जिसमे जनम्नजलजखत उपबंध है: - “8. अिजन की बाित् आपजत्तयां: (1) कोई व्यजक्त िो ककसी भूजम में जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी ककए िाने स े तीस कदन के भीतर सम्पूणज भूजम या उसके ककसी भाग या ऐसी भूजम म ें या उस पर के ककन्द्हीं अजधकारों का अिजन ककए िान े के बारे म ेंआपजत्त कर सकेगा। स्ट्पष्टीकरण:- इस धारा के अथज के अन्द्तगजत यह आपजत्त नहीं मानी िाएगी कक कोई व्यजक्त ककसी भूजम में कोयला उत्पादन के जलए स्ट्ियं खनन संकियाएं करना चाहता ह ैऔर ऐसी संकियाएं केन्द्रीय सरकार या ककसी अन्द्य व्यजक्त को नहीं करनी चाजहए। (2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम अजधकारी को जलजखत रूप में की िाएगी और सक्षम अजधकारी, आपजत्तकताज को स्ट्िय ं सुन े िाने, या जिजध व्यिसायी द्वारा सुनिाई का अिसर देगा और ऐसी सभी आपजत्तयों को सुनने के पश्चात् और ऐसी अजतररक्त िााँच, यकद कोई हो, करने के पश्चात, िो यह आिश्यक समझता ह,ै िह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम का या ऐसी भूजम में या उस पर के अजधकारों के संबंध म ें एक ररपोटज या ऐसी भूजम के जिजभन्न टुकड़ े या ऐसी S.O. 2202(E).–– Whereas by the notification of the Government of India in the Ministry of Coal number S.O. 2230(E), dated 19th May, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 or 1957) (hereinafter referred to as the said Act), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 19th May, 2023, the Central Government gave notice of its intention to prospect for coal in 787.893 hectares (approximately) or 1946.88 acres (approximately) of the land in the locality specified in the Schedule annexed to that notification; And whereas the Central Government is satisfied that coal is obtainable in a part of the said land prescribed in the Schedule appended to this notification.[भाग II—खण्‍ड 3(ii)] भारत का रािपत्र : असाधारण 7 Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 751.617 hectares (approximately) or 1857.25 acres (approximately) as all rights in or over the said land described in the Schedule appended hereto. Objection to acquisition. – (1) Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such land. Explanation: - It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government. (3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.”.
