का.आ. 5728(अ).— केन्दर ीय सरकार ने कोयला धारक क्षत्रे (अिजन और जिकास) अजधजनयम, 1957 (1957 का
20) (जिस े इसम ें इसके पश् चात ् उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) के अधीन, भारत सरकार के
कोयला मंत्रालय द्वारा िारी की गई अजधसूचना संख यांक का. आ. 3212(अ), तारीख 14 िुलाई, 2025, िो भारत के
रािपत्र के भाग 2, खण्ड 3, उपखण् ड (ii), तारीख 15 िलु ाई, 2025, म ें प्रकाजित की गई थी, उक्त अजधसूचना स े उपाबद्ध
अनुसूची म ें जिजनर्िजष् ट पररक्षेत्र म ें जिसका माप 373.598 हक्े ट र (लगभग) या 923.161 एकड़ (लगभग) भूजम म ें कोयल े
का पूिेक्षण करने के अपने आिय की सूचना िी थी;
और केन्द रीय सरकार का यह समाधान हो गया ह ै दक इस अजधसूचना स े संलग् न अनुसूची म ें जिजहत की गई उक्त
भूजम के दकसी भाग म ें कोयला अजभप्राप्य ह;ै
अत:, अब, केन्द रीय सरकार उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित् त िजक्त यों का प्रयोग करत े
हुए, इससे संलग् न अनुसूची म ें िर्णिंत 373.598 हक्े ट र (लगभग) या 923.161 एकड़ (लगभग) माप िाली भूजम और उक्त
भूजम म ें या उस पर के सभी अजधकारों को अिनज करने के अपन े आिय की सूचना िेती ह ै;
रटप्प ण 1: इस अजधसूचना के अधीन आने िाले क्षत्रे के रेखांक धारक संख यांक सी-I(ई)/III/एफ़आर/0825/1031,

रटप्प ण 2: पूिोक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध् यान आकृष्ट दकया िाता ह,ै जिसम ें जनम्न जलजखत
उपबंध ह:ै -
“8. अिजन की बाबत् आक्षेप - (1) कोई व् यजक्त िो दकसी भूजम म,ें जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की
गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िाने स े तीस दिन के भीतर सम् पूण ज भूजम या उसके दकसी भाग या ऐसी भूजम म ें
या उस पर के दकन्द हीं अजधकारों का अिजन दकए िान े के बारे म ेंआक्षेप कर सकेगा ।
स्ट् पष्ट ीकरण- इस धारा के अथाजन्दतगत यह आक्षेप नहीं मानी िाएगी, दक कोई व् यजक्त दकसी भूजम म ें कोयला उत् पािन के
जलए स्ट् ियं खनन संदियाए ं करना चाहता ह ै और ऐसी संदियाए ं केन्द रीय सरकार या दकसी अन्दय व् यजक्त द्वारा
नहीं करनी चाजहए।
(2) उपधारा (1) के अधीन प्रत् यके आक्षेप सक्षम अजधकारी को जलजखत रूप म ें दकया िाएगा और सक्षम अजधकारी,
आक्षेपकता ज को स्ट् िय ं या दकसी जिजध व् यिसायी द्वारा सुन े िान े का अिसर िगे ा और ऐसी सभी आक्षेपो को सुनन े के पश् चात ्
और ऐसी अजतररक्त िांच, यदि कोई हो, करन े के पश् चात ् जिसे आिश् यक समझे, िह या तो धारा 7 की उपधारा (1) के
अधीन अजधसूजचत भूजम के या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें एक ररपोटज या ऐसी भूजम के जिजभन्द न
टुकडों या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें आक्षपे ो पर अपनी जसफाररिों और उसके द्वारा की गई
कायजिाही के अजभलेख सजहत जिजभन्द न ररपोटज केन्द रीय सरकार को उसके जिजनश् चय के जलए िगे ा ।
(3) इस धारा के प्रयोिनों के जलए, कोई व् यजक्त भूजम म ें जहतबद्ध समझा िाएगा िो प्रजतकर म ें दकसी जहत का िािा
करने का हकिार हो, यदि भूजम या दकसी ऐसी भूजम म ें या उस पर के अजधकार इस अजधजनयम के अधीन अर्िजत कर जलए
िाते ह ै।”

MINISTRY OF COAL
NOTIFICATION
New Delhi, the 9th December,2025
S.O. 5728(E).— Whereas by the notification of the Government of India in the Ministry of Coal number
S. O. 3212(E), dated the 14th July, 2025 issued under sub-section (1) of section 4 of the Coal Bearing Areas
(Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), published in the
Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 15th July, 2025, the Central Government
gave notice of its intention to prospect for coal in 373.598 hectares (approximately) or 923.161 acres (approximately)
of the land in the locality specified in the Schedule annexed to the said notification;
And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed
in the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the
Central Government hereby gives notice of its intention to acquire the land measuring 373.598 hectares
(approximately) or 923.161 acres (approximately) and all rights in or over the said land described in the Schedule
appended hereto;
Note 1: The plan bearing number C-I(E)/III/FR/0825/1031, dated the 7th August, 2025 of the area covered by this
notification may be inspected in the office of the Collector, District Nagpur (Maharashtra) or at the office of
the Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th floor, Core-2, Laxmi
Nagar, Delhi 110092 or at the office of the General Manager, Western Coalfields Limited (Revenue
Department), Coal Estate, Civil Lines, Nagpur, 440001 Maharashtra.
Note 2: Attention is hereby invited to the provisions of section 8 of the aforesaid Act which provides as follows: -
“8. Objections to acquisition. - (1) Any person interested in any land in respect of which a notification under section
7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any
part of the land or of any rights in or over such land.
Explanation- It shall not be an objection within the meaning of this section for any person to say that he himself
desires to undertake mining operations in the land for the production of coal and that such operations
should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the
competent authority shall give the objector an opportunity of being heard either in person or by a legal
practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he
thinks necessary, either make a report in respect of the land which has been notified under sub-section (1)
of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such
land or of rights in or over such land, to the Central Government, containing his recommendations on the
objections, together with the record of proceedings held by him, for the decision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to
claim an interest in compensation if the land or any rights in or over such land were acquired under this
Act.”
Note 3: The Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th Floor, Core 2,
Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent authority
under section 3 of the said Act, vide notification number S. O. 2519 dated the 27th May, 1983, published in
Part II, Section 3, Sub-section (ii) in the Gazette of India, dated the 11th June, 1983.
