और जबदक ईजल्लजखत राजपत्र ऄजधसूचना की प्रजतयां जनता को 15 नवंबर, 2021 को ईपलब्ध करा दी गइ थीं; और जबदक, ईजल्लजखत प्रारूप जनयमों के संबंध म ेंजनता स ेकोइ अपजि और सुझाव प्राि नहीं हुए थे; ऄत:, ऄब, केंद्र सरकार समुद्री नौचालन सहायता ऄजधजनयम, 2021 (2021 का 20) की धारा 46 की ईप-धारा (2) द्वारा प्रदि िजियों का प्रयोग करते हुए जनम्नजलजखत जनयम बनाती ह,ै ऄथागत : - 1. लघ ु िीर् ग और प्रारंभता :– (1) आन जनयमों का नाम समुद्री नौचालन सहायता (महाजनदेिक के कतगव् य) जनयम, 2022 ह।ै (2) यह राजपत्र में ईनके प्रकािन की जतजथ से लाग ूहोगा । 2. पररभार्ाएं :(1) आस जनयमों म,ें जब तक दक जवर्य की ऄन्यथा अवश्यकता न हो, (क) “ऄजधजनयम” ऄथागत समुद्री नौचालन सहायता ऄजधजनयम, 2021(2021 का 20); 3967 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) “महाजनदेिालय” ऄथागत नौचालन सहायता महाजनदेिालय; (ग) “जनदेिालय” ऄथागत नौचालन सहायता जनदेिालय; (घ) “जनदेिक” ऄथागत जनदेिक, नौचालन सहायता महाजनदेिालय ; (ङ) “तायगपथ” ऄथागत पत् तन सीमा के बाहर नौग्‍ य जल ; (च) “प्रजिक्षण संस्ट्थ ान” ऄथागत समुद्री नौचालन प्रजिक्षण संस्ट्थ ान । (3) समुद्री नौचालन सहायता ऄजधजनयम, 2021, सामान् य जवत् तीय जनयम, 2017 (यथा सिं ोजधत) और सरकारी लेखा जनयम, 1990 (यथा संिोजधत) में प्रयुि िब्द एवं व्याख्या जो पररभाजर्त न की गइ हो और ऄजधजनयममें पररभाजर्त दकए गए हों, का आस ऄजधजनयम में क्रमिः समान तात्पय गप्रदान दकया गया ह।ै 3. महाजनदेिालय का सगं ठन.- (1) भारत सरकार पत् तन, पोत पररवहन और जलमाग ग मंत्रालय के माध् यम से पोत यातायात सेवा सजहत समुद्री नौचालन सहायता स ेसंबंजधत मामलों के जलए जनयंत्रक प्राजधकारी होगा। (2) महाजनदेिक द्वारा ऄजधजनयम के खंड 5 के ऄनुसार पोत यातायात सेवा सजहत नौचालन सहायता के संदभग में नौचालन सहायता के प्रजिक्षण और प्रमाणन से संबंजधत रार्् रीय और ऄंतरागष्र ीय दाजयत् वों को पूरा दकया जाएगा। (3) महाजनदेिक द्वारा ऄजधजनयम के ऄध् याय IV, खंड 8 और 9 के ऄनुसार सामान् य नौचालन सहायता के जवकास, स्ट् थापना, ऄनुरक्षण और प्रबंधन का प्रयोग दकया जाएगा। (4) महाजनदेिक द्वारा पोत यातायात सेवा सजहत नौचालन सहायता के कार्ममकों का प्रजिक्षण और प्रमाणन और साथ ही प्रजिक्षण संस्ट् थानों के प्रत् यायन का प्रयोग दकया जाएगा। (5) नौचालन सहायता महाजनदेिालय का मुख्यालय ऐस े स्ट्थान पर होगा,जैसा दक केन् द्र सरकार द्वारा अजधकाररक राजपत्र म ें ऄजधसूचना के माध्य म स े जवजन्द्ट दकया जाएगा, और समुद्री नौचालन सहायता के प्रिासन के प्रयोजनाथग,केन् द्र सरकार द्वारा ईपयुत त समझे ऐस े स्ट्थानों पर महाजनदिे ालय के क्षेत्रीय कायागलय कायागलय स्ट्थाजपत दकए जा सकते ह।ैं (6) महाजनदेिालय की प्रभावी कायग पद्धजत हते ु, भारत के समुद्री तट को जचजन्हत करत े हुए समद्रु ी नौचालन सहायता के जजले के रूप में जन्‍न ानुसार पररभाजर्त दकया गया ह ै: क्र.स.ं जजल ेका नाम जजल ेका क्षत्रे ाजधकार गुजरात राज्य का भाग- ऄंतरागष्र ीय सीमा रेखा (अइ बी एल) स े ऄक्षांि 1 गांधीधाम 22°24’ई तक तटीय खंड और द्वीप का जहस्ट्स ा। गुजरात राज्य का जहस्ट्स ा और केन् द्र िाजसत प्रदिे दीव 22°24’ई to 21°45’ईतक 2 जामनगर ऄक्षांि के मध् य खंड और द्वीप समूह, जजसमें कच् छ की खाीीऔर ख्‍ बात की खाीीका क्षेत्र सज्‍मजलत ह।ै गुजरात राज्य का जहस्ट्स ा , महाराष्र राज्य का जहस्ट्स ा और केन् द्र िाजसत प्रदिे 3 मु्‍ बइ दमन - 21°45’ ई से 16°30’ ई तक ऄक्षांि के मध् य तटीय खडं और द्वीप समूह। महाराष्र राज्य का जहस्ट्स ा, गोवाराज्य और कनागटक राज्य - 16°30’ ईसे 12°45’ 4 गोवा ई ऄक्षांि के मध् य तटीय खडं और द्वीप समूह । केरल राज्य और केन्द्र िाजसत प्रदेि लक्षद्वीप - 12°45’ ईसे 08°17’ ई ऄक्षांि के 5 कोच् ची मध् य तटीय खडं और द्वीप समूह। मन्न ार की खाीी सजहत तजमलनाडु राज्य और केन् द्र िाजसत प्रदेि पांजडचेरी के के 6 चैन् नइ मध् य तटीय खडं और द्वीप।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 13°27’ई से 18° 12’ई ऄक्षांि के मध् य अन् र प्रदेि राज्य के तटीय खंड और द्वीप 7 जविाखापत् तनम समूह । अन् र प्रदेि राज्य का जहस्ट्स ा, ईडीसा राज्य और पजचिमम बगं ाल - 18°12’ई 8 कोलकाता ऄक्षांि स े ऄंतरागष्र ीय सीमा रेखा (अइ बी एल) के मध् य तटीय खंड और द्वीप समूह। 9 पोटग ब् लेयर केन् द्र िाजसत प्रदेि ऄंडमान और जनकोबार द्वीप समूह। रटप्‍प्‍ ण ी : क. स्ट् थानीय लाभ, तकनीकी जस्ट्थरता और प्रिासजनक समीचीनता के अधार पर नौचालन सहायता का प्रिासन जभन् न हो सकता ह,ै जजसे समय - समय पर महाजनदेिक द्वारा ऄजधसूजचत दकया जाएगा। ख. तकनीकी प्रगजत और व् यापार जवकास के अधार पर, जजलों के क्षेत्राजधकार का पुनर्मवतरण अवश् यक हो सकता ह,ै जजसे महाजनदेिक द्वारा केन् द्रीय सरकार की पूव ग ऄनमु जत पर दक्रयाजन्वत और ऄजधसूजचत दकया जाएगा। 7. जनरीक्षण, जनगरानी, संचालन और तकनीकी जस्ट्थरता और प्रिासजनक सुजवधा के जलए दो ऄथवा दो से ऄजधक जजलों को समूहीकृत दकया जाएगा, और जजसका नेतृत् व ईप महाजनदेिक करेंगे। 8. प्रत् यके जजले के कायागलय को नौचालन सहायता जनदेिालय के रूप में नाजमत दकया जाएगा। ईप- जनयम 7 म ें ईपरोतत दकसी भी बात के होते हुए भी गांधीधाम के ऄजतररतत प्रत् यके जजले का प्रिासजनक प्रभार और जनयंत्रण, जनदेिक को प्रत् यायोजजत दकया जाएगा, जो संबंजधत जजल े की नौचालन सहायता के सामान् य प्रिासन के जलए ईत् तरदायी होगा। 9. गांधीधाम जजल,े जजस में पोत यातायात सेवा की स्ट् थापना ह,ै के प्रिासजनक प्रभार और जनयत्रं ण, ईप महाजनदेिक प्रत् यायोजजत दकया जाएगा, जो ऄपन े जजल े के पोत यातायात सेवा सजहत नौचालन सहायता के सामान् य प्रिासन हते ु महाजनदेिक के प्रजत ईत् तरदायी होंगे। 4. समद्रु ी नौचालन प्रजिक्षण सस्ट्ं थ ान और ईसका पररसर : (1) नौचालन सहायता और पोत यातायात सेवा हते ु प्रजिक्षण प्रदानगी स ेसंबंजधत एक समुद्री नौचालन प्रजिक्षण संस्ट् थान होगा। (2) प्रजिक्षण सस्ट्ं थान से संबंजधत सभी मामलों के जलए महाजनदेिक जज्‍ मेदार होंगे। (3) महाजनदेिक, ईप –जनयम (2) के ऄधीन संदर्मभत ऐसी जज्‍ मेदारी(यों) को ईस ऄजधकारी को प्रत् यायोजजत कर सकते ह,ैं जो जनदेिक के पद से नीचे के स्ट्त र का न हो। (4) केन् द्रीय सरकार,कुिल क्षमता जनमागण के एक भाग के रूप म ेंप्रजिक्षण संस्ट्थ ान के ईपरह ह पररसर की स्ट्थ ापना कर सकती ह।ै (5) प्रजिक्षण संस्ट् थान को नौचालन सहायता और पोत यातायात सेवा के क्षेत्र म ें वैज क जवकास के साथ बन े रहने के जलए ऄनुसंधान और जवकास गजतजवजधयों का संचालन करना होगा। . 5. महाजनदेिक के कतव्ग य .- महाजनदेिक जन्‍न जलजखत कतगव् यों के जनवगहन के जलए जज्‍ मेदार होंग:े - (i) प्रमुख के रूप म ेंप्रिासजनक, तकनीकी, जवत् तीय और वैधाजनक कायक का जनष्प ादन। (ii) ऄजधजनयम के प्रावधानों का दक्रयान् वयन; (iii) नौचालन सहायता से संबंजधत सभी मामलों के संदभग म ेंभारत सरकार को परामिग की प्रदानगी ; (iv) समुद्री नौचालन सहायता (लेखा और जवत् तीय िजि) जनयम, 2022के ऄनुसार समुद्री नौचालन सहायता िुल् क का प्रबंधन; (v) समुद्री नौचालन सहायता की केन् द्रीय दीपस्ट् तंभ सलाहकार सजमजत के सदस्ट् य सजचव की भूजमका का जनवगहन;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (vi) आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऄथॉररटीज म ें एक राष्र ीय सदस्ट् य के रूप में प्रजतजनजधत् व करना; (vii) पोत यातायात सेवा सजहत समुद्री नौचालन सहायता स े संबंजधत राष्र ीय और ऄंतरागष्र ीय संगठनों के साथ संपकग; (viii) नौचालन सहायता स े सबं ंजधत ऄतं रागष्र ीय स्‍ मेलनों और संजधयों को दक्रयाजन्वत करना, जजसमें भारत एक पक्ष ह।ै (ix) नौचालन सहायता के जवकास और प्रजिक्षण से संबंजधत मामलों के संदभग में जद्वपक्षीय ऄथवा बहुपक्षीय समझौता ज्ञापन देिों के साथ में सज्‍मजलत होना; (x) भारत के समुद्रीय तट के स्ट् थानीय नौचालन सहायता का जनरीक्षण करना; (xi) स्ट् थानीय नौचालन सहायता के प्रावधानों और जवस्ट् तार के संदभग म ें राज्य सरकार, राज्य समुद्री बोड,ग प्रमुख और लघु पत् तनों, मत् स्ट् य जवभाग और ऄन् य सगं ठनों को परामि गप्रदानगी; (xii) केन् द्रीय सरकार के जनदेिानुसार, भुगतान के अधार पर, संबंजधत पोत यातायात सेवा प्रदाता के ऄनरु ोध पर जवजिष्ट पोत यातायात सेवा का प्रबंधन और प्रचालन; (xiii) नौचालन सहायता के क्षत्रे में परीक्षण तल के जवकास सजहत जवकजसत हो रही प्रौद्योजगदकयों पर ऄनुसंधान, जवकास और ऄगं ीकरण; (xiv) समुद्री क्षेत्रों सजहत भारत के समुद्री तट पर सामान् य नौचालन सहायता की योजना, जवकास, जनष्प ादन और प्रबंधन करना; (xv) नौचालन सहायता का ऄनुकूलीकरण; (xvi) सामान् य नौचालन सहायता का ऄबाजधत प्रचालन की सजु वधा प्रदानगी; (xvii) आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऄथॉररटीज के जनयत मानकों के ऄनुरूप जन्दष् ट सटीकता सजहत सामान् य नौचालन सहायता की जनबागध ईपलब्ध ता सुजनजचिमत करना; (xviii) सांस्ट् कृजतक, िैजक्षक और पयगटन ईद्देश् यों हते ु जवरासती दीपस्ट् तंभों स े संबंजधत योजना, जवकास, जनष्प ादन और प्रबंधन; (xix) समुद्री क्षेत्रों के साथ भारत की समुद्रीय तट रेखा सजहत पोत यातायात सेवा के साथ नौचालन सहायता के संवधगनाथग जोजखम मूल् यांकन नीजत का जनमागण करना; (xx) नौचालन सहायता और पोत यातायात सेवा के क्षेत्र म ें क्षमता जनमागण हते ु एक राष्र ीय प्रजिक्षण योजना का जवकास और प्रबंधन करना; (xxi) नौचालन सहायता और पोत यातायात सेवा कार्ममकों और ईनके प्रजिक्षण की जस्ट्थजत से संबंजधत राष्र ीय डाटा बैंक का प्रबंधन करना; (xxii) नौचालन सहायता और पोत यातायात सेवाकार्ममकों का प्रजिक्षण और प्रमाणन; (xxiii) प्रजिक्षण सगं ठनों का प्रत् यायन और ऄनुवतल लेखा परीक्षा; (xxiv) केन् द्रीय सरकार के जनदिे ानुसार तायगपथ म ेंपोताविेर्ों को जचजन्हत करना; (xxv) नौचालन सहायता महाजनदेिालय से संबंजधत मामलों के संबंध म ें केन् द्रीय सरकार को अवजधक रूप म ें ऄवगत कराना; (xxvi) केन् द्रीय सरकार द्वारा सजपे जाने वाल ेऄन् य कायग । 6. महाजनदेिक की िजिया.ं - महाजनदेिक के ऄजधकार: (i) केन् द्रीय सरकार द्वारा सजपे गए दाजयत्वों के ऄधीन जवभाग के प्रमुख के रूप म ें प्रिासजनक, तकजनकी, जवत् तीय और वैधाजनेक कायक हते ु िजि का प्रयोग करेंग;े[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (ii) पत् तन, पोत पररवहन और जलमाग गमंत्रालय द्वारा प्रत् यायोजजत िजियों का प्रयोग करेंग;े (iii) ऄजधजनयम के दायरे म ें अंतररक कायग प्रचालन हते ु अदेि, जनयमावली, सूचना, मानक प्रचालन प्रदक्रयाए ं (एसओपी), ऄनुदिे जारी करेंग;े (iv) समुद्री नौचालन सहायता िुल् क के सरह ं हण और लौटान े के संदभग म ें दरों और पद्धजत की समीक्षा सजहत प्रावधानों को दक्रयाजन्व त करेंग;े (v) ऄध् यक्ष के परामिग पर समुद्री नौचालन सहायता की केन्द्र ीय सलाहकार सजमजत की बैठक का अयोजन करना और केन् द्रीय सलाहकार सजमजत की बैठकों में ईपजस्ट्थत होन े वाले गैर – िासकीय सदस्ट् यों को यात्रा व् यय की स्ट् वीकृजत प्रदान करना; (vi) आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऄथॉररटीज द्वारा अयोजजत होन े वाले स्‍ मेलनों, कायगिालाओं,संगोजियों, सभाओें, सेजमनार और प्रजिक्षण कायगक्रमों में भागीदारी हते ु केन् द्रीय सरकार की पूवग ऄनुमजत पर प्रजतजनजध मंडलों को नामांदकत करेंगे; (vii) पोत यातायात सेवा सजहत नौचालन सहायता स े संबजं धत मामलों के संदभ ग म ें जद्वपक्षीय और बहुपक्षीय ऄंतरागष्र ीय मंचों म ें प्रजतजनजधत्व करने हते ु केन् द्रीय सरकार की पूवग ऄनुमजत पर प्रजतजनजध मडं लों को नाजमत करेंग;े (viii) नौचालन सहायता से संबजं धत जवर्यों पर जहतधारकों की बैठक का अयोजन करना; (ix) “स्ट् थानीय” नौचालन सहायता का जनरीक्षण और नौचालन सहायता के संबंध म ें स्ट्थ ानीय प्राजधकारण स े अवश् यक जानकारी की प्राजि और तत्प श् चात:- (क) यदद दकसी प्रकार की जवसंगजत पाए जाने पर ईपचारी ईपाय के सुझाव की प्रदानगी; (ख) लागत के भगु तान के ऄनुरोध पर नौचालन सहायता की मर्‍ मत का कायग अरंभ करना; (x) नौचालन सहायता के क्षेत्र में जवकजसत हो रही प्रौद्योजगकी के साथ बने रहने के जलए ऄनसु ंधान और जवकास से संबंजधत योजनाओं को स्ट् वीकृजत प्रदान करना; (xi) सामान् य नौचालन सहायता के जवकास, जनष्प ादन और प्रबधं न हते ु योजनाओं को स्ट् वीकृजत प्रदान करना; (xii) समुद्री नौचालन सहायता के प्रचालन में हस्ट् तक्षेप ऄथवा ब् यवधान डालन े वाली गजतजवजधयों को अवश् यक समझे जाने पर प्रजतबंजधत करन े की कारगवाइ प्रारंभ करना; (xiii) सांस्ट् कृजतक, िैजक्षक और पयगटन ईद्देश् यों हते ु जवरासती दीपस्ट् तंभों के जव कास, प्रचालन, ऄनुरक्षण और प्रबंधन हते ु योजनाओं को स्ट् वीकृत; (xiv) संभाजवत दीपस्ट् तंभों में पयगटन को बढावा देने के जलए योजनाओं को स्ट् वीकृजत प्रदान करना; (xv) नौचालन सहायता / पोत यातायात सेवा कार्ममकों के प्रजिक्षण प्रदान करन े करन े वाली संस्ट् थाओं से प्रजिक्षण से संबंजधत जानकारी की मांग करना; (xvi) समुद्री नौचालन सहायता (प्रजिक्षण संस्ट् थानों का प्रत् यायन) जनयम, 2022 और केंद्र सरकार द्वारा जारी ऄन्य ऄनुदेिों / जनदेिों के ऄनुसार मान् यता, प्रजिक्षण और प्रमाणन से संबंजधत मामलों का जनपटान; (xvii) प्रजिक्षण और प्रमाणन से संबंजधत मामलों के संदभ ग में आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एंड लाआटहाईस ऄथॉररटीज/ आंटरनेिनल एसोजसएसन ऑफ मरीन एड्स टू नेवीगेिन एडं लाआटहाईस ऄथॉररटीज वल् ड वाइड ऄकादमी के साथ समझौता ज्ञापन / संस्ट्थ ापन प्रलेख म ेंसज्‍मजलत होना; (xviii) केन् द्रीय सरकार द्वारा जनधागररत मानदडं के ऄनुसार सामान् य नौचालन सहायता, जवरासती दीपस्ट्त ंभऔर पोत यातायात सेवा के जवकास, प्रचालन और ऄनरु क्षण हते ु पिे ेवर सेवाओं और श्रम िजि को िाजमल करना; (xix) नौचालन सहायता / पोत यातायात सेवा के कार्ममकों के प्रजिक्षण और प्रमाणन से संबंजधत कायग के जनवगहन हते ु संकाय और संसाधनों की बाह्यस्ट् त्रोत व् यवस्ट् था; (xx) समुद्री नौचालन सहायता महाजनदेिालय के ध् वज कोड, प्रतीक और कार्ममकों की वदल कोड का जनधागरण;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xxi) पोताविेर्ों का जचजन्हत करने संबंधी योजनाओं की स्ट् वीकृती; (xxii) केन् द्र सरकार की पूवग ऄनुमजत पर, सामान् य नौचालन सहायता की स्ट् थापना और रखरखाव हते ु अवश् यक वस्ट् तुओं और सामरह ी के अयात के संदभग में जवदेिी मद्रु ा का जारी दकया जाना; 7. िजियों के प्रत्य ायोजन का ऄजधकार:महाजनदेिक, आन जनयमों के ऄधीन ऄपन े ऄजधकारों को जलजखत माध् यम स े प्रजतबंधों, सीमाओं और ितक सजहत ऄजधकारी को प्रत् यायोजजत कर सकत े ह।ैं [फा.सं. एल एच -11012/2/2021-एसएल] लुकास एल कामसुअन, संयुत त सजचव MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 9th June, 2022 G.S.R. 443(E).— Whereas the Central Government had, in exercise of its powers under sub-section (1) of section 46 of the Marine Aids to Navigation Act, 2021 (20 of 2021), published the draft Marine Aids to Navigation (Duties of Director General) Rules, 2021, in the Gazette of India, Extraordinary, vide number G.S.R 819 (E), dated 18th November 2021 for information of all persons likely to be affected thereby; and notice was given that the said draft rules would be taken into consideration by the Central Government after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public; And whereas, the copies of the said Gazette notification were made available to the public on 18th November, 2021; And whereas, no objections or suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by sub-section (2) of section 46 of the Marine Aids to Navigation Act, 2021 (20 of 2021), the Central Government hereby makes the following rules, namely:- 1. Short title and commencement.-(1) These rules may be called the Marine Aids to Navigation (Duties of Director General) Rules, 2022. (2) It shall come into force from the date of their publication in the Official Gazette. 2. Definitions.-(1) In these rules, unless the content otherwise requires, (a) ―Act‖ means Marine Aids to Navigation Act, 2021 (20 of 2021); (b) ―Directorate General‖ means the Directorate General of Aids to Navigation; (c) ―Directorate‖ means Directorate of Aids to Navigation; (d) ―Director‖ means the Director of Aids to Navigation; (e) ―fairways‖ means navigable waters outside port limits; (f) ―Training Institute‖ means the Marine Navigation Training Institute. (2) Words and expressions used but not defined in this rules and defined in the Marine Aids to Navigation Act 2021, General Financial Rules, 2017 (as amended) and Government Accounting Rules, 1990 (as amended) will have the same meanings respectively assigned to them in that Act. 3. Organisation of the Directorate General.-(1) The Government of India through Ministry of Ports, Shipping and Waterways shall be the controlling authority for matters pertaining to Marine Aids to Navigation including Vessel Traffic Services. (2) The National and International obligations pertaining to Aids to Navigation and Training and Certification on Aids to Navigation including Vessel Traffic Service, shall be fulfilled by the Director General in accordance with Section 5 of the Act. (3) The development, establishment, maintenance and management of general aids to navigation shall be exercised by the Director General in accordance with Chapter IV, Sections 8 and 9 of the Act. (4) Training and Certification of personnel on Aids to Navigation including Vessel Traffic Service and Accreditation of Training Organisations, shall be exercised by the Director General.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (5) The head office of the Directorate General of Aids to Navigation shall be at such place as the Central Government may, by notification in the Official Gazette, specify, and for the purpose of administration of Aids to Navigation, there may be established at such places as the Central Government may think fit, branch offices of the Directorate General. (6) For the purpose of effective functioning of Directorate General, the coastline of India shall be demarcated and defined as Districts of Marine Aids to Navigation as below: Sr.No. Name of District Jurisdiction of the District Part of State of Gujarat – Costal stretches and Islands between International 1 Gandhidham Border Line (IBL) to Latitude 22°24‘N. Part of State of Maharashtra, State of Goa and State of Karnataka - Coastal 4 Goa stretches and Islands between Latitude from 16°30‘N to 12°45‘N. State of Kerala and Union Territory of Lakshadweep - Coastal stretches and 5 Kochi Islands between Latitude from 12°45‘N to 08°17‘N. Coastal stretches and Islands of State of Tamil Nadu and Union Territory of 6 Chennai Pondicherry including Gulf of Mannar Coastal stretches and Islands of State of Andhra Pradesh between Latitude 7 Visakhapatnam from 13°27‘N to 18° 12‘N Part of State of Andhra Pradesh, State of Orissa and West Bengal – Coastal 8 Kolkata Stretches and Islands between Latitude from 18°12‘N to International Border Line (IBL). 9 Port Blair Union Territory of Andaman and Nicobar Islands Note: a. The administration of certain aids to navigation might vary depending upon locational advantage, technical sustainability and administrative expediency, which shall be notified by the Director General from time to time. b. Based on to the technological advancement and trade development, further redistribution of jurisdiction of districts might be necessary, which shall be implemented and notified by the Director General, with prior approval of the Central Government. (7) Two or more Districts shall be grouped as zone for inspection, monitoring, operational and technical sustainability and administrative expediency, and shall be headed by the Deputy Director General. (8) The office of each district will be designated as Directorate of Aids to Navigation. Notwithstanding anything contained above in sub-rule 7, the administrative charge and control of each District, except Gandhidham, shall be delegated to the Director, who shall be responsible to the Director General for the general administration of Aids to Navigation of respective district. (9) The administrative charge and control of Gandhidham District, having a Vessel Traffic Service setup, shall be delegated to the Deputy Director General who will be responsible to the Director General for the general administration of Aids to Navigation including vessel traffic services in his district.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. Marine Navigation Training Institute and its campuses.-(1) There shall be Marine Navigation Training Institutes to impart training on Aids to Navigation and Vessel Traffic Services. (2) The Director General shall be responsible for all matters pertaining to the Training Institute. (3) The Director General may delegate such responsibilities referred to under sub-rule (2) to the officer not below the rank of Director. (4) As a part of skilled capacity building, the Central Government may establish satellite campuses of the Training Institutes. (5) The Training Institutes shall undertake Research and Development activities in the field of aids to navigation and vessel traffic services to remain abreast with the global developments. 5. Duties of Director General.-The Director General shall be responsible for discharging the following duties:- (i) Executing administrative, technical, financial and statutory functions as head of the Directorate General; (ii) Implementing provisions of the Act; (iii) Advising the Government of India for all matters related to Aids to Navigation; (iv) Managing the Marine Aids to Navigation dues in accordance with the Marine Aids to Navigation (Accounting and Financial Power) Rules, 2022; (v) Discharging the role of Member Secretary to the Central Advisory Committee on Marine Aids to Navigation; (vi) Representing as a national member at International Association of Marine Aids to Navigation and Lighthouse Authorities; (vii) Liaisoning with national and international organisations on matters pertaining to Marine Aids to Navigation; (viii) Implementing International Conventions and Treaties pertaining to Aids to Navigation, to which India is a party. (ix) Entering into bilateral or multilateral memorandum of understanding with the countries on the matters related with development of Aids to Navigation and training; (x) Inspecting Local Aids to Navigation along the coastline of India; (xi) Advising State Government, State Maritime Boards, Major and Minor Ports, Department of Fisheries and other organisations on the provision and improvement of Local Aids to Navigation; (xii) Managing and operating of certain Vessel Traffic Service, at the request of respective Vessel Traffic Service provider on payment basis, as per the direction of Central Government; (xiii) Researching, developing and adopting of evolving technologies including development of test beds in the field of Aids to Navigation; (xiv) Planning, developing, executing and managing General Aids to Navigation along the coast line of India including the maritime zones; (xv) Harmonising operation of Aids to Navigation; (xvi) Facilitating unobstructed functioning of General Aids to Navigation; (xvii) Ensuring uninterrupted availability of General Aids to Navigation with specified accuracy as per standards stipulated by the International Association of Marine Aids to Navigation and Lighthouse Authorities; (xviii) Planning, developing, executing and managing Heritage Lighthouses for cultural, educational and tourism purposes; (xix) Formulating risk assessment policy for augmentation of Aids to Navigation including Vessel Traffic Services along the coast line of India including the maritime zones; (xx) Developing and managing a national training plan for capacity building in the field of Aids to Navigation and Vessel Traffic Service; (xxi) Managing national data bank of Aids to Navigation and Vessel Traffic Service personnel and their status on training; (xxii) Training and certification of Aids to Navigation and Vessel Traffic Service personnel.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (xxiii) Accreditation of training organisations and follow-up audits; (xxiv) Marking of wrecks in fairways as per the direction of Central Government; (xxv) Undertaking periodical appraisal to the Central Government on matters related to the Directorate General of Aids to Navigation; (xxvi) Any other duties as may be assigned by the Central Government. 6. Powers of Director General.-The Director General shall be entitled to: (i) Exercise administrative, technical, financial and statutory functions as the Head of the Department as per the orders issued by the Central Government; (ii) Exercise all delegated powers issued by the Ministry of Port, Shipping and Waterways; (iii) Issue orders, manuals, notices, Standard Operating Procedures (SoPs), instructions for internal functioning under the ambit of the Act; (iv) Implement the provisions of Marine Aids to Navigation dues including review of rates and modalities for collection and refund with the prior approval of Central Government; (v) Convene the meeting of Central Advisory Committee on Marine Aids to Navigation on the advice of Chairman and to sanction travel expenses to non-official members to attend meetings of Central Advisory Committee on Marine Aids to Navigation; (vi) Nominate delegations to participate in the conferences, workshops, symposium, seminars and trainings organised by International Association of Marine Aids to Navigation and Lighthouse Authorities, with the prior approval of the Central Government; (vii) Nominate delegations to represent in the bilateral and multilateral International forums on the matters related to Aids to Navigation with the prior approval of the Central Government; (viii) Convene meetings of stakeholders on the matters related to Aids to Navigation; (ix) Inspect any ‗local‘ aids to navigation and seek required information from the local authority pertaining to respective Aids to Navigation and subsequently:- (a) Suggest corrective action, in case of any discrepancy observed; (b) Undertake restoration of Aids to Navigation service on request against payment of such cost; (x) Sanction schemes pertaining to research and development to remain abreast with the evolving technologies in the field of Aids to Navigation with the prior approval of Central Government; (xi) Sanction schemes for development, execution and management of General Aids to Navigation with the prior approval of Central Government; (xii) Initiate such action as may be necessary to restrict activities which interfere or obstruct the operation of aids to navigation; (xiii) Sanction schemes for development, operation, maintenance and management of heritage lighthouses for cultural, educational and tourism purposes; (xiv) Sanction schemes for promotion of tourism at potential lighthouses; (xv) Seek information on the training status of Aids to Navigation/ Vessel Traffic Service personnel from the respective providers of such training; (xvi) Deal with matters pertaining to accreditation, training and certification in accordance with Marine Aids to Navigation (Accreditation of Training Organisations) Rules, 2022 and other instructions/directions issued by the Central Government; (xvii) Enter into memorandum of understanding/ memorandum of association with International Association of Marine Aids to Navigation and Lighthouse Authorities/ International Association of Marine Aids to Navigation and Lighthouse Authorities World Wide Academy in the matters pertaining to training and certification with the prior approval of Central Government; (xviii) Engage professional services and manpower for development, operation and maintenance of General Aids to Navigation, Heritage Lighthouse and Vessel Traffic Service as per the norms prescribed by the Central Government; (xix) Outsource faculty and resources for discharging the functions pertaining to training and certification of Aids to Navigation/ Vessel Traffic Service personnel;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xx) Administer the flag code, emblem and uniform code of personnel of the Directorate General of Aids to Navigation; (xxi) Sanction schemes for marking of wrecks; (xxii) Release of foreign exchange for import of essential items and services for establishment and maintenance of General Aids to Navigation, subject to prior approval of the Central Government. 7. Power to Delegate.-The Director General may delegate his powers under these rules, to officers by an order in writing, subject to such restrictions, limitations and conditions.
