O. 4264(E), dated the 30th September, 2024 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 30th September, 2024 , the Central Government gave notice of its intention to prospect for coal in 773.2987 hectares (approximately) or 1910.821 acres (approximately) of the land in the locality specified in the Schedule annexed to the said notification; And, whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in the Schedule appended to this notification; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 773.2987 hectares (approximately) or 1910.821 acres (approximately) and all rights in or over the said land described in the Schedule appended hereto; Note 1: The plan bearing number C-I(E)/III/JJJR/1224/1023, dated the 19th December, 2024 of the area covered by this notification may be inspected in the office of the Collector, District Chandrapur, Maharashtra or in the office of the Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th floor, Core 2, Laxmi Nagar, Delhi 110092 or in the office of the General Manager, Western Coalfields Limited (Revenue Department), Coal Estate, Civil Lines, Nagpur 440001, Maharashtra. Note 2: Attention is hereby invited to the provisions of section 8 of the aforesaid Act which provides as follows: - “8. Objections to acquisition. - (1) Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such land. Explanation:.—It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person. (2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of proceedings held by him, for the decision of that Government. (3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.” Note 3: The Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th Floor, Core 2, Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S. B - C: Line starts from Point ‘B’, passes in South direction along the outer boundary of Plot Number 85 of village Sakhari and the already acquired land for Gauri-Pauni Expn. OCM and meets Point ‘C’ on the common village boundary of village Sakhari & Pauni. C -D: Line starts from Point ‘C’, passes in West direction along outer boundary of Plot Numbers 85, 84, 83, 82 & 81 of village Sakhari and the already acquired land for Pauni-II Expn. OCM and meets Point ‘D’ in village Sakhari. D - A: Line starts from Point ‘D’, passes in North direction along the outer boundary of Plot Number 81 of village Sakhari and the already acquired land for Pauni-II Expn.
