L.-33004/99 सी.जी.-डी.एल.-अ.-16102024-257941 CG-DxLx-xEG-I1D6H1x0x2x0 24-257941 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 581] नई दिल्ली सोमिार, अक्त बू र 14, 2024/ आजिन 22, 1946 No. 581] NEW DELHI, MONDAY, OCTOBER 14, 2024/ ASHVINA 22, 1946 आयषु मत्रं ालय अजधसचू ना नई दिल्ली, 11 अक्त बू र, 2024 सा. का. जन.637 (अ).—राष्ट्रीय होम्योपैथी आयोग अजधजनयम, 2020 (2020 का 15) की धारा 54 की उप- धारा (2) के खडं (छ) द्वारा प्रित्त िजियों का प्रयोग करत े हुए, केंद्रीय सरकार एतद्द्वारा राष्ट्रीय होम्योपैथी आयोग म ें जिजभन्न पिों पर भती की पद्धजत को जिजनयजमत करने के जलए जनम्नजलजखत जनयम बनाती है, अथाात:् (1) संजिप्त नाम और प्रारंभ.- (1) इन जनयमों को राष्ट्रीय होम्योपैथी आयोग (अजधकाररयों और कमाचाररयों की जनयुजि) भती जनयम, 2024 कहा िाएगा। (2) ये रािपत्र म ेंइनके प्रकािन की तारीख को प्रिृत्त होंगे। 2. पिों की संख्या, िगीकरण और िेतन मैररक्स में स्ट्तर – पिों की संख्या, उनका िगीकरण और उनसे संबंजधत िेतन मैररक्स में स्ट्तर, इन जनयमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) म ेंदिए गए जिजनर्िाष्टानुसार होंगे। 3. भती की पद्धजत, आयु-सीमा, अहता ाएं आदि- उि पिों से संबंजधत भती की पद्धजत, आय-ु सीमा, अहता ाएं और अन्य मामल,े उि अनुसूची के कॉलम (5) से (13) में दिए गए जिजनर्िाष्टानुसार होंगे। 4. प्रारंजभक गठन:- उि अनुसूची के कॉलम (1) में जिजनर्िाष्ट पिों के पिधारी जिन्ह ें इन जनयमों के प्रारंभ की तारीख स े पहले उि पिों पर जनयजमत आधार पर जनयुि दकया गया था, इन जनयमों के तहत जनयुि दकए गए माने िाएंग े और उि प्रारंभ से पहले उि पिों में उनकी जनयजमत और जनरंतर सेिा को िररष्ठता, पिोन्नजत और पेंिन के प्रयोिन हते ु ध्यान में रखा िाएगा। 6672 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5. जनरहता ा: िह व्यजि,- (क) जिसन े ऐसे व्यजि से जिसका पजत या पत्नी िीजित है, जििाह दकया ह ैया जििाह का अनबु ंध दकया है; या (ख) जिसने अपने पजत या पत्नी के िीजित रहत े हुए, दकसी अन्य व्यजि से जििाह दकया ह ै या जििाह का अनुबंध दकया ह,ै उि पि पर जनयुजि के जलए पात्र नहीं होगा: परन्त ुयदि केन्द्रीय सरकार का यह समाधान हो िाता ह ैदक ऐसा जििाह ऐसे व्यजि और जििाह के िसू रे पिकार को लाग ू स्ट्िीय जिजध के अधीन अनुमेय ह ै और ऐसा करन े के जलए अन्य आधार हैं, तो िह दकसी व्यजि को इस जनयम के प्रितान से छूट िे सकेगी। 6. जिजथल करन े की िजि: िहा ं केन्द्रीय सरकार की यह राय ह ै दक ऐसा करना आिश्यक या समीचीन ह ै िहां िह, आिेि द्वारा और जलजखत म ें कारण बतात े हुए, दकसी िगा या श्रेणी के व्यजियों के संबंध में इन जनयमों के उपबंधों में स े दकसी उपबंध को जिजथल कर सकेगी। 7. व्यािृजत्त: इन जनयमों की कोई बात आरिण, आय-ु सीमा म ें छूट और अन्य ररयायतों को प्रभाजित नहीं करेगी िो इस संबंध म ें समय-समय पर केंद्र सरकार द्वारा िारी आििे ों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, अन्य जपछड ेिगों, भूतपूि ासैजनकों और अन्य जििेष श्रेजणयों के व्यजि को प्रिान की िाती ह।ैं अनसु चू ी पि का नाम पिों की िगीकरण पे-मैररक्स चयन पि सीधी भती हते ु सीधी भर्तायों हते ु संख्या में स्ट्तर ह ै या आयु सीमा अपेजित िैिजणक अचयन और अन्य अहता ाएं पि (1) (2) (3) (4) (5) (6) (7) उप सजचि 01 (2024)* सामान्य केंद्रीय पे-मैररक्स चयन लाग ूनहीं होता लाग ूनहीं होता सेिा समूह- ‘क’, (78800- काय-ा भार के अननुसजचिीय 209200 आधार पर रुपए) में पररितान स्ट्तर-12 दकया िा सकता ह।ै सीधी भती दकए िान े िाल े व्यजियों के पररिीिा की भती की पद्धजत: भती सीधे होगी या प्रोन्नजत द्वारा या जलए जिजहत आय ु और िैिजणक अहता ाएं अिजध, यदि प्रजतजनयुजि या आमले न द्वारा तथा जिजभन्न पद्धजतयों द्वारा प्रोन्नत व्यजियों की ििा में लागू होंगी या कोई हो भरी िाने िाली ररजियों की प्रजतितता नहीं (8) (9) (10) लाग ूनहीं होता लाग ूनहीं होता प्रोन्नजत द्वारा, जिसके न होने पर प्रजतजनयुजि द्वारा प्रोन्नजत या प्रजतजनयुजि या आमेलन की ििा में ि े यदि जिभागीय प्रोन्नजत सजमजत भती करने की दकन श्रेजणयां जिनसे प्रोन्नजत या प्रजतजनयुजि या आमले न दकया मौिूि ह,ै तो इसकी संरचना पररजस्ट्थजतयों म ें संघ िाएगा। लोक सेिा आयोग स े परामिा दकया िाएगा। (11) (12) (13) प्रोन्नजत द्वारा: पे-मैररक्स (67700-208700 रुपए) के जिभागीय प्रोन्नजत सजमजत (प्रोन्नजत संघ लोक सेिा आयोग स्ट्तर-11 म ें राष्ट्रीय होम्योपैथी आयोग के अिर सजचि, पर जिचार हते )ु िो जनम्नजलजखत से से परामिा करना जिन्होंने ग्रेड म ें पांच साल की जनयजमत सेिा की है, जमलकर बनगे ी:- आिश्यक नहीं ह।ै प्रोन्नजत के जलए पात्र ह।ैं (i) अध्यि, राष्ट्रीय होम्योपैथी[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 रटप्पण: िहां अहता ा या पात्रता सेिा पूरी कर चुके आयोग -अध्यि; कजनष्ठों की प्रोन्नजत पर जिचार दकया िा रहा हो िहां, (ii) सजचि, राष्ट्रीय होम्योपैथी उनके िररष्ठों पर भी जिचार दकया िाएगा, बित े दक आयोग - सिस्ट्य; उनकी अपेजित अहता ा या पात्रता सेिा, ऐसी अहता ा या (iii) आयुष मंत्रालय द्वारा नाजमत पात्रता सेिा के आधे स े अजधक हो या िो िष ा हो, िो एक िो संयिु सजचि या भी कम हो, और जिन्होंने ऐसी अहता ा या पात्रता सेिा समकि के स्ट्तर से नीच े का न पूरी कर चुके अपन े कजनष्ठों के साथ अगली उच्च श्रणे ी म ें हो प्रजतजनजध - सिस्ट्य; प्रोन्नजत के जलए अपनी पररिीिा अिजध सफलतापूिाक पूरी कर ली हो। (iv) अनुसूजचत िाजत या अनुसूजचत िनिाजत या अन्य जपछडा िग ा प्रजतजनयुजि द्वारा: का प्रजतजनजध जिसे अध्यि, केंद्र सरकार या राज्य सरकारों या केंद्र िाजसत प्रिेिों या राष्ट्रीय होम्योपैथी आयोग स्ट्िायत्त या सांजिजधक संगठन, सािािजनक िेत्र के उपक्रम द्वारा नाजमत दकया िाएगा – या जििजिद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्थानों सिस्ट्य के जनम्नजलजखत अजधकारी िो: (क) (i) मलू संिग ा जिभाग में जनयजमत आधार पर समनुरूप पि पर हों; या (ii) मूल संिगा या जिभाग में पे-मैररक्स (67700- 208700 रुपए) के स्ट्तर-11 या समकि में पि पर जनयुजि के बाि पांच िषा की जनयजमत सेिा की हो और जिजध एिं जिधायी मामलों का अनुभि हो; (ख) जनम्नजलजखत िैिजणक अहता ाएं और अनुभि रखते हों:- (i) मान्यता प्राप्त जििजिद्यालय या संस्ट्थान से काननू की स्नातक जडग्री और जिजध एिं जिधायी मामलों को जनपटाने का आठ िष ा का अनुभि हो; या (ii) मान्यता प्राप्त जििजिद्यालय या संस्ट्थान स े कानून की स्नातकोत्तर जडग्री और जिजध एिं जिधायी मामलों को जनपटाने का पांच िष ा का अनुभि हो। रटप्पण 1: फीडर श्रणे ी के जिभागीय अजधकारी िो सीधी पिोन्नजत की लाइन में ह,ैं प्रजतजनयुजि पर जनयुजि हते ु जिचार के जलए पात्र नहीं होंगे। इसी प्रकार, प्रजतजनयुि प्रोन्नजत द्वारा जनयुजि पर जिचार करने के जलए पात्र नहीं होगा। रटप्पण 2: प्रजतजनयुजि की अिजध, जिसमें केंद्र सरकार के उसी या अन्य सगं ठन या जिभाग में इस जनयुजि से ठीक पहल े धाररत दकसी अन्य बाह्य-संिगा पि पर प्रजतजनयुजि की अिजध भी िाजमल ह,ै आमतौर पर तीन िषा से अजधक नहीं होगी। रटप्पण 3: प्रजतजनयुजि द्वारा जनयुजि के जलए अजधकतम आयु सीमा आिेिन प्राजप्त की अंजतम तारीख को छप्पन िषा से अजधक नहीं होगी। (1) (2) (3) (4) (5) (6) (7) 3. अिर 02 (2024)* सामान्य केंद्रीय पे-मैररक्स चयन लाग ूनहीं होता लाग ूनहीं होता सजचि सेिा समूह- ‘क’, (67700- काय-ा भार के अननुसजचिीय 208700 आधार पर रुपए) में पररितान दकया स्ट्तर-11 िा सकता ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (8) (9) (10) लाग ूनहीं होता लाग ूनहीं होता प्रोन्नजत द्वारा, जिसके न होने पर प्रजतजनयुजि द्वारा (11) (12) (13) प्रोन्नजत द्वारा: प-े मैररक्स (47600-151100 रुपए) के जिभागीय प्रोन्नजत सजमजत संघ लोक सेिा आयोग स े स्ट्तर-8 म ें राष्ट्रीय होम्योपथै ी आयोग के अनुभाग (प्रोन्नजत पर जिचार हते ु) िो परामि ा करना आिश्यक अजधकारी जिन्होंन े आठ साल की जनयजमत सेिा की हो, जनम्नजलजखत से जमलकर नहीं ह।ै प्रोन्नजत के जलए पात्र ह।ैं बनेगी:- रटप्पण: िहा ं अहता ा या पात्रता सेिा पूरी कर चुके (i) अध्यि, राष्ट्रीय होम्योपैथी कजनष्ठों की प्रोन्नजत पर जिचार दकया िा रहा हो िहा,ं आयोग -अध्यि; उनके िररष्ठों पर भी जिचार दकया िाएगा, बित े दक (ii) सजचि, राष्ट्रीय होम्योपैथी उनकी अपेजित अहता ा या पात्रता सेिा, ऐसी अहता ा या आयोग - सिस्ट्य; पात्रता सेिा के आधे से अजधक हो या िो िषा हो, िो भी कम हो, और जिन्होंने ऐसी अहता ा या पात्रता सेिा परू ी (iii) आयुष मंत्रालय द्वारा कर चुके अपने कजनष्ठों के साथ अगली उच्च श्रणे ी म ें नाजमत एक प्रजतजनजध िो प्रोन्नजत के जलए अपनी पररिीिा अिजध सफलतापूिाक संयुि सजचि या समकि पूरी कर ली हो। के स्ट्तर से नीचे का न हो - सिस्ट्य; जिचार दकया िाएगा, बित े दक उनकी अपेजित अहता ा या (ii) सजचि, राष्ट्रीय होम्योपैथी पात्रता सेिा, ऐसी अहता ा या पात्रता सेिा के आधे से अजधक हो आयोग - सिस्ट्य; या िो िषा हो, िो भी कम हो, और जिन्होंने ऐसी अहता ा या पात्रता सेिा पूरी कर चुके अपन े कजनष्ठों के साथ अगली उच्च श्रणे ी (iii) आयुष मंत्रालय द्वारा नाजमत में प्रोन्नजत के जलए अपनी पररिीिा अिजध सफलतापूिाक परू ी एक प्रजतजनजध िो संयुि कर ली हो। सजचि या समकि के स्ट्तर स े नीचे का न हो - सिस्ट्य; प्रजतजनयुजि द्वारा: (iv) अनुसूजचत िाजत या केंद्र सरकार या राज्य सरकारों या केंद्र िाजसत प्रििे ों या स्ट्िायत्त अनुसूजचत िनिाजत या अन्य या सांजिजधक संगठन, सािािजनक िेत्र के उपक्रमों या जपछडा िग ा का प्रजतजनजध जििजिद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्थानों के जिसे अध्यि, राष्ट्रीय जनम्नजलजखत अजधकारी िो: होम्योपैथी आयोग द्वारा (क) (i) मलू संिगा या अन्य जिभाग में जनयजमत आधार पर नाजमत दकया िाएगा – समनुरूप पि पर हों; Short title and commencement.- (1) These rules may be called the National Commission for Homoeopathy (appointment of Officers and Staff) Recruitment Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and level in the pay matrix.- The number of the post, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule. 4. Initial Constitution.- The incumbents of the posts specified in column (1) of the said Schedule who were appointed on regular basis to the said posts before the date of commencement of these rules shall be deemed to have been appointed under these rules and their regular and continuous service in the said posts before the said commencement shall be taken into account for the purpose of seniority, promotion and pension. 5. Disqualification.- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 7.
