(अ).— केन्द्र सरकार ने पेरोजलयम और खजनि पाईपलाइन (भूजम म ें उपयोग के अजधकार का अिजन) अजधजनयम ( का ) (जिसे इस में इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा की उपधारा ( के अधीन िारी की गई भारत सरकार के पेरोजलयम एवं प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ.

(अ) तारीख दिसम्बर, िो भारत के असाधारण रािपत्र तारीख 1 दिसम्बर , में प्रकाजित की गई थी, द्वारा उस अजधसूचना से संलग्न अनुसूची म ें जवजनर्दिष्ट भजू म में ओजडिा राज्य म ें पारािीप (ओजििा) से नुमालीगढ (असम) तक कच्चा तेल पररवहन के जलए नुमालीगढ़ ररफाइनरी जलजमटेड के द्वारा पाईपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार का अिजन के अपन ेआिय की घोषणा की थी;

और उक्त असाधारण रािपत्र अजधसूचना की प्रजतयां िनता को तारीख िनवरी तक उपलब्ध करा िी गई थी; और सक्षम प्राजधकार न,े उक्त अजधजनयम की धारा की उपधारा( के अधीन केन्द्र सरकार को ररपोटज ि े िी ह ै; और केन्द्र सरकार न,े उक्त ररपोटज पर जवचार करने के पश्चात, और यह समाधान हो िाने पर दक उक्त भूजम पाईपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जवजनश्चय दकया ह ै ;

GI/202THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC ii)] अतः अब, केन्द्र सरकार, उक्त अजधजनयम की धारा की उपधारा ( द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह घोषणा करती ह ैदक इस अजधसूचना से संलग्न अनुसूची में जवजनर्दिष्ट भूजम में पाईपलाइन जबछाने के जलए उपयोग के अजधकार का अिजन दकया िाए ;

NOTIFICATION New Delhi, the 3rd September S.O. (E).— Whereas by the notification of the Government of India, Ministry of Petroleum and Natural Gas S.O. No. 5736(E) dated the 10th December, 2025, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extraordinary Gazette of India dated the 11th December 2026, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in the State of Odisha for the transportation of Crude Oil from Paradip in Odisha to Numaligarh in Assam by Numaligarh Refinery Limited;

And whereas copies of the said Gazette notification were made available to the public up to 30.01.2026;

And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Numaligarh Refinery Limited, free from all encumbrances.

Numaligarh Refinery Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit or legal proceeding shall lie against the Central Government, the competent authority or State Government or Corporation on any matter relating to the pipeline.
