और उक्त साप्ताजहक रािपत्र अजधसूचना की प्रजतया ं िनता को तारीख 30 दिसंबर, 2025 को उपलब्ध करा िी गई थी ; और सक्षम प्राजधकारी ने, उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोटज ि े िी ह;ै 2576 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात, और यह समाधान हो िाने पर दक उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ; अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जवजनर्िजष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए ; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह जनिेि िेती ह ैदक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के बिाए, सभी जवल्लगं मों से मक्तु होकर जहन्द्िस्ट्ु तान पेरोजलयम कॉपोरेिन जलजमटेड म ेंजनजहत होगा। पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए जहन्द्िस्ट्ु तान पेरोजलयम कॉपोरेिन जलजमटेड पूणजतया उत्तरिायी होगी और धारा 13 के अधीन पाइपलाइन से सम्बजन्द्धत दकसी भी मामल े पर केन्द्रीय सरकार के जवरूद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी ; And whereas copies of the said Weekly Gazette notification were made available to the public on 30th December, 2025; And whereas the Competent Authority has, under sub-section (1) of section 6 of the said Act, submitted his report to the Central Government; And whereas the Central Government, after considering the said report and being satisfied that the said land is required for the purpose of laying the said pipeline, has decided to acquire the Right of User therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the Right of User in the land specified in the Schedule appended to this notification is acquired for the purpose of laying the said pipeline;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of this declaration, in Hindustan Petroleum Corporation Limited, free from all encumbrances; Hindustan Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 According to section 13 no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline;
