नहीं डाला िा सकता ह।ै ऐसा करन े की उपेक्षा करन े स े मास्ट्टर भारी िडं के जलए उत्तरिायी होते हऔैं र उनके माजलकों को गभं ीर क्षजत होती ह,ै िबदक उनके चालक िल के सिस्ट्यों को अपनी सेवाओं का ररकॉडग प्राप्त करन े म ें सक्षम नहीं होने के कारण असुजवधा का सामना करना पडता ह।ै यह उजचत प्रजवजष्टयों की अनुपजस्ट्िजत के कारण िुमानग ा या िब्ती को लागू होने स े रोकेगा और अनुिासन बनाए रखने के जलए प्रेररत करेगी। 4. आजधकाररक लॉग बुक म ें अजधजनयम द्वारा आवश्यक प्रजवजष्ट उस घटना के बाि जितनी िल्िी हो सके करनी चाजहए, जिससे यह संबंजधत ह,ै और, यदि यह उस घटना के दिन नहीं की िाती ह,ै तो घटना की तारीख और उसके संबंध म ें प्रजवजष्ट ििागने के जलए इस े प्रजवष्ट और दिनांदकत दकया िाएगा। 5. आजधकाररक लॉग बुक म ें प्रत्येक प्रजवजष्ट पर मास्ट्टर और अजधकारी या चालक िल के दकसी अन्द्य सिस्ट्य स े भी हस्ट्ताक्षर दकए िाएंगे और 6. यदि यह चोट या मृत्य ु की प्रजवजष्ट ह,ै तो िलयान पर उपजस्ट्ित जचदकत्सा अजधकारी, यदि कोई हो, के द्वारा हस्ट्ताक्षररत दकया िाएगा, और यदि यह चालक िल के मृत सिस्ट्य के िये वेतन या उसकी संपजत्त की प्रजवजष्ट ह ै तो इस पर अजधकारी और मास्ट्टर के अलावा चालक िल के कुि सिस्ट्य द्वारा हस्ट्ताक्षर दकए िाएंगे। 7. इन जनयमों द्वारा जनर्िष्टग तरीके स े आजधकाररक लॉग बुक में की गई प्रत्येक प्रजवजष्ट साक्ष्य के रूप म ेंस्ट्वीकाय ग होगी। 8. िब भी मास्ट्टर का पररवतनग होता ह,ै तो यह िेखन े के जलए ध्यान दिया िाना चाजहए दक सौंपे गए िस्ट्तावेज़ अद्यजतत ह।ैं 9. प्रजवजष्टयां तारीख के िम म ें की िानी चाजहए, और कोई भी स्ट्िान ररि नहीं िोडा िाना चाजहए। 10. यदि आजधकाररक लॉग म ें कोई Rules 2022, which the Central Government proposes to make, in the exercise of the powers conferred by sub-section (1) of section 106 of the Inland Vessels Act of 2021(24 of 2021), is hereby published for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft shall be taken into consideration after thirty days from the date on which the copies of this notification as published in the Official Gazette are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 439, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at abhay.sarode@gov.in and uttam.mishra27@gov.in within the period specified above; The objections or suggestions which may be received from any person concerning the said draft rules, within the period so specified will be considered by the Central Government. DRAFT RULES 1. Short Title Commencement (1) These Rules shall be called the Inland Vessels (Survey and Certification) Rules 2022. (2) They shall come into force on the date of their final publication in Official Gazette 2. Definitions (1) In these rules, unless the context otherwise requires,-- (a) Act means the Inland Vessels Act of 2021(24 of 2021); (b) “inland vessel” means any mechanically propelled inland vessel as defined under section 3(y) of the Act. (2) “Existing vessel” or “existing inland vessel” means any inland vessel which is not any new inland vessel that falls within the ambit of the definition provided under of sub-rule (3) of Rule 3 (3) “ New inland vessel” means any inland vessel whose keel is laid or which is at a similar stage of construction on or after the date of coming into force of the rules. (4) “Major conversion or modification” means any of the following; a) Change in Gross Tonnage of the vessel by more than ten percentum b) Change of vessel type c) Change of propulsion system/ main engines/ type of fuel (5) Words and expressions used and not defined in these rules but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Areas of Operation (1) The State Government may categorize inland water areas, based on the maximum significant wave height criteria, as Zone 1, Zone 2 and Zone 3, as stipulated below. (2) Vessels shall therefore be designed, constructed and maintained for service in the most onerous zone that it intends to operate in. (i) Zone 1 means an area (other than Zone 2 or Zone 3) where the maximum significant wave height does not exceed 2.0 metres. (ii) Zone 2 means an area (other than Zone 3) where the maximum significant wave height does not exceed 1.2 metres. (iii) Zone 3 means an area where the maximum significant wave height does not exceed 0.6 metres. 4. Certificate of Survey (1) The formats of certificate of Survey and relevant forms, to be issued under the purview of the Act shall be as per Appendix I, to these Rules. (2) The certificate of survey shall specify that the inland vessel is fit for a particular Zone of operation.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 (3) An inland mechanically propelled vessel shall not proceed on any voyage or be used for any service unless she has a valid certificate of survey for the type of service and for the zone intended for operation. (4) The Certificate of Survey shall remain valid for a period of 5 years, subject to any conditions specified by the Designated Authority, including the completion of periodical surveys as specified in these Rules. (5) The Designated Authority may allow a mechanically propelled vessel to proceed on a voyage during the interval between the date on which her certificate of survey expires and the earliest possible date of renewal. 5. Certification of compliance with design, construction, modification or alteration to be recorded. (1) The designated authorities or authorised persons shall ensure that the inland vessels, which are governed by the Inland Vessels (Design and Construction) Rules 2022, are in compliance with the said Rules. (2) Designated authorities or authorised persons shall ensure that the inland vessels, which are constructed and employed in the inland waters prior to the Act are in compliance with the laws and standards that were prevailing prior to the Act: Provided that Designated authorities or authorised persons shall ensure that the existing vessels which have undergone major conversion or modification, comply with the Inland vessels (Design and Construction ) Rules, 2022as far as it is considered reasonable and practicable by the Designated Authority. (3) Subject to sub-rule (1) and sub-rule (2) of the present Rule, the designated authority or authorised persons of respective State Government shall record the certification with regard to compliance of construction, design, modification or alteration, as the case may be; in the certificate of survey issued under the Act and in accordance with these Rules. (4) A vessel may be surveyed by the surveyors of the Designated Authority of the State in which it is plying though it may be registered elsewhere. 6. Inland Vessels: For the purpose of these rules, Inland vessels shallbe classified as per the following categories: - (1) The vessels which fall in Category A are decked vessels of any of the following types. (a) Vessels that are more than 24 metres in length (b) Vessels that carry more than 50 passengers on board. (c) All vessels equipped for tow, having a bollard pull capacity exceeding 10 t. (d) Vessels designed and constructed to carry petroleum goods, chemicals or liquefied gases bulk as cargo. (e) Vessels carrying dangerous goods as defined in the Act. Category A vessels shall be designed, constructed and maintained under the survey and requirements of a classification society, who is a member of the International Association of Classification Societies (2) Category ‘B’ vessels not covered under Category A or category C Category B vessels shall be designed, constructed and maintained according to the survey of a classification society, which is a member of the International Association of Classification Societies (IACS) Further designed and constructed under the survey the survey of classification society, which is a member of the International Association of Classification Societies and maintained under the survey of the Designated Authority (4) Category 'C' vessels are of less than10metres in length. Category C vessels shall be designed, constructed and maintained under the survey of a classification society, which is a member of the International Association of Classification Societies and standards prescribed for design, construction and survey considered appropriate by the Designated Authority and maintained under the survey of the Designated Authority 7. Action on Survey Recommendations (1) When the Designated Authority determines that the condition of the vessel or its equipment does not correspond substantially with the particulars of the certificate or is such that the vessel is not fit to be put to service without danger to the vessel, or persons on board, it shall ensure that corrective action is taken. (2) In the event as set forth in sub-rule (1), the Designated Authority may allow the vessel to be put into service depending on the nature of the defect or deficiency, provided that the corrective actions as prescribed during the survey are undertaken to be carried out by the owner or manager within a stipulated period.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 8. Types of Survey (1) The structure, machinery, life-saving appliances, radio installations, fire fighting and other equipment shall be subject to the surveys specified below: (a) an initial survey before the vessel is put in service (b) An annual survey within three months before or after each anniversary date of the Inland Vessel Certificate of Survey (c) A minimum of two inspections of the outside of the vessel’s bottom carried out during the five year period of validity of the Inland Vessel Safety Certificate, provided the interval between any two such inspections shall not exceed thirty-six months. (d) a renewal survey at intervals not exceeding five years. (e) An additional survey, which is an inspection, either general or partial according to the circumstances, to be made after a repair resulting from investigations or whenever any important repairs or renewals are made. (2) The Surveys referred in sub-rule (1) above shall include the following. (a) The structure, machinery and equipment other than those covered in clauses(b), (c) and (d) of this sub-rule; (b) The fire safety systems and appliances, life-saving appliances and arrangements, the vessel borne navigational equipment, means of embarkation for pilots if applicable, and other equipment; (c) The Safety equipment plans , nautical publications, lights, shapes, means of making sound signals and distress signals; and (d) The radio installations of the vessel. 9. Initial Survey: (1) The initial survey shall include the following: (a) complete inspection, and tests where necessary, of the items referred in sub-rule (2) to Rule 9 to ensure that the arrangements, materials, scantling and workmanship of the structure, boilers, and other pressure vessels, their appurtenances, main and auxiliary machinery including steering gear and associated control systems, electrical installations and other equipment comply with relevant requirements, and in satisfactory condition and are fit for the service for which the vessel is intended. (b) verification of the following items: i) Verification of the freeboard mark and draft marks on the vessel. ii) Verification of the approved tonnage computation of the vessel. iii) Verification of the approved Safety Equipment plan. iv) Verification of the approved stability particulars and loading manual (if applicable) of the vessel. (2) For existing vessels, the outside of the vessel’s bottom shall be inspected within twelve months preceding the issuance of the Certificate of Survey under these Rules. 10. Annual Survey: (1) The annual survey of the vessel shall include a general inspection of the items specified in sub-rule (2) to Rule 9 to confirm that they are in satisfactory condition and fit for the service for which the vessel is intended. (2) During the annual survey Surveyor shall satisfy himself regarding the efficient condition of the following : (a) Hatchways on freeboard and superstructure decks, ventilator and air pipe coamings, exposed casings, skylights, deckhouses and companionways, superstructure bulkheads, side scuttles and deadlights, together with all closing appliances. (b) Means of ensuring weathertightness of steel hatch covers. (c) Scuppers and sanitary discharges with valves; (d) guard rails and bulwarks; (e) freeing ports, gangways and lifelines; (f) Freeboard marks; (g) General examination of machinery and steering gear;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29 (h) Vent piping. (i) Fire fighting appliances (j) Life saving appliances 11. Intermediate Docking Survey between renewal surveys: (1) Vessels operating in sea ports and other vessels of 20 years of age and over are to be examined in drydock or slipway: Provided that, Consideration may be given to acceptance of in water survey for vessels of less than 20 years of age and operating in sea ports. Provided that, Consideration may also be given to waiver of this requirement for vessels of 20 years of age and over and not operating in seaports subject to satisfactory internal examination. 12. Renewal Survey: (1) The renewal survey shall consist of an inspection, with tests when necessary, of the structure, machinery and equipment mentioned in sub-rule (2) to Rule 9, to ensure that the requirements relevant to the Certificate of Survey are complied with and that they are in a satisfactory condition and are fit for the service for which the vessel is intended. (2) The renewal survey shall also consist of a check that all the certificates, record books, operating manuals and other instructions and documentation specified in the requirements relevant to the certificate of survey are on board the vessel. (3) For the purposes of renewal survey, the underwater parts are to be examined in a drydock or slipway as part of renewal survey. (4) Additionally, the propeller shaft shall be removed and inspected, and the surveyor shall be satisfied that the stern gear, including the propeller shaft, is in good working order and will continue to be in a serviceable condition for the five year period covered by the renewal survey. (5) In the case of other propulsion types, the surveyor shall assess whether maintenance or servicing is required, in any case the advice of the manufacturer shall be followed. (6) All passenger vessels are to be subjected to a Lightweight survey at renewal surveys to verify any changes in light displacement and longitudinal centre of gravity. The vessel is to be re-inclined whenever, in comparison with the approved stability information, a deviation from the light displacement exceeding 2 percent or a deviation from the longitudinal centre of gravity exceeding 1 percent of the length is found. 13. Additional surveys: (1) Whenever an accident occurs to a vessel or a defect is discovered which affects the safety or integrity of the vessel or the efficiency or completeness of its equipment, the master or owner should make a report at the earliest opportunity to the Designated Authority. (2) The Designated Authority, should then initiate an investigation to determine whether a survey, as required by the regulations applicable to the particular certificate, is necessary. (3) This additional survey, which may be general or partial according to the circumstances, should be such as to ensure that the repairs and any renewals have been effectively made and that the vessel and its equipment continue to be fit for the service for which the vessel is intended. 14. Maintenance of conditions after survey The owner or master of every Inland vessel shall ensure that: (1) The condition of the vessel and its equipment is maintained to conform with the provisions of the Certificate of Survey to ensure that the vessel in all respects will remain fit to operate without danger to the vessel, persons on board or the environment; (2) After any survey of the vessel has been completed, no significant change shall be made in the structural arrangement, machinery, equipment and other items covered by the survey, without the approval of the Designated Authority or a recognised organisation acting on its behalf; and (3) Whenever an accident occurs to the vessel or a defect is discovered, either of which affects the safety of the vessel or the efficiency or completeness of its life-saving appliances or other equipment, a request be made immediately to the Designated Authority or a recognised organisation acting on its behalf for a survey, to be carried out.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 15. Issue or endorsement of certificates (1) After an initial or renewal survey, the surveyor shall forthwith issue the applicant, a declaration in such form as prescribed in Form 2, specifying that of a vessel complies with the relevant requirements and provisions of these Rules, and the Act. (2) A certificate of Survey (refer Appendix-I) shall be issued by the State Government, or by the authority recognized by it, if satisfied that all the provisions of this Act have been complied with in respect of a declaration submitted under sub-rule (1) above, and upon receipt of payment of fee, as may be prescribed by the State Government (3) The certificate referred to in sub-rule (1) above shall be supplemented by a Record of Equipment and Vessel Information (refer Annexure 1 to Form 2) which shall be permanently attached thereto. (4) Notwithstanding sub-rule (2) above the surveyor who conducted the survey and issued the declaration specified in sub-rule (1) above, may grant a provisional certificate of survey based on an application on Form 3 , which shall be valid for a period not exceeding sixty days or, by endorsement, extend the validity of the prevailing certificate of survey, not exceeding sixty days. (5) Any mechanically propelled inland vessel, which has been issued with a provisional certificate of survey or endorsement, as described in sub-rule (4) above, may proceed on voyage or use in service, temporarily, pending the issue of the certificate of survey, in such manner and subject to the conditions as may be issued by the Designated Authority vide circulars, orders or directives from time to time. 16. Duration and validity of certificates (1) Certificate of Survey shall be issued for a period which shall not exceed Five years subject to endorsements being made for completion of annual. (2) When the renewal survey is completed within three months before the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of renewal survey to a date not exceeding five years from the date of expiry of the existing certificate. (3) When the renewal survey is completed not more than three months after the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing certificate. (4) When the renewal survey is completed more than three months before or after the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of completion of the renewal survey. (5) Where the renewal survey has been completed and new certificate cannot be issued or placed onboard the Inland vessel before the expiry date of the existing certificate, the Designated Authority or a recognized organization acting on its behalf shall endorse the existing certificate and such a certificate shall be accepted as valid for a further period which shall not exceed sixty days from the expiry date. (6) Where a vessel at the time when a certificate expires is not in a position to be surveyed, the Designated Authority may extend the period of validity of the certificate considering the circumstances, for a period not longer than 3 months. (7) In the case of exceptional circumstances due to non-availability of dry-docking facilities, the State Government may consider extension of certificates for a period not exceeding 6 months. (8) A certificate issued under sub-rule (5) above shall cease to be valid in any of the following cases: (a) where the relevant surveys and inspections are not completed within the periods specified under these Rules; or (b) where the certificate is not endorsed in accordance with the requirements of these Rules; or (c) where the vessel is withdrawn from the Registry. 17. Form of certificates The certificates and the record of equipment and information shall be drawn up in the form corresponding to the models given in the appendix to these Rules 18. Availability of certificates The certificates issued under Rule 16 shall be readily available on board for examination at all times.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31 19. Term of certificates of survey Any Certificate of Survey issued under the provisions of these Rules shall be subject to terms of certificate of survey contained in Chapter IV of the Act. 20. Change of name (1) Where a change of name of a vessel in respect of which a certificate of survey had been granted under the Act is required, the owner or master of the vessel shall forward the certificate of survey to the authority who issued the certificate along with an application for change of the name of the vessel entered in the certificate of survey. (2) Application provided under sub-rule (1) shall be in Form No.9and shall contain the particulars required therein. (3) The designated authority or the authorised officer shall, after due enquiry by himself or through any other officer satisfy that the new name is not allotted to any other vessel and cause such change as is necessary to be effected in the certificate of survey, which shall thereupon be returned to the owner after due process of carving/marking of the changed name on vessel and upon due changes effected by the Registering Authority in Registration Certificate and Book of Registration. 21. Inland vessel State Inspection (1) Every vessel while in a port (inland port or major/minor coastal ports) within the jurisdiction of another State Government shall be subject to inspection by the designated authorities or officers duly authorized by such Governmentfor the purpose of inspection to verify and ascertain that the certificates issued under these Rules, are valid. A vessel may also be surveyed by the officers of IWAI according to the Rules of IWAI when in National Waterways. Normally no such inspections by Ports or IWAI should be conducted within six months of the completion date of the last inspection. (2) Such certificates, if found valid, shall be accepted, unless there are clear grounds for believing that the condition of the vessel or of its equipment does not correspond substantially with the particulars of any of the certificates or that the vessel is not fit for service. . (3) In the circumstances specified in sub-rule (2) above or where a certificate has expired or ceased to be valid, the officer carrying out the inspection shall take steps to ensure that the vessel shall not leave the port unless it can proceed to the next port of call, or leave the port for the purpose of proceeding to an appropriate repair yard, without danger to the vessel or persons on board. 22. Official log book (1) The master and engineer/driver of the vessel shall keep an official log book in the form specified in these rules in Form No. 8 and shall make, or cause to be made, such entries in that log book as required. (2) An entry in an official log book shall be made by the Master, Engineer/Driver or officer in- charge of the inland vessel: a) as soon as possible after the occurrence to which it relates; and b) the date and time of the occurrence and the entry. (3) An entry in the official log book shall be made by the Master or the officer in-charge and counter signed by the Designated Authority carrying out any inspection of the vessel stating the outcome of the inspection and action taken if any. (4) Official log book shall be supplied by the Designated Authority on payment of prescribed fee. (5) Official log book is the property of the Port Authority and shall be maintained properly. (6) Official log book to be produced for verification at the time of annual survey of the vessel. (7) The officer carrying out the inspection shall make an entry in the ‘Official log book’. 23. An official log shall be kept in the prescribed form in every Inland Vessel. 2. The official log may, at the discretion of the master or owner, be kept distinct from or united with the ordinary ship’s log so that in all cases the spaces in the official log book be duly filled up. 3. The importance of keeping this book properly, and duly making all the entries at the proper time, and with the strictest regard to form, cannot be too strongly impressed on masters. By neglecting to do so masters render themselves liable to heavy penalties, and their owners to serious loss whilst members of their crew will suffer inconvenience from not being able to obtain records of their services. The absence of proper entries will also prevent fines or forfeitures from being enforced and will tend to prevent the maintenance of discipline.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 43 4. An entry required by the Act in the official log book shall be made as soon as possible after the occurrence to which it relates, and, if not made on the same day as that occurrence, shall be made and dated so as to show the date of the occurrence and of the entry respecting it. 5. Every entry in the official log book shall be signed by the master and by the officer or some other member of the crew and also 6. If it is an entry of injury or death, shall be signed by the medical officer on board, if any, and if it is an entry of wages due to or the property of a crew member who dies, shall be signed by the officer and by some member of the crew besides the master. 7. Every entry made in an official log book in the manner provided by these rules shall be admissible in evidence. 8. Care must be taken whenever there is a change of master to see that documents handed over are up-to-date. 9. Entries must be made in order of date, and no blanks should be left. 10. If any entry in the Official Log relates in any way to a member of the crew the page number is to be entered against the man’s name in the Official Log and Index. If any offence within the meaning of the Act of desertion or absence without leave or against discipline is committed or if any act of misconduct is committed for which the offender’s agreement imposes fine and it is intended to enforce the fine: a) an entry of the offences or acts shall be made in the official log-book and signed by the master and one of the persons employed or engaged in any capacity on board of the mechanically propelled vessel; b) the offender shall be furnished with a copy of the entry and have the same read over distinctly and audibly to him and may there upon make such reply there to as he thinks fit; c) a statement to a copy of the entry having been so furnished and entry having been so read over and the reply, if any made by the offender shall likewise be entered and signed in the manner aforesaid; d) in any subsequent legal proceedings the entries by this section required shall, if practicable, be produced or proved, and in default of such production or proof, the court hearing the case may in its discretion refuse to receive evidence of the offence or act of misconduct. 2. Every case in which the crew has faced shortage of food and/or drinking water. 3. Every case in which a member of the crew is promoted to a higher grade of service with the date of such promotion, the grade and the rate of wages which the crew member is to receive. 4. in cases of illness, frequent entries (daily if possible) showing the progress and treatment of patient. 5. Every case of drunkenness or misconduct on the part of any member of crew whether the Master wishes the case to be investigated or not. 6. Every important accident or damage to ship or cargo. 7. Every conviction by a legal tribunal of a member of his crew and the punishment inflicted; 8. a report on the quality of work of each member of his crew; or a statement that the master declines to give an opinion thereon with a statement of his reasons for so declining. 9. Every case of illness, hurt or injury happening to a member of his crew with the nature thereof and the medical treatment adopted (if any); 10. Every case of death happening onboard and the cause thereof, together with such particulars as may be prescribed; 11. Every birth happening on board, with the sex of the infant, the names of the parents and such other particulars as may be prescribed; 12. The name of every crew member who ceases to be a member of the crew otherwise than by death, with the place, time, manner and cause thereof; 13. The wages due to any crew member who dies during the voyage and the gross amount of all deductions to be made there from; 14. The money or other property taken over of any crew member who dies during the voyage; 15.
