(अ).— केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाईन (भूजम में उपयोग के अजधकार का अिजन) अजधजनयम, का जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया ह)ैं की धारा की उप-धारा ( के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ. (अ), तारीख िुलाई , िो भारत के असाधारण रािपत्र, क्रमांक तारीख िुलाई , में प्रकाजित की गई थी, इस अजधसूचना से संलग्न अनुसूची में जवजनर्दिष्ट भूजम में गुिरात राज्य में "कांडला गोरखपुर एल.पी.िी. पाइपलाइन पररयोिना अनुभाग: िहिे स े िमु ाड टर्ममनल” तालुका वागरा, जिला भरुच म ें एल.पी.िी. के पररवहन हेतु आई.एच.बी. जलजमटेड द्वारा पाईपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन करने के जलए अपने आिय की घोषणा की थी;

और उक्त रािपत्र अजधसूचना की प्रजतयां संबजन्द्धत भू-स्ट्वाजमयों को तारीख जसतम्बर, तक उपलब्ध करा िी गई थी ;

और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात् और यह समाधान हो िान े पर दक उक्त भूजम पाइपलाईन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ; अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा की उप-धारा ( द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जवजनर्दिष्ट भूजम म ें पाइपलाईन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए ;

और केन्द्रीय सरकार उक्त अजधजनयम की धारा की उप-धारा ( द्वारा प्रद्त्त िजक्तयों का प्रयोग करत े हुए, यह जनिेि िेती ह ै दक उक्त भूजम में उपयोग का अजधकार इस अजधसूचना के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के बिाए, सभी जवल्लगं मों से मुक्त होकर आई.एच.बी. जलजमटेड में जनजहत होगी । पेरोजलयम और खजनि पाइपलाईन अजधजनयम, की धारा के अधीन दकसी भी क्षजतपूर्मत के जलए आई.एच.बी. जलजमटेड पणू जतय: उतरिायी होगी और पाइपलाईन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जवरुद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी। अनसु चू ी तहसीलः- वागरा जिलाः- भरूच राज्यः- गिु रात क्षत्रे फल मौिा / ग्राम सव े/ ब्लोक / स.ं हक्े टेयर आरे वग ज मीटर दहेज़ 820 00 09 41 कडोदरा 806 00 12 49 जनीयादरा पखाजन पहाज [फा.स.ं आर-11025(15)/11/2019-ओआर-I-भाग (1)/ई-45901] हररत कुमार िाक्य] अवर सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION New Delhi, the 30th September, 2026 S.O. (E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas, Vide S.O. No. (E) dated July , published in the Extra Ordinary Gazette of India No. dated July , issued under Sub-Section (1) of Section-3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying “Kandla -Gorakhpur LPG Pipeline Project, Section :- Dahej to Dumad Terminal” for the transportation of LPG in Tehsil Vagra, District Bharuch in the State of Gujarat by IHB Limited;

And whereas, copies of the said Gazette notification were made available to the concerned land owners up to th September, ;

And whereas, Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy Collector (Retd.), Kandla - Gorakhpur LPG Pipeline Project, IHB Limited, Vadodara (Gujarat) has under Sub-Section-(1) of Section- of said Act, has submitted his report to the Central Government;

And whereas, the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire Right of User therein;

Now, therefore, in exercise of the powers conferred by Sub-Section-(1) of Section-6 of the said Act, the Central Government hereby declares that the Right of User in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by Sub-Section-(4) of Section-6 of the said Act, the Central Government hereby directs that Right of User in the said land for laying the pipeline shall, instead of vesting in the Central Government, vests on the date of publication of this declaration, in IHB Limited, free from all encumbrances.

IHB Limited shall be exclusively liable for any compensation in terms of Section-10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
